The Department of the Interior (DOI)/Interior Business Center (IBC), Acquisition Services Directorate (AQD) on behalf of the Appraisal and Valuation Services Office (AVSO) and the U.S. Fish and Wildlife Service (FWS), is issuing a request for quotation for market valuation and appraisal services for AVIS Case Name: Flathead County WPA; AVIS Case Number: F230105; AVIS Project Number: 00215222.

SOLICITATION/AWARD PROCEDURES

This Request for Quote (RFQ) is issued in accordance with the Federal Acquisition Regulation (FAR) Part 12, the acquisition of commercial items and FAR Part 13 Simplified Acquisition Procedures.

TECHNICAL QUALIFICATION FOR REQUIREMENT

The quotation shall include all the following information:

FACTOR A: TECHNICAL QUALIFICATIONS

1. State Certification: The appraiser must hold a valid license as a Certified General Appraiser by the State of Montana as demonstrated by a copy of the State Licensing Certificate or have the ability to obtain a temporary practice permit for the State of Montana. If the appraiser is licensed in another state and applying for a license in the subject jurisdiction, he/she must provide a copy of his/her current state license. (A temporary license must also be provided by the contracted appraiser and included in the addenda of the appraisal report.)

2. Technical Acceptability:

a. Experience for Assignment: Both geographical competency and technical competency will be considered. The contractor shall provide a standard Appraiser's Statement of Qualifications and a signed quotation letter that describes and attests to the following:

1. Please provide a summary of your years of experience appraising vacant agricultural use tracts similar to the subject property within the general market area, and/or similar market areas, to include site size range and improvement types.

2. Please provide a summary of your experience appraising agricultural use tracts encumbered by a perpetual easement similar to the subject property within the general or similar market area, to include site size and use type.

3. Please provide a summary of your years of experience appraising lands for federal acquisition under

UASFLA guidelines. If none, please state such.

4. Completion of a course in UASFLA is required for this assignment. Please provide a statement indicating whether a course has been completed, including the year of completion.

b. Qualifications of Associate Appraisers: Sub-contracting of this assignment is not permissible.

Any associates expected to contribute to the appraisal must be identified in the quote and a statement of qualifications and a copy of their license or permit must be provided.

c. Initial Delivery Date: Target date for initial delivery of the appraisal reports to the AVSO

Reviewer is within 200 days from the date of engagement. Earlier delivery is preferable and will be given consideration but is not a requirement.

FACTOR B – PAST PERFORMANCE

1. Past Performance

a. Submit a list of at least two (2) of the most recent UASFLA-compliant appraisal reports completed. Include property type, size of property, date of value, location, and the client contact information for reference purposes. If none completed, please state such.

b. Submit a list of at least two (2) of the most recent appraisal reports completed for agricultural land with or without improvements and two (2) of the most recent appraisals completed for partially or completely encumbered agricultural land or appraisals of conservation easements.

Include property type, size of site, date of value, location, and the client contact information for reference purposes.

FACTOR C – PRICE QUOTE

A. The Quoter must provide a firm-fixed price quote with any and all discounts applied for all the work to complete the assignment described in the Statements of Work (SOWs).

B. Price quotes will be evaluated for completeness and reasonableness.

EVALUATION OF QUOTATIONS:

FAR 52.212-2 Evaluation-Commercial Products and Commercial Services (Nov 2021)

a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Award of this Contract will be made on a Best Value/Trade Off basis. The following factors shall be used to evaluate offers: State Certification, Technical Acceptability, Past Performance and Price.

State Certification, Technical Acceptability and Past Performance, when combined, are more important than cost or price.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Further past performance determinations in federal contracting shall be made through a review of relevant information listed within the System of Award Management (SAM) and the Contractor Performance Assessment Reporting System (CPARS).

• All offerors are required to have an active Unique Entity Identifier (UEI) and be registered in www.SAM.gov prior to submission of quotation. **Note, the UEI replaced the DUNS number on April 4, 2022.

SECTION 1: CASE PROPERTIES

Case Name: Flathead County Waterfowl Production Area, Northwest Montana Wetland Management District F230105

Requested Service: Market value appraisal

Location: Flathead County, Montana

SECTION 2: SUBJECT OF THE APPRAISAL

Property Description: The Appraisal and Valuation Services Office (AVSO) is requesting a market value appraisal to be used for the acquisition of two non-contiguous tracts totaling 2,431.81 acres, more or less. The property is located approximately 20 miles northwest of Marion and Highway 2 via Pleasant Valley Road. The proposed acquisition adjoins the Lost Trail National Wildlife Refuge.

Legal Description: Please refer to the attached title commitment for the legal description.

Ownership: Provided upon award

Latitude / Longitude 48.182593° / -114.990745°

Property Rights Appraised: Fee simple subject to outstanding rights and/or reservations

Outstanding Rights and/or Reservations:

The appraisal is to consider the exceptions noted in the title commitment documents.

Any recorded or unrecorded documents, conditions, agreements, easements and/or encumbrances discovered must be identified and discussed in the appraisal report in relation to their impact on value.

1,812.304 acres of the property is subject to a Wetlands Reserve Easement in perpetuity. Easement document will be provided upon award.

A year-to-year grazing lease covers much of the subject property in addition to adjacent ranchland. The terms and legal description are included as an attached exhibit.

Access: The property reportedly has legal and physical access. The appraiser must verify the subject’s access as part of the appraisal process.

