SECTION 1:
Request for Quotation (RFQ) – Information and Instructions
The Department of the Interior (DOI), Acquisition Services Directorate (AQD) on behalf of the National Indian Gaming Commission (NIGC) has a requirement for Criminal Justice Information Service (CJIS) Security Policy training. The NAICS code is 611430, Professional Management and Development Training. In order to provide a total solution to complete all the requirements, other appropriate NAICS codes may apply. If this is the case, vendors shall indicate the additional NAICS code(s) in their quote.
This RFQ is open to all small business vendors and is being advertised through beta.SAM.gov using Federal Acquisition Regulation (FAR) Part 13, Simplified Acquisition Procedures.
The Government anticipates an award of a Firm-Fixed Price (FFP) Delivery Order as a result of this RFQ. The Government reserves the right to not make an award.
Questions may be submitted to the Contract Specialist, Sheila Johnson at Sheila_Johnsonmontalvan@ibc.doi.gov The deadline for questions is 2:00 PM ET, March 10, 2020. Late questions may not be answered.
Quotes are due via email no later than 2:00 PM ET, March 16, 2020. Late quotation submissions will not be considered for award.
Basis for Award: Award will be based on best value. Interested vendors shall provide specifications of the products to be furnished under this effort and their project management plans to meet the Government’s requirement including services to be performed within the parameters of the RFQ. Partial quotes will not be considered for award.
The Government will evaluate the quote as follows to determine technical acceptability:
Technical: The Government will evaluate the quotation for completeness and compliance with the instructions provided in the solicitation. A technical evaluation will be performed to determine if all items are quoted as identified in the requirements, and to determine if all requirements of this solicitation have been met.
Past Performance: A review may be conducted of information in Past Performance Information Retrieval System (PPIRS) and the Federal Awardee Performance and Integrity Information System (FAPIIS).
Price: The Government will perform a price analysis to ensure a fair and reasonable price. Examples of such techniques include but are not limited to the following: 1) Comparison of quoted prices received in response to this solicitation; 2) Comparison of proposed prices with prices obtained through market research for the same or similar items.
Discount: The Government requests a discount from the vendor’s regular pricing for this requirement.

Assumptions, Conditions, and/or exceptions

It is not the responsibility of the Government to seek out and identify assumptions, conditions, or exceptions buried within the vendor’s quote.
Notice Regarding Late Delivery/Delayed Performance
The contractor will immediately notify the Contracting Officer (CO) in writing in the event the contractor encounters difficulty in performance by giving pertinent details, including the date by which it expects to complete performance or make delivery. However, the notification will be informal only in character and will not be construed as a waiver by the Government of any contractual delivery schedule or date, or any rights or remedies provided by law or under this effort.
Other General Information
The Government reserves the right to ask for additional information to determine best value. Accordingly, prospective vendors should submit their quotes initially on the most favorable terms possible from both a technical and pricing standpoint.
The Government reserves the right to request additional information as may be necessary to determine the prospective vendor’s qualifications for an award or to clarify any aspects of their submissions. Such information shall be furnished promptly upon the Government’s request.

SECTION 2:
Statement of Work for the National Indian Gaming Commission – CJIS Training
1. BACKGROUND
The National Indian Gaming Commission’s (NIGC) primary mission is to work within the framework created by the Indian Gaming Regulatory Act (IGRA) for the regulation of gaming activities conducted by tribes on Indian lands to fully realize IGRA’s goals: (1) promoting tribal economic development, self-sufficiency and strong tribal governments; (2) maintaining the integrity of the Indian gaming industry; and
(3) ensuring that tribes are the primary beneficiaries of their gaming activities.
The NIGC is comprised of four divisions within the Office of Chief of Staff: Compliance, Technology, Public Affairs, and Finance.
The Division of Technology oversees the agency’s information technology and records management. It is also responsible for critical technological development in systems modifications, network enhancement, data management and operational support. They strive to provide up to date training and technical expertise and assistance to tribes.
A properly trained and informed workforce is the most successful key to regulation and the assurance of compliance. Focused, targeted and responsive training and technical assistance programs provide a foundation that maintains the integrity and success of Indian gaming. The courses are conducted by experienced and knowledgeable staff and regularly updated for relevancy. All NIGC training is based off of existing laws, regulations, processes and procedures, which are current and meet regulatory standards nationwide.

