This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.
This solicitation is issued as a Request for Quotation (RFQ)
The solicitation document and incorporated provisions and clauses are those in effect through
Federal Acquisition Circular 2022-04.

The USDA Forest Service, Fishlake National Forest has a need for temporary office space per the following specifications:
1. Located in Richfield Utah.
2. No more than two blocks east or west of Main Street, with easily visible public access.
3. Minimum total office space of 2500 square feet (SF). Space shall not be below grade or on multiple levels without an elevator (per ABA requirements for federal buildings).
4. Entire office and paved parking shall be ADA compliant. At a minimum, 5 regular parking spaces and 1 ADA parking space.
5. Must have minimum 120 SF reception area with power outlets and network outlets.
6. Minimum 4 separate offices of which are a minimum of 90 FS each. One of the offices must be secure. All offices must have power outlets and network outlets.
7. Must have a conference room of 300 FS minimum, with power outlets and network outlets.
8. Must have a 300 FS minimum mailroom/printer/plotter room, with power outlets and network outlets.
9. Breakroom with counter space, refrigerator, and sink.
10. Minimum 1 men’s restroom and 1 woman’s restroom, ADA compliant to accommodate 5-10 employees.
11. Office must be internet ready; internet ports shall be available on most walls.
• Provide a minimum of 2 duplex outlets for each office, 4 duplex outlets in the reception area and
6 duplex outlets minimum in the proposed conference room. Provide 1 outlet and 1 communications ports for each desk spot in open office areas
• Electrical system shall be compliant with the National Electric Code when the facility was constructed.
• Any temporary communications or electrical wiring shall be suitably protected from damage or accidental disconnection. The government shall not be held liable for damaged wiring.

Addenda to paragraph (b) Submission of Offers:
1) Offerors must have an active entity registration in the System for Award Management in order to submit an offer. https://www.sam.gov/SAM/
As a minimum, the technical portion of your proposal must clearly provide the following information:

1. Technical Capability: Offeror shall provide a written narrative describing Offeror’s technical capability in performing similar type work:
a. Location within Richfield, Utah, and within location requirements from
Supervisor’s Office location.
b. Square Footage
c. Floor plan/explanation demonstrating compliance with 3-15 above.
2. Experience:
a. Offeror shall provide a written narrative that outlines and identifies previous projects that demonstrate the offeror’s experience performing similar types of projects.
3. Past Performance:
Past Performance is a measure of the degree to which offeror, as an entity/organization, have satisfactorily completed contracted work, have satisfied their customers, and complied with Federal, state, and local laws and regulations. Provide a minimum of three
(3) past performance references, that reflect recent, relevant experience within the last
Five Years, as of the solicitation release date, that demonstrate the Offeror’s ability to handle the scope and breadth of the Statement of Work (SOW). If problems were encountered during contract performance, indicate your efforts to resolve them. For those contracts with less than positive performance, you are encouraged to provide a description of the problems and the efforts made to correct and to prevent future occurrences. Example contracts may have been performed for Federal, State, and/or local Governments, as well as private industry.
Offerors are responsible for providing contract descriptions and applicable experience in sufficient detail to permit evaluation of the example contract’s relevancy. If the Offeror does not provide up to three past performance references during the last five years, the
Offeror shall address this and provide a written narrative detailing the reasons for not providing three references.
Include the following information for each past performance reference:
1. Contract/Task Order number
2. Project Name
3. Total contract price
4. Short description of work performed
5. Names and valid phone number, e-mail address, and mailing address for the Procuring
Contracting Officer (PCO) and Contracting Officer’s Representative (COR)/Program
Manager (PM)
Offerors are advised that: (1) the Government may contact any or all references in the proposal and third parties (such as other customers, the Past Performance Information
Retrieval System (PPIRS), other Government contractors, the Department of Labor, consumer protection organizations, etc.) for performance information; (2) the
Government reserves the right to use any such information received as part of its evaluation of the Offeror’s past performance; (3) the Government reserves the right to directly solicit input on the Offeror’s past performance from any other sources and the
Government may use any other data available to its evaluators, including the personal knowledge of those individuals; and (4) if the Offeror omits projects of which the
Government evaluation team is aware or becomes aware, customer assessments may be sought from the relevant organization.
The Government reserves the right to limit or expand the number of references it contacts and to contact references other than those provided by the Offeror. If subcontracting is proposed for subject Contract, past performance references where the Offeror has served as a prime Contractor with Subcontractors would be of interest.
Note: Information shall be provided for the offeror as well as any principle subcontractor(s) that will perform key aspects of the requirement. If the offeror submits
Past Performance Information (PPIR) for a subcontractor, the offeror shall also submit the consent of the subcontractor for the Government to disclose the PPIR to the offeror
(prime) during negotiations.
b) Price Proposal – Include the following: 1) completed price schedule from section B of this solicitation, 2) Acknowledge any amendments issued on beta.sam.gov for this solicitation by completing and signing the posted SF-30.
c) Representations and Certifications – Fill in the check boxes for provisions
52.204-24, 52.209-7, and 52.212-3 found in this solicitation. Copy and paste the completed provisions onto your company letterhead and include your DUNS number.
2) Submit offers by email to the Contract Specialist, Christine.M.Hansen@usda.gov so that they are delivered into this inbox by the due date and time. Emails should contain 3 separate attachments (Technical Proposal, Price Proposal, and Representations and
Certifications) in Microsoft Word or Adobe PDF format. Be aware that large attachments may increase the time required to deliver an email. It is the offerors responsibility to confirm receipt of the offer from the Contract Specialist.

