Solicitation Number 12444521R0002
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, FAR Subpart 13 and as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; offers are being requested and a written solicitation will not be issued.
This solicitation is issued as a Request for Proposal (RFP).
The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2021-04.
This procurement is set aside for small business. The NAICS code is 115310 and the Small Business Size Standard is $8M.

Description of Requirement Vegetation management services on the Mark Twain National Forest per the attached project specifications and attachments. The Government may make multiple awards off of this solicitation, one per each bid item (up to four).

There is no organized site visit planned however many of the areas are open to the public or arrangements can be made to allow access. We will accommodate if possible but inability to accommodate/allow offerors to view any of the sites is NOT guaranteed. If you choose to propose you are doing so based on the available information.

Acceptance: Acceptance will be determined by inspection of work performed and will be based on adherence to the specifications within the contract. Reference the PWS for discussion of payment terms.
Invoicing: The "Submit Invoice-to" address for USDA orders is the Department of Treasury's Invoice Processing Platform (IPP). All invoices are to be submitted online via the electronic Invoice Processing Platform. This is a mandatory requirement initiated by the U.S. Department of Treasury and you can find more information at this website https://www.ipp.gov/index.htm. Your company must register at https://www.ipp.gov/vendors/enrollment-vendors.htm to establish an account in order to submit an invoice on this project.
Sustainable Acquisitions The Contractor shall comply with FAR Part 23 Sustainable Acquisition Policy and all associated laws, rules, regulations, and executive orders referenced therein.

52.212-1 Instructions to Offerors – Commercial Items (JUN 2020) (Provision) Addenda to provision 52.212-1:
Contact Danette Cappello at danette.cappello@usda.gov for more information or with questions concerning this solicitation. All questions must be received by 12pm CST, 18 March 2021.
Proposals shall be submitted electronically to: danette.cappello@usda.gov . No Facsimile proposals will be accepted.
Proposals must be submitted no later than 12pm CST, 5 April 2021.
Late proposals will NOT be considered.
All offerors must be registered in www.sam.gov in order to receive award. Obtaining a DUNS number and registering in SAM are free. Renewing/maintaining registration in SAM is free.
In order to be considered for award offerors must submit the following documentation:
1. Offer Submission Package – Attachment 1 – fill this out and return with each of the Bid Item Schedules (Attachment 1) for which you would like to be considered for award.
2. Technical Proposal – Proposal must adequately discuss each of the technical factors stated in the text of FAR 52.212-2.
3. 52.212-3 Offeror Representations and Certifications - If reps and certs ARE completed on www.sam.gov, offeror only needs to complete subsection b of the clause as reproduced on page 8 of this document, along with the other clauses. If reps and certs are not completed on www.sam.gov, you must print clause 52.212-3 in its entirety and submit it with your offer.

52.212-2 Evaluation – Commercial Items (OCT 2014) (Provision)
a) The Government will award contracts resulting from this solicitation to the responsible offerors whose offers will be most advantageous to the Government, price and other factors considered. Cost to the Government is not expected to be the controlling factor in the selection of Contractors for this solicitation. The degree of importance of cost as a factor could become greater depending upon the quality of the offers for other factors evaluated. Evaluation will be conducted on best-value principles. The following factors will be used in the technical evaluation of offers listed in descending order of importance:
Technical Evaluation Factors.
Factors I and II are significantly more important than III and IV. Factors III and IV are of equal importance. Subfactors listed are of equal importance.
I. PAST PERFORMANCE
a. List jobs that are of a similar nature you have completed in the last 3 years. Supply the project owners name and a contact address and/or telephone number for each project involved.
b. List any projects on which you defaulted or failed to complete on schedule. Explain how and why this occurred.
c. How did you maintain quality in workmanship on these projects?
II. EXPERIENCE AND KEY PERSONNEL
Indicate who you plan to have on site as supervisor. Also list any personnel you expect to be working on the project(s). Indicate the type of experience and number of years, related to this type of work.
III. COMPANY ORGANIZATION
Describe the company’s overall business experience and expertise. Include company representative(s) who will have authority on site.
IV. QUALITY CONTROL /SAFETY PLANS
a. Provide an explanation of how you plan to maintain quality control.
b. Provide a safety plan. It needs to include but is not limited to the following: safety equipment to be used; discussions planned related to safety before work starts; traffic control when needed, first aid equipment/materials that will be available.
V. Bio-Preferred Products – Offeror must demonstrate that an effort is made to utilize bio-based products in its operations. Products can be found at www.biopreferred.gov .
Price Proposal. Price is secondary to the technical proposal contents discussed above but will be included in the evaluation process as a consideration of award. The price proposal consists of the price submitted the Schedule of Items/Pricing from this request for proposal. This price will be utilized to evaluate the accuracy of the contractor’s estimating system. The prices will be compared with the Government estimated price. If the contractor’s proposed price is within 20% from the Government cost estimate, a green rating will be assigned to the cost evaluation factor. If the proposed price is not with 20% of the Government cost estimate, a red rating will be assigned to the cost evaluation factor.
Price and technical evaluations will be made independent of each other.
Technical and past performance, when combined, are approximately equal to price.
(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offerors within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt.
There are 5 Technical Evaluation Criteria Factors:
1. Past Performance

