GS0301 General Requirements. (JUL 2001) The Contractor shall furnish all facilities, labor, and materials to provide goods/services in accordance with the terms and conditions herein and the specifications set forth below, entitled “Statement of Work”

PERFORMANCE-BASED WORK STATEMENT

I. GENERAL INFORMATION

Introduction:

An annual preventative maintenance and service contract is required to maintain and repair the Nu Instrument NP2 (with NP3 upgrade) multi-collector inductively coupled plasma mass spectrometer (MC-ICP-MS). Included in the contract are most of the necessary parts and labor to effectively diagnose, repair, and replace essential operating components of the instrument, software updates, and one preventative maintenance service visit per year.

Background:

The USGS Geology, Geophysics, and Geochemistry Science Center maintains and operates a Nu Plasm 2 MC-ICP-MS in the High Resolution Laboratory, Building 20, Denver Federal Center.

The instrument provides critical isotope ratio research data for USGS research efforts and other Federal, State and University collaborations. The instrument also provide data for collaborators such as EPA, NASA, DOJ, DOE, BLM, and DHS and non-Federal entities such as Colorado School of Mines, University of Tennessee, and others. The instrument is comprised of several critical subsystems including turbo pumps, RF generator, faraday and ion counter detectors, proprietary software, and electronics. The NP2 instrument must always be maintained in full operating condition and to the manufacturer’s specifications. This is necessary because of the strict scientific requirements of USGS scientists and our Quality Management System as well as our obligation to USGS science and OFA clients. In order to meet these requirements, a full service contract for instrument preventative maintenance and repair is critical. The instrument must be maintained with highest priority service by Nu Instruments trained service personnel in order to ensure proper maintenance and repair and to prevent damage to the instruments with Nu Instruments parts.

Scope:

This Statement of Work covers the requirements for full maintenance, emergency visits, and software support for the Nu Instruments NP2 MC-ICP-MS housed in the Denver High Resolution Laboratory at the USGS located on the Denver Federal Center, Building 20, Lakewood, CO. The contract shall have a base year and four option years.

II. WORK REQUIREMENTS

Acceptable Quality Performance Standards:

For acceptable quality performance, the contractor shall assure that the NP2 MC-ICP-MS and its modifications are meeting to the manufacturer’s performance standards and are the service repairs and preventive maintenance is performed in accordance with the manufacture’s maintenance standards and meet the manufacture’s performance specifications.

Acceptable Time Performance Standards:

For acceptable time performance, the contractor shall assure the NP2 mC-ICP-MS under this contract, and its modifications, are performing to the manufacturer’s performance standards without lapse of more than seven consecutive working days. If a service is escalated the Contractor shall communicate with the technical liaison or other authorized High Resolution Laboratory representative the nature of the repair, measures that are being pursued to complete the repair, and an estimate of the time period required to complete the repair.

Technical Requirements:

1. The contractor shall provide Nu Instrument trained engineers to inspect instrument performance, perform instrument calibration, and preventative maintenance on an annual basis.

2. The contractor shall provide unlimited additional unscheduled site visits per service agreement year by a Nu Instrument trained engineers. The site visit must take place within five business days of a service call that cannot be resolved with telephone support.

3. The contractor shall provide telephone support for repair and maintenance Monday through Friday except holidays.

4. The service agreement shall cover shipping costs of necessary Nu Instrument approved parts to the instrument site. Subject to availability, the Nu Instrument factory approved part will ship within 48 hours of a repair diagnosis.

5. The contractor shall cover the instrument parts, hardware, and software and have access to Nu Instrument factory direct parts.

6. The contractor shall provide software updates as necessary from Nu Instrument.

7. The service agreement includes the labor and travel expenses of the Nu Instrument trained engineers.

8. External components and consumable items such as torch, cones, M80 rotary pump and chiller are not included in this service contract.

III. QUALITY ASSURANCE SERVEILLANCE PLAN (QASP)

Quality Control: The contractor is responsible for quality control. Prior to leaving the service technician shall test the instrument(s) to ensure that the instrument is performing in accordance with OEM and manufacturer specifications and provide documentation of the service visit.

Quality Assurance: The Government is responsible for quality assurance. The Denver Microbeam technical liaison (TL) and personnel will perform their own tests to ensure the instrument is performing in accordance with OEM specifications. The Contracting Officer’s Technical Representative (COTR) or TL will notify the contractor of substandard performance results. The contractor shall resolve substandard performance in accordance with the terms of the technical requirement D and E and within the written plan in the technical requirement F by then end of the next business day.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

52.217-8 Option to Extend Services (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days before expiration of period of performance.

52.217-9 Option to Extend the Term of the Contract (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days before the contract expires; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 60 months.

GS1440 Wage Determination Applicable (JUL 2001)

This requirement is subject to the Service Contract Act of l965, as amended. The wage determination will be determined at the time of award and will be incorporated thereto.

GS1131 Unilateral Deobligation of Unexpended Funds

The contractor shall submit all invoices under the award no later than 90 calendar days after the period of performance has expired, unless a request for extension has been submitted to the Contracting Officer. After 120 days has passed since the expiration of the performance period, the government reserves the right to issue a unilateral modification deobligating any unexpended funds, and to initiate closeout procedures.

Electronic Invoicing and Payment Requirements - Invoice Processing Platform (IPP) (April 2013)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor.
