This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement and attachments constitute the only solicitation; quotes are being requested, and a written solicitation will not be issued. Consider this solicitation (140L3726Q0140) as a Request for Quotes (RFQ). This solicitation documents incorporate provisions and clauses in effect through Federal acquisition Circular 2026-01. This solicitation is set-aside for small business.
NAICS 115310 – Support Activities for Forestry – Fuels Management Services. The small business size standard is $34.0 million. PWS 1.0 Background on the Government’s Requirement
The Bureau of Land Management Applegate Field Office is requesting a Prescribed Fire Support Module for 30 days (two 15-day tours) over a period of two years to provide assistance on prescribed burns within BLM administered public land. The Applegate BLM field office has conducted extensive hazardous fuels vegetation treatments for fire mitigation and community protection in high-risk wildfire areas, which require pile and broadcast burns. PWS 2.0 General Scope of Work This contract is to provide a 10-person prescribed fire module on a daily rate for 30 total days to assist with prescribed burning. The prescribed burning services consist of support for pile prescribed burns and broadcast burns.
Place of Performance:
The prescribed burning operations will occur on nine (9) different units on Bureau of Land Management administered public lands managed by the Applegate BLM Field Office (See Exhibit C for maps and directions). The units are:
Broadcast burn units:
• Hogback o Shasta County, CA, 3 miles south of Fall River Mills, CA – 620 acres
• Cassel o Shasta County, CA, 5 miles east of Burney, CA - 475 acres

Period of Performance:
The period of performance shall be for two (2) Year period with two 8-month active periods within the POP.

PWS 3.0 Overall Objective(s)
The objective of this contract is to provide a 10-person prescribed fire module on a daily rate for 30 total days to assist with prescribed fire operations.
PWS 4.0 Specific Tasks
Requirements common to all tasks:
Prescribed fire module support tasks will be performed on either prescribed pile burns or prescribed broadcast burns. The specific tasks for each operation are outlined below.
The required level of effort, standard equipment, personnel qualifications, and safety requirements are similar across all operations. The type of operation will be determined by factors such as time of year and weather conditions with broadcast burning primarily occurring in the drier portions of fall or spring and pile burning occurring during wetter times of fall, winter or spring.
The prescribed burns will be conducted by the BLM, utilizing a BLM burn boss under the Incident Command System, with the contractor providing assistance. The contractor shall provide all services, supervision of the module, equipment, and supplies (except those specified as Government furnished), transportation, lodging and qualified/trained personnel (see Section 5) necessary to meet or exceed the contract specifications.
Operations will be performed during a typical operational period of 12 hours, generally 7:00am to
7:00pm. Operations may be stopped under the direction of the BLM Prescribed Fire Burn boss if prescribed burn objectives are not met or if weather is outside prescription parameters. The contractor shall be paid the full daily rate if the operations are stopped by the BLM.
The Contracting Officer’s Representative (COR) will be on site during the operational period and may also function as the burn boss or will provide coordination of operations between the burn boss and contractor if not serving as the burn boss. The COR will describe the specific objectives of the operational duty to the contractor during a daily pre-operational briefing. The briefing will take place at a designated site for each unit (See Exhibit C for location), and at a designated time which will be determined by the COR at the time of activation. The briefing time will typically be between 0700 and 0800 but may vary based on travel distance to the unit and weather/road conditions. The specific objectives may change during a single shift, based on variables such as weather fire behavior, or phase of the burn operations, such as transitioning to holding operations after ignitions are completed.
The daily pre-operational briefing will include the following information:
• Briefing on Prescribed Fire Plan and Objectives
• Operational assignment.
• Access route into the area.
• Safety concerns, weather forecast.
• Special resource considerations
• Communication methods and emergency procedures.
• Target completion time, anticipated length of activation.
• Logistical support method for Government furnished equipment and supplies.
Access to the units may require travel during winter driving conditions or adverse weather and may require off-road travel with four-wheel drive capability and Utility Task Vehicle (UTV).
Cross country foot travel through steep or rugged terrain and exposure to harsh weather (cold, rain, snow, heat) will typically be required on most burn units.
