USE OF OTHER THAN FULL AND OPEN COMPETITION LESS THAN

SIMPLIFIED ACQUISITION THRESHOLD MEMO

SUBJECT: Sole Source for Use of Other than Full & Open Competition for an Acquisition under the

Simplified Acquisition Threshold (SAT)

I. BACKGROUND

1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.

2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

3. This memorandum is derived from Enclosure 3, Department of Navy Simplified Acquisition Procedures Guide (April 2018) and is only applicable to acquisitions under the SAT.

II. DESCRIPTION OF ITEM OR SERVICE

The subject of this procurement is for eight (8) Permaflect calibrated targets. The purpose of these calibration panels is to take real-time calibrated imagery of the local background area around a US Navy vessel in the full Visible and Near-Infrared electro-optical range (400-1000 nm). These measurements must be of high sensitivity and precision, accurate, and able to be performed real-time in the maritime environment.

The Brand Name Requirement is for eight (8) of the Labsphere Permaflect 1.2 x 2.4 meter calibration targets, 2 each of %5, %10, %18, and %94 reflectivity. The estimated value of the proposed acquisition is .

III. BASIS FOR DETERMINATION FOR USE OF OTHER THAN FULL & OPEN COMPETITION

A. BRAND NAME:

Item required must be a brand name product, or feature of a product, particular to one manufacturer.

1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.

2. Exclusive Licensing Agreements: The item or service is only available from the Original Equipment Manufacturer (OEM).

There is no other distributor for the Permaflect product other than Labsphere in the US.

3. Other Reasons:

To have a complete, accurate, real-time collection of background EO imagery of US Navy assets in real-world environments, Code 7411 will need a method to collect calibrated imagery. These collections need to be spectrally accurate in order to compare data with collaborators and test against other sensor systems, sensitive enough to measure low-reflectance, and take place both in the lab and in the maritime environment.

This will require calibration targets with sufficient surface area, accuracy, consistency, diffusivity, and hardened enough to operate in the field.

In order to get accurate color and intensity data, the calibration targets must be designed appropriately to be equally reflective across the desired wavelengths and specularly diffuse to be viewed at multiple angles. The size must be sufficient to cover enough Ground Sample Distance (GSD) for different resolution sensors operating at a wide range of distances. The variance in reflectivity and diffusivity over the area must be minimized.

Technical Requirements:

- >2 m2 of area coverage per reflectance value

- Transportable and deployable on Navy vessel

- Survivability and performance specs adequate for deployment in the maritime environment

- At least 4 different reflectance values near the ranges of %5, %10, %18 and 94%.

- Wavelength Range of 400nm to 1000nm

- Reflectivity to be within %5 of stated value over required wavelength range

- Diffusivity of within %10 of the ideal lamberian reflector shape for incident light up to 60° off nadir

Permaflect is the only product to meet the technical performance specifications while also large enough to use for the test needs. Labsphere is the only company found manufacturing this precise a surface in large area panels.

In addition, they are the only company found who was able to supply the necessary information to determine if the panels meet the required specifications.

Other test hardware was researched as part of this process. Other equipment either did not cover the full bandwidth under test, did not have the precision to be used as needed for this program (error over range of wavelengths >%5, diffusivity varied greatly over viewing angle, consistency of reflectivity across total area of target), or did not have the full area coverage required. Of the systems only the Permaflect fully met the required performance expectations and did not have potentially unresolvable systematic issues.