2. OBJECTIVE
The objective is to maintain compliance with the Federal Bureau of Investigation (FBI) Criminal Justice Information Service (CJIS) Security Policy to ensure NIGC, Tribal Gaming Regulatory Authorities (TGRA’s) and other entities who have authorized access to Criminal History Record Information (CHRI), CJIS systems and network document and implement all security awareness training requirements of CJIS Security Policy.
3. TYPE OF CONTRACT
Firm Fixed Price (FFP)
4. SCOPE OF WORK
The contractor will develop and provide virtual online CJIS Security Policy Awareness training for NIGC personnel, NIGC contractors, IT, participating tribal personnel, and IT currently receiving or accessing Criminal History Record Information (CHRI). Approximately 4,000 individuals throughout the United States will be required to complete various levels of CJIS Security Policy Awareness training.
5. SPECIFIC TASKS
The contractor shall be directly responsible for ensuring the accuracy, timeliness and completion of all tasks under this effort. Specifically, the contractor shall:
Design a virtual online system for participants to access and complete CJIS Security Policy Awareness training.
Design and provide a virtual online system for participants to access and complete CJIS Security Policy Awareness training.
Provide technical support for the system via phone and email, Monday – Friday 8 am EST – 8pm
EST
Train NIGC administrators and local administrators on how to use and navigate the system and enroll attendees.
System must accept enrollment from self-enrolled attendees, provide training, test operators, vendors and IT on training, export reports, issue certificates, and send reminders of training, etc.
Training must include the following levels currently required under the CJIS Security Policy:

When training is not retained by the contractor, initial and annual training shall be required for all contractors.
Training must be updated with all changes to CJIS Security Policy within timelines establish by the Policy with notice to NIGC of when updates have been made and what updates were made.
System access must be partitioned for Practitioners, Vendors, Operators/IT, ISO and NIGC Administrator.
System must allow vendors to add their own employees and print their own certification reports.
Local Agencies must be able to access vendor records to reduce duplication of vendor entry and training.
System must notify administrators via email of approaching deadlines for enrollees to retake biannual training.
System must be accessible through standard online browsers with no additional software needed on standard personal computers and mobile personal devices.
6. DELIVERABLES
In fulfillment of this effort, the contractor shall provide the following deliverables. All deliverables shall be submitted to the Contracting Officer’s Representative (COR), unless otherwise agreed upon.
The deliverables the contractor shall provide are:
Virtual online offerings of CJIS Security Policy Awareness Training o Four separate levels of CJIS o Each level of training is a combination of:
Recorded webinars Audio Learning Visual Learning Video Case studies Role-playing Testing Downloadable job aids, power points, etc.
Cite references/resources for additional trainee research/guidance
Technical Support Monday – Friday 8 am EST – 8pm EST Training should specifically cover:
Basic Security Awareness Training Basic security awareness training shall be required within six months of initial assignment, and biennially thereafter, for all personnel who have access to CJI to include all personnel who have unescorted access to a physically secure location. The CSO/SIB Chief may accept the documentation of the completion of security awareness training from another agency. Accepting such documentation from another agency means that the accepting agency assumes the risk that the training may not meet a particular requirement or process required by federal, state, or local laws.

A significant number of topics can be mentioned and briefly discussed in any awareness session or campaign. To help further the development and implementation of individual agency security awareness training programs the following baseline guidance is provided.
o 5.2.1.1 Level One Security Awareness Training At a minimum, the following topics shall be addressed as baseline security awareness training for all personnel who have unescorted access to a physically secure location:
1. Individual responsibilities and expected behavior with regard to being in the vicinity of CJI usage and/or terminals.
2. Implications of noncompliance.
3. Incident response (Identify points of contact and individual actions).
4. Visitor control and physical access to spaces—discuss applicable physical security policy and procedures, e.g., challenge strangers, report unusual activity, etc.
o 5.2.1.2 Level Two Security Awareness Training o In addition to 5.2.1.1 above, the following topics, at a minimum, shall be addressed as baseline security awareness training for all authorized personnel with access to CJI:
1. Media protection.
2. Protect information subject to confidentiality concerns — hardcopy through destruction.
3. Proper handling and marking of CJI.
4. Threats, vulnerabilities, and risks associated with handling of CJI.
5. Social engineering.
6. Dissemination and destruction.
5.2.1.3 Level Three Security Awareness Training
In addition to 5.2.1.1 and 5.2.1.2 above, the following topics, at a minimum, shall be addressed as baseline security awareness training for all authorized personnel with both physical and logical access to CJI:
1. Rules that describe responsibilities and expected behavior with regard to information system usage.
2. Password usage and management—including creation, frequency of changes, and protection.
3. Protection from viruses, worms, Trojan horses, and other malicious code.
4. Unknown e-mail/attachments.
5. Web usage—allowed versus prohibited; monitoring of user activity.
6. Spam.
7. Physical Security—increases in risks to systems and data.
8. Handheld device security issues—address both physical and wireless security issues.
9. Use of encryption and the transmission of sensitive/confidential information over the Internet—address agency policy, procedures, and technical contact for assistance.
10. Laptop security—address both physical and information security issues.
11. Personally owned equipment and software—state whether allowed or not (e.g., copyrights).
12. Access control issues—address least privilege and separation of duties.
13. Individual accountability—explain what this means in the agency.