Task 1: Pile Burning Ignitions
Ignition of hand or machine piles using handheld firing devices, such as drip torches or fussees within identified prescribed pile burn units. Overall goal is to ignite 90% or greater of piles within targeted prescribed burn units. Daily ignition accomplishment will vary due to a variety of factors, such as weather, terrain, pile moisture, and pile density. Typical production on similar burns is 10-20 acres per person per day. The piles are constructed of cut western juniper. Hand pile density on the units are approximately 10-20 hand piles per acre and 10-15 machine piles per acre. The hand piles on average are roughly 6 feet high and 6 feet in diameter. The machine piles are comprised of roughly 2-6 trees stacked together with an estimated size of 6-10 feet high, 15-25 feet long, and 10-15 feet wide.
Task 2: Broadcast Burn Support
Broadcast prescribed fire support operations include the following: pre-ignition unit preparation, ignition assistance, holding assistance, and burned unit mop-up. Any one of the above operations, a combination, or all of the operations may be required within a daily work shift, depending on the phase of the prescribed burn.
A: Preparation of prescribed fire units using chainsaws and handtools to cut and prune vegetation, construct handline, limb reserve trees, or cut fallen dead vegetation to reduce the threat of prescribed burn escape.
• Preparation operations will typically occur in each prescribed burn unit for approximately two days prior to prescribed fire implementation if preparation work has not yet been completed.
• No activation period of Prescribed Fire Support Module will be used primarily for burn unit preparation.
B: Ignition of vegetation using handheld firing devices such as drip torches or fusees within identified prescribed burn units.
• Ignition objective and pattern will be provided by the BLM Prescribed Fire Burn Boss and will occur after safety and operational briefing has been given to all assigned resources.
• Ignitions will be conducted in a method and pace to ensure prescribed fire objectives are met and with a limited risk of prescribed fire escape and in coordination with other assigned resources.
• Ignition operations will be stopped under the direction of BLM Prescribed Fire Burn boss as burn plan objectives are not met or within allowable ranges.
• Ignition personnel will immediately transition to holding or mop up tasks as directed by BLM Burn Boss.
C: Holding of prescribed fire lines during initial burn down phase. Holding operations may include:
• Monitoring fuel consumption and communicating spread outside of holding lines.
• Chunking or piling burning or partially burnt material to promote complete consumption.
• Patrolling unit boundaries or holding features for spot fires or fire growth outside of unit boundaries.
D: Mop-up, or extinguishing, of burning material near control lines using chainsaws, handtools, and water delivery equipment.
• Mop-up typically occurs after the initial burn down phase to secure the prescribed burn.
• Mop-up can occur for one or more days following prescribed burn ignition operations.
PWS 5.0 Delivery / Performance Schedule Prescribed Fire Support Module Configuration The following are the descriptions of requirements for personnel, specialized equipment, minimum crew transportation standards.
Ten Person Crew Module
1. Ten (10) persons
a. Crew Boss (CRWB) – 1
b. Fire Firefighter I (FFT1) – 1
c. Fire Fighter II (FFT2) - 8
2. Transportation – 2 or more vehicles, each with four-wheel drive capability
3. Equipment
i. Fireline handtools (Pulaski, Shovel, or equivalent) - 10
ii. Supplies for up to a 12-hour shift.
iii. Programmable handheld radio or other agreed upon communication device – 2
iv. Chainsaws with fuel - 2
4. Utility Terrain Vehicle (UTV) – 2
i. Each UTV will be capable of transporting five (5) module members and crew equipment.
ii. All UTV passengers must have Department of transportation (DOT) approved helmets
Ordering Prescribed Fire Support Modules BLM Contracting Officer Representative will contact the Contractor during the agreed upon activation period (October – May) of a given period of performance and request Prescribed Fire Module Support. Requests will be placed a 72hrs to 1 week before the desired reporting time to the project briefing location.
The Contractor will confirm the availability of the module, Basic Firefighter qualifications compliance of each activated crewmember, and communication method/ information for the primary crew leader the module.
Reporting instructions at the time of activation will include the unit to report to, and the date, and time needed. Initial activation may also include digital reference documents such as Maps, Incident Action Plans (IAP)s, or other special operational information.
