The National Park Service, Paterson Great Fall
National Historic Park, Paterson, NJ 07501 has a requirement for the rental of two (2) standard portable toilets and one (1) ADA Accessible portable toilet and provide all associated supplies and sanitary services; in accordance with the attached Statement of Work (SOW).
Instructions to Quoters:

Scope of Work
Portable Toilets
Paterson Great Falls NHP
1. Introduction. Paterson Great Falls NHP is located in the city of Paterson, New Jersey and is centered around the Great Falls of the Passaic River. The National Park is located within Paterson’s Great Falls Historic District and consists of parking facilities but no public restrooms.
2. Scope. Furnish portable toilets at Paterson Great Falls NHP and provide all associated supplies and sanitary services.
3. Period of Performance.
Base: 12 Months from Date of Award, with Option to Renew for Additional 12 Months
4. Required Service. Provide units, as indicated, to all locations listed in the schedule as shown herein. As a minimum, all units shall-
• Arrive, and be maintained in, a clean and serviceable condition.
• Doors must swing and close properly and securely and possess an interior mounted latching or locking mechanism. Color: units shall be green, brown, gray, or blue
• Include a wall mounted urinal and a bench style toilet with a seat and cover. Contain as multi-roll (2roll) lockable paper dispenser which shall be filled on every service visit.
• Include a wall mounted hand sanitizer dispenser which shall be checked on every service visit and contain enough liquid to last until next service. For units in place during winter months, if non-alcohol-based hand sanitizer is being used it should be replaced with alcohol-based sanitizer, so liquid is free-freezing temperatures.
• Include a log on the inside of each unit that documents the location of unit, date and time of the service call, and a signature/initials by the contractor/vender employee.
• Provide separate and sufficient ventilation to both the unit and the waste reservoir.
• Contain a waste reservoir with a minimum capacity of 30 gallons.
• Provide handicapped units as noted per schedules.
• Provide locks and keys for each unit to park staff.
Units shall be serviced on Mondays and Fridays between the hours of 6:00am and 6:00 pm
Access to the location is year-round. The contractor shall provide all the required personnel, equipment, tools, vehicles, materials, supervision, and all other necessities needed to provide and perform portable toilets services.
The pumping/cleaning of units shall be accomplished in an accordance with the schedules set forth herein.
The servicing of units shall include the pumping of the waste reservoir, filling toilet paper and hand sanitizer dispensers, addressing the janitorial and disinfecting needs on the interior of the unit, conducting an inspection of the entire unit and when needed, performing any necessary repairs. Servicing includes picking up related toilet debris within five (5) feet perimeters around the portable toilet units. The contractor shall maintain privacy by repairing locks if broken and patching holes as discovered at the vendor’s expense. If repairs are not possible at the time repairs shall be performed by the next scheduled pumping date or a replacement unit provided prior to the next scheduled pumping date. Damaged/lost units shall be replaced at contractor’s expense.
Units scheduled for removal from a location shall be picked up no later than five working days following the last day of the month unless otherwise agreed upon. There will be no additional payments charged for normal pickups as set forth in the monthly schedules. These costs should be incorporated into the contractor’s quote. Any units that are moved from the specified location due to vandalism must be put back at the existing site within 24 hours. This requirement applies even if a new unit has been placed due to the vandalism. Contractor is responsible for pick up and removal of portable toilet units at the end of the contract performance date scheduled for each unit at no additional cost to the government.
5. Government Furnished Property. None
6. Safety & Compliance. Portable units must meet all appropriate accessibility standards.
Disposal of waste shall be in accordance with all applicable federal, state, and local codes and per New Jersey Environmental Protection regulations.
• The contractor shall comply with pertinent provisions of the Occupational Safety and
Health Act (OSHA), and state, local, safety, laws.
• The contractor shall comply with pertinent Environmental Protection Agency laws and regulations.
• The contractor shall immediately report to the Park Superintendent Darren Boch all accidents resulting in employee injury or death or damage to property while performing this contract.
7. Safety/Spill Response Plan. In addition to a regular Safety Plan, Contractor/Vendor must provide a spill response plan to be used in the event of vandalism, tip over, flooding, etc., so that park on their truck ensuring no leakage occurs during travel.
8. Replacement of Contractor Employee for Security Reasons. The Government retains the right to request removal of the contractor’s employees (s), regardless of prior clearance.
9. Logs. Contractor/Vendor shall maintain a written and legible log of pumping/cleaning units and shall furnish a copy of such log to the Park within (5) business days after the end of each month. As a minimum, the log shall include location of portable toilet unit(s), date and time serviced and vendor’s signature. Logs should be consistent with the contract Schedules and the onsite logs for each unit.
10. Invoicing. Payment for services will be based on the schedule of unit prices herein with invoicing to occur monthly in arrears. Invoices shall be submitted to the COTR for acceptance/approval.
• Invoicing must be submitted monthly after services have been rendered for the given month, via Internet Payment Processing and in accordance with the Scope of Work
(SOW).
• Payment will constitute full compensation for furnishing all labor, tools, equipment, materials, and supervision necessary to complete the work in accordance with the PWS for servicing at the required location.
11. Equipment. Contractor’s servicing equipment and trucks must be readily identifiable and maintained in a clean, sanitary condition and inspected prior to servicing park units to ensure that all fittings are tight and not leaking. In the event that the vendor experiences equipment breakdowns that will prevent the vendor from meeting service schedule or placement/removal schedule, the COTR or designated government representative, must be notified via telephone prior to or on the service date. Failure to comply with the service schedule or time schedule for placing/removing units may result in withholding or payment.
12. Non-Payment for Additional Work. Any additional contractor performed services not specified in contract, either at its own volition or at the request of an individual other than an appointed Contracting Officer, except as may be explicitly authorized in the contract, shall be performed at the financial risk of the contractor. Only an appointed Contracting Officer is authorized to bind the Government to a change in specifications, contract terms, or conditions.
13. Non-Payment for Missed Service. Any missed and/or skipped service calls that cannot be performed within 24 hours of the scheduled service days (Mondays and Fridays) are the responsibility of the contractor and will be credited in-kind on the next monthly invoice based on the service call rate.
14. Conflict of Interest. The contractor shall not employ an off-duty Government employee if such employment would create a conflict of interest or be contrary to the policies contained in conflict-of-interest directives utilized by the Delaware Water Gap National Recreation Area.
15. Permits/Licenses/Insurance. The contractor is responsible for obtaining all required permits, licenses, and insurance as required by Federal, State, and local laws and should be able to provide if requested.
a. Insurance. The Contractor shall be insured in accordance with State(s) of New Jersey and Pennsylvania insurance regulations. The Government is not responsible for damage to Contractor’s equipment, vehicles, tools or materials or their employees and the personal property brought on-site. The Government will not accept any liability due to contractor employee negligence.
• Workers Compensation: The contractor shall comply with the Workman’s Compensation Laws of the State(s) of New Jersey and Pennsylvania.
• Liability: The Contractor shall maintain a level of insurance that will protect the contractor and the Government from any claims as a result of bodily injury (including death) and property damage which may arise from and during the performance of this contract and shall submit proof of insurance to the Contracting Officer not later than 10 days from award date.
• Meet minimum insurance required by Department of Interior per DOI Insurance clause.
b. Motor Vehicle & Traffic Regulations. Contractor employees operating motor vehicles shall possess a valid driver’s license. Driver and vehicle permit, licenses, registrations, and proof of insurance shall be maintained in the vehicle at all times and made available upon request. Contractor employees shall always comply with federal vehicle motor law requiring seat belts be worn. Contractor employees shall adhere to the posted speed limit signs.
16. Commencement and Prosecution
Performance of work should commence no later than seven (7) days from date award.
17. Toilet location
From date of award until on or about November 1, 2021, the units will be located in the north side of the park parking lot at 72 McBride Avenue, Paterson. From that date forward the units will be moved across the street to the 65 McBride Avenue, Paterson, for the duration of the contract.

