I. This is a solicitation for commercial items prepared in accordance with the format in Subpart 12.6. This is a combined synopsis/solicitation and this announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. This solicitation is issued as a Request for Quote (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2021-04, Effective 19 January 2021.
II. This procurement is for five (5) customized native seed mixes for the U.S. Fish & Wildlife Service, Sheldon-Hart Mountain National Wildlife Refuge Complex, Lakeview, OR.
III. This requirement is being procured in accordance with FAR Part 12, Acquisition of Commercial Items; and in accordance with FAR Part 13, Simplified Procedures for Certain Commercial Items. This requirement is being solicited as full and open competition with small business set-aside. The NAICS Code associated with this requisition is 113210 with a small business size standard of $12M. Buyer intends to issue a firm-fixed price Purchase Order (PO).
Delivery Date: November 30, 2021.
IV. Offerors are cautioned that the Contracting Officer (CO) is the only authorized Government Representative who can make contractual changes once an award is made. No unauthorized person(s) shall make any commitment, in any form or manner that will modify or otherwise affect the terms and conditions of the contract. In the event the contractor effects any such change at the direction of any unauthorized person, the change shall be considered to have been made without authority and no adjustment shall be made to the contract price to cover any increased costs incurred as a result thereof.
V. Government Representative (GR): Authorized Government Point of Contact for this order is Kevin Goldie, Kevin_Goldie@fws.gov. Kevin does not have the authority to make any changes to the PO.
VI. Description: Prospective bidders shall bid on per ton of the following line item based on the information provided in the specifications. Quote shall be submitted on a cost per ton basis to include delivery charges.
VII. Delivery Location: Hart Mountain National Antelope Refuge headquarters, 38782 Hart Mountain Road, Plush, OR 97637. Map coordinates are 42° 32.947’ N and 119° 39.292’ W (WGS84). Refuge headquarters is located at a junction on a long, rough, steep and winding gravel road. Access can be hard on equipment and vehicles, in addition loading docks are not available.
The contractor shall provide the Wildlife (Habitat) Biologist, Kevin Goldie Sheldon-Hart Mountain NWR Complex, PO Box 111, Lakeview, OR 97630; 541-947-3315; kevin_goldie@fws.gov with notice at least 48 hours prior to delivery to ensure Government staff and equipment will be available to receive and inspect delivery.
Deliveries shall be made between Monday thru Friday from 8:00 AM to 4:30 PM (PST), except Federal Holidays. The designated Government Inspector will inspect and inventory upon delivery by the Technical POC or their designee. Government acceptance is contingent upon the following:
- Results of purity, viability (germination and/or TZ test(s)), weed test (including all-states noxious weed analysis), and crop and weed test(s);

- All delivered bags being individually labeled with the contained mix (see paragraph of Specifications);
- Condition of delivered seed; and
- Completeness of order.

XI. RFQ Due Date: Telephone quotes will NOT be accepted. All quotes must be received at this office no later than August 20, 2021, 12:00 PM Local Eastern Time. ONLY EMAILED QUOTES WILL BE ACCEPTED. Email to joni_dutcher@fws.gov. Reference/subject: solicitation number. Quotes should be attached document that is either Microsoft Word compatible or PDF. The anticipated award date is on or about August 30, 2021. Please do not request award status prior to this date.

Requirement is to demonstrate similar requirements. Show at least a total of 3 years of related experience. (Maximum 4 pages)
Any offeror who demonstrated unsatisfactory past performance shall not be considered eligible for award.
If the Government does not obtain past performance information for the projects identified by the offeror and cannot establish a past performance record for the offeror through other sources, or if the offeror has no past performance record proposed for this project to cited past performance will be evaluated neither favorably nor unfavorably.

Note: Offerors that cannot provide past performance information must provide a statement citing no past performance and provide explanation on their company ability to effectively meet the requirements with no past experience. (d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. CONTRACTOR PERFORMANCE ASSESSMENT REPORTING SYSTEM (JUL 2010)
(a) FAR 42.1502 directs all Federal agencies to collect past performance information on contracts. The Department of the Interior (DOI) has implemented the Contractor Performance Assessment Reporting System (CPARS) to comply with this regulation. One or more past performance evaluations will be conducted in order to record your contract performance as required by FAR 42.15.
(b) The past performance evaluation process is a totally paperless process using CPARS. CPARS is a web-based system that allows for electronic processing of the performance evaluation report. Once the report is processed, it is available in the Past Performance Information Retrieval System (PPIRS) for Government use in evaluating past performance as part of a source selection action.
(c) We request that you furnish the Contracting Officer with the name, position title, phone number, and email address for each person designated to have access to your firm's past performance evaluation(s) for the contract no later than 30 days after award. Each person granted access will have the ability to provide comments in the Contractor portion of the report and state whether or not the Contractor agrees with the evaluation, before returning the report to the Assessing Official. The report information must be protected as source selection sensitive information not releasable to the public.
(d) When your Contractor Representative(s) (Past Performance Points of Contact) are registered in CPARS, they will receive an automatically generated email with detailed login instructions. 52.212-2 Evaluation - Commercial Items. (OCT 2014)
(a) The Government intends to award a Purchase Order resulting from this solicitation to the responsible offer conforming to the solicitation requirements contained within that provides the Best Value/Trade-off.
At the discretion of the Contract Specialist, the Government intends to evaluate quotes and award a PO without discussions with offerors but reserve the right to conduct discussions if deemed necessary.
The following factors will be used in the technical evaluation process listed in the descending order of importance: 1. Technical Requirements, 2. Past Performance, and 3. Price. Non-price evaluation factors are significantly more important than price.
1. Initial Review of quote will check for completeness of solicitation requirements as identified in section XIII; “All interested Contractors shall provide a quote as follows:”
2. Quotes will be evaluated using Best Value/Trade-off. Each area of the Contractor’s Quote will be reviewed and rated. Contractor with the Best-value to the government will be awarded the PO.

1) Technical
a) Meets identified specification
i) Native seed will be required to be “source identified.” The source(s) for native plant material for the PKF Juniper, PKF Broken Basalt, and PKF Rock Creek Filler mixes should be as close to Hart Mountain National Antelope Refuge 38782 Hart Mountain Road, Plush, OR 97637 as possible, to include (but not necessarily limited to) geographic location, elevation, and climatic conditions. The source(s) for native plant material for the SL4 Dozer Line and SL4 West Toe mixes should be as close to Sheldon National Wildlife Refuge as possible, to include (but not necessarily limited
to) geographic location, elevation, and climatic conditions. Seeds must have their origin in this area, unless otherwise cleared through the Technical Coordinator(s).
Per US Fish & Wildlife Service policy, unless sufficient justification can be provided to counter the policy at the Service’s discretion, all plant materials must be adapted to the conditions of the site and it is necessary to acquire seed that has the best chance of germinating to achieve rehabilitation goals.
ii) Seed shall be certified “weed free”, indicating there are no noxious weeds in the seed.
iii) Seed supply should be based on pure live seed (PLS) per pound, based upon purity and germination testing.
iv) All species provided through this contract will be from the harvest from year of 2021.
All seed will be required to have tested within 120 days of sale of purity, germination, and noxious weed content. Seed certification tag without testing documentation will not be accepted. Inert matter will not exceed 10%.