The BLM may change the unit to be worked on and reporting location during the activation depending on conditions, such as weather, or completing of a unit. The COR will notify the contractor at least 24 hours before the reporting time at the new location. The new unit and reporting location be one of the nine units identified in section 2.
Government supplied equipment may be transferred to the contractor at the initial briefing or at the prescribed burn unit – Drip torches and Five-gallon slash mix cans.
Minimum Activation Guarantee
Each PFSM activation will meet a minimum guaranteed duration regardless of continued burn operations. Minimum activation period will be for two (2) full rate operational days, exclusive of travel.
Scenarios in which the PFSM is activated but prescribed burn operations are not implemented based on conditions, smoke, resource concerns or other constraints the contractor/ PFSM will at a minimum be activated the identified two (2) full rate days.
Communication and Language requirements
As identified in PFSM Configuration and equipment section, each five person PFSM will have a minimum of One (1) handheld programmable radio or other agreed upon communication device.
One PFSM module member is expected to operate the radio sufficiently to stay in communication with BLM COR or Prescribed Fire Burn Boss. BLM COR or Prescribed Fire Burn Boss will ensure common radio frequencies are communicated and programmed into the provided radio equipment at the briefing time.
One PFSM Module member must speak, read and sufficiently communicate in English as to receive instructions, communicate with other resources/ supervisors, and relay critical instructions to non-English speaking module members in order to meet prescribed burn objectives.
Minimum Fireline Qualification Requirement
Each PFSM crewmember must meet minimum qualification standards for Firefighter Type 2, as identified by National Wildland Fire Coordinating Group (NWCG) Standards for Wildland Fire Position Qualifications, PMS 310-1, https://www.nwcg.gov/positions/fft2/position-qualification-requirements.
Basic Firefighter Training:
ICS-100, Introduction to ICS L-180, Human Factors in the Wildland Fire Service S-130, Firefighter Training S-190, Introduction to Wildland Fire Behavior Arduous Level Work Capacity Test
Each PFSM activation requires documentation of participant crewmember Basic Firefighting Training to be provided to the COR and CO at the time of request.
Map/navigation capabilities
Digital PDF Maps of each prescribed burn unit will be provided at the time of activation or at the initial Operational Briefing. Area and transportation maps will also be provided in order to access Prescribed Burn Units. PFSM must be able to navigate using map products both digital, such as with Avenza PDF maps, or on paper to reach prescribed burn units and during Prescribed Burn operations in order to ensure objectives are met.
PWS 6.0 Government-Furnished Property, Materials, Services
General:
The Contractor shall furnish all personnel, materials, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform the work tasks defined in this Performance Work Statement, except for those items specified as government furnished.
Materials:
The Contractor shall furnish all materials necessary to meet the requirement of this contract except for those items specified as government-furnished property and services.
Equipment:
The Government shall furnish the below Equipment to assist the Contractor in meeting the requirement of this contract, Handheld Firing devices such as Drip Torches or Fusees during ignition operations, Drip Torch fuel in 5-gallon safety cans to be used in handheld drip torches while igniting burn piles.
PWS 7.0 Security and Administrative Matters
Regular Work Hours:
The performance period established for this contract is based upon all work being conducted during work periods up to 12 hours in length (typically 0700-1900 hrs or less per operational shift).

PWS 8.0 Technical Exhibits and Definitions
Standard Definitions:
Physical Condition The Physical appearance of Federal equipment or facilities that considers cracks, chips, dents, abrasions, rust, corrosion, general cleanliness, vibration, operating temperature, and discoloration and other items as identified by the COR. Physical condition may be determined by visual as well as diagnostic means.
Contracting Officer (CO) The Secretary of the Interior or designated authorized representative who is the only agent capable of signing a federal award or obligating funds.
Contracting Officer’s Representative (COR) The Contracting Officer’s designated representative as indicated in a delegation of authority letter.
Quality Assurance (QA) Surveillance of Contractor performance to determine performance requirements are met.
Performance Requirements Summary (PRS) (see Technical Exhibit below) The PRS identifies the key performance indicators of the Contract that will be evaluated by the Government to assure Contract performance standards are met by the Contractor.
Quality Control Those actions taken by the Contractor to control the production of goods or services so that they meet the requirements of the performance work statement.
