The proposed work consists of the contractor shall provide all labor, materials, transportation, supervision, and incidentals necessary for construction of the Hogan and Arch way in accordance with the statement of work for Tuba City Boarding School.

Miscellaneous Work: The contractor shall not perform any of contingent sum work, until the Contracting Officer issues a contract modification authorizing performance of work in accordance with FAR Clause 52.243-4, Changes; and subject to availability of funds, FAR Clause 52.232-18, Availability of Funds.
The Contractor shall promptly notify the Contracting Officer, in writing, of subsurface or any physical conditions different from those indicated in this contract or unknown unusual physical conditions at the site before proceeding with the work.
The change orders request shall be forwarded to the Contracting Officer by memorandum outlining the need and a justification for the change order. Upon receipt of a change order request, the Contracting Officer will request a cost proposal from the Contractor. All cost proposals shall be in detail and itemized, showing price breakdown in sufficient detail to permit an analysis of cost for material, labor, equipment, hours, taxes, insurance, bonds, overhead costs, profit, and complete description of work involved in the change order, including any time extension.
In an emergency, a telephone approval may be granted by the Contracting Officer, and immediately the Contractor shall follow through by submitting a written cost proposal to the Contracting Officer.

SECTION C: DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK
SECTION C: Hogan Building-LABOR ONLY
SCOPE OF WORK
I. GENERAL INFORMATION
A. Purpose of this document
This document defines both contractor's responsibilities in each phase of construction. It is intended as a checklist that will define contractor's standard of quality and professionalism. The Framing labor contractor's work will not be considered complete until all specifications herein contained are fully met.
B. Relationship to other documents

(All issues on the checklist must be completed prior to submitting for payment)
II. PAYMENT DEFINITIONS
Scheduled task payments will only be approved for payment after Tuba City Boarding School and Contractor's foreman has inspected and certified that all contract work is completed per the following criteria:
A. All Trade Quality Checklist (where applicable) items have been completed 100% and accepted by the Contracting Office.
B. All punch out work identified during inspection is completed, No deficiencies remain.
C. The property is completely clean, safe and ready for usage.
D. Scheduled tasks have passed all inspections, statutes and requirements.
E. All work has been installed and completed as per contract scope of work, and manufacturer's instructions and recommendations.
F. All related requirements per Contracting Office have been completed.

- Arbor Structure.
Tuba City Boarding School will initiate the followings to build and renovate the hogan project in stages.
A. Supplies & Materials: Tuba City Boarding School will procure and purchase construction supplies and materials for hogan building project. This includes lumber, sheetrock, door, windows, nail, screws, and essentials to complete the project.
B. Ready Mix Cement: Tuba City Boarding will bid out the ready-mix cement to be delivered on site. The mixing and placement will be employed by the concrete contractor.
C. Labor Contract: Two structures will be built, and they are.

D.Building hogan Structure - Tuba City Boarding School will contract a building contractor to prep surface, dig trend, build form for the ready-mix cement, troweling and finish and insert with anchor bolts. Erect the exterior walls, electrical wiring, installation, weather wrap, outside paneling, insert the roof rafters with a central roof cap securely, windows and door, install the metal roof panels, exterior trimmings, and electrical outlets, lighting fixtures, wall heaters and light switches (Drawing - Hogan Design Page 1 & Drawing page 2 - Floor Plan).
E. Arbor Structure - The arbor structure, 16' X 24" X 8' is an open structure with posts to upright the structure, roof covering with beams, panels and recycled logs of old hogan. Each will be braced with L and T joints for secure and stabilize structure. An east and open doorway will accommodate movement of the shade structure (Drawings Page 3 -Arbor Structure).
F. This CONTRACTOR shall include all labor, tools, material, equipment, etc. to complete the work per this agreement as required by plans, customer requirement, and individual lot conditions as identified but not limited to each tasks below.
1. Foundational work for concrete floor

3. Roof Metal Sheathing / Wall Sheathing
4. Interior Walls/ Framed Exterior walls.
5. General Framing
6. Blocking & Bracing
7. Exterior Wood
8. Trim Exterior

