This emergency contract will provide additional lead time to cover the time needed for preventative maintenance and service the FACGENS. The availability of the specific generators needed, and vendor who can support the continuation of the generators on-site can meet the requirement and in preparation for de-mobilization.

This unusual and compelling urgency requirement will be awarded as a fixed price type contract.

4. Statutory Authority Permitting Other than Full and Open Competition:

FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement.

Competition is restricted on this procurement for the reason below:

Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): This requirement is needed urgently to ensure the continuity of critical operators during power outage. Due to the criticality of these operations, it is essential to have reliable and effective emergency power backup system in place. The current FACGENS is inoperable. The emergency generators are necessary to mitigate the risk and critical operations continue without interruption to patient care. Unforeseen events such as natural disasters or equipment failure can occur at any time and hurricane season in Louisiana has impacted the facility in the past which caused evacuations of patients due to availability of electrical power supply.
