SECTION 1:

I. This is a combined synopisis/soliciation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued.

II. This action is being processed in accordance with FAR Part 12 and FAR Part 13. The solicitation number is 140D0423Q0818 for a Maintenance Assistant at the Museum of the Plains Indian in Browning, Montana on the Blackfeet Reservation. This solicitation is issued as a Request for Quote (RFQ). The solicitation will result in the award of a Firm Fixed Price Purchase Order. The Acquisition Services Directorate of the Department of the Interior, on behalf of the Indian Arts and Crafts Board (IACB), is issuing this combined solicitation/synopsis for the purpose of entering into a Purchase Order after receipt and evaluation of quotes.

III. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular Number 2023-04, dated June 2, 2023.

IV. This requirement is a Total Small Business set-aside. The NAICS code is 561210 – Facilities Support Services, and the size standard is $47M.

VI. Description of the requirements for the services to be acquired: See Statement of Work in Section 2.

VII. The Period of Performance shall be 2,160 hours or approximately 12 months.

VIII. The provision at FAR 52.212-1, Instructions to Offerors—Commercial, applies to this acquisition. See Page 45 for the reference.

IX. The provision at FAR 52.212-2, Evaluation—Commercial Items, applies to this acquisition. See Page 25 for full text of the provision, along with the specific evaluation criteria to be included.

SECTION 2:

Statement of Work

REQUIREMENTS

The Indian Arts and Crafts Board (IACB)/Museum of the Plains Indian (MPI) is located in Browning, Montana on the Blackfeet Reservation. The IACB/MPI employs three full time staff who are responsible for handling museum visitors, collections care, changing promotional Indian arts exhibitions, grounds upkeep, and the general repair of the facility.

The IACB/MPI has a requirement for (1) one Contractor Provided Full Time Employee Maintenance Worker Maintenance Assistant, hereinafter referred to as Maintenance Assistant to work the duties outlined below. The Contractor must be able to provide at least one qualified Maintenance Assistant to perform the duties at the MPI from 8:00AM through 5:00 PM – 5 (five) days a week, an 8-hour workday, with a one-hour break for lunch.

The total contract is for 2,160 hours or roughly 12 months. The work shall begin upon award of contract and the selected Maintenance Assistant has a favorable clearance from the required DOI background check. The work will end after 2,160 hours have been performed or approximately July 31, 2024.

SPECIFIC TASKS

Maintenance Worker Assistant

The Contractor shall provide a Maintenance Assistant who reports to and works in the MPI located at 19 Museum Loop Rd, Browning MT, 59417.

Under the supervision and training of the Maintenance Worker, the Maintenance Assistant will perform the following duties:

1. Mow museum lawn, minor trimming of bushes and trees, edging of sidewalks and curbs, and other landscaping duties as assigned.

2. Clean museum restrooms, clean glass and plexiglass exhibit cases, sweep and mops museum galleries, take out trash from museum building, picking up trash from museum law, and other janitorial duties as assigned

3. Collect garbage and refuse from museum grounds and parking lot and dispose trash in appropriate receptacle.

4. Assist the Maintenance Worker with routine electrical, plumbing, and HVAC work.

5. Assist the Maintenance Worker with basic carpentry and painting tasks.

6. Assist with the removal of snow during the winter months.

7. Assist with special maintenance projects as assigned like fence repair, concrete repair, drywall/plaster repairs, and moving equipment and exhibit cases.

The Maintenance Assistant is responsible for reporting any issues or concerns to the on-site museum staff and take any appropriate direction concerning these issues as directed by the staff.

If the Maintenance Assistant cannot perform the work duties on a particular day the Contractor and/or Maintenance Assistant shall notify the on-site contact and the Contracting Officer’s Representative (COR) via email no later than 9am local time. If for some reason email is not available a call should made and voice message left with the on-site contact and COR, no later than 9am local time.

If the museum has an unscheduled closure on a workday the Museum Curator will contact the Contractor and Maintenance Assistant to inform them as soon as they become aware of the closure (closure could be due to lack of museum staff, no power or other issues effecting the operation of the museum).

Days and Hours of work

July 17 through September 30, 2023 the days of work will be Tuesday through Saturday from 8am to 5pm with 1 hour for lunch.

October 1, 2023 through May 31, 2023 the days of work will be Monday through Friday from 8am to 5pm with 1 hour for lunch.

June 1 through July 31, 2024 the days of work will be Tuesday through Saturday from 8am to 5pm with 1 hour for lunch.

The MPI is open Tuesday through Saturday from June 1 - September 30 and Monday through Friday from October 1 – May 31. There is no work on Federal holidays. Federal holidays are September 4, October 9, November 10, November 23, December 25, 2023 and January 1, January 15, February 19, May 27, June 19, and July 4, 2024.