14. Use of acknowledgement statements—passwords, access to systems and data, personal use and gain.
15. Desktop security—discuss use of screensavers, restricting visitors’ view of information onscreen (mitigating “shoulder surfing”), battery backup devices, allowed access to systems.
16. Protect information subject to confidentiality concerns—in systems, archived, on backup media, and until destroyed.
17. Threats, vulnerabilities, and risks associated with accessing CJIS Service systems and services.
o 5.2.1.4 Level Four Security Awareness Training o In addition to 5.2.1.1, 5.2.1.2, and 5.1.2.3 above, the following topics at a minimum shall be addressed as baseline security awareness training for all Information Technology personnel (system administrators, security administrators, network administrators, etc.):
1. Protection from viruses, worms, Trojan horses, and other malicious code—scanning, updating definitions.
2. Data backup and storage—centralized or decentralized approach.
3. Timely application of system patches—part of configuration management.
4. Access control measures.
5. Network infrastructure protection measures.
6.1. Project Management Plan
The contractor shall prepare a Project Management Plan describing the technical approach, organizational resources and management controls to be employed to meet the cost, performance and schedule requirements for this effort. The Project Management Plan shall detail the products, methods for developing the products, allocation of staff and other resources necessary to produce the products and a revised timeline for producing the products, if necessary.
6.2. Monthly Status Report
The contractor shall document the efforts performed in the completion of each task in a detailed Monthly Status Report due on or before the 15th of each month. Reporting requirements for the monthly status reports will be outlined at the initial kick-off meeting. The status report shall include, at a minimum:
Program status, including work completed, and work remains outstanding Issues or obstacles impeding progress and recommended solution Status of deliverable / milestones Issues and resolutions Resource planning / status Topics or issues identified by the government COR

6.3. Final Report
The contractor shall provide a final report to the COR at the conclusion of this effort. The report will summarize objectives achieved, significant issues, problems and recommendations to improve the process in the future.

The contractor will also have a maximum of [10] working days from the day comments are received to incorporate all changes and submit the final deliverable to the Government. All days identified below are intended to be workdays unless otherwise specified.
6.7. General Acceptance Criteria
The general quality measures set forth below will be applied to each work product received from the contractor under this statement of work.
Accuracy - Work products shall be accurate in presentation, technical content, and adherence to accepted elements of style.
Clarity – Work products shall be clear and concise Consistency to Requirements – All work products must satisfy the requirements of this statement of work.
File Editing – All text and diagrammatic files shall be editable by the Government.
Time-lines - Work products shall be submitted on or before the due date specified in this statement of work or submitted in accordance with a later scheduled date determined by the Government.

7. PERFORMANCE
7.1. Period of Performance
The period of performance for this effort is date of award through a period of 12 months (the Base Period). This effort includes [4] option periods of 12 months each which may be unilaterally exercised by the Government. Each option period shall have a period of performance of one year. All terms and conditions applicable to the base period shall extend to the options unless otherwise agreed upon.
7.2. Place(s) of Performance
Virtual online secured platform. The Contractor will provide access and use to designated website/platform and will release it to NIGC upon date of completion. The virtual online platform will be accessible at any location where there internet service is available and comply with all DOI OCIO requirements.
8. OTHER PERFORMANCE REQUIREMENTS
8.1. Orientation Briefing
Within 10 working days of award, the contractor shall conduct an orientation briefing for the Government. The intent of the briefing is to initiate the communication process between the Government and contractor by introducing key task participants and explaining their roles, reviewing communication ground rules, and assuring a common understanding of subtask requirements and objectives.
8.2. Contractor Interfaces
The contractor and/or his subcontractors may be required as part of the performance of this effort to work with other contractors working for the Government. Such other contractors shall not direct this contractor and/or their subcontractors in any manner. Also, this contractor and/or their subcontractors shall not direct the work of other contractors in any manner.
8.3. Disclosure of Information
Information made available to the contractor by the Government for the performance or administration of this effort shall be used only for those purposes and shall not be used in any other way without the written agreement of the Contracting Officer (CO).
8.4. Limited Use of Data
Performance of this effort may require the contractor to access and use data and information proprietary to a government agency or government contractor which is of such a nature that its dissemination or use, other than in performance of this effort, would be averse to the interests of the

