This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.

Solicitation 140FS323Q0130 is issued as a request for quotation (RFQ). The anticipated award date is within 10 days after the close of this announcement.

This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC Number: 2023-04, Effective Date: 06/02/2023.

This requirement is being solicited as a 100% Small Business Set-Aside. The applicable North American Classification System (NAICS) code is 115310, Support Activities for Forestry. The small business size standard is $11.5M.

The Government intends to award a firm fixed price contract resulting from this combined synopsis/solicitation.

1. Site Inspection:

Prior to submitting a quote, Contractors are encouraged to inspect the site where services are to be performed to satisfy themselves regarding all general and local conditions that may affect the cost and performance of the contract.

A site visit inspection has been scheduled for Thursday, July 20, 2023 at 10:00am EDT. The inspection will take place at the Pelican Island National Wildlife Refuge located at 4055 Wildlife Way, Vero Beach, Florida. The POC is Oliver Van Den Ende, Phone # 772-205-0697.

2. Question Submission:

All questions regarding this Solicitation must be submitted in writing to the Contracting Officer, Ryna Russell at ryna_russell@fws.gov no later than Wednesday, July 26, 2023 at 11:00am EDT. Please be advised that the government reserves the right to transmit responses to those questions of common interest to all competing schedule contractors through an Amendment to this Solicitation.

PART 1. GENERAL INFORMATION

General The U.S. Fish & Wildlife Service (FWS) is seeking a Contractor to provide tree planting at the Pelican Island National Wildlife Refuge (Refuge) located in Vero Beach, Florida.

Description of Services The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items necessary to perform tree planting as defined in this Performance Work Statement (PWS) except for those items specified as government furnished property and services. The contractor shall perform to the standards in this contract.

Background The historic land use within the project was citrus groves. Upon purchase by the FWS, the Refuge cleared the citrus groves as part of a maritime/tropical restoration effort. This project would complement un-assisted reforestation through native tree planting on approximately 30 acres of the Jungle Restoration Area (see map).

Objective The Contractor shall plant a minimum of 3,000 one-gallon pot size or larger native trees within 30-acres on the restoration site as described in this PWS.

Place of Performance:

All work shall take place within the project area shown on the map.

Period of Performance:

The period of performance (POP) shall be from the date of award thru 12/31/2024. If supplemental tree planting is necessary due to 80% of the trees not surviving after 90 days of planting, the Contractor shall complete the new plantings no later than 1 month following notice of non-compliance.

Tree Planting POP: Tree plantings shall be completed 180-days once planting begins.

GIS Map POP: The GIS map shall be provided no later than 30-days after completion of plantings.

GIS data needs to be provided in shapefiles or geodatabase compatible with the latest ArcGIS program.

Hours of Operation:

The contractor is responsible for conducting business between sunrise and sundown, seven days a week, except when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. The Contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons.

PART 2. SCOPE / REQUIREMENTS / SITE INFORMATION

Scope The project consists specifically of supplying all labor, equipment, materials, lodging and supplies necessary for planting a variety of native trees as identified under the following tasks:

Tasks:

1. Plant a variety of native trees within the project area according to the below work specifications.

2. Provide a GIS map upon completion of the work. This map shall show the locations of trees planted on the site.

Work Tasks/Specifications Task 1 – Tree Planting Contractor shall plant at least three different native tree species (a minimum of 3,000 one-gallon pot size or larger), generally able to thrive in USDA Plant Hardiness Zones 10-11. Contractor shall warrant that all trees will be delivered disease free and in good health at the time of installation. Suggested trees include sea grape (Coccoloba uvifera), strangler fig (Ficus aurea), paradise tree (Simarouba glauca), and pigeon plum (Simarouba glauca). Other native trees may be used based on price and/or availability but must be approved by the COR.

Contractor shall submit a planting-plan requiring site manager approval prior to commencing with reforestation. The planting plan shall include a list of trees, quantity, size, and general location of areas to be planted.

Trees are to be planted in a clumped pattern, where each tree is no more than 20 feet from its nearest neighbor. Trees must be one gallon (pot size) or larger, planted at densities no less than 100 trees/acre.

No less than 3,000 trees shall be planted within 30 acres across the project area.

The Contractor shall ensure a survival rate of at least 80% through the first 90-days after planting thru whatever means necessary. The Contractor is responsible for supplying and planting additional trees as necessary to meet the minimum survival rates. The COR will schedule a site visit with the Contractor to inspect tree survival rates within 1-month immediately following the planting in order to determine whether the 80% survival threshold was met.

