SECTION 1:

I. This is a combined synopisis/soliciation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued.

II. This action is being processed in accordance with FAR Part 12 and FAR Part 13. The solicitation number is 140D0423Q0570 for Unarmed Security Guard services at the Museum of the Plains Indian in Browning, Montana, on the Blackfeet reservation. This solicitation is issued as a Request for Quote (RFQ). The solicitation will result in the award of a Firm Fixed Price Purchase Order. The Acquisition Services Directorate of the Department of the Interior, on behalf of the Indian Arts and Crafts Board (IACB), is issuing this combined solicitation/synopsis for the purpose of entering into a Purchase Order after receipt and evaluation of quotes.

III. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular Number 2023-02, dated 03/16/2023.

IV. This requirement is a Total Small Business set-aside for Indian Small Business Economic Enterprises (ISBEE). The NAICS code is 561612, Security Guard and Patrol Services, with a size standard of $29M.

VI. Description of the requirements for the services to be acquired: See Statement of Work in Section 2.

VII. The Period of Performance shall be May 30, 2023, through September 30, 2023

SECTION 2:

Statement of Work

BACKGROUND

The Indian Arts and Crafts Board (IACB)/Museum of the Plains Indian (MPI) is located in Browning, Montana on the Blackfeet Reservation. The IACB employs three full time staff who are responsible for handling museum visitors, collections care, changing promotional Indian arts exhibitions, grounds upkeep, and the general repair of the facility. During May through September, the area sees an increase in tourism due to nearby Glacier National Park.

REQUIREMENT

The IACB/MPI has a requirement for an unarmed Security Guard(s). The Security Guard shall be at the MPI Tuesday through Saturdays beginning May 30 through September 30, 2023. The Security Guard(s) must be present during each day from 8:30am to 5pm, for a total of 765 hours.

*The museum will be closed each Sunday and Monday, with the exception of July 16, 2023, when the museum will remain open for North American Indian Days.

The Contractor shall furnish an unarmed security guard with knowledge, skills, and abilities in infrastructure protection to guard MPI from threats until law enforcement resources arrive. The Contractor shall perform to the standards required in this contact and as follows:

• Control entrance to critical areas - Enforce all building access procedures according to the MPI procedures.

• Roving Patrol Posts - Make routine patrols in accordance with the route and schedule established in the Post Orders and provide breaks when necessary.

- Location/Station at MPI: The MPI Security Guards’ main post station will be in the lobby area of Museum of the Plains.

- Patrol area: The MPI Security Guard will patrol the public areas in and around the Museum of the Plains Indian Museum building, yard, and parking lot.

- Time/Frequency: The MPI Security Guard will patrol these public areas every half hour and report any urgent security issues or problems.

• Public Order - Maintain public order within the area of the assignment as needed.

• Unauthorized Access - Discover and prevent persons from attempting to gain unauthorized access into the MPI, or designated areas within the building.

• Disorderly/ Unruly Patrons - Any problems or difficulties encountered (e.g., disturbances in the lobbies, unruly visitors, disorderly contractors/employees) shall immediately be reported to the on-site MPI staff.

• Monitor Building Rules and Regulations – Observe and enforce compliance with posted rules, regulations, for visitors.

• Panhandling - Monitor Museum grounds for panhandling activity and direct individuals engaged in panhandling to leave the museum property. Contact local law enforcement in the event that panhandlers do not leave museum property.

• Respond to injuries and illnesses - In the event of injury or illness to visitors or Government employees while in the building or on the grounds, obtain professional assistance in accordance with procedures in the Post Orders book, which will be provided upon award. Generate a written incident report, which must be forwarded to the COR, MPI Curator, and Senior Curator.

• Public tour monitoring duties - Monitor large tour groups to ensure they are complying with museum policies and take corrective action in the event of inappropriate behavior.

• Civil disturbance/criminal acts – Provide for the safety of the occupants and security of the building as well as perform other functions as may be necessary in the event of situations or occurrences such as civil disturbances vandalism, pan handling, loitering, or criminal acts adversely affecting the security and/ or safety of the visitors and Government employees, property and of the general public lawfully in building or on the grounds under control of the Government.

• Emergency response - In case of an emergency condition requiring immediate attention, the employee shall, at the direction of the MPI staff, divert security personnel from their normal assigned duties to meet the condition and summon appropriate assistance as may be required in the Occupant Emergency Plan (OEP). A copy of the OEP shall be in Post Orders book. Each officer shall familiarize themselves with the OEP. The designated Government official or agency, as applicable, shall be immediately notified of action taken. No additional cost shall be charged to the Government for the diversion, and the Contractor shall not be penalized for normal daily work not done for which was otherwise scheduled.

Incidents of this nature shall be reported in accordance with procedures outlined in the post orders book.

In case of an emergency condition requiring immediate attention, the employee shall, inform the MPI on-site staff, to meet the condition and summon appropriate assistance as may be required in the OEP.

• Incident reports – daily incident reports should be completed and emailed to the COR, MPI Curator and Senior Curator no later than 9:30am MST the following business day.

