PERFORMANCE WORK STATEMENT

1. DESCRIPTION OF SERVICES. The contractor shall provide all personnel, equipment, tools, supervision, and other items and services necessary to ensure that grounds maintenance is performed at (Big Branch Marsh National Wildlife

Refuge, St. Tammany Parish Lacombe, Louisiana

70445) in a manner that will maintain healthy grass, trees, shrubs, and plants and present a clean, neat, and professional appearance. During the performance of its work, the Contractor shall report all obvious deficiencies (e.g., drainage problems/water puddles, safety hazards, etc.) to the Government Representative (GR) as soon as possible.

The grounds are public use areas and are open

Monday through Friday from 7:00 AM to 4:00 PM and

Saturday from 9am to 4 pm closed on major Federal holidays. The Contractor must provide quote on the price per mowing based on the schedule listed in the solicitation.

The entire mowing area is approximately 18.25 acres. A map of identified areas to be mowed and trimmed is included; however, you must attend the site visit to receive consideration. Interested contractors should make an appointment with the

Refuge Manager Jimmy Laurent (985) 882-2031 or

Jimmy_laurent@fws.gov to view the area before bidding since mowing includes cramped areas around buildings, trees, a pond, and fences. The

Contractor shall furnish all necessary management, supervision, labor, and equipment

(except as otherwise specified), and shall plan, schedule, coordinate, and assure effective performance of lawn services for the entire duration of contract. The service shall include all functions normally considered a part of a satisfactory mowing service.

In order to ensure performance and accomplishment of the work as outlined herein, the Contractor shall provide adequate and competent supervision at all times for all work to be accomplished by the Contractor's employees.

When contract work is in progress, supervisory personnel shall be available at all times to receive notices, reports, or requests from the

GR/COR or his authorized representative. At no time shall Government representatives direct or supervise the activities of the Contractor's employees. An on-site supervisor, with the ability to speak and understand English clearly and with the authority to act for the Contractor on a day-to-day basis and to sign for inspection reports and all other correspondence on behalf of the Contractor, shall be present at the work site at all times when contract work is in progress, unless the contractor employee can act on the supervisor's behalf. Supervisory responsibilities shall include, but shall not be limited to, the following: Providing an adequate labor force;

this includes the immediate replacement of personnel dismissed for cause or leaving employment of their own volition. Ensures that

Contractor personnel are properly trained to perform their assigned work in a proper, safe, and efficient manner, and ensuring that the proper supplies, materials, and equipment are on hand, takes action to prevent general carelessness by employees and/or abuse of facilities or equipment. Continually ensures that the conduct of the Contractor's employees reflects favorably upon the Contractor's and FWS organization(s). If applicable, supervisory personnel are responsible for ensuring that employees fully support and participate in the energy-conservation program within the facilities. Use lights or other energy-consuming equipment only in areas where and when work is actually being performed. Secure lights and other equipment when not in use or needed.

shall be cut on approximately 18.25 acres of improved grounds as indicated in Appendix A.

140F0922Q0043 roadways/walkways. All grass clippings must be removed from all walkways/driveways/parking areas/roadways that are made of asphalt, concrete, or pavestone brick. Contractor shall maintain the growth of grass height on improved grounds between 1 to 4 inches, depending upon the type of grass. The height is a guideline for a neat and professional appearance. All improved grounds shall look well-manicured at all times.

1.1.2. Edging- Sidewalks, driveways, curbs, and

other brick, concrete edges located in the improved grounds areas shall be edged two times per year (May and September). Edging shall include removal of vegetation from cracks in sidewalks, driveways, and curbs within .5 inch of the edged surface and to a depth of 2.0 inches.

This work involves approximately 4800 linear feet as indicated in Appendix A and B. Once edged, all dirt and grass removed from the edging must be removed from the concrete/brick/ surfaces and a sharp/clean appearance of the edging will be apparent. Area to be edges include all pavestone, concrete /grass interfaces and exist at the

Visitor Center, Conservation Room, and Main

Headquarters buildings and nearby walkways as shown in Appendix B.

1.1.3. Trimming. Grass and weeds shall be trimmed

around trees, shrubs, buildings, fences, poles, posts, fire hydrants, sidewalks, parking areas, parking lot bumper blocks, boulders, and other fixed obstacles. Trimming height shall match surrounding area grass heights. Trimmed vegetation height will be to ground level. This task involves all improved grounds as shown in

Appendix B. All areas shall be trimmed concurrent with mowing. Damage to trees and shrubs from trimming shall be repaired by the contractor. If a plant should die or become unhealthy due to damage, the contractor will be responsible for replacing the damaged plant with a plant of same size and type. Plant replacement shall occur within 15 days of noticed damage.

Responsibilities shall include, but not be limited to, the removal and disposal of all natural debris, (tree limbs, dry brush, rodent habitats, dead animals, etc.), and man-made debris. All man-made debris will be bagged and disposed of in the dumpster behind the conservation room and all natural debris will be disposed of all debris in the burn pile on site.

1.1.6. Repair Damaged Areas. Areas damaged by

contractor vehicles, erosion, drought or insect/diseases shall be seeded, sprigged, or sodded to meet the standards of surrounding areas. Other than lawn areas will be repaired to match the surrounding area.

1.2. EMERGENCY AND SPECIAL EVENT SERVICES. Within

twenty four (24) hours after receiving a written or verbal notification from the contracting officer or the COR, the contractor shall perform emergency or special event ground maintenance services in areas covered under this contract.

