Sole Source Justification and Approval

III. Description of supplies/services required to meet agency needs.

The 306 Rescue Squadron is requesting the purchase of TS-16 Harnesses and TP-400 M2 / TP-460 M3 Canopies with necessary accessories for a complete parachute system. The CLIN structure is below:

IV. Statutory authority permitting other than full and open competition.

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

In accordance with the Air Force Approved For Use List (AUL) signed 8 April 2020, The Tandem Phoenix (TP) Series parachutes are required to be procured from Complete Parachute Solutions. The TS16 TP is a tandem system that can accommodate personnel recovery equipment loads of up to 1,000 pounds, or tandem passengers such as Flight Surgeons that are not qualified to parachute.

The current systems in use are approaching their service life and will be unusable in the near future. If unable to acquire the systems, the 306th RQS will lose a valuable Personnel Recovery mission tool for deployment and civil search and rescue.

The application of FAR 6.302-1 is used when the customers' needs of a unique supply are only available through one source or supplier. After contacting multiple businesses with the parachute manufacturing and distribution industry, it was discovered that the TS-16 and TP-400 / TP-460 parachutes and harnesses are only available for purchase for military operations through Complete Parachute Solutions Inc. To further verify, the manufacturer, United Parachute Technologies, was contacted and an exclusivity agreement was provided between the two parties.

Based on the information provided, it was determined that with the consideration of the organization's critical mission there is reasonable basis to conclude that the unique supplies available from a single source is applicable under the authority and application of FAR 6.302-1.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

In accordance with FAR Part 8, a review of the mandatory sources, including the AIB Procurement List, GSA, and UNICOR were reviewed to identify any sources that could meet the customer's requirement. The results of the review of sources indicated that there were no mandatory sources that could meet the requirement.

Through an internet search of the TS 16 harness and the TP-400/TP-460 canopies, only one business was located as a distributor of the products, Complete Parachute Solutions (CPS). After contacting other vendors, it was confirmed that this particular parachute series is only available through CPS as a complete system.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

Prices will be determined fair and reasonable in accordance with applicable Federal Acquisition Regulation procedures.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

Mandatory sources were reviewed, however, the product was not available. After reviewing similar acquisitions and conducting thorough market surveys, only Complete Parachute Solutions responded as being able to fulfill the requirement.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

X. List of any sources that expressed, in writing, an interest in the acquisition.

Sources that have expressed an interest and capability in this acquisition at this time include Complete Parachute Solutions Inc.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

The goal of the 355th Contracting Squadron is to utilize the most efficient and affordable courses of action in order to meet the customer's needs in a timely manner. The unit makes a priority of developing competition to the maximum extent practicable.