Technical Definitions:
Ignition – The act of starting the prescribed fire. Ignition devices that may be used are drip torches and fusees. Contractor will ensure any hand crew members assigned to ignition duties are trained and qualified to operate ignition devices safely and competently.
Ignition Pattern – The manner in which a prescribed fire is ignited. The distance between ignition lines or points and the sequence of igniting them is determined by weather, fuel, topography, firing technique, and other factors which influence fire behavior and fire effects.
Incident Action Plan (IAP) - The IAP is a written plan that sets forth the incident objectives and reflects the tactics necessary to manage an incident during an operational period. The IAP provides essential information regarding incident organization, work assignments, resources, and safety-all of which are driven by the incident objectives.
Prescribed (RX) Burning - The burning of forest or range fuels on a specific area under predetermined conditions so that the fire is confined to that area to fulfill silvicultural, wildlife management, sanitary or hazard reduction requirements, or otherwise achieve forestry or range objectives.
Prescribed Fire Support Module (PFSM) – Ten-Person Module – Consisting of one Crew Boss (CRWB), One Squad Boss (FFT1) and eight crew members (FFT2), equipment and transportation.
Prescribed Fire Burn Boss (RXB2 or RXB3) - Is responsible for the organizing and management of all personnel and equipment on the burn project and for meeting prescribed burn objectives.
Single Resource Crew Boss (CRWB) - Responsible for supervising and directing a fire suppression hand crew. The Crew Boss shall have met the training and experience requirements for Single Resource - Crew Boss and the performance tasks in PMS 311-13 (PTB) for CRWB.
Squad Boss (FFT1) - Responsible for supervising and directing up to five fire crew members (FFT2). Each Squad Boss shall have met the training and experience requirements for Advanced Firefighter/Squad Boss and the performance tasks in PMS 311-14 (PTB) for FFT1.
Mop up - Extinguishing or removing burning material near control lines, felling snags, and trenching logs to prevent rolling after an area has burned, to make a fire safe, or to reduce residual smoke.
Utility Terrain vehicle (UTV) – A self-propelled off-road vehicle intended for utility use to transport persons and cargo, have a non-straddle seat, are designed to travel on four or more wheels.

Experience
1) Quotation provided documentation on recent experience on at least 2 projects of similar scope and complexity.
Key Personnel Qualifications and Experience
1) Key Personnel information shall be provided to include resumes of key staff (CRWB) who will work on this project.
2) Resumes must demonstrate professional qualifications necessary for satisfactory performance of key personnel to include:
a) The CRWB must meet the minimum qualification standards for Crew Boss, as identified by National Wildland Fire Coordinating Group (NWCG) Standards for Wildland Fire Position Qualifications, PMS 310-1, https://www.nwcg.gov/positions/crwb/position-qualification-requirements, and

(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.
(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award.
The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor.
Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.
(c) The COR is not authorized to perform, formally or informally, any of the following actions:
(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;
(2) Waive or agree to modification of the delivery schedule;
(3) Make any final decision on any contract matter subject to the Disputes Clause;
(4) Terminate, for any reason, the Contractor's right to proceed;
(5) Obligate in any way, the payment of money by the Government.
(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.
(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph
(d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.
(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.
(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.

(a) Definitions. As used in this clause—
United States means the 50 states, the District of Columbia, Puerto Rico, the Northern Mariana Islands, American Samoa, Guam, the U.S. Virgin Islands, Johnston Island, Wake Island, and the outer Continental Shelf as defined in the Outer Continental Shelf Lands Act (43 U.S.C. 1331, et seq.).
Worker –
(1)
(i) Means any person engaged in performing work on, or in connection with, a contract covered by Executive Order 14026, and–
(A) Whose wages under such contract are governed by the Fair Labor Standards Act (29 U.S.C. chapter 8), the Service Contract Labor Standards statute (41 U.S.C. chapter 67), or the Wage Rate Requirements (Construction) statute (40 U.S.C. chapter 31, subchapter IV);
(B) Other than individuals employed in a bona fide executive, administrative, or professional capacity, as those terms are defined in 29 CFR part 541; and
(C) Regardless of the contractual relationship alleged to exist between the individual and the employer.