IV. GENERAL REQUIREMENT (applies to all aspect of above-mentioned scopes)
A. Contractor agrees to a 5-day work week during construction of models at no extra charge.
B. Before and while proceeding with the job, the contractor shall accurately check everything previously or contemporaneously done by other trades in any way relating to the work performed pursuant to its Agreement and determine the correctness of it to ensure its work is not placed over previously faulty workmanship. Any failure on contractor's part to detect or report such discrepancies to the contractor, in writing, shall relieve the contractor of any and all claims by contractor for costs, expenses or damages resulting there from. Contractor is not to construct over faulty work and will make every effort to determine if previous work is accurate and notify contractor of any deficiencies.
C. Contractor shall not drive or park on common areas, lots or driveways, except for loading or unloading construction material only.
D. Contractor shall provide hand tools, powered tools, cords, and all equipment necessary to install all lumber, trusses, shots, hangers, bolts, rough hardware (if applicable), fire wall blocking, exposed exterior wood and all furring strips, etc. per plan.
E. Install framing hardware connections and miscellaneous fasteners including but not limited to, nails, screws, bolts, lags, clips, straps, washers, hangers, hold-downs, post bases, pins, metal reinforcing plates, ornamental straps, and other miscellaneous hardware, etc., as required.
F. Install all studs, plates, blocking, braces, framing, posts, nailers, furring, stripping, bracing, shear walls, Mountain School structural, headers, bearing, plywood, sheathing, decking, joists, beams, rafters, trusses, fire caulking, fire blocking, draft stopping, backing, trim, shower niches, attic access, stops, grounds, screeds, kickers, curbs, walkways in truss space, etc., as required in the sizes, quantities, finishes, plans, specifications, contractor approval, all applicable Building Codes and authorized requirements.
G. All nailing to be as specified by State codes per Engineered plans).
H. Contractor shall confer with all other trades to obtain all rough in dimensions, truss spacing and equipment locations (i.e., fireplace, plumbing, windows, skylight, doors, HVAC, roofer, electrician, carpenter, equipment, ducts and or penetrations, etc.) as shown per plan.
I. Trusses/joist materials are not to interfere with fireplace chases, recessed lighting, electrical or heating duct chases.
J. Structural pick-up, including drop ceilings, missing studs and joists, posts, attic accesses, shall start immediately upon completion of sheathing to prepare for boring and strapping through framing members by mechanical trades.
K. Contractor shall remove all usable lumber from the inside of unit(s)s and clear roofs of all usable lumber prior to clean-up by contractor, and before other trades start their work. All usable lumber shall be neatly stacked in yard fence, out of the way to other trades.
L. If production should fall behind schedule, contractor shall increase his labor force and catch up to required schedule. If sufficient labor is not furnished during the normal working hours, the contractor agrees to work overtime and/or weekends at no extra cost to CONTRACTING OFFICE.
M. Prior to commencement of layout, Tuba City Boarding School shall review construction plans with all mechanical, including (but not necessarily limited to) electrical, HVAC and design plan.
N. Contractor shall supply equipment scaffolding, if required, for the contractor portions of work only;
and hand tools as required, compressors, etc.
O. It is hereby understood that the structures covered herein are to be built as shown on the contract plans and any variations or discrepancies noted shall be brought immediately to the attention of Tuba City Boarding School and resolved prior to construction.
P. All materials will be installed such that weather elements will not loosen, dismantle or damage the material. Within the installation, provide a security so that water flowing off the unit(s) and does not run into or behind the materials.
Q. Headers to have no splices over doorways.
R. Nails and screws shall not penetrate finish membrane or siding. Regulators must be used on all nail guns to prevent over driving on all sheathing. Failure to use regulators on nail guns will result in trade contractors being responsible for any damaged material caused by overdriven nails.
S. AII final pick-up work to be performed after rough electrical is complete.
T. AII framing shall be constructed with all joints true, and well-nailed or bolted, according to plans or manufacturer's specifications. All horizontal member subject to bending shall be set with crown up and shall not be spliced between bearings. Interior and exterior angles shall be properly framed to receive interior and exterior finish work.
U. Bolting: holes for bolts shall be bored true to line and of the same diameter as the bolts. Bolts shall be driven into place with a tight fit and provided with plates or washers as indicated on detailed drawings. All nuts, bolts, and lag screws shall be turned up and made tight at time of installation and again just before being enclosed with other fixed material or at the completion of the work to ensure that shrinkage has been overcome and the fastenings are tight.
V. Joist and floor truss anchors, bolts, etc., shall be provided as indicated and required. Joist anchors, clip angles, etc., shall be spaced as required and securely attached to the joist or other members. No nail smaller than 9 gauge in shank shall be used.