• CCTV/alarm system-dispatch - When on duty at the museum lobby post, the guard shall monitor the museums CCTV system to ensure visitors are complying with museum policies and take corrective action if necessary.

• Additional Duties - Turn off unnecessary lights, lock and secure doors, close windows, open and secure doors, and gates, etc.

The contractor shall demonstrate that individuals working under this contract are able to -

• Use a baton, pepper spray, or other less-lethal applications of force, and apply handcuffs or other restraining devices as needed to mitigate a threat.

• Read post assignments, produce reports, and respond to both routine and emergency dispatches/orders with precision and calm.

• Apply verbal control techniques, including giving loud and clear directions in English to crowds or others failing to comply with established guidance.

• Run, sprint, lift/carry/drag/pull/push heavy objects, climb stairs and/or steep grades (when, for example, responding to emergencies, ensuring timely and complete facility evacuations, in pursuit of an individual, etc.), and doing so while wearing protective gear.

• Physically engage violent or potentially violent individuals.

• Provide security services to defend and protect crucial assets within the facility until local law enforcement arrives.

• Ability to intervene in a medical crisis situation (such as providing emergency first aid/CPR while waiting for arrival of paramedics or other emergency personnel), or other high-stress situation involving employees or members of the general public.

• Make frequent contact with the general public, law enforcement, and dispatch center via radio or telephone, requiring the ability to speak clearly and distinctly in English while remaining calm in stressful situations (for example, confrontations with angry, distraught, disturbed, or violent persons).

• Perform limited and very basic counter-surveillance duties (e.g., watch a suspicious person or persons without raising concern with those persons and report the results in a timely matter).

• Meet the requirements of a drug-free workplace.

Government Responsibilities

Determine and provide the necessary access, equipment, facilities, training, and orientation that MPI and the Contractor deem necessary to support the MPI mission.

Immediately contact the Contractor to discuss and correct any MPI or Contractor issue that is incompatible with the program.

Contractor Responsibilities

Contractor shall perform a standard background check on any employee working at the Museum prior to their working at the facility. The Contractor shall provide the IACB with notification the employee successfully passed the background check prior to that employee working in the facility.

Work closely with IACB/MPI and any other appropriate local, State, and Federal entities to facilitate security at

MPI.

The Contractor must be able to provide an unarmed guard(s) to work Tuesday through Sunday from 8:30am to 5pm.

Promptly report all known incidents and/or criminal activities occurring on or around to the MPI Curator or in her absence the MPI Museum Technician, or Maintenance Worker.

The Contractor shall inform the Government through daily activity briefing reports which include details regarding any unusual activity, including the description of the incident, its duration, the number of officers that responded, and resolution of the event. These reports should be emailed to the COR, MPI Curator, and Senior Curator no later than 9:30am MST the following business day.

The Contractor shall provide the Government any work-related accidents and/or injuries to guards by COB the following business day. These reports shall identify the cause of the accident or injury, the extent of the injury, and any corrective action to be taken.

The Contractor shall require all its employees, including those who are prospective contract guards under this award, to undergo a pre-employment medical/physical examination. The Contractor shall provide a plan that defines medical and physical fitness standards and ensure that all its uniformed employees meet the defined standards.

Physical Fitness

To be eligible to perform under the contract, each Contract employee assigned to this contract shall meet all federal, state, and Contractor employment standards required for the job classification employed, including the following –

• United States Citizenship - All employees must be a United States citizen.

• Education – All employees must possess, at minimum, a high school diploma, or equivalency.

• Health-Physical - All employees must be in good physical health, without physical defects or abnormalities which would interfere with performing the duties required by this contract.

• Contractor will develop and administer random drug screening.

• Health-Mental - All employees shall be mentally alert and emotionally stable. Employees must not have detectable neurotic or psychotic conditions which would adversely affect their ability to work and cooperate with others and to act properly during situations involving mental stress.

• Background checks – All employees shall successfully pass a standard background check.

Government Furnished Property (GFP) IACB/MPI will furnish all necessary office space to facilitate security operations including storage space, and work areas (including access to fixed telephones). Any additional items the Contractor determines necessary may be negotiated between the parties and documented in a modification to this contract approved by the Contracting Officer.

Contractor Furnished Property (CFP) The Contractor shall maintain, in acceptable condition, any uniforms, accessories, equipment, and vehicles necessary to perform the work required by the contract.

Uniform –

The employee shall be in uniform and ready to begin work promptly at the start of their shift. The employee shall be in proper unform and present a neat, clean, and professional appearance as referenced in the SOW.

The Contractor shall furnish and maintain in acceptable condition, at no cost to Contract employees, all items listed below and in attachments, such as, uniform and equipment necessary to perform work required under this contract. The Contractor is solely responsible for the quality and performance of all Contractor provided equipment used in performance of this contract.