(ii) Includes workers performing on, or in connection with, the contract whose wages are calculated pursuant to special certificates issued under 29 U.S.C. 214(c).
(iii) Also includes any person working on, or in connection with, the contract and individually registered in a bona fide apprenticeship or training program registered with the Department of Labor’s Employment and Training Administration, Office of Apprenticeship, or with a State Apprenticeship Agency recognized by the Office of Apprenticeship.
(2)
(i) A worker performs on a contract if the worker directly performs the specific services called for by the contract; and
(ii) A worker performs in connection with a contract if the worker's work activities are necessary to the performance of a contract but are not the specific services called for by the contract.
(b) Executive Order Minimum wage rate.
(1) The Contractor shall pay to workers, while performing in the United States, and performing on, or in connection with, this contract, a minimum hourly wage rate of $15.00 per hour beginning January 30, 2022.
(2) The Contractor shall adjust the minimum wage paid, if necessary, beginning January 1, 2023, and annually thereafter, to meet the applicable annual E.O. minimum wage. The Administrator of the Department of Labor’s Wage and Hour Division (the Administrator) will publish annual determinations in the Federal Register no later than 90 days before the effective date of the new E.O. minimum wage rate. The Administrator will also publish the applicable E.O. minimum wage on https://www.sam.gov (or any successor website), and a general notice on all wage determinations issued under the Service Contract Labor Standards statute or the Wage Rate Requirements (Construction) statute, that will provide information on the E.O. minimum wage and how to obtain annual updates. The applicable published E.O. minimum wage is incorporated by reference into this contract.
(3)
(i) The Contractor may request a price adjustment only after the effective date of the new annual E.O.
minimum wage determination. Prices will be adjusted only for increased labor costs (including subcontractor labor costs) as a result of an increase in the annual E.O. minimum wage, and for associated labor costs (including those for subcontractors). Associated labor costs shall include increases or decreases that result from changes in social security and unemployment taxes and workers’ compensation insurance, but will not otherwise include any amount for general and administrative costs, overhead, or profit.
(ii) Subcontractors may be entitled to adjustments due to the new minimum wage, pursuant to paragraph (b)(2). Contractors shall consider any subcontractor requests for such price adjustment.
(iii) The Contracting Officer will not adjust the contract price under this clause for any costs other than those identified in paragraph (b)(3)(i) of this clause, and will not provide duplicate price adjustments with any price adjustment under clauses implementing the Service Contract Labor Standards statute or the Wage Rate Requirements (Construction) statute.
(4) The Contractor warrants that the prices in this contract do not include allowance for any contingency to cover increased costs for which adjustment is provided under this clause.
(5) A pay period under this clause may not be longer than semi-monthly, but may be shorter to comply with any applicable law or other requirement under this contract establishing a shorter pay period. Workers shall be paid no later than one pay period following the end of the regular pay period in which such wages were earned or accrued.
(6) The Contractor shall pay, unconditionally to each worker, all wages due free and clear without subsequent rebate or kickback. The Contractor may make deductions that reduce a worker’s wages below the E.O.

(7) The Contractor shall not discharge any part of its minimum wage obligation under this clause by furnishing fringe benefits or, with respect to workers whose wages are governed by the Service Contract Labor Standards statute, the cash equivalent thereof.
(8) Nothing in this clause shall excuse the Contractor from compliance with any applicable Federal or State prevailing wage law or any applicable law or municipal ordinance or any applicable contract establishing a minimum wage higher than the E.O. 14026 minimum wage. However, wage increases under such other laws or municipal ordinances are not subject to price adjustment under this subpart.
(9) The Contractor shall pay the E.O. minimum wage rate whenever it is higher than any applicable collective bargaining agreement(s) wage rate.
(10) The Contractor shall follow the policies and procedures in 29 CFR 23.240(b) and 23.280 for treatment of workers engaged in an occupation in which they customarily and regularly receive more than $30 a month in tips.
