About this file
This document is a justification and approval for a sole source contract extension. The incumbent contractor, Duro Health LLC, will provide injury prevention, mitigation, rehabilitation, and human performance optimization services to personnel assigned to the 125th Special Tactics Squadron of the Oregon Army National Guard from August 2021 through September 2021. The initial contract was awarded on a full and open basis in 2020, and prior contracts with the same incumbent were also awarded competitively. The justification cites the need for service continuity and increased costs that would result from transitioning to a new contractor for the brief interim period. Market research identified several small businesses capable of providing the services, but transitioning to an alternative source would disrupt operations.

4. Authority Cited: 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Reason for Authority Cited:
(a) For only one source or a limited number of sources under FAR 6.302 1: As described at FAR 6.302-1(a)(2), when the supplies or services required by the agency are available only from one responsible source, or for DoD, NASA and the Coast Guard, from only one or a limited number of responsible sources, and no other types of supplies or services will satisfy agency requirements, full and open competition need not be provided for.
1) The current contractor, Duro Health, is currently providing the required services. They are uniquely positioned to carry on uninterrupted services. These services are critical to ensuring injury prevention and mitigation, rehabilitation, and human performance optimization to personnel assigned to the 125 Special Tactics Squadron. No other company would be capable of providing these services without significant negative impact to the continuity of the services and increased cost to the government.
(b) Alternatives: The alternatives that are available to the Government are as follows:
1) Suspend Operations – This alternative would leave the operators without the daily and weekly services which ensure injury prevention and rehabilitation, thereby putting their welfare and the mission at risk.
2) Use In-House Personnel/Expertise – In-house expertise is not available for this service.
(c) The Government has an ongoing requirement for this service. Extension of the current contract will allow for the award of a multiple year contract. Additional time is required due to unforeseen delays in the review process and coordination of the acquisition process.
(d) It would be neither cost effective nor realistic to expect another Contractor to perform during the brief interim period. The start-up costs; manning problems including recruitment and associated relocation fees; continuity of service, transfer of personnel records and the preparation of management plans would be prohibitive.
6. Efforts to Obtain Competition: The anticipated award date is August 2021 and a break in service would occur if the contract is not extended.
7. Actions to Increase Competition: The new contract will be fully competed.
8. Market Research: In accordance with Defense Federal Acquisition Regulation Supplement (DFARS) 205.205-71, DFARS 206.302-1(d), and DFARS Procedures, Guidance and Information (PGI) 206.302-1(d), a sources sought was posted to beta.SAM.gov on 1 October 2020 for 15 days and the results were as follows:

Except for the current incumbent any other contractor would not be able to meet the requirement without a disruption to the continuity of operations and increased cost to the Government.