W. The entire work shall be performed in accordance with the best standards of practice relating to the trade and under the constant supervision of a competent foremen who shall carefully plan and lay out the work as required to carry out the intent of drawing and to properly accommodate the work of other trades. All lumber framing shall be accurately cut and fitted into respective locations to render all framing substantial and rigid in all parts and connections.
V. Foundational Work, Ground Prep & Form Construction (Drawing Attached)
A. Smooth ground, level, dig 2' outer trend, place and compact subbase to re-enforce with rebars, surface cover, fence meshing, stabilizers and spread gravel over cover and fill gravel outer trend. Build form construction with lumber, secure and balance for the ready-mix cement on outer trend 2' deep and entire floor 6" deep (Drawing page 4 - Campus Site & Drawing page 5 - Hogan Location).
B. Prep the ground, east courtyard area, west of Bldg. 1703, north of Bldgs. 8 & 9, and east of Bldg. 11, in measurement 16'X8 octagon design, east doorway, 24' diameter corners to corners, and 244 square feet.
Clear rocks, shrubs, old concrete and exposing bare earth (Drawing page 6 - Concrete Form).
C. Smooth ground, level, dig 2' outer trend, place and compact subbase to re-enforce with rebars, surface cover, fence meshing, stabilizers and spread gravel over cover and fill gravel outer trend. Build form construction with lumber, secure and balance for the ready-mix cement on outer trend 2' deep and entire floor 6" deep.
D. Contractor will have the cement contractor place and pour wet concrete into the forms until they are full to edge top. Use shovels, rakes, and "some alongs", no voids or pockets, to place and finish concrete surface sand insert the anchor bolts for stud wall construction.
E. Contractor will initiate final finishing by screeding to compact and consolidate the concrete to smooth and level on control joints and edges for entire floor and outer trend.
F. Initiate final finishing with trowel (float or steel) will be completed to finish the concrete setting and application.
VI. TRUSSES
A. Install all trusses as required, including all truss connections.
B. Proper bracing shall be installed to hold the trusses true and plumb and in safe condition until permanent truss bracing and bridging can be solidly nailed in place to form a structurally sound roof and floor framing system. All erection of trusses shall be permanently fastened before the application of any loads (Drawing page 7 - Stud Wall Frames).
C. Install all trusses and their framing per the drawings - roof framing layout plans, including all roof ties, truss bracing, bridging, collar ties, hanger, ridge blocks, gable/cathedral ceiling bracing and/or miscellaneous blocking as required by plans.
D. Framer is responsible for layout of lintel straps per engineered drawings. Framer is responsible for correct placement of all embedded fasteners. Framer is responsible for all costs associated with missed fasteners.
E. Trusses shall be stored in a level plane (Drawing Page 8 - Roof Rafter Plan).
F. Inspect all trusses and notify the contractor of any damage or any difference in dimension or configuration from the drawings, prior to installation. Damage noted after installation will be at the expense of contractor.
G. Build roof crickets as required and per plan even if not specifically noted. Install a south skylight for natural roof lighting 21" X 45 ¾", roof panel 3. The roof cap is last central addition to complete the roof (Drawing Page 9 - Roof Rafter Frame/Drawing page 10 - Roof Top Addition).