(c)
(1) This clause applies to workers as defined in paragraph (a). As provided in that definition–
(i) Workers are covered regardless of the contractual relationship alleged to exist between the contractor or subcontractor and the worker;
(ii) Workers with disabilities whose wages are calculated pursuant to special certificates issued under 29 U.S.C. 214(c) are covered; and
(iii) Workers who are registered in a bona fide apprenticeship program or training program registered with the Department of Labor’s Employment and Training Administration, Office of Apprenticeship, or with a State Apprenticeship Agency recognized by the Office of Apprenticeship, are covered.
(2) This clause does not apply to–
(i) Contracts or subcontracts to which the States of Texas, Louisiana, or Mississippi, including their agencies, are a party;
(ii) Fair Labor Standards Act (FLSA)-covered individuals performing in connection with contracts covered by the E.O., i.e. those individuals who perform duties necessary to the performance of the contract, but who are not directly engaged in performing the specific work called for by the contract, and who spend less than 20 percent of their hours worked in a particular workweek performing in connection with such contracts;
(iii) Individuals exempted from the minimum wage requirements of the FLSA under 29 U.S.C. 213(a) and 214(a) and (b), unless otherwise covered by the Service Contract Labor Standards statute, or the Wage Rate Requirements (Construction) statute. These individuals include but are not limited to-
(A) Learners, apprentices, or messengers whose wages are calculated pursuant to special certificates issued under 29 U.S.C. 214(a) ;
(B) Students whose wages are calculated pursuant to special certificates issued under 29 U.S.C. 214(b) ; and
(C) Those employed in a bona fide executive, administrative, or professional capacity (29 U.S.C.
213(a)(1) and 29 CFR part 541).
(d) Notice. The Contractor shall notify all workers performing work on, or in connection with, this contract of the applicable E.O. minimum wage rate under this clause. With respect to workers covered by the Service Contract Labor Standards statute or the Wage Rate Requirements (Construction) statute, the Contractor may meet this requirement by posting, in a prominent and accessible place at the worksite, the applicable wage determination under those statutes.
With respect to workers whose wages are governed by the FLSA, the Contractor shall post notice, utilizing the poster provided by the Administrator, which can be obtained at www.dol.gov/agencies/whd/government-contracts, in a prominent and accessible place at the worksite. Contractors that customarily post notices to workers electronically may post the notice electronically provided the electronic posting is displayed prominently on any Web site that is maintained by the contractor, whether external or internal, and customarily used for notices to workers about terms and conditions of employment.
(e) Payroll Records.
(1) The Contractor shall make and maintain records, for three years after completion of the work, containing the following information for each worker:
(i) Name, address, and social security number;
(ii) The worker’s occupation(s) or classification(s);
(iii) The rate or rates of wages paid;
(iv) The number of daily and weekly hours worked by each worker;
(v) Any deductions made; and
(vi) Total wages paid.
(2) The Contractor shall make records pursuant to paragraph (e)(1) of this clause available for inspection and transcription by authorized representatives of the Administrator. The Contractor shall also make such records available upon request of the Contracting Officer.
(3) The Contractor shall make a copy of the contract available, as applicable, for inspection or transcription by authorized representatives of the Administrator.
(4) Failure to comply with this paragraph (e) shall be a violation of 29 CFR 23.260 and this contract. Upon direction of the Administrator or upon the Contracting Officer's own action, payment shall be withheld until such time as the noncompliance is corrected.
(5) Nothing in this clause limits or otherwise modifies the Contractor’s payroll and recordkeeping obligations, if any, under the Service Contract Labor Standards statute, the Wage Rate Requirements (Construction) statute, the Fair Labor Standards Act, or any other applicable law.

(f) Access. The Contractor shall permit authorized representatives of the Administrator to conduct investigations, including interviewing workers at the worksite during normal working hours.
(g) Withholding. The Contracting Officer, upon his or her own action or upon written request of the Administrator, will withhold funds or cause funds to be withheld, from the Contractor under this or any other Federal contract with the same Contractor, sufficient to pay workers the full amount of wages required by this clause.
(h) Disputes. Department of Labor has set forth in 29 CFR 23.510, Disputes concerning contractor compliance, the procedures for resolving disputes concerning a contractor’s compliance with Department of Labor regulations at 29 CFR part 23. Such disputes shall be resolved in accordance with those procedures and not the Disputes clause of this contract.
