This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a separate written solicitation will not be issued.

U.S. Fish and Wildlife Service, Lakeview, OR has a requirement for Supply of Native Seed Mixes. The anticipated required delivery date is 11/30/2022.

This Request for Quotation (RFQ) is a TOTAL SMALL BUSINESS SET ASIDE and is conducted under the procedures of FAR Parts 12 and 13, incorporating provisions and clauses in effect through Federal Acquisition Circular 2022-07. The NAICS code is 562910 and the small business size standard is 750 employees.

Instructions All responsible small business sources may submit a quote, which shall be considered by the agency.

Award will be made as a firm-fixed-price contract. The basis of award is the Lowest Price. The vendor that submits the lowest priced quote, meeting the specifications in the Statement of Work, will be awarded the contract. Award will be made to a responsible source pursuant to FAR subpart 9.1.

Additionally, if your company holds a GSA contract that would apply to this requirement, please provide the contract number. STATEMENT OF WORK

Supply of Native Seed Mixes

Sheldon – Hart Mountain National Wildlife Refuge Complex

1. General:

1.1. The U.S. Fish & Wildlife Service, Sheldon-Hart Mountain National Wildlife Refuge Complex (PO Box 111, Lakeview, OR 97630; hereafter Complex) has a requirement for supply of three (3) customized native seed mixes for integrated rehabilitation treatments in selected project areas on Sheldon National Wildlife Refuge, northern Washoe County, Nevada.

1.2. Two of the native seed mixes (paragraphs 2.1 and 2.2) will be used in an area burned in a wildfire in 2020 (Sheldon Fire [aka, S-4 Fire]), to reestablish native components in areas damaged during the fire response and to restore and bolster native plant species competition against invasive annual grasses in areas of extreme fire impacts. These mixes will be applied through ground broadcast using ORUV and/or tractor-mounted or drawn equipment.

1.3. The third native seed mix (paragraph 2.3) will be used in areas where encroaching western juniper (Juniperus occidentalis) have been removed from sagebrush-steppe habitats, to bolster native plant species competition against invasive annual grasses. This mix will be applied by hand within ash piles and ancillary burn areas after removed juniper material is prescribed burned.

2. Scope:

2.1. The contractor shall supply a sufficient quantity of the following native seed mixture to apply at 23.5 # PLS per acre to 60 acres:

Mix Total: 23.5 # PLS/acre (60 acres)

2.1.1. This mix shall be referred to as the “SL4 Upper Bench Mix”, such as in labeling.

2.1.2. The “SL4 Upper Bench Mix” is intended to be applied using ORUV and/or tractor-mounted or drawn broadcast seeders to severely burned leeward areas between and along ridges on the upper edge of a basaltic rim, in otherwise intact low sagebrush and big sagebrush habitats.

2.1.3. Intended application area for this mix is between 6,800 – 7,020 feet ASL elevation; with an overall southerly aspect; has variably silt loam/silty clay and generally deeper soils with lots of rock; and receives an estimated 14-18 inches of precipitation per year on average.

2.2. The contractor shall supply a sufficient quantity of the following native seed mixture to apply at 26.5 # PLS per acre to 50 acres:

Mix Total: 26.5 # PLS/acre (50 acres)

2.2.1. This mix shall be referred to as the “SL4 West Toe Filler Mix”, such as in labeling.

2.2.2. The “SL4 West Toe Filler Mix” is intended to be applied using ORUV and/or tractor-mounted or drawn broadcast seeders to a severely burned, transitional steppe/toe slope area between a basaltic rim and a playa basin. The intended application area had been late seral Wyoming and basin big sagebrush vegetative habitats with reduced to limited understories prior to the fire, and now has fair forb response but limited native bunchgrass. The area has received an initial seed application but requires follow-up efforts to “fill-in” ecological gaps, especially in the native bunchgrass components.

2.2.3. Intended application area for this mix is between 5,535 – 5,740 feet ASL elevation; with a WNW to NNW aspect; soils range from silty loess to silt loam/fine sandy loam; and receives an estimated 8-12 inches of precipitation per year on average.

2.3. The contractor shall supply a sufficient quantity of the following native seed mixture to apply at 25.5 # PLS per acre to 95 acres:

Last Chance Juniper Mix:

Mix Total: 25.5 # PLS/acre (95 acres)

2.3.1. This mix shall be referred to as the “Last Chance Juniper Mix”, such as in labeling.

2.3.2. The “Last Chance Juniper Mix” is intended to be applied by hand to ash piles and any ancillary burn areas following prescribed burning of previously piled encroaching juniper material. The targeted project area is primarily a mix of relatively intact low sagebrush, Wyoming big sagebrush, and mountain big sagebrush/mountain shrub vegetative communities in an area dominated by basaltic tablelands and drainages.

