About this file

This sole source justification document approves contracting with North Central International Truck in Rapid City, SD for repairs to a 2012 International 7400 fire truck owned by the Bureau of Land Management. The needed repairs include replacement of the exhaust gas recirculation system, fuel injectors, and cleaning of the diesel oxidation catalyst and diesel particulate filter systems. The estimated value of the contract is $5,000. The justification for restricting competition and awarding sole source is that the vehicle manufacturer, International, recommends repairs be done by an authorized dealer for warranty purposes. The fire truck is currently undriveable and at the dealer's facility awaiting repairs, which are needed urgently for the upcoming fire season. Moving the vehicle to another dealer would significantly delay repairs.

SOLE SOURCE (INCLUDING BRAND NAME) JUSTIFICATION AND APPROVAL

FOR ACQUISITIONS UNDER THE SIMPLIFIED ACQUISITION PROCEDURES

This document sets forth the justification and approval as required by 13.106-1(b)(1) &(2).

1. Contracting agency and activity.

The Department of the Interior, Bureau of Land Management (BLM), Eastern Montana Dakotas District Office Division of Fire Management, Doanld Jones, requests the Montana State Office Division of Support Services Procurement Division, to contract on a sole source basis to North Central International Truck in Rapid City, SD.

2. Nature and/or description of action being approved

This will be a new contract for the needed repairs of Engine I622724. This is a 2012 International 7400 Fire Truck. The needed repairs include EGR (Exhaust gas recirculation) is an emission control technology allowing NOx emission reductions from diesel engines, replacement, fuel injector replacement and the cleaning of the DOC (diesel oxidation catalyst) and DPF(diesel particulate filter) systems.

Description of supplies or services.

Fire truck repairs which include a EGR and fuel injectors replacement. During this time, the fire truck will also need their DPF and DOC to be cleaned.

Estimated dollar value.

5. Statutory authority.

__X__41 U.S.C. 1901 – Simplified acquisition procedures (use when the simplified procedures for purchases of property and services for amounts (1) not greater than the simplified acquisition threshold

____41 U.S.C 1903 – Special emergency procurement authority (applies when in support of a contingency operation as defined in section 101(a) of title 10 or to facilitate the defense against or recovery from nuclear, biological, chemical, or radiological attack against the United States).

6. Rationale supporting use of the authority stated in paragraph 5.

WCF (Working Capital Fund) and NFEP (National fire equipment program) recommends that this work be done through an OEM dealer. According to the BLM WCF Class Vehicle Repair Decision Matrix if repairs recommended by the OEM are not performed the NOC will not allow WCF to repair any additional issues related to the original repair. Furthermore, the fire truck is currently undriveable and sitting at an OEM dealer (North Central International) in the que for repair. It is not feasible to have several mechanics tear down the fire truck to perform their own diagnosis, because the towing or hauling of the equipment is a large expensive. Additionally, North Central International already has stated that this fire truck can be repaired next week, which is essential given that the fire truck is needed for fire season. Currently, fire season has already begun in the area. If we were to move it to Nelson International (another OEM dealer that is 3 hours away) both dealers would not be able to schedule repairs next week. The next available slot would be 2 to 3 weeks out.

7. Other information.

Not Applicable.

8. The efforts to identify additional sources including the market research conducted.

We contacted both nearby OEM dealers for similar estimates for known work that needed to be completed, but the full extent of the work was not gathered until North Central did their full diagnosis of the issues. Once the fire truck is taken to one of the OEM dealers for a full diagnosis competition becomes restricted because of the cost to haul the fire truck to another OEM dealer for their diagnosis. Future efforts will be made to have multiple OEM dealers visit the fire truck onsite to run diagnostics to compete requirements.

9. Future plans to permit competition.

The Government will attempt to compete this requirement among local OEM dealers before the taking the fire truck to one specific dealer. Once the truck has been taken to a specific dealer, competition is significantly limited due to the additional cost of moving the fire truck from location to location.

10. The ordering activity Contracting Officer’s certification that the justification is accurate and complete to the best of the Contracting Officer’s knowledge and belief and evidence that the supporting data that form a basis for the justification have been certified as complete and accurate by technical/program personnel.