Minimum Qualifications

The Maintenance Assistant selected to work at the museum must demonstrate one year of previous work, including volunteer work, in a maintenance, construction, and/or landscaping field. Relevant experience could include but is not limited to mowing lawns, repairing sprinkler systems, janitorial duties, plumbing experience, electrical experience, HVAC experience, and carpentry.

Employee Timesheets

Monthly Timesheet for Contractor Employees

Daily Timesheets of the Contractor’s Maintenance Assistant working hours for each month shall be submitted with the month end invoice. Timesheets are required to be signed by the Maintenance Assistant and Contractor supervisor. Timesheet can be in Contractor format.

The timesheets shall be emailed to the COR at the end of the month.

KEY PERSONNEL

The Contractor shall submit resumes for the key personnel listed below; the contractor shall also provide the necessary certifications/ credentials for the Contractor personnel identified below.

- MPI Maintenance Assistant

If the personnel proposed in the key position are replaced, the resume of their successor shall be submitted to the Contracting Officer (CO) and COR for evaluation. The Government retains the sole right to reject a proposed a key person based upon its assessment of the key person’s capabilities. In the event of a rejection the Contractor shall provide the Government with a resume for a different candidate for evaluation.

Tribal Permits

The Contractor shall obtain all necessary permits needed to conduct business on the Blackfeet Reservation within five (5) days upon award of contact. Contract may contact the Blackfeet Tribal Employment Rights Office (TERO) at (406) 338-7887, https://btero.com/ to obtain permits. The Blackfeet TERO is located at 65 Hospital Road, Browning, MT 59417.

CONTRACTOR START UP REVIEW (Kick-Off Meeting)

Within 5 business days of award of contract and prior to performance, the COR, MPI Curator, and Senior Curator meet to discuss the work.

APPLICABLE CLAUSES AND PROVISIONS

ACQUISITION SERVICES DIRECTORATE (AQD) CUSTOM CLAUSES

CUSTOM CLAUSE # 1 - NOTICES TO THE GOVERNMENT OF DELAYS OR NON-COMPLIANCE

WITH DELIVERY SCHEDULES

The Contractor must immediately notify the Contracting Officer or designated representative when delays exceeding 1-business day are expected, and in the following cases:

1. When the Contractor anticipates difficulty in complying with the purchase order delivery schedule or date, and

2. When the Contractor has knowledge that any actual or potential situation is delaying, or threatens to delay, the timely performance of this purchase order.

In cases of delays that are under 1 business day and/or in cases when the Contractor is unable to comply with the delivery schedule, the Contractor must immediately notify the Contracting Officer or designated representative by phone. These notifications shall be informational in character and this provision shall not be construed as a waiver by the Government of any delivery schedule or of any rights or remedies provided by law or under this purchase order.

The Contractor will not be liable for failure to perform services where such failure is caused, directly or indirectly, by: (i) a strike, (ii) an act of God, or (iii) circumstances beyond the control of the Contractor.

CUSTOM CLAUSE # 2 - INVOICING

Electronic Invoicing and Payment Requirements – Internet Payment Platform (IPP) (Apr 2013)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP). Monthly invoicing is allowed.

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice.

INVOICE CONTENTS:

Invoices must include, as a minimum, the following information:

The contractor is responsible for ensuring invoices submitted are accurate and complete, and all labor, travel and other direct costs are in accordance with federal guidelines, the FTR and other Government mandates and directives.

Additional supporting documentation MAY BE REQUESTED at the discretion of the COR or CO.

PAYMENT:

a. Payments under this order will be due 30 calendar days after the date of actual receipt of proper invoice in the office designated to receive the original invoice or final acceptance of the goods or services, whichever is later.

b. The date of the check issued in payment or the date of payment by wire transfer through the Treasury Financial Communications System shall be considered to be the day payment is made.

Final Invoice:

Within sixty calendar days of product acceptance and/or completion of services:

a. The contractor shall submit a final invoice, designated as such by a clear statement of “FINAL

INVOICE” on the face of the invoice document.

b. The contractor shall provide a certificate of completion which certifies all goods and service have been provided as required by this task order.

c. The contractor shall provide a release of claims against the government for any further payment under this task order.

The sixty-calendar day submission timeframe shall not be extended without written authorization from the Contracting Officer. In the event items a, b, or c above are not submitted within the authorized timeframe, the contracting officer will make final cost determinations in order to make final payment and close out the contract unilaterally.

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment.

The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) prior to the contract award date, but no more than 3

- 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.

If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)

(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1), in a subcontract for commercial products or commercial services.