H. Roof addition, east entrance over door, 8' X 3 X 9', shall be a permanent addition to be installed to the roof (Drawing page 11 - East Roof Top Addition).
I. Top and bottom cords of trusses must be string lined to validate they plane out and are level for metal roof panel application.
VII. ROOF SHEATHING - (Drawing Attached)
A. Prep roof surface, measure, cut and install all metal roof panel per applicable codes.
B. Install all metal roof paneling(s) so that joints parallel to the trusses or rafters fall on framing members and texture of surface (Drawing Page 12 - Metal Panels Install).
C. Metal roof panels shall be applied with face grain across rafters with rib forms outside glued closure securely.
D. Provide all roof cuts to accommodate sheet metal roof vents, water flow, universal ridges, and associated finishings.
E. Framer to cut panels and screw holes and install proper measurement and water blockage at the base or behind materials of the roof cap finish.
F. Install roof bus r/v bus installation kit for wood stove, stove pipe with proper vent as required (Drawing Page 13 -Wood Stove Addition).
VIII. INTERIOR WALLS - (Drawing Attached)
A. All wall framing including, but not limited to, plates, cripple studs, sills, blocking, bracing, shear, headers, structural, plywood, sheathing, posts, bearing members, opening, 1 -hour, 2-hour draft stops and all other firewall construction, etc., as required. All wall and partition studs shall be on bearing walls, 24" on center non-bearing size indicated on drawings and, unless otherwise noted, shall be spaced 16" O.C. Bearing stud wall and partitions shall have single bottom plates and double top plates of the same widths as studs, unless otherwise noted, all joints in the upper and lower members of top plates shall be spliced as indicated on drawings. Splicing of framing members between bearing points and excessive shimming (over 1/8") of short studs, trimmers, headers, etc., will not be permitted.
B. Wall and principal interior structural partitions shall be braced as indicated on drawings and whatsoever requirement to provide adequate rigidity to the framework (Drawing Page 14 - Stud Walls).
C. Full height studs as required and called for on the plans and specifications.
D. Headers installed as required called for on the plans and specifications.
E. Shear panels: Contractor shall be aware of a variation in size of door frames where structural shear panels occur and shall be responsible for proper installation of same at their respective locations. Shear panels shall be built exactly as shown on plans and nailed as indicated. No deviation of plans will be allowed.
F. Cripples will be installed straight within 1/8" tolerance in 6'. All work to be plumbed square, straight, checked with level, and brought to within 1/8" tolerance in 6'.
G. Where conditions make it impossible to effectively brace walls and partitions as before specified, they shall be sheathed with not less than fifty percent (50%) solid sheathing applied to face of studs and nailed as specified.
H. Set all interior walls plumb, square.
I. All bearing walls to be installed per plan.
J. Contractor must check all plate lines with string line to validate quality assurance.
K. Framing of all openings to be correct to accept work for door jambs, door frames, doors, windows, sliding
Mountain School glass doors, ducts, vents, and for other framed-in items as required by other trades. Contractor to make all opening adjustments at no additional cost to contractor block and/or cross nail/screw all door studs in order to secure.
L. All furred ceilings and walls as required, framing for HVAC, layout provided by contractor. Build all platforms at a finished standard height as required to meet contractor's needs and do not fasten ¾" plywood on platform.
Mechanical contractor will be responsible for fastening where they occur. Where applicable platform shall be constructed in a manner which allows for "full height door installation".
M. Bucks and nailing blocks shall be installed as indicated on drawings and as required to suit their specific purposes; firmly secured in precise position as required by the specific application. All bucks and nailing blocks to be embedded in concrete or masonry shall be made of treated lumber and shall be securely anchored therein with bolts, tapcons, or other anchorage as detailed.
N. Nailers and plates: provide and install all wood nailers, plates, blocking, etc., as indicated on drawings or required to complete the work. These details, where embedded in or lying against concrete within 0-6" or the adjoining grade lines, shall be made of treated lumber and elsewhere shall be made.
O. Cutting and notching of lookouts, corbels, beams, etc., as necessary to complete the framing as required.
P. Framing of openings for flues, vents, chases, catwalks, etc., for plumbing, solar, electrical, HVAC, and other trades including, but not limited to, vents, water heater flues, ducts, supplies, returns, furred areas, etc., as may be required, per plan during construction. Provide access to all over-built roof conditions for insulation contractor. Include all draft stopping and fire stopping per building codes, plans and all applicable codes.
IX. ELECTRICAL - (Drawing Attached)
A. Lace electrical lines inside walls, install electrical locks securely, 10 receptacles (two exterior east/back walls), wiring devices and dimmer control (Drawing Page 11 - Electrical Layout).
B. Hang and secure ceiling light/fans to ceiling, wiring devices and controls at doorway (Drawing Page 15 - Electrical Plan/Drawing Page 16 - Hanging Fixture/Wall Heater).
C. Insert wall HVAC panel 6" high on north side of room.
D. Mount and fasten wiring devices and control for porch light (east doorway).
E. Mount box, insert 6-20 Amps breakers, wiring electrical fixtures and outlets to specifications.
X. TRIM - EXTERIOR
A. Exterior siding where applicable shall be face nailed or screwed with placement schedule. Contractor shall take precautions to ensure that nails OR SCREWS are in alignment and spacing is uniform throughout the job. No unevenness shall be acceptable. Do not crush finished material.
B. (If applicable) Fascia and horizontal trim joints to be mitered galvanized nailed or plated on backside.
C. All exterior trim joints and splices shall be mitered not less than thirty degrees.
D. All exterior trim work including, but not limited to, all horizontal trim, fascia, rough-sawn/re-sawn members, stucco ground, etc., as required.
E. All trim to be applied in a professional manner- level, plumb, and per drawings and details.
F. Check all notes, legend, shear panel schedule and nailing schedule.
G. Plywood and OSB sheets shall be laid with the long dimension and face grain perpendicular to joists and shall be gaped 1/8" as shown on framing plans. Joists shall be staggered, unless otherwise indicated. All door bucks must be held½" from floor.
H. Install all waterproof building paper or House Wrap as required on drawings by contractor, specification, all
Mountain School applicable building department codes and authorized governing agency requirements unless specifically excluded from trade contractor’s quote. All house wrap to extend 2" minimum past all sheet metal edges, corners, tops, etc.
or taped by approved methods.
I. Exterior plywood/OSB sheathing, or "Zip Wall" sheathing shall have 1/8" spacing required at joints.
J. All exposed wood i.e., beams, truss tails, fascia, trim, etc. must be of presentable quality with no objectionable defects. Contractor shall reserve the right of rejection of exposed wood. Any wood that shows signs of twisting, splitting or cupping after installation, shall be replaced by contractor at contractor's discretion.
K. Trim siding scope includes any accent features shown on plans including but not limited to shutters;
louvers; brackets, column trim etc.
XI. CLEANING & PROTECTING
A. Return trip to complete framing items per frame check and local inspection requirements.
B. Contractor to remove and pile all scrap to designated area. House shall be cleaned up daily.
C. Store all extra and/or uninstalled materials, including lumber and plywood, 1-1/2" off ground in designated area. Provide easy access for identification and inspection.

