PERFORMANCE WORK STATEMENT

Custodial Services at Togiak National

Wildlife Refuge 6 Main Street, Dillingham AK 99576

GENERAL: This is a non-personal services contract to provide custodial services within the facilities of US Fish and Wildlife Service (FWS) at Togiak NWR. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the contractor who, in-turn is responsible to the Government.

The square footage provided for flooring types is approximate. It is the responsibility of the contractor to verify the actual area of the various flooring types as required for determination of cleaning supplies, finishes, etc. The Contractor shall furnish all labor and supervision necessary to perform custodial services.

Square footage is as follows:

The first floor office area is approx. 3900 square feet. This includes the lobby, mechanical room, restroom & conference room. Carpeted area is approx. 3000 square feet & 900 square feet of tile flooring.

The second floor office area is approx. 3900 square feet. This includes the lobby, kitchen, restroom & conference room. Carpeted area is approx. 3000 square feet & 900 square feet of tile flooring.

Approximate Period of Performance: The period of performance shall be a base two year period with an optional two year period as follows:

March 1, 2021 to February 28, 2023 - Base Year March 1, 2023 to February, 2025 - Option Year One

DESCRIPTION OF WORK TO BE PERFORMED: Janitorial services as described below are required for the office areas, all restrooms and kitchen areas.

Areas & surfaces shall receive the cleaning, care, and treatment specified at the frequency designated below. The contractor shall perform janitorial services in all designated spaces including, but not limited to offices, lobby, restrooms, kitchen, hallways, and entryways.

Waste receptacles containing food or liquid waste shall be completely emptied to include removing the soiled liner & replacing with a new liner. When the contents of a receptacle are dry (i.e. paper, candy wrappers, or plastic bags) the waste may be removed from the receptacle & deposited in a larger container for disposal, leaving the unsoiled liner.

Cleaning staff are not to do dishes or in any way pick up the clutter left by Refuge employees in any areas list above. Only general cleaning is required. The program’s contact (identified upon contract award) shall be notified the next business day of any areas which could not be properly cleaned due to clutter left by Refuge employees.

No towel or cleaning rag that was ever used in any bathroom will be used in any kitchen or lounge area. Only high temperature machine washed (clean) rags or clean paper towels will be used. No gloves that were ever used in any bathroom will be used when cleaning kitchen.

WEEKLY SERVICES FOR THE HEADQUARTERS BUILDING

Building wide work – one day per week:

(a) Empty all wastebaskets and replace liners.

(b) Clean and sanitize drinking fountains and sinks.

(c) Dust, mop or sweep vinyl floors.

(d) Vacuum all open carpeted areas.

(e) Inspect all floors for spots and stains; remove spots or stains larger than 1” in diameter when they occur.

(f) Remove all trash and transport it to the dumpster located at the Office Building parking lot.

(g) Take all recyclable materials to the recycling center.

(h) Clean and polish all glass at both entryways.

Restrooms:

(a) Check and replenish all dispensers: toilet tissue (leave spare rolls in all bathrooms), paper towels, hand soap, etc.

(b) Thoroughly clean and sanitize bathrooms: sinks, toilets (including but not limited to seat, back edges, floor flanges, handles, and pipe connections), urinals, mirrors (including shelves), partitions, fixtures, countertops, entry door handles and door push plates. All surfaces shall be free of grime, soap scum, mold, mildew, and smudges.

(c) Remove spots, stains, and splashes from wall area adjacent to hand basins, toilets, and urinals.

SEMI-ANNUAL SERVICES FOR THE OFFICE BUILDING

Months of September and March:

(a) Machine shampoo all open carpeted areas.

(b) Vacuum and /or steam-clean all public furniture.

(c) Clean forced-air outlets in ceilings and walls.

(d) Remove dust and cobwebs from ceiling and display areas.

