PERFORMANCE BASED WORK

STATEMENT

1.0 INTRODUCTION

The National Water Quality Lab (NWQL) uses two (2) Perkin Elmer Inductively Coupled Plasma – Mass Spectrometers (ICP-MS) NexION 350D instruments, with ESI Prepfast autosamplers, and chillers for trace metal analyses. Timely and reliable instrument service and maintenance is critical to this analysis as these instruments analyze thousands of samples per year. The NWQL is located in building 95 at the Denver Federal Center, located in Lakewood, CO.

2.0 SCOPE

The Contractor shall provide full on-site service, maintenance and software support for the Perkin Elmer and ESI instruments listed below.

3.0 TECHNICAL REQUIREMENTS

A. The Contractor shall inspect the equipment identified below and shall maintain the equipment to OEM specifications for operations and performance throughout the period of performance of this contract. This inspection shall be conducted within fourteen (14) days of contract award, at a date and time that is agreeable to the Government. The contractor shall coordinate their inspection with the NWQL’s Technical Representative.

The Contractor shall notify the NWQL’s Technical Representative in writing when the inspection has been completed.

B. The Contractor shall diagnose equipment failure (including failure caused by OEM supplied software) and provide all parts, labor, testing equipment, travel, software and firmware upgrades required to maintain the equipment covered in this order to the original equipment manufacturers’ (OEM) published operating capabilities and specifications. All software and firmware provided by the Contractor shall be free of malicious code and spyware.

C. The Contractor shall perform preventive maintenance in accordance with the procedures and at the frequencies recommended by the OEM (at least annually) as part of this service agreement. Preventive maintenance shall be conducted at the NWQL. All preventative maintenance calls shall be scheduled with the technical liaison or designated NWQL representative. Within 30 days of contract award, the equipment to be covered shall be inspected by the Contract Service Engineer and shall be maintained to the OEM specifications for operations and performance. The Contractor shall coordinate this inspection visit through the NWQL’s Technical Liaison.

D. All repairs and preventative maintenance, provided by the Contractor, shall be performed by a certified, factory-trained technician and be scheduled with the concurrence of the technical liaison or other authorized NWQL employee. If the technician is not factory trained, he/she shall provide documentation of adequate training, which may include references from two other customers, and proof of at least one year of successful experience repairing the equipment in the contract. The documentation shall be provided upon request from the technical liaison or other authorized NWQL employee and prior to the commencement of any work.

E. Emergency repairs shall be completed within three (3) working days of verbal notification to the Contractor by the Technical Liaison or other authorized NWQL representative. Emergency repair is defined as “as system or component of a system that cannot carry out its intended function without repair”. An emergency repair will be so specified, at the initiation of the service call, by the initiator of the service call, at the sole discretion of the initiator of the service call.

F. The Contractor shall provide non-emergency repairs as required within five (5) working days of its verbal notification by the Technical Liaison or other authorized NWQL representative. Non-emergency repair is defined as “a system or component of a system that requires repair or service but can presently operate or carry out its intended function with the repair or service”. If the category of the repair is not specified by the initiator of the call, the repair shall be considered a non-emergency repair.

G. The Contractor shall obtain and arrange to have the new, OEM parts on site within forty-eight (48) hours of the initial service visit. This contract shall include the cost of all parts required for repair or service.

H. The Contractor shall be responsible for shipping expenses of all replacement parts and return shipment expenses for all non-expendable replacement parts.

I. When the service engineer and the technical liaison concur that the equipment requires offsite repair, the Contractor shall provide shipping expenses for both the shipment of the equipment to the repair facility and the return to the NWQL.

J. In the event of a service repair that cannot be completed within five (5) business days of the original request, the Contractor shall submit to the Technical Liaison or other authorized NWQL representative- in person or electronically- a written detailed report. This report shall be received by the NWQL no later than the sixth (6th) business day of such request and shall include the nature of the repair, measures that are being pursued to complete the repair, and an estimate of the time period required to complete the repair. The Contractor shall include a contingency plan for repairs that cannot be completed within five (5) working days. This contingency plan shall provide additional procedures for obtaining expertise and/or resources when the equipment cannot be diagnosed and repaired within the set period of time.

K. The Contractor shall provide local or toll-free telephone numbers for unlimited telephone service and support, available 8 AM to 5 PM Mountain Time, Monday through Friday, excluding Federal holidays, as part of this order. These numbers shall be staffed to accommodate the aforementioned hours.

L. All hazardous wastes generated, as a consequence of series (i.e. cleaning solvents, etc.) will be disposed of by the NWQL. The Contractor shall provide a profile of all hazardous waste generated on site to the responsible NWQL personnel for proper disposal.

M. The Government shall furnish the following consumable operating supplies for these systems. Any item not listed here and considered to be consumable by the Contractor must be submitted with the contract bid.

1. Sample introduction components: spray chamber, nebulizer, torch, injector, cones, and associated O-rings, gaskets, and nuts.

2. Tubing and sample introduction lines.

3. Auto-sampler probe, auto-sampler valve rotors and stators.

4. Dual-stage detector.

N. Verbal agreements between the Contractor or one of its representatives and personnel from the NWQL, if contrary to implied or stated provision of the contract, are non-binding unless agreed to by the contracting officer.

O. The Contractor (if other than the OEM) shall, within 30 days prior to contract completion, have the equipment inspected by the OEM and certified in writing that all equipment specified in the contract is operating to OEM specifications. The Government reserves the right to hold the contractor responsible for bringing the equipment up to OEM standards at no expense to the Government.

P. All services provided hereunder shall be accomplished between the hours of 8:00 a.m. and 5:00 p.m. Contractor personnel shall be required to sign in upon arrival and out upon leaving Bldg. 95. The Contractor shall coordinate all visits with the Technical Liaison or other NWQL personnel and shall comply with all Denver Federal Center security protocols, which will be provided upon award.

Q. The Government reserves the right to add or remove individual pieces of equipment unilaterally by written notice to the contractor. Items added or removed will be done so for complete months only, i.e. no partial monthly billing will be required. The unit price for items added shall be made at the Contractor’s standard catalog or market price, less any discounts provided under this contract.