2. SERVICE DELIVERY SUMMARY. The contractor service requirements are summarized into performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement. These thresholds are critical to mission success. Mowing and trimming locations include: The entrance road right-of-way from

Highway 434 to the refuge office building, the fields at the entrance (approximately ½ acre), the campground area, the grounds around the cemetery and law enforcement building and the open space in front of and behind the refuge office building. *This equates to 20-22 annual mowing's and two annual edgings. All trash shall be picked up and bagged prior to cutting. Damages to trees, shrubs, sign post and other fixed objects shall be repaired or replaced by the contractor. If a tree or shrub should die or become unhealthy due the damage from trimming, the contractor will responsible for replacing the damaged plant with a plant of the same size and type. Edging. Sidewalks, curbs, driveways, and other concrete, or pavestone edges located in the grounds areas shall be edged (two times/year), trimmed and blown free of dirt and debris from all unnatural surfaces. Edging visits are to occur once each in May, and September.

Assurance Surveillance Plan. Inspections may occur by a government representative after each treatment. GROUNDS MAINTENANCE SERVICES INTRODUCTION

This Quality Assurance Surveillance Plan (QASP) has been developed to evaluate contractor actions while implementing this PWS. It is designed to provide an effective surveillance method of monitoring contractor performance for each listed objective in the PWS in the maintenance contract.

This QASP is based on the premise the Government desires to maintain a quality standard in operating, maintaining, and repairing facilities and that a service contract to provide the service is the best means of achieving that objective.

The contractor, and not the Government, is responsible for management and quality control actions to meet the terms of the contract. The role of the Government is quality assurance to ensure contract standards are achieved.

In this contract the quality control program is the driver for product quality. The contractor is required to develop a comprehensive program of inspections and monitoring actions. The first major step to ensuring a ¿self-correcting¿ contract is to ensure that the quality control program approved at the beginning of the contract provides the measures needed to lead the contractor to success.

Once the quality control program is approved, careful application of the process and standards presented in the remainder of this document will ensure a robust quality assurance program.

SURVEILLANCE: The Government Contracting Officers

Representative (COR) person will receive complaints from Government personnel and pass them to the contractor's quality control inspector (QCI) for correction.

STANDARD: The government will periodically evaluate the contractor¿s performance in accordance with the Quality Assurance

Surveillance Plan. Inspections may occur by a government representative after each treatment.

PROCEDURES: Any Government employee that observes unacceptable services, either incomplete or not performed, for any of the above performance objectives should immediately contact the

COR/Government Representative (COR) and the COR will complete appropriate documentation to record the complaint. The COR will consider the customer complaint valid upon receipt from the customer.

Inspector (QCI) to pick up the written customer complaint. The QCI will be given two hours after verbal notification to correct the unacceptable performance. If the QCI disagrees with the complaint after investigation of the site and challenges the validity of the complaint, the QCI will notify the COR. The COR will conduct an investigation to determine the validity of the complaint. If the COR determines the complaint as invalid, he will document the written complaint of the findings and notify the customer. The COR will retain the annotated copy of the written complaint for his/her files. If after investigation the COR determines the complaint as valid, the COR will inform the QCI and the QCI will be given an additional hour to correct the customer complaint. A customer complaint will not be recorded if proper and timely correction of the unacceptable condition(s) is accomplished.

The QCI shall return the written customer complaint document, properly completed with actions taken, to the COR, who will file the complaint for monitoring future recurring performance. Recurring customer complaints are not permitted for any of the above service items.

If a repeat customer complaint is received indicating the same deficiency during the service period (month, quarter, etc.), the COR should contact the Contracting Officer for appropriate action.

Electronic Invoicing and Payment Requirements - Invoice Processing Platform (IPP) (April 2013)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. 52.204-24 Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment. (OCT 2020)

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Items. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.

(a) Definitions. As used in this provision-

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to-

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system.

This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to-

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."

(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and

(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(ii) For covered services-

(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained:

Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or

(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:

52.237-1 Site Visit. (APR 1984)

Offerors or quoters are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a

52.237-2 Protection of Government Buildings, Equipment, and Vegetation. (APR 1984)

The Contractor shall use reasonable care to avoid damaging existing buildings, equipment, and vegetation on the Government installation. If the Contractor's failure to use reasonable care causes damage to any of this property, the Contractor shall replace or repair the damage at no expense to the Government as the Contracting Officer directs. If the Contractor fails or refuses to make such repair or replacement, the Contractor shall be liable for the cost, which may be deducted from the contract price.

52.212-2 Evaluation - Commercial Items. (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: best value.

Price Proposal The Government intends to issue a fixed-price contract as a result of this RFQ. Interested parties shall submit one (1) copy of a price proposal that includes the vendor DUNS number and itemizes, at a minimum, the cost per hour for each labor category needed to perform services, chemical costs, equipment

Big Branch Marsh NWR costs, fuel costs, and incidental expenses. Offerors are advised to provide their best and final pricing, including any proposed discounts, upon initial submission. Email offers will be accepted and are preferred over fax or USPS mail.

Technical Proposal The offeror shall provide one (1) copy of the technical proposal. The technical proposal should be prepared simply and economically providing straight forward, concise delineation of capabilities. The information provided shall be factual and complete. Proposals that merely offer to provide supplies as described in the SOW will not receive further consideration for award. The proposal shall also include references.

Technical Experience The Contractor will be selected based on a competitive bid and the contractor’s comprehension of the requirements, the contractor’s ability to complete the assessments, and the experience of the contractor with contracts of similar complexity, as demonstrated in the contractor’s proposal

- Provide references from other similar projects that they have performed.

The factors listed above will be evaluated equally and considered significantly more important than price during the evaluation phase. Award will be made on a firm-fixed price basis. Due to time constraints, the government anticipates awarding this order based on initial proposals. Contractors are strongly encouraged to propose their 'best and final' pricing with the initial proposal.

Technical and past performance, when combined, are significantly more important when compared to price.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
