This is a combined synopsis/solicitation for commercial products and commercial services prepared in accordance with the format in Federal Acquisition Regulation (FAR) 12.6 and (FAR) 13 as supplemented with additional information included in this notice. The incorporated provisions and clauses are those in effect through Federal Acquisition Circular

(FAC) 2023-06.

THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITATION AND A SEPARATE SOLICITATION WILL NOT BE ISSUED. The solicitation number for this acquisition is CFSAN-2024-120751 and is being issued as a Request for Quotation (RFQ). The NAICS Code for this solicitation is 811210 (Electronic and Precision Equipment Repair and Maintenance) and the Small Business Size Standard is $34.0M. This requirement is being solicited on an unrestricted Full and Open competitive basis. Prospective quoters are responsible for downloading the solicitation and any amendments from SAM.gov. The Government reserves the right to award a contract without discussions if the Contracting Officer determines that the initial quote is providing the Best Value and discussions are not necessary.

The U.S. Food and Drug Administration (FDA) has an ongoing requirement for the maintenance of six Applied Biosystems (AB) 7500 FAST Real-Time PCR systems at the FDA’s Gulf Coast Seafood Laboratory located at 1 Iberville Drive, Dauphin Island, AL 36528. Further details are outlined in the Performance Work Statement (PWS) below.

2. QUOTATION DEADLINE: The deadline for receipt of quotations for this requirement is: Wednesday, January 3, 2024 at 10:00AM ET. Quotation submissions shall be submitted by email only to Contract Specialist Benjamin Dorgan at: benjamin.dorgan@fda.hhs.gov. Subject line of the email should be titled: “Quotation Submission:

CFSAN-2024-120751_AB 7500 Maintenance Services”.

3. QUOTATION SUBMISSION INSTRUCTIONS:

3.1 The Contractor shall submit a firm-fixed-price quote, including details of all costs supporting the price for the required deliverables. **NOTICE: Payment for extended warranties/maintenance agreements will be made in arrears upon service completion or at a mutually agreed upon defined timeframe at time of award.**

3.2 The Contractor shall include and complete the pricing chart below. Pricing shall include all applicable fees; any charges presented after contract award shall not be considered/acceptable.

3.3 Quotes shall be in two volumes: Volume I shall be Technical and Volume II shall be Price. The volumes shall be separate and complete, so the evaluation of one may be accomplished independently of, and concurrently with, the evaluation of the other. No pricing information shall be provided in Volume I. This volume shall provide the equipment description including specs, proposed work breakdown schedule for completion, warranty, delivery timeframe, etc. and not exceed 10 pages in length.

3.4 Quotes shall clearly reference the solicitation, date of quotation, company quoting and point of contact.

3.5 The Contractor’s current address and System for Award Management Unique Entity ID (UEI) shall be included in the quote.

3.6 Quotes shall be for all the deliverables requested.

3.7 Quotes shall be valid for at least 60 days after close of solicitation.

3.8 The solicitation does not commit the Government to pay any cost for the preparation and submission of a quote. It is also advised that the Contracting Officer (CO) is the only individual who can legally commit and obligate the Government to the expenditure of public funds in connection with the proposed acquisition.

4. AWARD CRITERIA:

Quotations that do not respond to all requirements in the solicitation may be considered non-responsive without further evaluation, deliberation, or discussion. The Government reserves the right to award without discussions.

The Government contemplates award of a Firm-Fixed-Price purchase order resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation will be most advantageous to the Government and whose quote is the Lowest Priced Technically Acceptable (LPTA).

PERFORMANCE WORK STATEMENT

U.S. Food and Drug Administration (FDA)

TITLE: SERVICE MAINTENANCE AGREEMENT FOR (X6) AB7500 FAST RT-PCR INSTRUMENT SYSTEMS

1. PURPOSE

To obtain a service contract for the preventative maintenance and technical support of six (6) AB7500 FAST RT- PCR instrument systems.

2. BACKGROUND

The need for rapid detection and characterization methods of foodborne pathogens is increasing. As methods are developed and validated, many are platform specific due to the specific performance characteristics of the instruments. The AB7500 FAST Real-Time PCR machines are instruments used to develop and validate methods used for the detection and characterization of foodborne contamination which affects the safety of our nation’s food supply. The machines are also used by Office of Regulatory Sciences (ORS) for regulatory purposes to quickly detect foodborne contaminants. Is it essential that the machines remain calibrated and maintained to ensure the validity of results.

3. SCOPE

The Contractor shall provide assurance planned maintenance service agreement for six (6) AB7500 FAST RT- PCR instrument systems (SN# 275012494, 275013732, 275017175, 275017242, 275017248, 275017245) for excellent operational condition.

a. Service contract shall provide yearly preventative maintenance.

b. Calibration dye kits, reagents, and parts shall be provided.

c. The maintenance agreement shall cover manufacturer approved parts, labor, travel and accommodation for the planned maintenance service and remedial service during the contract period.

d. Thermo-Fisher Scientific factory trained and certified engineers shall respond within one (1) business day for service.

e. The planned service shall be delivered for all the system components at the same time to reduce down-time of the system.

f. The service shall provide hardware, software and application telephone support during normal business hours.

g. Service shall upgrade software to the latest version and cover all software patches.

h. The service shall also include prioritized software phone and online support.

