About this file
This document is a justification for a sole source contract award. The Department of Justice seeks to procure and install a modular sensitive compartmented information facility to support court-ordered review of classified information through January 2024. The facility must be operational to meet court-imposed deadlines. Due to limited site access restrictions and urgency, there is insufficient time for full and open competition. Centurion Secure specializes in modular SCIFs and agreed to expedite work to meet deadlines. As the incumbent SCIF provider to intelligence agencies, Centurion is uniquely qualified. Price will be determined fair based on past contracts. The justification and determination was certified by the Assistant Director of Litigation Security and Contracting Officer.

Department of Justice SEPS/Litigation Security Group
Justification for other than full and open competition, Sole Source Justification
Description of Action:
This justification is prepared in accordance with the requirements of FAR 6.303 and/or 13.106 to support the recommendation that the Department of Justice (DOJ) use other than full and open competition for the acquisition of the following item:
Purchase and installation of modular sensitive compartmented information facility (SCIF).
Period of Performance: through January of 2024 (removal and relocation at later date).
Total Estimated Value $749,990
Negotiations will be conducted with Centurion on a noncompetitive basis under the statutory authority of 41 U.S.C.
253(c)(2), unusual and compelling urgency, as implemented in FAR 6.302-2 and/or 13.106.
Description of Requirement:
The proposed acquisition will provide, on a firm, fixed price basis, a modular sensitive compartmented information facility (SCIF) that will support court-ordered judicial and defense review, storage, and processing of classified information throughout the course of litigation. A aaaaaaaaaaa AAAAAAAAA Aaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaa At the conclusion of the case, the Department will take possession of the modular SCIF and relocate it.
Technical Justification:
AAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAA
The presiding judge, AAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAA AAAAAAAAAAAAA has ordered the Department to arrange a SCIF AAAAAA AAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAA which will be used for the above purposes.
Unique Qualifications of the Acquisition:
This project is extremely time-sensitive and must meet Court-imposed deadlines in the case. The Department does not have ample time to properly compete the work. The nature of the work to be performed further exacerbates this issue. For instance, the contemplated location for the SCIF is highly restricted. The Department does not own the location and does not control access to the site. Accordingly, the Department is unable to secure required site-visit access to interested contractors on a competitive basis. As a result, with very limited time to conduct research, the Department was required to choose a single contractor capable of performing the work without delay.
Centurion Secure (Centurion) is an organization that specializes in the construction and installation of modular SCIFs. It has extensive experience in providing similar services government-wide. The Department selected this company specifically based upon their successful work on other sensitive matters within the intelligence community. Further, when contacted about this specific work, Centurion agreed to expedite this particular project in order to meet imposed deadlines and bring the SCIF into full performance.
Due to restricted access to the proposed site and due to the urgency in making the SCIF operational, the Department does not have the time or ability to conduct a competitively open procurement. Finally, the proposed site itself is sensitive, non-public information. Even if a competitive procurement were possible, and even if the Department could control access to the proposed site, there is no certain way to publish information about the site’s location to other interested companies, without bearing significant risk of compromising the site location.
Price Determination:
A price evaluation will be conducted based on previously purchased membership access along with other relevant information to determine that the price is fair and reasonable.
Certifications and Approvals:
Technical/Requirements Personnel Certification:
I certify that the technical justification is accurate and contains complete data necessary to support the recommendation for other than full and open competition.
