DETERMINATION TO SOLICIT FROM A SINGLE SOURCE

Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.

1. Agency and Contracting Activity. U.S. Department of the Interior, Bureau of Reclamation, Denver Acquisition Operations Branch.

2. Name and Address of Single Source.

Omicron Electronics Corp USA 3550 Willowbend Blvd Houston, TX 77054

3. Description of Supplies/Services and Estimated Cost.

Reclamation has a need is for a device to measure the partial discharge from a variety of antennas, while also seamlessly allowing access to the raw data and device settings through custom third-party software. The three (3) most critical requirements aspects for the desired device are 1) onboard algorithmic detection of partial discharge pulses from input signals, 2) a selectable measurement bandwidth for measuring partial discharge from a variety of antennas and coupling devices, and 3) a documented application programming interface which allows our own custom applications to access all measurement values and settings. The capabilities of these requirements were identified with the following equipment:

- MPD 600-1 Single-Channel High-End PD ,and

- Module: "Integration" (License Key)

Description of Circumstances, including why only one source is reasonably available. The

Omicron’s MPD 600-1 Single Chanel High-End PD is the only device capable of fulfilling

Reclamation’s Science and Technology Department current needs and mission parameters.

This device is a critical component of a revolutionary method of testing hydro-generators, that was developed internally. Upon successful implementation of this this new method of testing, significant cost savings could be realized throughout Reclamation’s operations and maintenance programs.

Omicron’s MPD 600-1 Single Chanel High-End PD is the only device that contains the required 1) onboard algorithmic detection of partial discharge pulses from input signals, 2) a selectable measurement bandwidth for measuring partial discharge from a variety of antennas and coupling devices, and 3) a documented application programming interface which allows our own custom applications to access all measurement values and settings.

IAW FAR 13.106-1(b)(1)(ii) it is Contracting Officer’s determination that sole source award to Omicron Electronics Corp. USA, is the only known source for this device, presenting the least amount of risk, and is in the best interest to the Government.

5. Determination of Fair and Reasonable Price.

The Contracting Officer will perform necessary price analysis techniques such as a review of current price lists or catalogs (FAR 13.106-3(a)(2)(iii)), and/or compare pricing within the

Independent Government Estimate (FAR 13.106-3(a)(2)(vi)).

6. Description of Market Research.

In October of 2021 Reclamation’s Science and Technology Department conducted extensive market research consulting with other industry experts wherein the Market research conducted revealed four (4) potential providers of potential devices. However, on closer examination of the potential sources two of the four providers devices do not meet the second and third aspects for this requirement. The remain two (2) identified sources of these devices did meet all three of the critical requirement aspects however, one of the providers requires a non-disclosure agreement for the use their application programming interface (API), as this feature is not yet available to the public, which prohibits the publishing of any data gained by its use. Though this is understandable, it is also unacceptable due to Reclamation’s Science and Technology

Department mandate to have all research results publicly published. As the only remaining qualified provider, Omicron, Electronics Corp USA, was identified as the only capable provider for this equipment with no other authorized re-sellers were identified