The Contractor shall provide, and require the appropriate wear/use of, the following uniform clothing and accoutrements, to each on-site unarmed contract officers:

Pair of Dark Navy-Blue or black Slacks Black Belt Black Shoes Light Blue or White Shirt (button-down, collared) Appropriately styled and similar feminine uniforms shall be worn by female employees.

Casual clothes, blue jeans, tee shirts, tennis shoes, etc., are not authorized for wear during working hours.

The Contractor’s employee uniforms shall be a color and style in general use by large guard or security organizations and shall be readily distinguishable from those of local or state law enforcement agencies Federal Protective Service Officers. Appropriately lettered breast and cap badges with the company name shall be worn and prominently displayed as part of the uniform. Identification nametags shall be worn over the right breast

Page shirt pocket on all uniforms. A ball cap style hat shall be required for each officer. Color and style of the uniforms are to be approved by the COR before issuance.

Contractor provides its own computer, internet, and IT support if needed.

Repairs and replacements of all CFP shall be the sole responsibility of the Contractor.

Standards of Conduct The contractor shall develop a standard of contact for its employees consistent with industry standards.

The contractor shall include their proposed standard of conduct with their proposal; this stand will become a part of any resulting contract.

Quality Control Adequate and consistent quality control is an essential component of successful contract performance.

Outstanding performance is the ultimate goal. A Quality Control Plan will be established by the Contractor with the COR input and be implemented and adhered to by both parties.

Contractor Provided Quality Control Plan.

The contractor's Quality Control Plan shall ensure quality service by:

Supervision by Contractor personnel

Unannounced, spot-check appraisal by COR or designee

Partner to resolve informal issues raised by Contractor and IACB/MPI management.

Routine open communications between Contractor and IACB/MPI to meet the security mission.

Documenting and correcting deficiencies of Contractor performance consistent Place of Performance with established Contractor and/or IACB/MPI policies and procedures as defined in this contract.

Prompt resolution of problematic safety concerns consistent with established Contractor and/or IACB/MPI policies and procedures as defined in this contract submitted to the Contracting Officer.

Tribal Permits

The Contractor shall obtain all necessary permits needed to conduct business on the Blackfeet Reservation within five (5) days upon award of contact. CUSTOM CLAUSE # 1 - NOTICES TO THE GOVERNMENT OF DELAYS OR NON-COMPLIANCE

WITH DELIVERY SCHEDULES

The Contractor must immediately notify the Contracting Officer or designated representative when delays exceeding 1-business day are expected, and in the following cases:

1. When the Contractor anticipates difficulty in complying with the purchase order delivery schedule or date, and

2. When the Contractor has knowledge that any actual or potential situation is delaying, or threatens to delay, the timely performance of this purchase order.

In cases of delays that are under 1 business day and/or in cases when the Contractor is unable to comply with the delivery schedule, the Contractor must immediately notify the Contracting Officer or designated representative by phone. These notifications shall be informational in character and this provision shall not be construed as a waiver by the Government of any delivery schedule or of any rights or remedies provided by law or under this purchase order.

The Contractor will not be liable for failure to perform services where such failure is caused, directly or indirectly, by: (i) a strike, (ii) an act of God, or (iii) circumstances beyond the control of the Contractor.

CUSTOM CLAUSE # 2 - INVOICING

Electronic Invoicing and Payment Requirements – Internet Payment Platform (IPP) (Apr 2013)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP). Monthly invoicing is allowed.

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice.

INVOICE CONTENTS:

Invoices must include, as a minimum, the following information:

1. CLIN/Item number of deliverable

2. Description of deliverable

3. Price of deliverable

4. Quantity of deliverable

5. Date deliverable was provided to the Government for inspection

6. Serial number/part number if applicable

7. Other Direct Costs (ODCs) incurred (including supporting documentation/receipts of all other charges) for the current billing period and cumulative to date

The contractor is responsible for ensuring invoices submitted are accurate and complete, and all labor, travel and other direct costs are in accordance with federal guidelines, the FTR and other Government mandates and directives.

Additional supporting documentation MAY BE REQUESTED at the discretion of the COR or CO.

PAYMENT:

a. Payments under this order will be due 30 calendar days after the date of actual receipt of proper invoice in the office designated to receive the original invoice or final acceptance of the goods or services, whichever is later.

b. The date of the check issued in payment or the date of payment by wire transfer through the Treasury Financial Communications System shall be considered to be the day payment is made.

Final Invoice:

Within sixty calendar days of product acceptance and/or completion of services:

a. The contractor shall submit a final invoice, designated as such by a clear statement of “FINAL

INVOICE” on the face of the invoice document.

b. The contractor shall provide a certificate of completion which certifies all goods and service have been provided as required by this task order.

c. The contractor shall provide a release of claims against the government for any further payment under this task order.

The sixty-calendar day submission timeframe shall not be extended without written authorization from the Contracting Officer. In the event items a, b, or c above are not submitted within the authorized timeframe, the contracting officer will make final cost determinations in order to make final payment and close out the contract unilaterally.

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment.

The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) prior to the contract award date, but no more than 3

- 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.

If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.
