INFORMATION TO PROSPECTIVE QUOTERS

This is a combined Synopsis/Solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Firm, fixed-price quotes are requested under Request for Quotation (RFQ) Solicitation number 140L5221Q0007. This document incorporates provisions and clauses which are in effect through Federal Acquisition Regulations 2021-05. This solicitation is set-aside for small business under North American Industry Classification System (NAICS) code 115310. The Small Business Annual Receipts for the preceding three (3) fiscal years does not exceed $20.5 Million.

Site Visit:

(a) The clauses at 52.236-2, Differing Site Conditions, and 52.236-3, Site Investigations and Conditions Affecting the Work, will be included in any contract awarded as a result of this solicitation. Accordingly, offerors or quoters are urged and expected to inspect the site where the work will be performed.

DESCRIPTION/SPECIFICATIONS/WORK STATEMENT

Introduction: The Salmon Field Office, Idaho Falls District, Bureau of Land Management (BLM) is soliciting contract forestry management services that require cutting (falling) standing live trees and subsequent limbing and topping, and piling cut material (215 acres). The work to be bid is part of the Cabin Creek Forest Restoration Project (DOI-BLM-ID-I040-2020-0003-EA).

Purpose: The purpose of the proposed action is to manage forest structure and composition to improve resilience to insects and disease and to protect prior silvicultural investments that have been made within the project area.

Location of Contract Area: The contract area is located 28 miles south of Salmon, Idaho. T18N, R21E, section

19. The project area can be accessed by driving south from Salmon by following US-93 S to Iron Creek Road in Elk Bend, ID. Take the first left after crossing the bridge. Continue Old Stage Road and take the first right onto Cabin Creek Road for approximately 3 miles. Continue along the road that follows Cabin Creek for another ½ mile to reach contract area.

Contract Area Boundary: The contract area boundary will be identified by (pink) flagging hung on trees or other convenient features along the perimeter. Prior to implementation, the Contracting Officer’s Representative (COR) or a Project Inspector (PI) will be available on site to walk the perimeter with the Contractor if requested, to ensure the Contractor understands the contract area layout. Area acreage was determined by calculations based on a horizontal plane using GPS technology.

Access: Access will be by both gravel roads (improved) and dirt roads (unimproved), which may require four-wheel drive vehicles. Access is by all-weather and seasonal roads. Seasonal roads may be impassable for several days after heavy rains or snow-blocked during the winter months.

Government Furnished Property:

Geographic Information System (GIS) map of the contract area.

Scope of Work: The Contractor shall furnish all tools, labor, supervision, equipment, materials, supplies, transportation, and incidentals necessary to accomplish the stated work.

Specifications: UNIT 1- 215 acres of vegetation treatment Specifications for treatment of trees to be cut inside the identified boundary

Cutting:

Currently the 215-acre stand is very densely stocked with trees in the smaller diameter classes. Approximately 540 trees per acre (TPA) are within the zero to eight-inch diameter class and 28 TPA are merchantable trees (trees greater than or equal to eight inches in diameter at breast height (DBH)). Through pre-commercial activities, on average a spacing of 18 feet X 18 feet would be carried forward to maintain a residual 134 TPA of acceptable crop trees within the 0 - 8-inch size class. Because of the scattered nature of the vegetation, not all acres within the established boundary of the unit will require the same amount of labor to achieve the specifications outlined below.

All conifers greater than or equal to eight inches DBH, all aspen, and all birch would be reserved from treatment;

however, Douglas-fir, greater than 8 inches in DBH, showing visible signs of Dwarf mistletoe will be cut or girdled to prevent the spread of Dwarf mistletoe in the remaining stand.

Leave tree selection would be based on selecting the largest, healthiest, best formed and most vigorously growing trees available at approximately 18-foot intervals. Selection of leave trees would be prioritized as follows:

1. Ponderosa pine

2. Douglas-fir with no sign of Mistletoe

3. Lodgepole pine with no sign of Mistletoe

If no coniferous tree species are available, the largest, healthiest, best-formed hardwood tree species (alder, maple, etc.) would be selected as a leave tree.