DOI ELECTRONIC INVOICING Electronic Invoicing and Payment Requirements - Invoice Processing Platform (IPP) (Apr 2013)
Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).
"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. The IPP website address is: https://www.ipp.gov.
Before, Contractor submits an invoice through IPP the Contractor must complete the following:
An invoice will be prepared by the Contractor and submitted to the COR. The COR will confirm work completed. The invoice will include the location, date services rendered, number of stalls serviced.
Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice:
a. An approved (COR certified) copy of each invoice must be attached in IPP.
b. Each invoice must include the Contract award number, Period of Performance and/ or delivery date, Contractor name and address, Invoice Number, Dollar value, Unit of issue (as applicable), description of services completed and/or items received, and other documents required per the contract.
c. If an IPP invoice is submitted without the attached invoice, the IPP submission will be rejected, and the contractor will be required to re-submit said invoice.
d. Submit a courtesy copy of the invoice and attachments to the Purchasing Agent, Linda
Richardson at linda_richardson@nps.gov.
The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in CCR) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) within 3 - 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.
If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

1452.228-70 - DOI Liability Insurance
(a) The Contractor shall procure and maintain during the term of this contract and any extension thereof liability insurance in form satisfactory to the Contracting Officer by an insurance company which is acceptable to the Contracting Officer. The named insured parties under the policy shall be the Contractor and the United States of America. The amounts of the insurance shall be not less than as follows:
• Workman’s Compensation and Employer Liability Insurance: Compliance with applicable Federal and State Worker’s Compensation and Occupational Disease Statues shall be required.
Employer liability coverage in the minimum amount of $100,000.
• General/Professional Liability Insurance: Bodily injury liability insurance minimum amount of $1,000,000 per occurrence.
• Automobile Liability Insurance: This insurance shall be required on the comprehensive form of the policy and shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. The minimum limits of $200,000 per person and $500,000 per occurrence for bodily injury and $100,000 per occurrence for property damage shall be required.
(b) Each policy shall have a certificate evidencing the insurance coverage. The insurance company shall provide an endorsement to notify the Contracting Officer 30 days prior to the effective date of cancellation or termination of the policy or certificate; or modification of the policy or certificate which may adversely affect the interest of the Government in such insurance. The certificate shall identify the contract number, the name and address of the Contracting Officer, as well as the insured, the policy copy of an acceptable insurance certificate prior to beginning the work.
SPECIAL CONTRACT REQUIREMENTS
1452.201-70 Authorities and Delegations (SEP 2011)
(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.
(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award.
The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor.
Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.
(c) The COR is not authorized to perform, formally or informally, any of the following actions:
(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;
(2) Waive or agree to modification of the delivery schedule;
(3) Make any final decision on any contract matter subject to the Disputes Clause;
(4) Terminate, for any reason, the Contractor's right to proceed;
(5) Obligate in any way, the payment of money by the Government.
(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.
(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph
(d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.
(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.
(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.

Restriction on Endorsements—Department of the interior (JUL 1996)
The Contractor shall not refer to contracts awarded by the Department of the Interior in commercial advertising, as defined in FAR 31.205–1, in a manner which states or implies that the product or service provided is approved or endorsed by the Government or is considered by the Government to be superior to other products or services. This restriction is intended to avoid the appearance of preference by the Government toward any product or service. The Contractor may request the Contracting Officer to make a determination as to the propriety of promotional material.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
