B.2. Performance Work Statement (PWS)

I. GENERAL INFORMATION

A. Objective

The U S Geological Survey’s Eastern Ecologic Science Center (formally Leetown Science Center) requires upgrade and installation of control systems in several buildings. The installed devices shall be compatible with existing control and monitoring equipment, as well as help reduce energy cost and maintain the building in comfort.

B. Background

The U.S. Geological Survey, Ecological Science Center, is located at 11649 Leetown Road, Kearneysville, WV 25430. Research conducted at this facility includes study of infectious and noninfectious diseases of fishes and other aquatic organisms. The facility also conducts research on invasive fish species with the intent of better understanding the adaptations these fish are applying in these new, non-native habitats and developing ways to stop their spread and potentially eradicate them.

C. Scope

Fish Health Lab

• Provide a revision 3 upgrade to the existing Schneider Electric EcoStruxure Enterprise Server and associated Automation Server Network Controllers (3).

• Provide direct digital control for the (2) existing AAON make up air units. Provide necessary temperature sensors, relays, and current sensors that will enable the complete control of the units. Unit control will consist of occupied/unoccupied control, discharge air reset control, and economizer. T

• The field controller shall seamlessly integrate to the existing building automation system. Provide necessary alarming and monitoring.

• Provide graphical representation via a web browser interface.

• Provide building automation system monitoring of the alarm contacts for (9) -80 low temperature freezers. The BAS alarm point shall be capable of sending alarm messages through the existing DDC system.

Administration Building

• Provide direct digital control of two existing Trane roof top units. The room controller shall seamlessly integrate to the existing building automation system.

• Provide a graphical user interface for the following control, occupied/unoccupied, room temperature and setpoint adjustment.

• Provide direct digital control and monitoring of the heating water and chilled water systems. This control would include occupied/unoccupied control. Outside air temperature control.

• Provide pump control with status feedback.

• Provide building supply and return sensors for both systems.

• Provide chiller and boiler alarm contact monitoring with BAS alarming. The field controllers shall seamlessly integrate to the existing building automation system.

• Provide a graphical user interface for both systems for monitoring and setpoint control.

Stream Lab

• Provide Schneider Electric Automation Server that will connect to the existing campus EcoStruxure

Enterprise server. The new automation server will integrate to the existing Schneider Electric I/A Series field controller that is operating the building heating water system.

• Provide direct digital control of (7) hot water unit heaters.

• Provide a graphical user interface for the following control, occupied/unoccupied, room temperature and setpoint adjustment to the existing building automation system.

• Provide direct digital control of one DX split air handling unit. Provide a graphical user interface for the following control, occupied/unoccupied, room temperature and setpoint adjustment to the existing building automation system.

UV Building

• Provide digital controller with HMI that will control existing pond level duplex water pumping system and rotating drum screen panel.

• POND LEVEL CONTROL - Provide one new Submersible Level Transmitter for the pond to connect to the new digital controller. The sensor shall be a Dwyer PBLT2 or equal. The controller will cycle between pump 1 and pump 2 to maintain the pond level setpoint.

• WATER DRUM SCREEN CONTROL – Provide interface between the new Digital controller and the water drum screen panel. The new controller will provide drum rotation with flush pump start-stop control.

II. WORK REQUIREMENTS

A. Technical Requirements

a. The contractor is to furnish all equipment, supplies and labor to install control systems and other associated items. Contractor shall obtain all permits required by federal, state, and local regulations prior to commencement of work. All required paperwork and calculations required to obtain any permits shall be provided to the Technical Liaison (TL) and Facility Manager (FM) at time of submission as well as the permits themselves upon receipt of the documents from the permitting agencies.

b. Criteria for acceptance is to meet or exceed the requirements and all work is completed to code.