Water Rights: Owned water rights, if any, are to be included in the appraisal.

Minerals: Owned mineral rights, if any, are to be included in the appraisal.

Real Property Improvements: There appears to be an older farmstead with associated barn and outbuildings located on the property. All real property improvements are to be included in the appraisal.

Personal Property: Personal property must be disregarded for purposes of the appraisal.

SECTION 3: APPRAISAL PROBLEM IDENTIFICATION

Client: AVSO

Intended Users: AVSO and FWS, on behalf of the United States of America

Intended Use: The appraisal report will be used to assist the FWS in its determination of the amount to be paid as just compensation for the property rights acquired. The appraisal report is not intended for any other use. (UASFLA 1.2.3, pg. 10)

Type of Value: Market Value

Definition of Market Value: The Uniform Appraisal Standards for Federal Land Acquisitions (UASFLA) defines market value as follows:

Market value is the amount in cash, or on terms reasonably equivalent to cash, for which in all probability the property would have sold on the effective date of value, after a reasonable exposure time on the open competitive market, from a willing and reasonably knowledgeable seller to a willing and reasonably knowledgeable buyer, with neither acting under any compulsion to buy or sell, giving due consideration to all available economic uses of the property.

Effective Date: The effective date must be no later than 30 calendar days prior to the submission of the completed appraisal report, unless the AVSO review appraiser approves in advance other conditions in writing.

SECTION 4: ASSIGNMENT CONDITIONS

Applicable Standards / Law Regulation and Policy:

The standards applicable to this appraisal assignment include:

- Uniform Appraisal Standards for Federal Land Acquisitions (UASFLA), 6th Edition, and the

- Uniform Standards of Professional Appraisal Practice (USPAP), 2020-

2021 edition.

The appraisal must conform to the following laws, regulations, and policies:

- Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (PL 91-646) as amended. Federal Regulations 49 CFR, Part

Extraordinary Assumptions: None. If the appraiser determines that extraordinary assumptions are necessary, the appraiser must contact the AVSO review appraiser for prior written approval.

Hypothetical Conditions:

None. If the appraiser determines that hypothetical conditions are necessary, the appraiser must contact the AVSO review appraiser for prior written approval.

Jurisdictional Exceptions: The appraiser has been instructed to produce a UASFLA compliant appraisal.

Section 1.2.4 of UASFLA states that “appraisers should not link opinions of value under these Standards to a specific opinion of exposure time.” USPAP requires the appraiser to develop and report a reasonable exposure time if it is a component of the definition of market value, which contravenes the UASFLA. Therefore, the appraiser should invoke USPAP’s Jurisdictional Exception Rule.

Pre-Work Meeting: A meeting with the appraiser will be conducted prior to the inspection of the property. The purpose of the meeting will be to discuss the Statement of Work. The meeting may occur at the property at the time of the inspection or by teleconference. If by teleconference, the AVSO review appraiser will coordinate the date and time with the appraiser.

Highest & Best Use / Larger Parcel Analyses:

Upon completion of the Highest and Best Use and Larger Parcel analyses, the contract appraiser must discuss the conclusions with the review appraiser.

SECTION 5: APPRAISAL REQUIREMENTS AND INSTRUCTIONS

1. If applicable, strict compliance with UASFLA Sections 1.5.2.1, 1.5.2.4, and Appendix E is required.

2. The AVSO Statement of Work, engagement letter, and other assignment instructions must be included in the addenda to the appraisal report. Reference to these documents should be provided in the body of the report.

3. The appraisal report should conform to the sequence and content described in Section 2 of the UASFLA.

4. If including any proprietary information in the appraisal, the appraiser must gain concurrence from the AVSO review appraiser and deliver the proprietary information in a separate binder.

5. When the appraiser has performed any services regarding the subject property within the prior three years, he/she must disclose this to the AVSO review appraiser prior to engagement.

6. AVSO is the appraiser's sole client. The appraiser may not communicate assignment results to any party except

AVSO, unless authorized to do so in writing by AVSO.

7. If the appraiser discovers material facts which differ from those provided by AVSO or encounters circumstances which prevent the appraiser from developing an unbiased appraisal, the appraiser must contact the AVSO review appraiser for instructions.

8. Any communication with the bureau realty contact or property owner shall include the assigned AVSO review appraiser.

9. Even though communication is encouraged with the property owner and FWS, only the assigned AVSO review appraiser can modify appraisal instructions (in writing).Any communications between AVSO (Client) and the contract appraiser that pertain to the appraisal review (i.e., review questions, comments, concerns, etc.) are confidential. Disclosure of these communications requires the written approval of the Client. This appraisal assignment will be an engagement between the appraiser and AVSO, the appraiser’s client. The appraiser must address any questions regarding appraisal instructions and/or technical requirements for the appraisal with the AVSO review appraiser. Appraisal assignment contacts are included in Section 7 of this Statement of Work.

SECTION 6: PERFORMANCE / DELIVERABLE REQUIREMENTS

Appraisal Consultation: Before determining opinions of value, the appraiser must provide the Review Appraiser the draft Highest and Best Use and Larger Parcel analyses.

Draft Appraisal Report Due: Best offer (unlocked PDF format)

Review & Comments Provided: Not later than 30 calendar days after receiving initial appraisal report.

Final Appraisal Due: Not later than 10 calendar days after final draft approval.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement.

Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)

(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1), in a subcontract for commercial products or commercial services. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-
