JUSTIFICATION FOR SOLE SOURCE ACQUISITION

FAR 13.5 – SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL ITEMS

1. Contracting Agency:

DoDEA-Pacific Procurement Division Unit 35007

2. Description of Supplies and Services:

DoDEA-Pacific Okinawa District requires School Bus Driver services for daily commuting, curricular, co-curricular, and special needs busses.

3. Description of Action: A Firm fixed price contract is planned with a total estimated value of . The period of performance will be 1 February 2016 – 31 March 2016. FY16 Operating and Maintenance (O&M) funds are available.

4. Authority: 41 U.S.C. 1903, FAR 13.5

5. Reason for Authority Cited: There is only one responsible source available in Okinawa that can satisfy the Government’s requirement. The current contract for Okinawa Bus Driver services, HE1260-10-C-1004, expires 31 January 2016. Procurement is currently in final negotiations to award the new five year contract for bus driver services. Additionally, there are lengthy security requirements for military installation access and background checks for newly awarded contract personnel. This bridge contract is required to allow sufficient time for these tasks to be completed.

It is practicable to solicit and negotiate with the incumbent contractor, Senon Limited, to avoid break in service.

Based on market research and historical data, there’s not a reasonable expectation that offers would be received from other vendors, especially with the limited amount of time required to have this contract awarded without a break in service. Any delays in awarding a bridge contract would result in approximately 4,000 students not having school bus transportation; which would have an adverse effect on the community.

6. Effort to Obtain Competition: This bridge contract is only an interim contract for two months to avoid a break in service. The new five year contract was solicited using competitive procedures and posted on Federal Business Opportunities to promote and provide for full and open competition. In accordance with FAR 13.501(a)(iii), this justification will be made publicly available within 14 days after contract award.

7. Effort to Remove Barriers to/Increase Competition: Award for the new five year contract is expected to be completed by the end of February, allowing the new contractor 30 days to complete their installation security requirements and background checks. Therefore an additional sole source bridge will not be required once this contract is completed on 31 March 2016.

8. Market Research: Based on market research and Government knowledge, there are a limited amount of contractors available throughout Japan that are capable and interested in providing bus driver services to the U.S.

Government. Additionally, security installation requirements for base access and passes cannot be expedited for new contract personnel; but short term base pass extensions for current vetted contract personnel can be processed in a short time frame to prevent a break in service.

9. Interested Sources: Reference paragraph 6, this is only an interim contract to avoid a break in service and only the incumbent was contacted for a quote. No other vendors have expressed an interest in this requirement.