Freshwater is available on-site. ATVs, UTVs and light trucks can be used anywhere. All materials, supplies, and equipment must be provided by contractor. Some areas are locked; contractor will be provided lock combinations and keys to check out.

Contractor shall provide a schedule of work days planned for the plantings to the COR no later than 7 days prior to mobilization. Contractor needs to complete project in 180 days once work begins.

The Contractor shall provide a weekly log of the number and location of trees planted.

Task 2 – GIS Map Contractor shall provide an electronic copy of the GIS map to the COR no later than 30-days after completion of plantings. This map shall show where trees were planted, labelled by species.

Site Information Pelican Island National Wildlife Refuge (Refuge) is restoring native habitats. Native tree planting is part of the restoration process. This project covers the Jungle Trail Restoration Area (see map below).

Contracting Officer Representative (COR):

The COR will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration The COR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract; perform inspections necessary in connection with contract performance; maintain written and oral communications with the Contractor concerning technical aspects of the contract; issue written interpretations of technical requirements, including Government drawings, designs, specifications; monitor Contractor’s performance and notifies both the Contracting Officer and Contractor of any deficiencies; coordinate availability of government furnished

PWS - Page 5 of 10 property; and, provide site entry of Contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order.

Key Personnel:

The follow personnel are considered key personnel by the government:

The contractor shall provide a contract manager who shall be responsible for the performance of the work.

The name of this person and an alternate who shall act for the contractor when the manager is absent shall be designated in writing to the contracting officer. The contract manager or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. The contract manager or alternate shall be available between 8:00 AM and 4:00 PM ET, Monday thru Friday, except when the government facility is closed for administrative reasons.

Identification of Contractor Employees:

All contract personnel working onsite where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of the public that they are government officials. They must also ensure that all document or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed.

PART 3. GOVERNMENT FURNISHED PROPERTY, EQUIPMENT, AND SERVICES

Services: The Government will:

• Provide directions for navigating to the site and where the planting zones are, including producing maps and participating in site visits as necessary.

• Ensure that the Contractor has access to the site and can park nearby.

• Conduct monitoring along with Contractor to inspect tree survival rates, Water: The Contractor will have access to water for irrigation onsite. Well water is available along Wildlife Way. No other sources of freshwater are available on-site.

Facilities: The Government will provide access to the Refuge proper where all field work shall take place.

Utilities: The Government will not provide any utilities in the field.

PART 4. CONTRACTOR FURNISHED ITEMS AND SERVICES

General: The Contractor shall furnish all materials, supplies, equipment, labor, services, and equipment necessary to meet the requirements under this PWS. This includes procuring trees from a nursery that meet the requirements under the PWS.

Services: The Contractor shall complete the plantings in a safe manner without contamination of the soil or water supply or the introduction of invasive plant or animal species. Equipment and field gear (e.g., boots, etc.)

must be clean and free of weed seed before arriving on site.

PART 5. COMPLIANCE REQUIREMENTS

Accident Reporting: The Contractor shall maintain an accurate record of all accidents and shall immediately report to the COR all accidents resulting in death, trauma, or occupational disease. All accident records/reports must be submitted to the CO and COR within twenty-four (24) hours of their occurrence and be noted on the Log. For life-threatening emergencies, calls shall be directed to 911.

Damage Reporting: In all instances where Government property or equipment is damaged, a full report of the fact and extent of such damage will be submitted in writing to the CO and COR within twenty-four (24) hours.

Fire Prevention: The Contractor and its employees are to be familiar with the method of turning on a Fire Alarm. The Contractor and its employees shall be cognizant of and shall observe all requirements for handling and storage of combustible supplies and materials, and for daily disposal of combustible waste and trash.

Hazardous Conditions: If a hazardous condition is seen, the Contractor and its employees shall notify the CO and COR in writing within twenty-four (24) hours.

Personnel Behavior: The Contractor is responsible for the behavior of its employees while working within the facility. Contractor personnel shall not engage in prohibited activities, such as gambling, consumption of alcohol, use of non-prescribed medicines or drugs, or smoking. Contractor employees are to observe acceptable courtesies when engaging Government officials and non-government visitors to the facility.

Contractor employees shall not conduct harassing behavior based on race, color, religion, sex (including pregnancy and gender identity), sexual orientation, national origin, age, disability, genetic information (including family medical history), status as a parent, marital status, and political affiliation.