(ix) 52.212-2 Evaluation – Commercial Products and Commercial Services (NOV 2021)
(Provision)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the
Government, price and other factors considered. The following factors shall be used to evaluate offers:

The evaluation factors below are listed in descending order of importance.
Based upon the results of the integrated assessment of the technical and cost/price proposals, the
Government may make an award to other than the lowest-priced offeror or the offeror with the highest technical score if the source selection official determines that to do so would result in the best value to the Government.
(a) Technical Evaluation Factors.
Factor 1 - TECHNICAL APPROACH. The proposal will be evaluated on how the offeror intends to organize and manage the contract and the means that will be used to accomplish the contract requirements. The degree to which the proposal demonstrates an understanding of the requirements will be evaluated, Factor 2 - EXPERIENCE. The offeror's background, experience, and qualifications will be assessed to determine the likelihood that that offeror can successfully perform the contract requirements and the degree of the risk of non-performance
Factor 3 - PAST PERFORMANCE. The offeror's past performance on related contracts will be evaluated to determine, as appropriate, successful performance of contract requirements, level of communication between the contracting parties, proactive management and customer satisfaction.
The Government will use its discretion to determine the sources of past performance information used in the evaluation, and the information may be obtained from references provided by the offeror, the agency's knowledge of contractor performance, other government agencies or commercial entities, or past performance databases.
If an offeror does not have a history of relevant contract experience, or if past performance information is not available, the offeror will receive a neutral past performance rating; however, an offeror without a history of relevant experience may receive a lowered rating for the experience evaluation factor.
(b) Cost/Price Evaluation.
(1) The proposed prices/costs will be evaluated but not scored. The cost evaluation will determine whether the proposed costs are realistic, complete, and reasonable in relation to the solicitation requirements. Proposed costs must be entirely compatible with the technical proposal.
(2) The Government may use the results of cost/price realism analysis to adjust the offeror's proposal to a most probable cost to the Government. The analysis may include information from a government auditing agency, Government technical personnel, and other sources.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced.
Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(d) Comptroller General Examination of Record. (1) The Comptroller General of the United States, or an authorized representative of the
Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the
Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

452.204-70 Modification for Contract Closeout (OCT 2021)
Upon contract closeout for contracts utilizing Simplified Acquisition Procedures (SAP) according to FAR 13:
(a) If unobligated funds in the amount of $1000 or less remain on the contract, the
Contracting Officer (CO) shall issue a unilateral modification for deobligation. The contractor will receive a copy of the modification but will not be required to provide a signature. The CO shall immediately proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.
(b) If unobligated funds of more than $1000 remain on the contract, the CO shall issue a bilateral modification for deobligation. The contractor will receive a copy of the modification and will be required to provide a signature. (The CO may also request a
Release of Claims be completed by the contractor, although not required for contract and orders using SAP procedures.) If the bilateral modification and Release of Claims are not returned to the CO within 60 days, the CO shall release the modification as unilateral and proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.
Post Award Conference
A post award conference with the successful offeror is required. It will be scheduled within 10 days after the date of contract award. The conference will be held via conference call.
Insurance Coverage
Pursuant to FAR clause 52.228-5, Insurance-Work on a Government Installation, the
Contractor will be required to present evidence to show, as a minimum, the amounts of insurance coverage indicated below:
(a) Workers Compensation and Employer's Liability. The Contractor is required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except https://www.acquisition.gov/agar https://www.dm.usda.gov/procurement/policy/FARClassDeviations.htm when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit worker's compensation to be written by private carriers.
(b) General Liability. (1) The Contractor shall have bodily injury liability coverage written on a comprehensive form of policy of at least $500,000 per occurrence. (2) The
Contractor shall have property damage liability insurance shall be required in the amount of enough to cover damage to the property.

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Products or Commercial
Services. Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on

(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense
Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to—
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization
Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to—