2.3.3. Intended application areas for this mix are between 5,745 – 6,345 feet ASL elevation; predominantly with ENE to NE aspects, although with some areas of SSW aspects (these tend to be the mountain big sagebrush/mountain shrub communities); soils range from silty loess to shallower silt loam/silty clay with scattered areas of fine sandy loams, and are all rocky to very rocky or are otherwise stony; and the areas receive an estimated 10-14 inches of precipitation per year on average.

2.4. The seed mixes shall be supplied in individually labeled 50-pound sacks (standard poly, cotton, or heavy paper), for field transport and hand-loading of ORUV and/or tractor-mounted broadcast seeder hopper(s).

2.5. Seed material shall meet the following requirements:

2.5.1. Native seed will be required to be “source identified.” The source for native plant material should be as close to Sheldon National Wildlife Refuge as possible, to include (but not necessarily limit to) geographic location, elevation, and climactic conditions. Seeds must have their origin in this area, unless otherwise cleared through the Technical Coordinator(s). Per US Fish & Wildlife Service policy, unless sufficient justification can be provided to counter the policy at the Service’s discretion, all plant materials must be adapted to the conditions of the site and it is necessary to acquire seed that has the best chance of germinating to achieve rehabilitation goals.

2.5.2. Seed shall be certified “weed free”, indicating there are no noxious weeds in the seed.

2.5.3. Seed supply should be based on pure live seed (PLS) per pound, based upon purity and germination testing.

2.5.4. All species provided through this contract will be from the harvest year of 2022. All seed will be required to have been tested within 120 days of sale for purity, germination, and noxious weed content.

Seed certification tag without testing documentation will not be accepted. Inert matter will not exceed 10%.

3. Deliverables:

3.1. Prior to delivery, contractor shall provide to the Technical POCs electronic copies of the results of purity, viability (germination and/or TZ test(s)), weed test (including all-states noxious weed analysis), and crop and weed test(s). Information is required for all seed lots.

4. Delivery:

4.1. Seed is to be delivered to Hart Mountain National Antelope Refuge headquarters, 38782 Hart Mountain Road, Plush, OR 97637. Map coordinates are 42° 32.947’ N and 119° 39.292’ W (WGS84). Refuge headquarters is located at a junction on a long, rough, steep and winding gravel road. Access can be hard on equipment and vehicles. Contractor(s) are strongly encouraged to take adequate preparation and precautions when traveling to the Refuge headquarters.

4.1.1. Loading docks are not available.

4.2. Seed delivery is anticipated to be on or about November 1, 2022, but no later than November 30, 2022. Actual delivery date(s) for seed will be dependent upon local weather conditions and availability of Complex personnel; contractor shall coordinate actual delivery dates with the Technical Coordinator.

4.2.1. Seed shall be delivered between Monday thru Friday from 8:00 AM to 4:30 PM (PST), except Federal Holidays.

4.2.2. Contractor shall contact the Technical POCs at least 48 hours prior to delivery to ensure Government staff and equipment will be available to receive and inspect delivery.

5. Evaluation and Acceptance:

5.1. Seed will be inspected and inventoried upon delivery by the Technical POC or their designee. Government acceptance is contingent upon the following:

5.1.1. Results of purity, viability (germination and/or TZ test(s)), weed test (including all-states noxious weed analysis), and crop and weed test(s);

5.1.2. All delivered bags being individually labeled with the contained mix (see paragraphs 2.1.1, 2.2.1, 2.3.1, 2.4, and 2.5.1 of Statement of Work);

5.1.3. Condition of delivered seed; and

5.1.4. Completeness of order.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. Local Clauses

USFWS R7 Environmentally Preferable and Energy-Efficient Products and Services Policy

Whenever cost effective, the contractor should provide products and/or services that are energy efficient, promote water conservation and are bio-based. The use of nonhazardous and recovered materials is encouraged.

Electronic Invoicing and Payment Requirements – Invoice Processing Platform (IPP)

Payment requests must be submitted electronically through the U.S. Department of the Treasury’s Invoice Processing Platform System (IPP).

“Payment request” means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions – Commercial Items included in commercial item contracts. Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice:

1. Invoice billed according to contract line items and rates.

2. If final payment is billed, the last invoice shall state “FINAL”

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contract (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) prior to the contract award date, but no more than 3 – 5 business days of the contract award date.
