USE OF OTHER THAN FULL AND OPEN COMPETITION LESS THAN

SIMPLIFIED ACQUISITION THRESHOLD MEMO

SUBJECT: Sole Source/Brand Name Justification / Limited Source Justification for Use of Other than Full &

Open Competition for an Acquisition under the Simplified Acquisition Threshold (SAT)

I. BACKGROUND

1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting

Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.

2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

3. This memorandum is derived from Enclosure 3, Department of Navy Simplified Acquisition Procedures Guide

(April 2018) and is only applicable to acquisitions under the SAT.

II. DESCRIPTION OF ITEM OR SERVICE (include manufacture/sole source name and address)

NSWCCD requires two (2) license renewals for ModelCenter MSBE, Integrate, and Explore to include technical enhancements and customer support and training classes for five (5) students.

III. BASIS FOR DETERMINATION FOR USE OF OTHER THAN FULL & OPEN COMPETITION

NSWCCD researched numerous alternative software suites. Ansys ModelCenter is the only product that can meet all of the needs of Code 825 and their projects. Of the software suites researched, MobilityTestBed is used only for mobility, NASTRAN and FEMAP offer finite element analysis (FEA) all of which are not within the scope of

Code 825 projects. Simulink uses MATLAB and in-house modules already developed by Code 825 are not all

MATLAB based and would require extensive redevelopment.

☒ 1. Restrictive Rights:

ANSYS (formerly Phoenix International) owns ModelCenter and is the sole distributor. Use of different software is not feasible as existing in-house navy multi-hull design synthesis tools have been developed using ModelCenter as its foundation. Additional in-house tools have been developed for small ship design synthesis. These tools are required for use to complete existing in-house OPNAV tasking on a classified system for which current licenses will expire August 3, 2022. This is a critical and immediate need as existing in-house tasking cannot be completed without this software and its associated training.

☒ 2. Exclusive Licensing Agreements: ANSYS (formerly Phoenix International) owns ModelCenter and is the sole distributor.

☒ 3. Other Reasons: A search for similar software with the necessary functionality was done using online tools for identifying software alternatives. While several alternatives were identified, none met the critical capability to link multiple analysis software tools. The majority of simulation software is CAD and/or FEA focused which is outside the scope of 825 tasking.