B. Deliverables

a. Timeline: Work may not begin without the approval of the timeline by the FM. The project schedule shall be a chart which graphically depicts the proposed sequence to accomplish each work feature or operation. It shall show start dates and completion dates for each event on a horizontal time scale. The progress schedule time scale shall begin with the contract award and indicate the number of days to completion. The schedule will be the reference to which the contractor’s progress and efforts are compared. Three paper copies or one soft copy shall be submitted to the FM.

b. Kick-off Meeting: The contractor shall schedule and conduct a kick-off meeting on-site with the FM and TL to review the requirements and conditions of this contract. The contractor shall have the project manager, field superintendent, and all subcontractors on site, or available by conference call, for the kick-off meeting with Government officials prior to the commencement of work for this project.

C. Other Requirements

a. Contractor shall be licensed to perform work in WV.

b. The contractor shall directly superintend the work or assign and have on the worksite a competent superintendent with authority to act for the contractor.

c. COVID 19 requirements: All contractors are to wear face coverings and self-check each day before entering the building, a sign-in sheet is to be kept and issued to FM each week or upon request.

d. Outages and Interruptions: The contractor is advised that the Science Center will continue to perform research functions during the contract. Work shall be conducted as to minimize interruption to service.

Contractor shall notify FM at least 3 days prior to any outages and interruptions. Contractor shall not proceed with work without approvals from the FM. Changes to the schedule require the submission of a new schedule to the FM for review.

e. Normal working hours shall be 7:30am- 4:00pm, Monday - Friday. The contractor and sub-contractors (if required) shall not work Saturdays, Sundays, legal holidays, or non-normal working hours, unless

140G0121Q0090 Page 6 of 27 otherwise authorized by the TL or FM. Request to work other than the normal hours shall be made, and approved, in writing through the TL or FM. Work performed during “other than the normal hours” shall not change the total cost to the government.

f. Changes / Clarifications: All work must be completed as shown in the contract documents. If ‘no cost’ change orders are to be made, a written request to the TL must be made detailing why the work can not be completed as shown, as well as the corrective action suggested by the contractor. For change orders which will alter the price or requirements of the contract, the Contracting Officer’s approval must be given in writing before beginning the work described.

g. Disposal and Transporting of Debris and Material: All materials and construction debris shall be removed from the work area and placed in an approved dumpster or removed from the site daily by the contractor. All demolished materials shall be disposed of in an environmentally friendly manner, recycling wherever possible.

h. Organization and storage of contractor(s) items at the site: The FM shall designate areas where the contractor can store or place materials and equipment for short-term storage in preparation for installation. There is limited space on site for the storage of contractor equipment. There is no inside storage space available. Storage and security of materials and equipment as required for the performance of the contract requirements are the responsibility of the contractor. The contractor shall be responsible for making all arrangements for the receipt of materials and supplies at the job site.

Government personnel are not permitted to receive or sign for items delivered to the site. Upon completion of the contract, the contractor shall remove all equipment and excess materials, and shall restore the site to its original condition, as approved by the FM, at no additional cost to the government.

i. Site Cleanliness: The contractor shall maintain the site free of construction debris outside of approved containers (dumpsters). The contractor shall provide dust protection and shall maintain cleanliness of the work site by promptly removing debris, tools, and excess material.

j. Contractor Parking, Security, and Smoking Regulations: The contractor shall maintain a daily log of all contractor and subcontractor employees (date, name, arrival time, departure time) and provide a copy of the log to the TL at least weekly. The FM or TL will designate a parking area (or areas) for the contractor to park vehicles. There shall be no smoking in any buildings at any time. All personnel that smoke will have to do so outside in designated smoking areas.

k. Environmental Protection: The contractor and subcontractors shall perform all work and activities in accordance with local, state, and Federal environmental regulations.

l. Safety: The contractor and subcontractors shall perform all work and activities in accordance with local, state, and Federal safety regulations, including OSHA, NEC, and USGS policy.

m. Notice to the Government of Delays: In the event the contractor encounters difficulty in meeting performance requirements, or when it anticipates difficulty in complying with the contract delivery schedule or date, or whenever the contractor has knowledge that any actual or potential situation is delaying or threatens to delay the timely performance of this contract, the contractor shall immediately notify the TL in writing, giving pertinent details. This data shall be informational only in character.