4. SPECIFIC TASKS

4.1 Task 1 – Yearly Preventative Maintenance (PM)

a. A Thermo-Fisher Scientific factory trained and certified technician shall travel to the place of performance specified below in section 7 to calibrate the machines one time per year. A minimum of two (2) days prior to arrival, the contractor shall contact the PMO Point of Contact (POC) or Technical Point of Contact (TPOC) to schedule an appointment to visit the system site for any work. At that time, any maintenance needed to keep or bring the machines to fully functional status with adequate calibration results consistent with manufacturer operating requirements shall be done.

b. All dye calibration kits, reagents, parts, and labor shall be included.

c. Shall use only manufacturer made parts or manufacturer certified parts for the service.

d. Shall deliver full upgrades to latest software versions for all entitled software.

e. Shall deliver updates to latest software versions for all entitled software.

f. Shall conduct annual software check to ensure that all software is up to date with the latest entitled version.

4.2 Task 2 – Technical Support

a. Shall provide technical support on the instrument and informatics and remote telediagnostic feature for troubleshooting for efficient performance if needed.

b. Technical support via internet, phone, or in person shall be provided during the contract period.

c. Shall provide prioritized software and application telephone support.

4.3 Task 3 – Repairs

a. Services and repairs shall be provided by Thermo-Fisher Scientific factory trained and certified engineers and using manufacturer diagnostic tools for efficient diagnosis and performance.

b. Shall provide customer technical phone support during normal business hours.

c. Quick response of Thermo-Fisher Scientific factory trained and certified engineers within 2 business days for remedial repair during the contract period.

d. Shall cover engineer dispatch charges, travel, labor, accommodation.

e. Service shall be provided on regular workdays.

f. All workmanship shall be warranted for at least sixty (60) days.

5. DELIVERABLES

a. Contractor shall provide calibration dye kits, reagents, and parts needed for maintenance and repair of the instruments.

b. Planned maintenance services shall be scheduled at one (1) per year, during the contract period.

c. Contractor shall provide service and support for instruments located at the Gulf Coast Seafood Laboratory, 1 Iberville Drive, Dauphin Island, AL 36528.

d. Contractor shall provide a signed report of maintenance and repair, clearly identifying the work performed, delivered as paper copy and/or email in PDF form to the Program Management Office (PMO) contacts and Technical Point of Contact (TPOC) indicated below in section 11.

6. SECURITY

a. This position does not require a badge or access to FDA’s network. Contractor shall provide photo identification for security pass.

b. PMO/TPOC will monitor the Contractor while on-site.

c. A minimum of two (2) days prior to arrival, the contractor shall contact the PMO Point of Contact (POC) or Technical Point of Contact (TPOC) to schedule an appointment to visit the system site for any work. Upon arrival, the contractor shall alert security guard on duty, at the gate, with their purpose and a contact name, when visiting the system site. The Contractor shall sign in at the front desk, provide any additional forms or identification required for entry, and obtain a visitor’s pass. When departing, the Contractor shall “check out” with the guard and return the visitor’s pass. The risk level is non-sensitive.

d. During the contractor’s visit/appointment, the Contractor shall abide by all policies and procedures in place at the system site.

7. PLACE OF PERFORMANCE

All tasks shall be performed at FDA GCSL, 1 Iberville Drive, Dauphin Island, AL. Work shall be conducted Monday through Friday, excluding federal holidays.

8. HOLIDAYS AND GOVERNMENT CLOSURES

a. The Contractor is not required to provide on-site services on the days that are official Federal Holidays.

b. In the event of inclement weather when the Federal government is closed, the Contractor is not required to provide on-site service.

c. The Contractor may not bill the Government for any work that the Contractor did not perform due to any Government closure.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the

Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

I.4 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor any time before the contract expires.

I.5 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor any time before the contract expires; provided that the Government gives the Contractor a preliminary written notice of its intent to extend before the contract expires. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

I.14 HHSAR 352.232-71 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS

(a) Definitions. As used in this clause- Payment request means a bill, voucher, invoice, or request for contract financing payment with associated supporting documentation. The payment request must comply with the requirements identified in FAR 32.905(b), “Content of Invoices” and the applicable Payment clause included in this contract.

(c) Except as provided in paragraph (c) of this clause, the Contractor shall submit payment requests electronically using the Department of Treasury Invoice Processing Platform (IPP) or successor system. Information regarding IPP, including IPP Customer Support contact information, is available at www.ipp.gov or any successor site.

(d) The Contractor may submit payment requests using other than IPP only when the Contracting Officer authorizes alternate procedures in writing in accordance with HHS procedures.

(e) If alternate payment procedures are authorized, the Contractor shall include a copy of the Contracting Officer's written authorization with each payment request.

I.15 FDA ELECTRONIC INVOICING AND PAYMENT REQUIREMENTS - INVOICE PROCESSING PLATFORM (IPP)

a. All Invoice submissions for goods and or services must be made electronically through the U.S. Department of Treasury's Invoice Processing Platform System (IPP). http://www.ipp.gov/vendors/index.htm

b. Invoice Submission for Payment means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in FAR 32.905(b), "Content of Invoices" and the applicable Payment clause included in this contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial items contracts. 1. The Agency will enroll the Contractors new to IPP. The Contractor must follow the IPP registration email instructions for enrollment to register the Collector Account for submitting invoice requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive Registration email from the Federal Reserve Bank of St. Louis (FRBSTL) within 3 - 5 business days of the contract award for new contracts or date of modification for existing contracts.