Personnel Attire/Vehicle: This Refuge provides visitor services to the public. Therefore, the Contractor's employees must perform work in clothing that is clean and orderly as possible, given the type of work performed. Contractor employees shall not wear on their clothing or have on their vehicle, any slogans, profanity, political or social-cause messages, or advertising (other than the company name or logo).

Safety Requirements: Contractor must perform this contract in a safe manner, observing any necessary safety precautions. The contractor shall promptly correct any condition which, in the opinion of the CO or COR, endangers the safety of personnel and/or property during the performance of this contract. Failure to observe this requirement shall result in contract termination, with the Contractor liable for any such damages that may occur. The Contractor is obligated to perform a thorough inspection each working day of all areas to assure that all necessary safeguards relative to safety and fire hazards are being taken.

PART 6. QUALITY / INSPECTION / ACCEPTANCE / WARRANTY

Quality Assurance:

The government shall evaluate the contractor's performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).

Inspection and Acceptance: (Refer to FAR 52.212-4(a)) The work shall be accepted when work is completed as described here within and in accordance with the specifications. Comments, recommendations, reports, and maps must be submitted according to the schedule established by the COR. The contractor must work closely with the COR to ensure deadlines are met. Work will be inspected to assure compliance with the contract documents. However, quality control and adherence to all contract requirements is still the responsibility of the contractor.

The Refuge requires that 80% of the trees planted by the contractor survive after a 90-day period. If less than 80% of the trees did not survive, the contractor shall purchase and replant the amount of trees necessary to complete the 80% survival rate at no expense to the Refuge. The COR will be responsible for surveying the planted trees and documenting that less than 80% of the trees survived 90-day after completion of plantings.

Once the trees have been planted, the COR will schedule a site visit with the Contractor to inspect tree survival rates within 1-month immediately following the 90-day survival rate in order to determine whether the 80% survival threshold was met.

PART 7. PERFORMANCE REQUIREMENT SUMMARY (PRS)

The Contractor service requirements are summarized into performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement. These thresholds are critical to mission success.

PART 8. QUALITY ASSURANCE PLAN

Purpose This Quality Assurance Surveillance Plan (QASP) provides a systematic method to evaluate performance for the stated contract. This QASP explains the following:

• What will be monitored

• How monitoring will take place

• Who will conduct the monitoring

• How monitoring efforts and results will be documented

This QASP does not detail how the contractor accomplishes the work. Rather, the QASP is created with the premise that the contractor is responsible for management and quality control actions to meet the terms of the contract. It is the Government's responsibility to be objective, fair, and consistent in evaluating performance.

In addition, the QASP should recognize that unforeseen and uncontrollable situations may occur. This QASP is a "living document" and the Government may review and revise it on a regular basis. However, the Government shall coordinate changes with the contractor. Updates shall ensure that the QASP remains a valid, useful, and enforceable document. Copies of the original QASP and revisions shall be provided to the contractor and Government officials implementing surveillance activities. FAR & DOI Local Clauses apply to this contract.

a) Contracting Officer (CO) -The CO shall ensure performance of all necessary actions for effective contracting, ensure compliance with the contract terms, and shall safeguard the interests of the United States in the contractual relationship. The CO is ultimately responsible for the final determination of the adequacy of the contractor's performance.

• The contractor shall work with COR to schedule times of inspections

• The contractor shall provide operational oversight of the activities taking place on the Refuge in coordination with the Service.

• The contractor shall provide GIS track maps to the Service.

• The contractor shall furnish all labor, supplies, transportation, lodging and materials for the project.

Performance Standards Performance standards define desired services. The Government performs surveillance to determine if the contractor exceeds, meets or does not meet these standards. The Performance Requirements Summary includes performance standards. The Government shall use these standards to determine contractor performance and shall compare contractor performance to the Acceptable Quality Level (AQL).

Methods of Quality Assurance (QA) Surveillance Various methods exist to monitor performance. The COR shall use the surveillance methods listed in the administration of this QASP.

Regardless of the surveillance method, the COR shall always contact the contractor when a defect is identified and inform the manager of the specifics of the problem. The COR shall be responsible for monitoring the contractor's performance in meeting a specific performance standard/ AQL.

100% Inspection Surveillance results may be used as the basis for actions (to include payment deductions) against the contractor. In such cases, the Inspection of Services clause in the Contract becomes the basis for the CO's actions.

Documenting Performance

Unacceptable Performance When unacceptable performance occurs, the COR shall inform the contractor. This will normally be in writing unless circumstances necessitate verbal communication. In any case, the COR shall document the discussion and place it in the COR's file.