Notice under this provision shall not be construed as a waiver by the Government of any delivery schedule or date or any rights or remedies provided by law or under this contract

B.5. Unscheduled Closures – Fixed Price (March 2003)

(a) The USGS facility where contractor employees are working may occasionally be closed temporarily and federal employees dismissed, such as for inclement weather, holiday early closings, power outages, or other emergencies.

In these cases, the Contracting Officer or COR will advise the contractor whether any of the contractor's activities on Government facilities are considered critical and require continued performance. In most cases, the Contractor will be required to dismiss employees at Government facilities who are performing noncritical tasks after federal employees are dismissed.

(b) If the unscheduled closure causes an increase in the cost of contract performance or if any contract term or condition is affected by the closure, the Contractor may request an adjustment pursuant to Clause FAR 52.242-17 Government Delay of Work.

(c) Contractor performance at locations that are not affected by the unscheduled closure will not be subject to this clause.

B.6. 52.000S-5079 Technical Liaison - Technical Direction (OCTOBER 1997)

(a) The performance required herein shall be subject to the technical direction of the Technical Liaison (TL) as identified below. As used herein, "technical direction" is defined as direction to the contractor that fills in details, suggests possible lines of approach, or otherwise supplements the scope of the work set forth herein and shall not constitute a new assignment, and does not supersede or modify any article or clause of this contract.

(b) The Technical Liaison is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(3) Make any final decision on any contract matter subject to the Disputes Clause;

(4) Terminate, for any reason, the contractor's right to proceed;

(5) Obligate in any way, the payment of money by the Government. Only a warranted Contracting Officer is authorized to obligate funds on this or any other contract action.

(c) The contractor shall immediately notify the Contracting Officer in writing if the Technical Liaison has taken an action (or fails to take action) or issues direction (written or oral) that the contractor considers exceeding the above limitations.

B.7. GS1440 Wage Determination Incorporation

In the performance of this contract, the contractor shall comply with the requirements of U.S. Department of Labor Wage Determination 2015-4285, Rev 16 dated 12/21/2020. The wage determination is incorporated and made a part of this order.

B.8. 1452.228-70 Liability Insurance (JUL 1996)

(a) The Contractor shall procure and maintain during the term of this contract and any extension thereof liability insurance in form satisfactory to the Contracting Officer by an insurance company which is acceptable to the Contracting Officer. The named insured parties under the policy shall be the Contractor and the United States of America. The amounts of the insurance shall be not less than as follows:

(b) Each policy shall have a certificate evidencing the insurance coverage. The insurance company shall provide an

140G0121Q0090 Page 9 of 27 endorsement to notify the Contracting Officer 30 days prior to the effective date of cancellation or termination of the policy or certificate; or modification of the policy or certificate which may adversely affect the interest of the Government in such insurance. The certificate shall identify the contract number, the name and address of the Contracting Officer, as well as the insured, the policy number and a brief description of contract services to be performed. The contractor shall furnish the Contracting Officer with a copy of an acceptable insurance certificate prior to beginning the work.

C.1. DOI ELECTRONIC INVOICING Electronic Invoicing and Payment Requirements - Internet Payment Platform (IPP) (September 2011)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Internet Payment Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. The IPP website address is: https://www.ipp.gov.

Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice [CO to edit and include the documentation required under this contract]:

The Contractor must use the IPP website to register, access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in CCR) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) within 3 - 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.

If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

C.2. GS1131 Unilateral Deobligation of Unexpended Funds (MAY 2013)

The contractor shall submit all invoices under the award no later than 90 calendar days after the period of performance has expired, unless a request for extension has been submitted to the Contracting Officer. After 120 days has passed since the expiration of the performance period, the government reserves the right to issue a unilateral modification deobligating any unexpended funds, and to initiate closeout procedures.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
