SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL

ITEMS IN ACCORDANCE WITH FEDERAL ACQUISITION REGULATION (FAR) 13.5

2. Nature and/or Description of the Action Being Processed:

This acquisition is for the contractor to provide onsite Register Nurse (RN) services to include general RN and specialty RN services in accordance with FAR 13.5 Simplified Procedures for Certain Commercial Products and Commercial Services and specifically FAR 13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR part 6, but still require a justification using the format of FAR 6.302-2.

Contactor is to provide all necessary personnel/labor, equipment/software, transportation, supplies, and travel/housing to perform onsite RN services at JVAMC located at 1500 East Woodrow Wilson Avenue, Jackson, MS 39216. This proposed single source award (sole source) for this firm fixed price type contract will be procured through soliciting from a single source acquisition to SolVet Services, LLC.

3. :

RN Services shall consist of contractor to provide RN services to care for patients in JVAMC s Emergency Room (ER), Intensive Care Unit (ICU), Community Living Centers (CLC), Clinics (4C), Mental Health (MH) and in JVAMC other departments if needed. In accordance with Federal Acquisition Regulation (FAR) 13.106-1 (b) Soliciting from a single source and FAR 13.5, the Contracting Officer has deemed this requirement as an unusual and compelling urgency.

Period of performance of this requirement is from 08-01-2022 through 10-31-2023 which is a length of three (3) months. The total estimated cost of this procurement is $741,916.50.

Without the contracted services eligible Veterans will not receive the care that they need, and additional beds will be shut down/unavailable due to not having bed capacity.

4. Statutory Authority Permitting Restricted Competition:

FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

5. Demonstratio the Use of the Authority Cited Above (applicability of authority):

Unusual and Compelling Urgency

This service is needed at once to ensure that existing Department of Veterans Affairs coverage for beds is available to support the Veterans of JVAMC. This is it ensure that Department of Veterans Affairs have the appropriate staffing levels for existing VA RN s are not affected by burnout (error/mistake by Nursing Staff due to not enough staff for coverage) until JVAMC may hire additional Nursing Staff for coverage of beds. This is to ensure that quality of care/patient safety are not affected. Without these RN Services for coverage, JVAMC would not be able not perform up to full capacity for beds throughout the different work units with in JVAMC which would overall affect patient safety. This is an emergent need due to the effect that this service has on patient safety and to not lower the quality of care provided to the Veterans of JVAMC. If award is not made to SolVet Services, LLC, additional beds to provide care to the Veterans will be closed/shut down to lower the capacity of JVAMC to provide care which would normally be available to provide care to the Veterans, which is unacceptable. Per market research conducted by the Contracting Officer SolVet Services, LLC is willing and capable to satisfy agency requirements and a sole source award will be made under unusual and compelling urgency to meet JVAMC quality standards and need date.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

In the future a source sought synopsis may be issued on Contract Opportunities by the Contracting Officer to conducted additional market research to find potential sources to provide this requirement. But, due to the urgency (Emergency Acquisition Procedures) of this requirement to ensure that additional beds for Veterans at JVAMC are not closed/shut down only a few capable Service-Disabled Veteran Owned Small Business (SDVOSB) were contacted to get market research pricings. It was determined based on need and timeline and past performance record for the surrounding geographical location that SolVet Services, LLC is currently the most advantageous option to meet this requirements timeline.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable:

An informal price analysis was conducted by the Contracting Officer and in accordance with FAR 13.106-3 it is anticipated that overall pricing will be determined fair and reasonable for the estimated award amount of $741,916.50

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons

Market Research Was Not Conducted:

In accordance with FAR 10 market research was conducted it was identified that multiple Service- Disabled Veteran Owned Small Business (SDVOSB) or Veteran Owned Small Business (VOSB) that showed up by querying the VIP database, but due to the urgency of this requirement SolVet Services, LLC was searched and verified as a SDVOSB company in VIP database and is capable to provide this requirement.

to this requirement being an urgent requirement to ensure additional beds are not shut down at JVAMC based on the informal pricing submitted back by SolVet Services, LLC it would be the best interest of the Government to move forward and award this emergency acquisition to SolVet Services, LLC.

Onsite RN Services that will be provided by SolVet Services outlined below:

Period of Performance: Three (3) Months Location: Jackson, MS

Specialty RN (ICU/ER) Services: 2,601 Hours (5 FTE) General RN (MH, 4C, and CLC) Services: 3,120 Hours (6 FTE)

It has been determined and confirmed through market research conducted by the service line and the Contracting Officer that SolVet Services, LLC can provide and is capable to provide this requirement. Service line has also confirmed that SolVet Services, LLC has the ability to provide these services to meet the quality-of-care standards set fourth for the Department of Veterans Affairs. SolVet Services, LLC has been confirmed as a SDVOSB and has a valid System for Award Management (SAM) registration in the database.

Competition before Making subsequent acquisitions for the supplies or services required:

Human Resources Service which supports JVAMC is actively recruiting FTEs for a various RN s to provide these services.

In addition, the Government will continue to conduct market research to ascertain if there are changes in the marketplace that would enable future actions to be competed.

12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona

Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