When the COR determines formal written communication is required, the COR shall prepare a Contract Discrepancy Report (CDR), and present it to the contractor.

The contractor shall acknowledge receipt of the CDR in writing. The CDR will specify if the contractor is required to prepare a corrective action plan to document how the contractor shall correct the unacceptable performance and avoid a recurrence. The CDR will also state how long after receipt the contractor has to

PWS - Page 10 of 10 present this corrective action plan to the COR. The Government shall review the contractor's corrective action plan to determine acceptability.

Any CDRs may become a part of the supporting documentation for contract payment deductions or other actions deemed necessary by the CO.

** UNIFORM ALLOWANCE **

If employees are required to wear uniforms in the performance of this contract (either by the terms of the Government contract, by the employer, by the state or local law, etc.), the cost of furnishing such uniforms and maintaining (by laundering or dry cleaning) such uniforms is an expense that may not be borne by an employee where such cost reduces the hourly rate below that required by the wage determination. The Department of Labor will accept payment in accordance with the following standards as compliance:

The contractor or subcontractor is required to furnish all employees with an adequate number of uniforms without cost or to reimburse employees for the actual cost of the uniforms. In addition, where uniform cleaning and maintenance is made the responsibility of the employee, all contractors and subcontractors subject to this wage determination shall (in the absence of a bona fide collective bargaining agreement providing for a different amount, or the furnishing of contrary affirmative proof as to the actual cost), reimburse all employees for such cleaning and maintenance at a rate of $3.35 per week (or $.67 cents per day). However, in those instances where the uniforms furnished are made of ""wash and wear"" materials, may be routinely washed and dried with other personal garments, and do not require any special treatment such as dry cleaning, daily washing, or commercial laundering in order to meet the cleanliness or appearance standards set by the terms of the Government contract, by the contractor, by law, or by the nature of the work, there is no requirement that employees be reimbursed for uniform maintenance costs.

REQUEST FOR AUTHORIZATION OF ADDITIONAL CLASSIFICATION AND WAGE RATE

Conformance Process:

The contracting officer shall require that any class of service employee which is not listed herein and which is to be employed under the contract (i.e., the work to be performed is not performed by any classification listed in the wage determination), be classified by the contractor so as to provide a reasonable relationship (i.e., appropriate level of skill comparison) between such unlisted classifications and the classifications listed in the wage determination. Such conformed classes of employees shall be paid the monetary wages and furnished the fringe benefits as are determined (See 29 CFR 4.6(b)(2)(i)). Such conforming procedures shall be initiated by the contractor prior to the performance of contract work by such unlisted class(es) of employees (See 29 CFR 4.6(b)(2)(ii)). The Wage and Hour Division shall make a final determination of conformed classification, wage rate, and/or fringe benefits which shall be retroactive to the commencement date of the contract (See 29 CFR 4.6(b)(2)(iv)(C)(vi)). When multiple wage determinations are included in a contract, a separate SF-1444 should be prepared for each wage determination to which a class(es) is to be conformed.

The process for preparing a conformance request is as follows:

1) When preparing the bid, the contractor identifies the need for a conformed occupation(s) and computes a proposed rate(s).

2) After contract award, the contractor prepares a written report listing in order the proposed classification title(s), a Federal grade equivalency (FGE) for each proposed classification(s), job description(s), and rationale for proposed wage rate(s), including information regarding the agreement or disagreement of the authorized representative of the employees involved, or where there is no authorized representative, the employees themselves. This report should be submitted to the contracting officer no later than 30 days after such unlisted class(es) of employees performs any contract work.

3) The contracting officer reviews the proposed action and promptly submits a report of the action, together with the agency's recommendations and pertinent information including the position of the contractor and the employees, to the Wage and Hour Division, U.S. Department of Labor, for review (See 29 CFR 4.6(b)(2)(ii)).

4) Within 30 days of receipt, the Wage and Hour Division approves, modifies, or disapproves the action via transmittal to the agency contracting officer, or notifies the contracting officer that additional time will be required to process the request.

5) The contracting officer transmits the Wage and Hour decision to the contractor.

6) The contractor informs the affected employees.

Information required by the Regulations must be submitted on SF-1444 or bond paper.

When preparing a conformance request, the ""Service Contract Act Directory of Occupations"" (the Directory) should be used to compare job definitions to ensure that duties requested are not performed by a classification already listed in the wage determination. Remember, it is not the job title, but the required tasks that determine whether a class is included in an established wage determination.

Conformances may not be used to artificially split, combine, or subdivide classifications listed in the wage determination."
