SF 1013 - JUSTIFICATION & APPROVAL FOR FAR SUBPART 13.5 SOLE SOURCE
(INCLUDING BRAND NAME) ACQUISITIONS
1. Identification of the requiring activity and the contracting activity:
The requiring activity is the Bureau of Engraving & Printing – Office of Manufacturing Support & the contracting activity is the Bureau of Engraving & Printing – Office of Acquisition.
2.a Nature and/or description of the action being approved:
The proposed contract action is for Health Unit Services for the BEP Western Currency Facility (WCF). A time and materials letter contract was issued for these services to Spectrum Healthcare Resources, Inc. September 30, 2020 in the amount of $498,490.42.
These services had previously been acquired utilizing an interagency agreement through the Federal Occupational Health (FOH). A late, unexpected change to the services in late FY20 by FOH resulted in the BEP issuing a letter contract to avoid a lapse in services.
The period of performance is:
October 1, 2020 through July 31, 2021.
2.b Name of Proposed Contractor: Spectrum Healthcare Resources, Inc 2.c Requisition No.: 1401188 2.d Bridge contract: ☐ Yes ☒ No 2.e Brand name: ☐ Yes ☒ No 3.a A description of the supplies or services required to meet the agency’s needs:
The Bureau of Engraving and Printing (BEP) is the component of the United States Department of the Treasury that designs, engraves, and manufactures U.S. currency and other U.S. security products. The purpose of this contract is to provide Health Unit services for the Western Currency facility (WCF). There are many industrial processes at the WCF BEP facility that require the BEP to conduct medical surveillance and/or screening to ensure employees are able to perform essential job functions.
The purpose of this requirement is to provide the WCF with a comprehensive occupational health program. The Contractor shall provide the necessary personnel, supervision, and supplies to maintain such a program.
• The services to be provided by the Contractor under this contract includes, but are not limited to, emergency treatment, fitness-for-duty examinations, preventive health screening examinations, treatment and/or assessment of on-the-job illnesses and injuries, authorization for emergency medical treatment at another medical facility, general medical services which help keep employees at work, and the administration of allergy shots and other vaccinations. Provide treatment for injuries (within their scope of practice) to include, but not limited to, suture and suture removal, irrigation of the eye, abrasions, and minor musculoskeletal injuries.
• To implement a medical surveillance program which meets the requirements of WCF;
• To provide a wide range of emergency and non-emergency medical services. If medical treatment beyond the capability of the facility is required, the Contractor shall refer the employee to outside care;
• To provide medical consultations for illnesses which include both non-occupational and occupational illnesses;
• To promote and provide prevention-oriented clinical assessment, health screenings and vaccinations, as part of a wellness initiative;
• To document and maintain employee injury and wellness data using Medgate®
Occupational Health and Safety Software (supplied by BEP); and
• To create an annual report that provides statistics, documents achievements and identifies positive and negative health trends and injuries, and opportunities for improvement.
29 CFR Part 1926 “Safety and Health Regulations” require the BEP to maintain the above Health services.
3.b Includes IT: ☐ Yes ☒ No 3.c IGCE/Estimated dollar value: $498,490.42
4. Identification of the authority being used (Check the box that applies):
☒ 41 U.S.C. 1901 – Simplified acquisition procedures.
☐ 41 U.S.C. 1903 – Special emergency procurement authority.
5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:
The services to be procured are “commercial” in nature, as defined at Federal Acquisition Regulation (FAR) Part 2, and will be solicited using FAR Part 12, as well as the procedures outlined at FAR 13.500, “Simplified Procedures for Certain Commercial Items.” The acquisition will be a sole source as described at FAR 13.501(a) utilizing simplified acquisition procedures under the authority of section 41 U.S.C. 1901. BEP is restricting competition because the agency’s need for the supplies or services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to award a contract without providing full and open competition.
In late June 2020, FOH met with the BEP informing them that they could no longer provide the services they had previously provided to the BEP under their interagency agreement (IAA) (10-BEP-R-0001-004). This included services for the Health Unit. FOH support would end in correspondence with the end of the period of performance of IAA 10-BEP-R-0001-004, September 30, 2020. This late, unexpected change to the services provided by FOH left the bureau facing the discontinuation of services required by statute. Without ample time to plan a competitive acquisition, the BEP determined issuing this letter contract for these services for ten (10) months would be most efficient to ensure a continuity of operations until a competitive, long term contract could be issued. Spectrum has performed Health Unit services at the BEP WCF for the past several years via an interagency agreement with the Federal Occupational Health (FOH).. Spectrum currently staffs these services, and has performed the http://www.gpo.gov/fdsys/granule/USCODE-2011-title41/USCODE-2011-title41-subtitleI-divsnB-chap19-sec1901 http://www.gpo.gov/fdsys/granule/USCODE-2011-title41/USCODE-2011-title41-subtitleI-divsnB-chap19-sec1903 services satisfactorily for the past several years under the FOH interagency agreement. Due to the unforeseen time constraints imposed on the BEP, the planning and preparation needed to solicit a competitive procurement was not possible. To reduce risk and phase-in costs that changing contractors may entail, under the circumstances, Spectrum has the existing resources in place to service the BEP WCF satisfactorily with the least amount of performance and cost risk.
6. A description of efforts to ensure that offers were solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by FAR subpart 5.2 and, if not, which exception under FAR 5.202 applies:
This award was issued under unusual and compelling urgency circumstances, therefore per FAR 5.202(a)(2), a notice was not submitted.
Previously, these services were procured via an interagency agreement through FOH.
However, a late, unexpected change to the services provided by FOH resulted in the BEP being unable to solicit sources due to time constraints, consequently issuing a letter contract for these services. The BEP anticipates soliciting sources for a longer term award at the end of this period of performance July 31, 2021.
7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable:
The Contracting Officer will determine that the anticipated price(s) will be fair and reasonable based on a comparison of the proposed prices with the Independent Government Cost Estimate
(IGCE).
8. A description of the market research conducted (see FAR part 10) and the results or a statement of the reason market research was not conducted:
Due to the unusual and compelling urgency of this acquisition and the unique qualifications of the proposed contractor, as described in section 5 above, Government market research was not conducted. However, the Government will seek competition for these services in subsequent acquisitions.
9.a Any other facts supporting this justification:
Services were performed in FY20 via Interagency Agreement no. 10-BEP-R-0001-004 between the BEP and FOH.
9.b Attachments: ☐ Yes ☒ No
10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition:
Due to the Unusual and Compelling urgency of this acquisition, maket research was not performed or posted. Therefore, no interested sources were captured.
11. A statement of the actions, if any, the Requiring Activity or Contracting Activity may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:
A competitive solicitation for these services is anticipated being issued in calendar Qtr. 1 or 2 of 2021. The Contracting Activity will continue to search the market place for potential sources by conducting market research to identify potential vendors.
