SOL-514-16-000024 – PARAMOS AND FORESTS
Attachment 1 – List of Changes to the Request for Proposals
1. In PART I – THE SCHEDULE, SECTION B – SUPPLIES OR SERVICES AND
PRICES/COSTS, B.3.3 – Payment of Fixed Fee:
Delete the first sentence: “The Contractor’s fixed fee is tied to the accomplishment of the deliverables under each CLIN and all terms and conditions of the award.”
And, replace the language under CLIN 2 in its entirety as follows: “Payment of the corresponding fixed fee for each Task Order will be negotiated at the task order level; made upon receipt of a proper invoice, and must directly correspond to the percentage of allowable costs being paid and the level of effort furnished. In no event, the fixed fee of the Task Orders under CLIN 0002 can exceed the negotiated fee under CLIN 0001.”
2. In PART II - CONTRACT CLAUSES, SECTION I – CONTRACT CLAUSES, insert the following clause:
I.16 CHILD SAFEGUARDING STANDARDS (AUG. 2016)
(a) Implementation of activities under this award may involve children, or personnel engaged in the implementation of the award may come into contact with children, which could raise the risk of child abuse, exploitation, or neglect within this award. The contractor agrees to abide by the following child safeguarding core principles:
(1) Ensure compliance with host country and local child welfare and protection legislation or international standards, whichever gives greater protection, and with U.S. law where applicable;
(2) Prohibit all personnel from engaging in child abuse, exploitation, or neglect;
(3) Consider child safeguarding in project planning and implementation to determine potential risks to children that are associated with project activities and operations;
(4) Apply measures to reduce the risk of child abuse, exploitation, or neglect, including, but not limited to, limiting unsupervised interactions with children; prohibiting exposure to pornography; and complying with applicable laws, regulations, or customs regarding the photographing, filming, or other image-generating activities of children;
(5) Promote child-safe screening procedures for personnel, particularly personnel whose work brings them in direct contact with children; and
(6) Have a procedure for ensuring that personnel and others recognize child abuse, exploitation, or neglect; mandating that personnel and others report allegations; investigating and managing allegations; and taking appropriate action in response to such allegations, including, but not limited to, dismissal of personnel.
(b) The contractor must also include in the code of conduct for all personnel implementing USAID-funded activities, the child safeguarding principles in paragraphs (a)(1) through (6) of this clause.
(c) The following definitions apply for purposes of this clause:
(1) Child. A child or children are defined as persons who have not attained 18 years of age.
(2) Child abuse, exploitation, or neglect. Constitutes any form of physical abuse; emotional ill-treatment; sexual abuse; neglect or insufficient supervision; trafficking; or commercial, transactional, labor, or other exploitation resulting in actual or potential harm to the child's health, well-being, survival, development, or dignity. It includes, but is not limited to: Any act or failure to act which results in death, serious physical or emotional harm to a child, or an act or failure to act which presents an imminent risk of serious harm to a child.
(3) Emotional abuse or ill treatment. Constitutes injury to the psychological capacity or emotional stability of the child caused by acts, threats of acts, or coercive tactics. Emotional abuse may include, but is not limited to: Humiliation, control, isolation, withholding of information, or any other deliberate activity that makes the child feel diminished or embarrassed.
(4) Exploitation. Constitutes the abuse of a child where some form of remuneration is involved or whereby the perpetrators benefit in some manner. Exploitation represents a form of coercion and violence that is detrimental to the child's physical or mental health, development, education, or well-being.
(5) Neglect. Constitutes failure to provide for a child's basic needs within USAID-funded activities that are responsible for the care of a child in the absence of the child's parent or guardian.
(6) Physical abuse. Constitutes acts or failures to act resulting in injury (not necessarily visible), unnecessary or unjustified pain or suffering without causing injury, harm or risk of harm to a child's health or welfare, or death. Such acts may include, but are not limited to: Punching, beating, kicking, biting, shaking, throwing, stabbing, choking, or hitting (regardless of object used), or burning. These acts are considered abuse regardless of whether they were intended to hurt the child.
(7) Sexual abuse. Constitutes fondling a child's genitals, penetration, incest, rape, sodomy, indecent exposure, and exploitation through prostitution or the production of pornographic materials.
(d) The contractor must insert this clause in all subcontracts under this award.

3. In PART IV – REPRESENTATION AND INSTRUCTIONS, SECTION L – INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS OR RESPONDENTS, L.7 GENERAL
INSTRUCTIONS, replace sections (b) and (e) as follows:
(b) RFP Instructions Proposals must be submitted in accordance with t he i n s t r uc t i ons i n Section L. If an offeror does not follow the instructions set forth herein, the offeror’s proposal may be eliminated from further consideration or the proposal may be down-graded and not receive full or partial credit under the applicable evaluation criteria.