SECTION D – PACKAGING AND MARKING
D.1 PACKAGING AND MARKING
A. All shipments of materials, equipment and/or supplies to the project site shall be addressed to the Contractor and not the Government. Preservation, packaging, and packing shall be in accordance with standard practices for commercial packaging.
B. Government personnel are not authorized to accept deliveries for the contractor, nor are they responsible for off-loading shipments. A contractor representative must be present to accept deliveries.

SECTION E – INSPECTION AND ACCEPTANCE
E.1 52.246-12 INSPECTION OF CONTRUCTION AUG 1996
(a) Definition."Work" includes, but is not limited to, materials, workmanship, and manufacture and fabrication of components.
(b) The Contractor shall maintain an adequate inspection system and perform such inspections as will ensure that the work performed under the contract conforms to contract requirements. The Contractor shall maintain complete inspection records and make them available to the Government. All work shall be conducted under the general direction of the Contracting Officer and is subject to Government inspection and test at all places and at all reasonable times before acceptance to ensure strict compliance with the terms of the contract.
(c) Government inspections and tests are for the sole benefit of the Government and do not-
(1) Relieve the Contractor of responsibility for providing adequate quality control measures;
(2) Relieve the Contractor of responsibility for damage to or loss of the material before acceptance;
(3) Constitute or imply acceptance; or
(4) Affect the continuing rights of the Government after acceptance of the completed work under paragraph (i) of this- section.
(d) The presence or absence of a Government inspector does not relieve the Contractor from any contract requirement, nor is the inspector authorized to change any term or condition of the specification without the Contracting Officer’s written authorization.
(e) The Contractor shall promptly furnish, at no increase in contract price, all facilities, labor, and material reasonably needed for performing such safe and convenient inspections and tests as may be required by the Contracting Officer. The Government may charge to the Contractor any additional cost of inspection or test when work is not ready at the time specified by the Contractor for inspection or test, or when prior rejection makes reinspection or retest necessary. The Government shall perform all inspections and tests in a manner that will not unnecessarily delay the work. Special, full size, and performance tests shall be performed as described in the contract.
(f) The Contractor shall, without charge, replace or correct work found by the Government not to conform to contract requirements, unless in the public interest the Government consents to accept the work with an appropriate adjustment in contract price. The Contractor shall promptly segregate and remove rejected material from the premises.
(g) If the Contractor does not promptly replace or correct rejected work, the Government may-
(1) By contract or otherwise, replace or correct the work and charge the cost to the Contractor; or
(2) Terminate for default the Contractor’s right to proceed.
(h) If, before acceptance of the entire work, the Government decides to examine already completed work by removing it or tearing it out, the Contractor, on request, shall promptly furnish all necessary facilities, labor, and material. If the work is found to be defective or nonconforming in any material respect due to the fault of the Contractor or its subcontractors, the Contractor shall defray the expenses of the examination and of satisfactory reconstruction.

