Included in contract is: one (1) anode rebuild (includes rebuild kit, anode cup(Cu only), balancing, labor and shipping) per generator to be used during the contract period. Specialty replacement cups (Cobalt [Co], Platinum [Pt], Molybdenum [Mo], Chromium [Cr], Gold [Au], Silver [Ag], or DW anode will be priced extra (request separate quote).

Other Direct Cost (ODC) $1,750.00 Travel Not-To-Exceed

(NTE) $1,750.

C - Description/Specifications

PART 1

GENERAL INFORMATION

1.1. Description of Services/Introduction:

The contractor shall provide all personnel, equipment, tools, materials, supervision, and other items and non-personal services necessary to perform installation of equipment as defined in this Performance Work Statement. The contractor shall perform to the standards in this contract.

Manufacturers will provide a 12 month warranty including all parts and labor from the installation delivery date.

1.2. Background: The Department of Labor (DOL), OSHA, SLTC, Industrial Hygiene Chemistry (IHC) Division annually analyzes thousands of samples submitted by Compliance Safety and Health Officers (CSHOs) evaluating worker exposure to regulated chemicals in workplaces all over the United States and the territories of Puerto Rico, Virgin Islands, and Guam. Analytical results provided by SLTC to CSHOs are often used as the basis for citations and these results must be accurate, precise, and defendable in court proceedings.

The SLTC has been using XRD instrumentation to identify respirable crystalline silica for decades. The SLTC requires aXRD instrumentation that has the sensitivity to reliably measure respirable crystalline silica at the more recent, lower PEL and action levels. A system with a 9kW rotating anode X-ray source configured with vertical theta/theta goniometer is required.

1.3 Objectives: The objective is to procure an XRD instrument for use in Respirable Crystalline Silica analysis at OSHA Salt Lake Technical Center.

1.4 Scope: The contractor shall deliver and install one XRD system.

1.5 Period of Performance: The period of performance shall be for 6 month from contract award.

1.6. Travel: Travel may become necessary in performing task under this PWS. In no event shall the Service Provider incur travel expenses without prior approval from the Contracting Officer or authorized technical representative (COR). Travel expenses incurred and necessary to fulfill requirements of this PWS shall be reimbursed at cost (no profit or G&A) pursuant to the Federal Travel Regulation (FTR), FAR 31.205-46, and the not to exceed amount specified in Price Schedule of this contract. For purposes of invoicing and payments, the Service Provider shall submit documentation to support all costs incurred. At a minimum, this includes receipts for air/ground transportation, lodging, and receipts for expenses per occurrence. The Contractor shall not incur expenses beyond the not-to-exceed amount established in the contract Schedule of Supplies and Services.

1.6 General Information

1.6.1 Quality Control: The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s quality control program is the means by which he assures himself that his work complies with the requirement of the contract. As a minimum, the contractor shall develop quality control procedures that address the areas identified in Technical Exhibit 1, “Performance Requirements Summary”.

1.6.2 Quality Assurance: The government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).

1.6.3 Government Remedies: The contracting officer shall follow FAR 52.212-4, “Contract Terms and Conditions-Commercial Items” or 52.246-4, “Inspection of Services-Fixed Price” for contractor’s failure to perform satisfactory services or failure to correct non-conforming services.

1.6.4 Recognized Holidays: The contractor is not required to perform services on Federal Holidays

1.6.5 Hours of Operation/Place of Performance: The contractor is responsible for conducting business between the hours of 8:00am to 5:00pm, Monday thru Friday, except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. The Contractor must at all times maintain an adequate work force for the uninterrupted performance of all tasks defined within this statement of work when the Government facility is not closed for the above reasons. When hiring personnel the contractor shall keep in mind that the stability and continuity of the work force are essential telecommuting or “work at home” is not authorized under this contract unless under emergency situations as determined by the COR.

1.6.7 Security Requirements: The contractor shall adhere to all current DOL OSHA facility security policies.

1.6.7.1 Physical Security. The contractor shall be responsible for safeguarding all government property provided for contractor use. At the close of each work period, government facilities, equipment, and materials shall be secured.

1.6.7.2 Conservation of Utilities. The contractor shall instruct employees in utilities conservation practices. The contractor shall be responsible for operating under conditions that preclude the waste of utilities, which include turning off the water faucets or valves after using the required amount to accomplish cleaning vehicles and equipment.

1.6.7.3 Special Qualifications: N/A

1.6.7.4 Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The contracting officer, Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the contracting officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.

1.6.7.5 Contracting Officer Representative (COR): A COR will be delegated after award.

1.6.7.6 Contract Manager: The contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the contractor when the manager is absent shall be designated in writing to the contracting officer. The contract manager or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract.

1.6.7.7 Identification of Contractor Employees: All contract personnel attending meetings, answering Government telephones, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed.