(e) In restroom areas, sanitize all surfaces with the exception of ceilings. This shall include a sanitizing wet and wipe of all floors, walls (floor to ceiling height), fixtures, partitions, doors, handrails, etc.

ANNUAL SERVICES FOR THE OFFICE BUILDING

Month of June:

(f) Strip and wax all vinyl floors. Move chairs, boxes, wastebaskets, coat racks, etc in order to work on floors. Replace all the above to original position upon completion.

(g) Wash windows on the inside and the outside surfaces, including glass in doors. When complete, the window surfaces shall be free of smudges, lint, streaks, film, dirt, and water.

(h) Remove and wash all window screens. When complete, reinstall screens.

(i) Clean all windowsills, casement slots, and edges to remove smudges, lint, streaks, film, dirt, and water.

TIMING OF WORK

Cleaning:

(a) All cleaning shall be accomplished between the hours of 5:00pm and 10:00pm or anytime on weekend days. Carpet shampooing shall be done to allow adequate time for carpet to thoroughly dry.

(b) All cleaning of the Office Building shall be accomplished one (1) day per week, days to be agreed upon between contractor manager and government contracting representative at the beginning of the contract.

Monthly, semi-annual, and annual services:

(a) Monthly and Semi-Annual services can be done on the same day as a normal weekly service.

(b) Semi-annual services should be performed in the months of September and March.

(c) Annual services should be completed in the month of June.

(d) In all cases, coordinate with the program’s local point of contact for dates of either monthly or semi-annual services.

The objective of this contract is to provide clean facilities and a safe and healthy environment for employees and visitors. Specifically:

(a) The contractor shall ensure that the building presents an overall appearance of cleanliness. The definition of clean is to remove dirt, water streaks, gum, grease, tar or any other extraneous matter from all surfaces or objects in order to present an overall appearance of cleanliness.

(b) The contractor shall ensure that the facilities are sanitized and kept free from accumulations of dust.

CONTRACTOR PERSONNEL

For security reason, at the start of this contract the contractor will provide a list of names, addresses and phone numbers of personnel that will be assigned to this contract. The contractor shall have a competent, on-site representative authorized to act on behalf of the contractor if they are not available. The representative shall be available to the program’s point of contact to receive instructions or information regarding work under the contract.

The on-site representative shall provide a phone number where he/she can be contacted.

CONDUCT OF CONTRACTOR EMPLOYEES AND SUB-CONTRACTORS

The contractor shall provide a qualified work force to meet the contract requirements. The contractor’s designated representative or sub-contractor shall be available by telephone to discuss problem areas with the program’s point of contact responding with two days.

The following is expected of the contractor and his/her sub-contractors:

a. The contractor employees and subcontractors shall meet OSHA standards in their methods and conduct.

b. Contractor/sub-contractors shall perform their duties in such a way that there will be no interruption to, or interference with, the normal operation of Government business on the premises.

c. No children will accompany the contractor(s) while performing work.

d. None of the office equipment is available for contractor(s) personal use; to include: telephones, photocopier, fax machine, computers, and other office equipment.

e. Janitor closet is to be kept clean, neat, organized, and free from any odor (i.e. stale wet mops, un-emptied trash cans).

f. All cleaning products shall be environmentally friendly and safe. Cleaning substances that are to be used on an irregular basis for which there are no green alternatives shall be secured in the appropriate custodian closet. All cleaning material secondary containers must be clearly labeled with their contents and with specific safety warnings. Product safety information, MSDS or SDS, shall be provided by the Contractor, employees, or sub- contractor to the COR (by email, mail, or in person) as well as added to the SDS booklets (located in the custodial closets) at the sites where the products are used.

g. All contrator personnel will keep a checklist of completed tasks posted for review by the program’s point of contact. Each checklist should indicate that the task was completed and the date of completion. All tasks should be completed in compliance with the frequency/cleaning schedule for the area listed.