Retain (Do Not Cut) any five needle pine species, i.e., Whitebark pine.

Only snags considered to be a safety hazard would be cut.

All trees to be cut shall be completely severed below the lowest live limb, and the resultant stump shall be no taller than four (4) inches measured from the ground on the uphill side. The cut surface of stumps should be horizontal (level) when finished. Angle cuts are not acceptable.

Piling:

All slash between 1 to 7 inches in diameter and greater than or equal to 2 ft. in length shall be piled. Plied slash will not exceed 4 ft. in length. Slash less than 1 in. diameter and less than 2 ft. in length shall be left on the ground. Slash left on the ground shall not exceed 6 inches in depth.

Piles will be constructed so they are tightly woven together, air space free, and dirt free. The piles will consist of a mixture of small diameter and larger diameter material (Needles, Stems, and boles).

Unless otherwise approved by the COR, maximum hand pile size shall be 8 feet in diameter by 8 feet in height, and the minimum hand pile size shall be 7 feet in diameter by 7 feet in height.

Unless otherwise approved by the COR, hand piles shall not be closer than 10 feet to reserve tree’s (leave tree’s) drip line or 25 feet to a unit boundary. Slash shall not be piled or placed on logs or stumps, in roadways, drainage or canal ditches, or within channel bottoms, streams or within no-treatment zones. Piles shall be compact and free of dirt or other non-flammable material.

Notification of Cessation or Restart of work: The Contractor will notify the Contracting Officer's Representative (COR) whenever he/she intends to cease operations for three or more days and will notify the COR before starting operations after a shutdown of three or more days.

Personnel Requirements: The crew is responsible for maintaining a safe working environment following OSHA standards. The Contractor must attend the pre-work meeting and provide a written performance plan including crew size prior to beginning work.

Crew Foreman: A crew foreman must be on-site directing work at all times. This person will also serve as an on the ground contact person for the COR/PI. Failure to maintain a crew foreman will result in suspension of work until a crew foreman is provided. A maximum of three (3) days will be allowed to produce a qualified foreman.

Failure to produce a qualified on-the-ground foreman within five days may result in the Contracting Officer (CO) issuing a Suspend Work Order. CO and COR must be informed of any changes in Crew Foreman.

Protection of Improvements: The COR may order a cessation of work if vehicles are operated on roads within the work area when ground or weather conditions cause or lead to loss of traction. Such conditions usually develop where frozen ground is thawing, when snow is melting, and during or immediately following rainstorms.

Any soil and ground disturbance caused by equipment during and after operations will be rehabilitated.

Work hours under this contract: Shall be limited to the time between one-half hours before sunrise to one-half hour after sunset each day. No work will be done on legal National Holidays unless authorized by the COR.

No work will be allowed when snow levels exceed six inches

Work Camps: Camping on agency-administered lands will only be allowed in approved sites and with the prior written authorization of the responsible land manager. Should such a work camp be authorized, the Contractor shall maintain the camp in an orderly and sanitary manner. All fire regulations and permits shall be followed. All garbage and refuse shall be removed from the camp site(s) by the Contractor and disposed of off-site before final payment is made.

Fire Prevention: The following Primarily for purposes of fire prevention and control, the Contractor shall comply with provisions:

The Contractor shall comply with all the applicable Idaho State Fire Prevention Laws, Rules, Regulations, and Standards.

Prior to starting operations during a closed fire season or periods of high fire danger, the Contractor shall prepare a fire prevention and fire control plan to the satisfaction of the COR.

Provide and maintain in good repair on the contract area the following equipment for use during a closed fire season or periods of high fire danger:

A. Firefighting tools shall be kept at vehicle staging areas or at such other place(s) as the COR shall designate whenever employees of the Contractor are working on the contract area. All firefighting tools shall be identified, organized, and easily accessible to all Contractor employees. The fire tools shall be in good condition, be tight on strong handles, and have sharp cutting edges. There shall be at least one (1) tool for each Contractor employee working on the contract area. Three-fourths (3/4) of all fire tools shall be shovels, hoes, or other scraping tools. The fire tools shall be used only for fighting fire.

