JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

Pursuant to the Federal Acquisition Regulation (FAR) Subpart 6.302-1 and the Bureau of Prisons Acquisition Policy (BPAP) Part 6.304(a) and AGD 06-006, the Federal Bureau of Prisons (BOP) has determined that the procurement of Digital mobile x-ray system service agreement for the United States Penitentiary, located in Jonesville, Virginia, meets the criteria established for other than full and open competition. This limitation on competition is justified as supported by the following information:

1. IDENTIFICATION OR THE AGENCY AND THE CONTRACTING ACTIVITY:

Department of Justice Federal Bureau of Prisons United States Penitentiary Hickory Flats Road Jonesville, VA 24263

2. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED:

This action is for the acquisition of Digital mobile x-ray system service agreement through GE Healthcare for our Health Services Department for the United States Penitentiary LEE, located in Jonesville, Virginia. This entity provided initial evaluation therefore no other provider will resume service. The specialized services are necessary to maintain care for inmates here at USP Lee.

3. DESCRIPTION OF SUPPLIES AND SERVICES REQUIRED TO MEET THE

AGENCY NEEDS (INCLUDING ESTIMATED VALUES):

The USP has a requirement to purchase outside specialized services from GE Healthcare. The total amount is $36,498.00.

IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN

FULL AND OPEN COMPETITION:

This justification and approval is being submitted for approval in accordance with 41 U.S.C. Sec. 253 (c) (1) and FAR 6.302-1, “Sole Source/Limited Source.”

6. DETERMINATION THAT PROPOSED CONTRACTOR’S UNIQUE

QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE

OF THE AUTHORITY CITED:

This procurement will be outside medical services from GE Healthcare. This is deemed to be highly-specialized service.

7. EFFORTS TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY

POTENTIAL SOURCES AS PRACTICAL:

Competition was not sought due to specialized medical services required.

8. DETERMINATION THAT THE ANTICIPATED COST TO THE GOVERNMENT

WILL BE FAIR AND REASONABLE:

The Contracting Officer anticipates the cost to the Government will be fair and reasonable.

9. DESCRIPTION OF MARKET RESEARCH:

Due to the highly-specialized service of this procurement no market research was conducted.

10. OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN

COMPETITION:

This procurement was for an inmate that needed highly-specialized service through outside medical care.