CONTRACTOR FURNISHED EQUIPMENT AND PROPERTY

The contractor shall determine and furnish all equipment required for the performance of work under this contract. All equipment will comply with applicable OSHA guidelines, and shall be in good operating condition. The contractor will operate the equipment in accordance with the original manufacturer's recommendations.

Equipment shall include but is not limited to: buffing, polishing, and scrubbing machines for use on floors, vacuum cleaners, ladders, buckets, mops, cloths, brushes, squeegees, brooms, bulk waste receptacles, rolling trash bins, etc. Equipment used shall be in good operating condition. Electrical appliances shall be equipped with grounded type male plugs of the most suitable grade for the purpose intended. There are spaces available for the contractor to store small equipment and supplies such as vacuum cleaners, cleaning products, etc.

CONTRACTOR SUPPLIES

The contractor shall furnish all cleaning supplies and materials necessary for the performance of work under this contract. Materials include but are not limited to cleaners, dust rags, tile cleaner, polishes and wax. Materials shall be priced into the cost of the weekly, monthly, and semi-annual services, as applicable.

Earth-friendly is defined by Executive Order 13101, Greening the Government through Waste Prevention, Recycling and Federal Acquisition requires items designated by the Environmental Protection Agency (EPA) be purchased with the maximum recycled content possible. The Contractor is required to use products with the highest recovered material content whenever they are commercially available at a reasonable price. The Contractor shall purchase products containing the highest content of recovered material possible unless products are not: 1) available competitively within a reasonable timeframe, or 2) available at a reasonable price. If one of the two exceptions above applies, the contractor shall furnish the program’s point of contact verbal or written notification.

GOVERNMENT FURNISHED MATERIAL AND PROPERTY

The government shall provide at no expense to the contractor, all trashcan liners, hand soap, toilet tissue, and paper towels. The government will also furnish refuse dumpsters outside of buildings and recycling containers, and entry keys for buildings. Failure by the government to provide these shall not relieve the contractor of responsibility to fulfill requirements except those directly affected by such items. Contractor shall keep the program’s point of contact informed of inventory requirements.

STORAGE

There are two janitor closets available under this contract at the Headquarter Building.

No flammables will be stored anywhere on Government premises.

The Government will not be responsible for damage and/or loss to the contractor's stored supplies, materials, equipment, or the personal belongings of the contractor's employees occasioned by fire, theft, accident, or otherwise.

Failure to keep any of the storage facilities described above in a clean and orderly condition, satisfactory to the program’s point of contact, may result in the withdrawal of the privilege of using them.

PAYMENT

Payment for all services will be made on a monthly basis, in arrears, after acceptable completion of such services and submission of a proper invoice, to include certified payroll showing billable hours with hourly wage per Department of Labor Wage Determination if using a subcontractor. The contractor shall submit the monthly invoice via Internet Payment Platform (IPP.gov) at the end of the month.

PERFORMANCE MEETING

The contractor shall contact the program’s point of contact within 3 business days to schedule a meeting upon notification of award of this contract. Whether or not the contractor uses employees or a sub-contractor, the contractor shall attend this meeting. The purpose of this meeting is to review the Performance Work Statement and complete a walk through inspection of each building to delineate work and storage requirements, to provide http://www.epa.gov/cpg/products.htm communication and understanding between both parties. The same meeting is required each time a new sub-contractor is retained. A physical “walk through” for subsequent new employees is required and is the responsibility of the contractor.

Issuance of keys to new subcontractors is the responsibility of the contractor and will be given once all required security paperwork has been completed.

SECURITY CLEARANCE

Access to federal buildings requires a security clearance.

Within seven (7) days of the contract award date, the contractor shall provide all required background information for employees or sub-contractors entering the facilities or when hired as follows:

(a) The Contractor shall provide a list of names, mailing addresses, email addresses, and phone numbers of personnel that will be assigned to this contract (regular and substitute personnel)

(b) a signed resume (complete with references and contact information)

(c) a completed OPM form OF-306; and a DOI-Access/Background Investigation Sheet (to be provided)

(d) an email address is required for each person to accomplish an online portion of the background investigation through the government eQIP system. The contractors employees and sub-contractors are required to complete the eQIP data and fingerprinting requests when asked.