PART 2

DEFINITIONS & ACRONYMS

PWS. Performance Work Statement

Contracting Officer’s Representative (COR). A representative from the requiring activity assigned by the Contracting Officer to perform surveillance and to act as liaison to the contractor

Defective Service. A service output that does not meet the standard of performance associated with it in the Performance Work Statement.

DOL. Department of Labor

Quality Assurance Surveillance Plan (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.

Quality Control. Those actions taken by a contractor to control the performance of services so that they meet the requirements of the PWS.

Quality Assurance. Those actions taken by the government to assure services meet the requirements of the Performance Work Statement.

XRD System. X-Ray Diffractometer (XRD) system

Best Effort: That effort expended by the contractor to perform within the awarded ceiling price all work specified in this acquisition and all other obligations under this acquisition. This effort includes providing required qualified personnel, properly supervised, and following industry accepted methodologies and other practices. The effort is further characterized by operating at all times with the Government’s best interest in mind, using efficient and effective methods, and demonstrating sound cost control. The effort must be identical to the effort that would be expended if this were a firm-fixed price acquisition and the contractor’s profits were dependent upon reducing costs while meeting the Government’s requirements in terms and quality and schedule. Failure to provide this required effort may result in the withholding of payment for hours expended that do not qualify as best effort or a reduction in the rate per hour to reflect decreased value of services received.

PART 3

GOVERNMENT FURNISHED PROPERTY, EQUIPMENT, AND SERVICES

3.1 GENERAL: The government shall provide, the facilities, equipment, materials, and/or services listed below.

3.2 Equipment and Materials: The Government will provide the necessary equipment and materials to complete the services listed in this contract. All GFE will remain at the Center at all times.

3.3 Utilities. All utilities in the facility will be available for the contractor’s use in performance of duties outlined in this PWS. The Contractor shall instruct employees in utilities conservation practices. The contractor shall be responsible for operating under conditions that preclude the waste of utilities.

3.4 Facilities: The Government will furnish the necessary workspace for the contractor staff to provide the support outlined in this PWS to include desk space, telephones, computers and other items necessary to maintain an office environment.

PART 4

CONTRACTOR FURNISHED ITEMS AND SERVICES

4.1 General: Except for those items specifically stated to be government furnished in Part 3, the contractor shall furnish everything required to perform this PWS. The contractor shall cover all travel related expenses involved in the execution of this contract.

4.2 Clearance: The Contractor shall possess or be eligible to receive and maintain a background investigation.

4.3 The CO or COR shall excise full and complete control over granting, withholding, or canceling clearances for contract employees. The CO or COR may grant temporary clearances to employees of the contractor; however the granting of a temporary clearance shall not be considered an assurance that full clearance shall in no way prevent, preclude, or bar the withdrawal or termination of any such clearances by the department.

PART 5

SPECIFIC TASKS

5.1 Basic Services: The contractor shall provide services for installation of the XRD system.

Also, the contractor shall aid in optimization of system to ensure technical requirements (low levels of respirable crystalline silica) can be reliably measured.

Contractor shall ensure that the Gas Chromatography-Mass Spectrometry (GC-MS) system will have the following specifications:

5.1.1a. XRD system will have 9kW rotating anode X-ray source with Cu target.

5.1.1b XRD system with a 9kW rotating anode X-ray source configured with vertical theta/theta goniometer is required.

5.1.2a. XRD system will have goniometer system.

5.1.3a. XRD system will have sample stage.

(a) A Contracting Officer’s Representative (COR) will be delegated upon award. A copy of the delegation memorandum will be provided to the COR and a delegation letter sent to the vendor.

(b) The COR is responsible, as applicable, for: receiving all deliverables; inspecting and accepting the supplies or services provided hereunder in accordance with the terms and conditions of this contract; providing direction to the contractor which clarifies the contract effort, fills in details or otherwise serves to accomplish the contractual scope of work; evaluating performance; and certifying all invoices/vouchers for acceptance of the supplies or services furnished for payment.

(c) The COR does not have the authority to alter the contractor’s obligations under the contract, and/or modify any of the expressed terms, conditions, specifications, or cost of the agreement. If, as a result of technical discussions, it is desirable to alter/change contractual obligations or the scope of work, the contracting officer must issue such changes.

(d) ACOR is not authorized to direct any action that results in a change in the scope, price, terms or conditions of this contract.

1. Electronic Invoice Submittal

Invoices for the services/goods provided under this award shall be submitted through the Department of Treasury’s Invoice Processing Platform (IPP) or through the Department of Labor (DOL) Quickpay email system, as directed by the Contracting Officer. IPP is a Federal Government owned and operated website accessible to contractors free of charge. Information about IPP, including enrollment instructions, are available and should be obtained by the enrolled contractors directly from the Department of Treasury after award at, https:www.ipp.gov.

a. The following instructions apply to Invoices submitted through IPP.Gov or the DOL Quickpay email system:

IPP invoice attachments SHALL NOT exceed the size limit of 10 megabytes (MB) each.

However, you may submit multiple attachments of less than 10MB each with the invoices.