B. A shovel in good condition with not less than a three (3) foot handle and a blade not less than seven and three-quarters (7 3/4) inches wide shall be within fifty (50) feet of any power saw when in operation.

C. Two (2) back-pack pumps at each vehicle staging area to be kept full of water and in good operating condition.

D. A serviceable chemical fire extinguisher of at least eight (8) ounces minimum capacity shall be carried during a closed fire season or period of high fire danger by each saw operator using a power saw on the contract area. Such fire extinguisher shall be filled and in operating condition and shall at all times be immediately available to the operator when the saw is being fueled or the motor of the saw is running.

Any fueling of a power saw shall be done in an area which has first been cleared of all flammable material. Power saws shall be moved at least twenty (20) feet from the place of fueling before the engine is started. A shovel shall be available with each gas can when refueling. Each power saw shall be equipped with an exhaust system and a spark arresting device.

The CO may require additional fire tools and fire equipment as the fire danger may warrant.

Inspection and Acceptance:

The Government will make periodic inspections as a basis for acceptance and payment and recommendations for adjustments in work quality while work is in progress. The Contractor is encouraged to observe inspections while they are being made.

As the basis for payment, inspections for compliance with specifications will be made for contract areas reported as completed by the Contractor. All plots will be averaged together to determine payment.

Inspections will be made on a series of plots located randomly across the contract area. A sufficient number of plots will be taken to obtain at least one percent sample of the contract area.

The following information will be recorded for each plot inspected:

Stumps exceeding four (4) inches in height and not cut flat Severed trees are not completely limbed.

Cut vegetation less than one (1) inch in diameter is not evenly spread and exceeds six (6) inches in depth.

Cut vegetation less than one (1) inch in diameter exceeds two (2) feet in length.

Trees that were not cut.

Determination of Work Quality Percentage:

Work quality percentages are derived from data developed from inspection plots. The final work quality percentage times the bid price determines the pay. A work quality percentage of 90 percent or higher will result in full payment. If high stumps or uncut surplus trees are the primary reason for unsatisfactory work, the Contractor shall rework areas designated by the Government until satisfactory work quality is obtained.

Acceptance:

Satisfactory Work Quality: A minimum work quality standard of 90 percent is required.

Unsatisfactory Work Quality: Based on inspection results, if the work quality percentage falls below 90 percent, the Contracting Officer will immediately notify the Contractor in writing and instruct the Contractor to improve the quality of the work. If the quality of the work is not raised to an acceptable level within two consecutive workdays after written notification, the Contracting Officer may issue a stop work order.

Designation of Contracting Officer’s Representative: The CO shall designate the COR and project inspectors.

The COR is responsible for administering the performance of work under this contract. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms of this contract be effective or binding upon the Government unless formalized by proper contractual documentation executed by the CO prior to completion of the contract.

Prework Conference: Prior to the commencement of work, a pre-work conference will be arranged with the Contractor to discuss the contract terms and work performance requirements.

(d) Comptroller General Examination of Record. 3. 52.204-25 Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment (Aug 2020)

(a) Definitions. As used in this clause— Backhaul means intermediate links between the core network, or backbone network, and the small subnetworks at the edge of the network (e.g., connecting cell phones/towers to the core telephone network). Backhaul can be wireless (e.g., microwave) or wired (e.g., fiber optic, coaxial cable, Ethernet). Covered foreign country means The People’s Republic of China. Covered telecommunications equipment or services means–

(1) Telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities);

(2) For the purpose of public safety, security of Government facilities, physical security surveillance of critical infrastructure, and other national security purposes, video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities);

(3) Telecommunications or video surveillance services provided by such entities or using such equipment; or (4) Telecommunications or video surveillance equipment or services produced or provided by an entity that the Secretary of Defense, in consultation with the Director of National Intelligence or the Director of the Federal Bureau of Investigation, reasonably believes to be an entity owned or controlled by, or otherwise connected to, the government of a covered foreign country.