Experience – Offeror must demonstrate experience with project(s) similar in scope to the requirements detailed in the Statement of Work. Offeror may submit projects in which they performed as either a prime or sub- contractor. Work performed by the offeror must have exceeded $5000. Offerors are requested to submit AT LEAST 3 past projects – no more than 10 projects will be considered. If more than 10 are submitted, only the first 10 will be evaluated. For all projects submitted, offeror must provide the following information:
a) Contract number
b) Contract/award amount
c) Brief description of the work performed
d) Location of work performed
e) Date begun/completed
f) Name/address/telephone number of person to contact for further information This factor will be evaluated on whether the projects were completed with minimal instances of poor or late performance – and with only moderate customer oversight. Note – Technical Evaluators may use their personal knowledge of the offeror’s prior experience and/or consider information not contained in the proposal as long as it can be validated (i.e. additional information obtained from discussing a project with the POC). It is vital you provide all of the requested information. If you do not provide enough information to validate previous relevant experience that example may not be considered. If the Government elects not to enter Discussions, there will be no avenue to clarify the information. Ensure you have included the requested information.
2. Experience and Key Personnel –

b) To achieve an Acceptable rating for this factor offeror must propose a specific foreman and describe how that foreman will perform quality control to accomplish work to the accepted AQL and ensure deadlines are met. Offeror must submit a description of foreman’s experience.
c) If offeror is proposing on tasks including herbicide, offeror must provide evidence of foreman or crew leader that possesses the required licensure for the state of MO.
d) If offeror is proposing on multiple line items, offeror must provide a narrative detailing how the crews AND foreman will accomplish all of the items within the timelines.
e) 12444521R0002 includes AGAR 452.237-74 Key Personnel – please ensure that you have read and understood this clause and able to comply with it if awarded a contract resulting from this solicitation.

3. Company organization –

To receive a rating of Acceptable for this factor, technical proposal must contain the requested information in enough detail to ensure that the Government will be able to access a representative of the Contractor (who has decision making authority) in real time.

4. Quality Control Plan– Offeror must demonstrate a focus and emphasis on proactive quality control in their day to day operations. Offeror shall not rely on the Government/COR/CO to alert them to deficient performance.

Safe Project Management – Offeror must demonstrate a focus and emphasis on safety in their day to day operations. Technical proposal shall indicate whether a safety plan exists and how employees are trained.

EVALUATION PROCEDURES AND BASIS FOR AWARD
The Contracting Office will review all proposals to determine initial acceptability of the offeror’s proposals. This review will ensure that the proposals are complete, were prepared in accordance with the instructions, and meet all requirements set forth. If proposals are initially acceptable, a team will further evaluate the technical proposals using the evaluation factors listed. The Government reserves the right to reject any or all offers if such action is determined to be in the best interest of the Government. Any proposal found initially unacceptable may be rejected and the offeror notified of that rejection.
If proposals continue to be acceptable, and the Contracting Officer determines that award without discussions is suitable, then award will be made to the offerors that provide the best value to the Government based on technical, price and consideration of other non-price factors. Therefore, proposals should be submitted initially on the most favorable terms from a price, technical, and other standpoint that the offeror can submit to the Government.
Evaluation factors other than price, when combined, are approximately equal to price in the award decision. The critical factor in making any cost/technical trade-off is not the spread between the technical scores but, rather, the significance of that difference. The significance of the spread of scores will be determined on the basis of what the difference might mean in terms of performance and what it would cost the Government to take advantage of it. Award may not necessarily be made for technical capabilities that would appear to exceed those needed for the successful performance of the work. The Government reserves the right to make cost/technical trade-offs that are in the best interest and advantageous to the Government’
52.212-3 Offeror Representations and Certifications – Commercial Items (FEB 2021) (DEVIATION JUL 2020) (Provision) If Offeror Representations and Certifications are not complete in SAM the offeror shall submit a completed copy of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items, with your offer. If Offeror Representations and Certifications are complete in SAM, the offeror shall complete the following:

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

52.204-24 Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment (OCT 2020) (Provision) The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.
(a) Definitions. As used in this provision— Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to—
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to—
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services".
(d) Representation. The Offeror represents that—
(1) It ☐will, ☐will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and
(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that— It ☐ does, ☐ does not use covered telecommunications equipment or services, or use any equipment, system, or service that uses covered telecommunications equipment or services. The Offeror shall provide the additional disclosure information required at paragraph (e)(2) of this section if the Offeror responds "does" in paragraph (d)(2) of this section.
(e) Disclosures. (1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded "will" in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment—
(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);
(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and
(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(ii) For covered services—
(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or
(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment—
(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the OEM or a distributor, if known);

(B) If not associated with maintenance, the PSC of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(2) of this provision.
52.209-7 Information Regarding Responsibility Matters (OCT 2018) (Provision) (a)Definitions. As used in this provision— Administrative proceeding” means a non-judicial process that is adjudicatory in nature in order to make a determination of fault or liability (e.g., Securities and Exchange Commission Administrative Proceedings, Civilian Board of Contract Appeals Proceedings, and Armed Services Board of Contract Appeals Proceedings). This includes administrative proceedings at the Federal and State level but only in connection with performance of a Federal contract or grant. It does not include agency actions such as contract audits, site visits, corrective plans, or inspection of deliverables.
Federal contracts and grants with total value greater than $10,000,000” means— (1)The total value of all current, active contracts and grants, including all priced options; and (2)The total value of all current, active orders including all priced options under indefinite-delivery, indefinite-quantity, 8(a), or requirements contracts (including task and delivery and multiple-award Schedules).
“Principal” means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).