(e) Offer Acceptability USAID may determine an offer to be unacceptable if an offeror does not comply with all of the terms and conditions of the RFP and prospective contract, including:
1) Completion of Standard Form 33, Blocks 12 through 18;
2) Submission of proposed costs/prices and indirect cost information as required by Section B and L of this RFP;
3) Completion of the “Representations, Certifications, and Other Statements of
Offerors” in Section K; and
4) Submission of information required by Section L or any other section of this
RFP. Incomplete proposals may be eliminated from further consideration. The submission of these items in accordance with these instructions will, if the USAID accepts the offer, contractually bind USAID and the successful offeror to the terms and conditions of the prospective contract. Offerors must follow the instructions contained in this RFP and supply all information and signature/certifications, as required.”
4. In PART IV – REPRESENTATION AND INSTRUCTIONS, SECTION L – INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS OR RESPONDENTS, L.9.2 Format, Page Limitation and Content, replace the first paragraph as follows:
“The proposal must be written in English and typed on standard 8.5” x 11” paper (216mm x 297mm), single spaced, Times New Roman font not less than 12 points in size, with margins no less than one inch of each border. Number each page consecutively. All graphs and charts must be included in the annexes. Text in graphs, charts and text boxes may be less than 12 points in size but no less than 8 points and must be legible.”
In the same section referencing annexes, replace bullet Annex A, and add bullet Annex G as follows:
• Annex A: CV/Resumes for proposed Key Personnel (up to three pages per KP)
• Annex G: Relevant graphs and charts referenced in Technical Proposal (maximum 5 pages)
5. In PART IV – REPRESENTATION AND INSTRUCTIONS, SECTION L – INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS OR RESPONDENTS, L.9.3, Technical Approach, replace the language of paragraph #3 as follows:
The plan to engage with all the relevant GOC counterparts describing how the verification data from the 8 REDD+ projects will feed into the national MRV system and national REDD+ strategy, and how the Activity will improve IDEAM and MADS’ capacity to use forest and terrestrial carbon monitoring methodologies and technologies as part of the MRV system.
Additionally, paragraph #8 which reads: "Description of financial instruments proposed to attract private and public finance to sell carbon credits, and improve livelihoods in the REDD+ territories..." has been shifted from Objective 2 to Objective 1, and is now paragraph #4.
6. In PART IV – REPRESENTATION AND INSTRUCTIONS, SECTION L – INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS OR RESPONDENTS, L.9.6 Past Performance Information, (d)(3)(B), replace the language as follows:
“(B) To supplement the narrative summary in (A), provide a copy of the three (3) most recent SF 294 “Subcontracting Report for Individual Contracts” reports submitted to eSRS (FAR 52.219- 9(d)(10) over the past three years or a copy of any similarly recent subcontracting reports if they were not submitted to eSRS.”
7. In PART IV – REPRESENTATION AND INSTRUCTIONS, SECTION L – INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS OR RESPONDENTS, L.10, the first paragraph has been modified to read: “The Total Estimated Cost plus Fixed Fee for services under this contract (CLIN 0001 & CLIN002) is estimated to fall within the range of $38 million and $40 million for the period of performance identified in Section F.2.”
8. In PART IV – REPRESENTATION AND INSTRUCTIONS, SECTION L – INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS OR RESPONDENTS, L.10.A.(12) Fixed fee (if any), delete the following sentence: “USAID will not agree to allow the GUCs to be included in the calculation of fixed fee.”
9. In PART IV – REPRESENTATION AND INSTRUCTIONS, SECTION L – INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS OR RESPONDENTS, L.10 - Part 3 - Representations, Certifications, and Other Statements of Offerors, replace the first paragraph as follows:
“Offerors and all proposed subcontractors must ensure they are registered in the System for Award Management (SAM) (www.sam.gov) per FAR part 4. The offeror and each proposed subcontractor must complete and submit all applicable certifications in Section K, “Representations, Certifications, and Other Statements of Offerors.”
10. In PART IV – REPRESENTATION AND INSTRUCTIONS, SECTION L – INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS OR RESPONDENTS, L.10(B) CLIN 0002, replace the fifth paragraph as follows: “For estimating purposes, the offeror must propose costs for a total of [800] person-days equally distributed across all labor categories for each year of the seven-year contract.”
11. In PART IV – REPRESENTATION AND INSTRUCTIONS, SECTION M – EVALUATION FACTORS FOR AWARD, M.1 GENERAL INFORMATION, delete paragraph 8 that reads:
(b) “If an offeror’s technical proposal is determined to be technically unacceptable, USAID will not evaluate their cost proposal. A “technically unacceptable” proposal is defined as a proposal that does not clearly meet the minimum requirements of the solicitation.”
Additionally, paragraph 7 that is labeled (a), should be labeled (g).
12. In PART IV – REPRESENTATION AND INSTRUCTIONS, SECTION M – EVALUATION FACTORS FOR AWARD, M.3 COST EVALUATION, in the first paragraph, delete the third sentence that reads:
“If an offeror’s technical proposal is determined to be technically unacceptable, USAID will not evaluate their cost proposal.”
13. In ATTACHMENTS AND OTHER DOCUMENTS, replace ATTACHMENT 4 – BUDGET
TEMPLATE with the revised excel file attached through the amendment of the solicitation.
14. In ATTACHMENTS AND OTHER DOCUMENTS, add the following attachment:
