Sole Source Justification and Approval

Sole Source Title: Programming of AMX Systems

Purchase Request: F1PT6F9238AW01

Contracting Activity: 355 Contracting Squadron, Davis-Monthan Air Force Base, Arizona

Type of Program: Other, Contracting

Type of Determination: Individual

(i) Authority:

41 U.S.C. 3304(a)(1) and Federal Acquisition Regulation (FAR) 6.302-1(a)(2)

(ii) Nature and/or Description of the Action Being Approved:

612th Air and Space Operations Center (AOC) currently utilizes a robust AMX audio/visual (AV) system, integrated throughout twenty-one different rooms, which was coded with specific software provided by Figure-H Design LLC in 2007 and 2015. Although AMX systems are commercially available, thereby allowing certified and non-certified technicians to service the units, when updates are available, the particular source code embedded in the 612th control panels is known only to Figure-H Design LLC;

whereupon, the coding accomplished during previous installations are proprietary to Figure-H Design LLC, and the original installer needs to recode specific parts of the A/V system to recover it to operational status.

(iii) Description of the Supplies/Services Required to Meet the Agency’s Needs:

The objective of the 612th AOC, which resides under, and supports, the larger Air and Space component of the 12th Air Force, Davis-Monthan AFB, is to provide oversight and administrative support for the Air Forces Southern forward operating locations in Central America, South America and the Caribbean. The following services are being procured to meet the needs of the 612th AOC.

[0001 - Qty. 1: EA] - AMX Panel Programming (offsite): Revise existing source code & touch panel files to accommodate new digital switching

[0002 - Qty. 1: EA] - AMX Panel Programming (3 days onsite): Test revised source code and touch panel files

[0003 – Qty. 1: EA] - Travel

(iv) Efforts to Obtain Competition:

Agency needs govern the necessity to issue a sole source, brand-name or openly competed acquisition, and, under this stipulation, thorough research was accomplished to verify which best suits the current requirement. The final determination, however, to utilize one of three avenues of competition, is at the discretion of the Contracting Officer, after a review of the relevant data provided both online and through previous acquisition experience. In this instance, the decision to acquire the one-time AMX Panel services, delineated above, in accordance with FAR 6.302-1(a)(2) Circumstances Permitting Other Than Full and Open Competition, has been determined applicable.

(v) Steps to Preclude Future Use of Sole Source Acquisitions:

The goal of the 355th Contracting Squadron is to procure affordable products and services, in effort to meet the Government’s needs in a timely manner, however, this does not preclude any justification to acquire items, commercial and non-commercial, that are technically acceptable. Further, it is our priority to find responsible vendors who are capable of satisfying the diverse requirements of Davis-Monthan AFB, which, consequently, leads to more opportunity for future competition.

(vi) Contracting Officer’s Determination:

As evidenced by my signature below, I hereby determine that the use of sole-source procedures is applicable to this acquisition.