Government and/or others.
Contractor personnel shall not divulge or release data or information developed or obtained in performance of this effort, until made public by the Government, except to authorized government personnel or upon written approval of the CO. The contractor shall not use, disclose, or reproduce proprietary data that bears a restrictive legend, other than as required in the performance of this effort.
Nothing herein shall preclude the use of any data independently acquired by the contractor without such limitations or prohibit an agreement at no cost to the Government between the contractor and the data owner which provides for greater rights to the contractor.
8.5. Payment for Unauthorized Work
No payments will be made for any unauthorized supplies or services or for any unauthorized changes to the work specified in this document. This includes any services performed by the contractor of their own volition or at the request of an individual other than a duly appointed CO. Only a duly appointed CO is authorized to change the specifications, terms, and conditions under this effort.
8.6. Contractor Personnel
The contractor shall be responsible for managing and overseeing the activities of all contractor personnel, as well as subcontractors used in performance of this effort. The contractor's management responsibilities shall include all activities necessary to ensure the accomplishment of timely and effective support, performed in accordance with the requirements contained in the statement of work.
8.6.1. Project Manager
The contractor shall provide a Project Manager (PM). The PM shall be the primary technical and managerial interface between the contractor, the CO, and the COTR. The PM will have full authority to act for the contractor on all contract matters relating to daily operations.
9. SECTION 508 REQUIREMENTS
Any/all electronic and information technology (EIT) procured through this effort must meet the applicable accessibility standards at 36 CFR 1194. 36 CFR 1194 implements Section 508 of the Rehabilitation Act of 1973, as amended, and is viewable at http://www.section508.gov.
The Standards apply to the following:

10. GOVERNMENT-FURNISHED PROPERTY/INFORMATION
Government-furnished property (material, equipment, and/or information) is to be provided under this effort. At the request of the Government, or at completion of this effort, the contractor shall immediately return any Government-provided property, material, equipment, or information provided by the Government for the contractor to use to complete this effort.
11. PERMITS AND LICENSES
In performance of work under this award, the contractor must, without additional expense to the Government, be responsible for obtaining any necessary licenses and permits, and for complying with any federal, state, and municipal laws, codes, and regulations applicable to the performance of the work.
12. CONFIDENTIALITY
All information regarding the procedures developed under this task order must be regarded as sensitive information by the contractor and not to be disclosed to anyone outside the contractor’s organization without the written permission of the CO.

APPLICABLE CLAUSES AND PROVISIONS

CUSTOM CLAUSE # 1 - NOTICES TO THE GOVERNMENT OF DELAYS OR NON-COMPLIANCE
WITH DELIVERY SCHEDULES
The Contractor must immediately notify the Contracting Officer or designated representative when delays exceeding 1-business day are expected, and in the following cases:
1. When the Contractor anticipates difficulty in complying with the purchase order delivery schedule or date, and
2. When the Contractor has knowledge that any actual or potential situation is delaying, or threatens to delay, the timely performance of this purchase order.
In cases of delays that are under 1 business day and/or in cases when the Contractor is unable to comply with the delivery schedule, the Contractor must immediately notify the Contracting Officer or designated representative by phone. These notifications shall be informational in character and this provision shall not be construed as a waiver by the Government of any delivery schedule or of any rights or remedies provided by law or under this purchase order.

The Contractor will not be liable for failure to perform services where such failure is caused, directly or indirectly, by: (i) a strike, (ii) an act of God, or (iii) circumstances beyond the control of the Contractor.

Electronic Invoicing and Payment Requirements – Internet Payment Platform (IPP) (Apr 2013)
Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).
"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. The contractor is responsible for ensuring invoices submitted are accurate and complete, and all labor, travel and other direct costs are in accordance with federal guidelines, the FTR and other Government mandates and directives.
Additional supporting documentation MAY BE REQUESTED at the discretion of the COR or CO.
PAYMENT:
a. Payments under this order will be due 30 calendar days after the date of actual receipt of proper invoice in the office designated to receive the original invoice or final acceptance of the goods or services, whichever is later.
b. The date of the check issued in payment or the date of payment by wire transfer through the Treasury Financial Communications System shall be considered to be the day payment is made.

Final Invoice:
Within sixty calendar days of product acceptance and/or completion of services:
a. The contractor shall submit a final invoice, designated as such by a clear statement of “FINAL
INVOICE” on the face of the invoice document.
b. The contractor shall provide a certificate of completion which certifies all goods and service have been provided as required by this task order.
c. The contractor shall provide a release of claims against the government for any further payment under this task order.
The sixty-calendar day submission timeframe shall not be extended without written authorization from the contracting officer. In the event items a, b, or c above are not submitted within the authorized timeframe, the contracting officer will make final cost determinations in order to make final payment and close out the contract unilaterally.
The Contractor must use the IPP website to register access and use IPP for submitting requests for payment.
The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) prior to the contract award date, but no more than 3
- 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.
If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.