Critical technology means–

(1) Defense articles or defense services included on the United States Munitions List set forth in the International Traffic in Arms Regulations under subchapter M of chapter I of title 22, Code of Federal Regulations;

(2) Items included on the Commerce Control List set forth in Supplement No. 1 to part 774 of the Export Administration Regulations under subchapter C of chapter VII of title 15, Code of Federal Regulations, and controlled-

(i) Pursuant to multilateral regimes, including for reasons relating to national security, chemical and biological weapons proliferation, nuclear nonproliferation, or missile technology; or

(ii) For reasons relating to regional stability or surreptitious listening;

(3) Specially designed and prepared nuclear equipment, parts and components, materials, software, and technology covered by part 810 of title 10, Code of Federal Regulations (relating to assistance to foreign atomic energy activities);

(4) Nuclear facilities, equipment, and material covered by part 110 of title 10, Code of Federal Regulations (relating to export and import of nuclear equipment and material);

(5) Select agents and toxins covered by part 331 of title 7, Code of Federal Regulations, part 121 of title 9 of such Code, or part 73 of title 42 of such Code; or

(6) Emerging and foundational technologies controlled pursuant to section 1758 of the Export Control Reform Act of 2018 (50 U.S.C. 4817).

Interconnection arrangements means arrangements governing the physical connection of two or more networks to allow the use of another's network to hand off traffic where it is ultimately delivered (e.g., connection of a customer of telephone provider A to a customer of telephone company B) or sharing data and other information resources.

Reasonable inquiry means an inquiry designed to uncover any information in the entity's possession about the identity of the producer or provider of covered telecommunications equipment or services used by the entity that excludes the need to include an internal or third-party audit.

Roaming means cellular communications services (e.g., voice, video, data) received from a visited network when unable to connect to the facilities of the home network either because signal coverage is too weak or because traffic is too high.

Substantial or essential component means any component necessary for the proper function or performance of a piece of equipment, system, or service.

(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system.

The Contractor is prohibited from providing to the Government any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in FAR 4.2104.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub.

L.115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract, or extending or renewing a contract, with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in FAR 4.2104. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract.

(c) Exceptions. This clause does not prohibit contractors from providing—

(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(d) Reporting requirement. (1) In the event the Contractor identifies covered telecommunications equipment or services used as a substantial or essential component of any system, or as critical technology as part of any system, during contract performance, or the Contractor is notified of such by a subcontractor at any tier or by any other source, the Contractor shall report the information in paragraph (d)(2) of this clause to the Contracting Officer, unless elsewhere in this contract are established procedures for reporting the information; in the case of the Department of Defense, the Contractor shall report to the website at https://dibnet.dod.mil. For indefinite delivery contracts, the Contractor shall report to the Contracting Officer for the indefinite delivery contract and the Contracting Officer(s) for any affected order or, in the case of the Department of Defense, identify both the indefinite delivery contract and any affected orders in the report provided at https://dibnet.dod.mil.

(2) The Contractor shall report the following information pursuant to paragraph (d)(1) of this clause

(i) Within one business day from the date of such identification or notification: the contract number; the order number(s), if applicable; supplier name; supplier unique entity identifier (if known); supplier Commercial and Government Entity (CAGE) code (if known); brand; model number (original equipment manufacturer number, manufacturer part number, or wholesaler number); item description; and any readily available information about mitigation actions undertaken or recommended.

(ii) Within 10 business days of submitting the information in paragraph (d)(2)(i) of this clause: any further available information about mitigation actions undertaken or recommended. In addition, the Contractor shall describe the efforts it undertook to prevent use or submission of covered telecommunications equipment or services, and any additional efforts that will be incorporated to prevent future use or submission of covered telecommunications equipment or services.

(e) Subcontracts. The Contractor shall insert the substance of this clause, including this paragraph (e) and excluding paragraph (b)(2), in all subcontracts and other contractual instruments, including subcontracts for the acquisition of commercial items.

1. Authorities and Delegations (Sep 2011)

(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award.

The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor.

Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.

(c) The COR is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(3) Make any final decision on any contract matter subject to the Disputes Clause;

(4) Terminate, for any reason, the Contractor's right to proceed;

(5) Obligate in any way, the payment of money by the Government.

(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum.

The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.

(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.

(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.