The Contractor or subcontractor will not be provided keys or be granted any access to the buildings until the above paperwork has been provided and the Service’s Human Resources Division (HR) has given approval that it is complete and adequate.

The Contractor shall advise the program’s point of contact immediately of any changes in personnel. The paragraph above (b-d) and HR approval apply to all new subcontractors and employees; access shall not be granted without fulfillment. No person(s) other than those designated in writing, and with an approved background check to the program’s point of contact, shall be permitted in this facility.

GOVERNMENT PERSONNEL

The Contracting Officer is the individual executing this contract on behalf of the Government and is responsible for the administration of the contract. He/she is the only person authorized to make any changes in the prices, terms or other conditions of the contract.

CONTRACTOR PERSONNEL

The Contractor is the individual or company who signs and is awarded the contract. The Contractor may have sub-contractors accomplish the custodial work described by the contract. The contractor shall be available for on-site monthly meetings with the program’s point of contact to discuss performance, do joint site inspections, and receive instructions or information regarding work under the contract; these meeting should last approximately 1-hour. A sub-contractor or on-site employee, who accomplishes the day-to-day work covered in the contract, may not act in this capacity. A sub-contractor must be able to read, write, speak, and understand English to effectively interact with the COR. The Contractor shall provide a phone number where he/she can be contacted and be available to address occasional off-schedule or urgent custodial issues.

ASSESSMENT

The program’s point of contact will monitor the Contractor's performance to ensure compliance with this Performance Work Statement. The Government may use other methods to monitor performance such as random inspections, customer complaints, etc.

When deficiencies are observed the program’s point of contact will notify the Contractor. The Government may require re-performance to correct discrepancies at no additional cost to the Government. The Contractor shall re-perform services within 24 hours of notice by the program’s point of contact. The Government may have services which were not acceptably performed by the Contractor performed by other means and charged back to the Contractor.

DOI ELECTRONIC INVOICING Electronic Invoicing and Payment Requirements – Invoice Processing Platform (IPP) (APR 2013)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. The IPP website address is: https://www.ipp.gov.

Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice:

Itemized invoice for items delivered and/or work performed.

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment.

Vendors new to IPP must enroll at: - https://www.ipp.gov/vendors/enrollment-vendors The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of St. Louis (FRBSTL) within 3 - 5 business days of the contract award date.

(a) Definitions. As used in this provision—

"Covered telecommunications equipment or services" has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

Forced or indentured child labor means all work or service—

Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

Immediate owner means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

Inverted domestic corporation, means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).

Place of manufacture means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

Predecessor means an entity that is replaced by a successor and includes any predecessors of the predecessor.

Reasonable inquiry has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

(3) Consist of providing goods or services to marginalized populations of Sudan;

(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;

(5) Consist of providing goods or services that are used only to promote health or education; or

Sensitive technology—

(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—

(i) To restrict the free flow of unbiased information in Iran; or

Service-disabled veteran-owned small business concern—

Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.

Small disadvantaged business concern, consistent with13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that—

(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by—

(i) One or more socially disadvantaged (as defined at13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and

(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR124.104(c)(2); and

Subsidiary means an entity in which more than 50 percent of the entity is owned—

(1) Directly by a parent corporation; or

(2) Through another subsidiary of a parent corporation

Successor means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term "successor" does not include new offices/divisions of the same company or a company that only changes its name. The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.

Veteran-owned small business concern means a small business concern—

(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and

(2) The management and daily business operations of which are controlled by one or more veterans.

Women-owned small business (WOSB) concern eligible under the WOSB Program (in accordance with 13 CFR part 127), means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States.