However, if the work is found to meet contract requirements, the Contracting Officer shall make an equitable adjustment for the additional services involved in the examination and reconstruction, including, if completion of the work was thereby delayed, an extension of time.
(i) Unless otherwise specified in the contract, the Government shall accept, as promptly as practicable after completion and inspection, all work required by the contract or that portion of the work the Contracting Officer determines can be accepted separately. Acceptance shall be final and conclusive except for latent defects, fraud, gross mistakes amounting to fraud, or the Government’s rights under any warranty or guarantee.

SECTION F -- DELIVERIES OR PERFORMANCE
F.1 52.211-10 Commencement, Prosecution, and Completion of Work Apr 1984
The Contractor shall be required to (a) commence work under this contract within ten (10) calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 120 (one hundred twenty) calendar days. The time stated for completion shall include final cleanup of the premises.
F.2 52.211-13 TIME EXTENSIONS SEPT 2000
Time extensions for contract changes will depend upon the extent, if any, by which the changes cause delay in the completion of the various elements of construction. The change order granting the time extension may provide that the contract completion date will be extended only for those specific elements related to the changed work and that the remaining contract completion dates for all other portions of the work will not be altered. The change order also may provide an equitable readjustment of liquidated damages under the new completion schedule. (End of clause)
F.3 52.211-18 VARIATION IN ESTIMATED QUANTITY APR 1984
If the quantity of a unit-priced item in this contract is an estimated quantity and the actual quantity of the unit-priced item varies more than 15 percent above or below the estimated quantity, an equitable adjustment in the contract price shall be made upon demand of either party. The equitable adjustment shall be based upon any increase or decrease in costs due solely to the variation above 115 percent or below 85 percent of the estimated quantity. If the quantity variation is such as to cause an increase in the time necessary for completion, the Contractor may request, in writing, an extension of time, to be received by the Contracting Officer within 10 days from the beginning of the delay, or within such further period as may be granted by the Contracting Officer before the date of final settlement of the contract.
Upon the receipt of a written request for an extension, the Contracting Officer shall ascertain the facts and make an adjustment for extending the completion date as, in the judgment of the Contracting Officer, is justified.
F.4 52.236-01 PERFORMANCE OF WORK BY THE CONTRACTOR APR 1984
The Contractor shall perform on the site, and with its own organization, work equivalent to at least fifteen percent (15%) of the total amount of work to be performed under the contract. This percentage may be reduced by a supplemental agreement to this contract if, during performing the work, the Contractor requests a reduction and the Contracting Officer determines that the reduction would be to the advantage of the Government.
F.5 52.236-15 SCHEDULES FOR CONSTRUCTION CONTRACTS APR 19845
(a) The Contractor shall, within five days after the work commences on the contract or another period of time determined by the Contracting Officer, prepare and submit to the Contracting Officer for approval three copies
Mountain School of a practicable schedule showing the order in which the Contractor proposes to perform the work, and the dates on which the Contractor contemplates starting and completing the several salient features of the work (including acquiring materials, plant, and equipment). The schedule shall be in the form of a progress chart of suitable scale to indicate appropriately the percentage of work scheduled for completion by any given date during the period. If the Contractor fails to submit a schedule within the time prescribed, the Contracting Officer may withhold approval of progress payments until the Contractor submits the required schedule.
(b) The Contractor shall enter the actual progress on the chart as directed by the Contracting Officer, and upon doing so shall immediately deliver three copies of the annotated schedule to the Contracting Officer. If, in the opinion of the Contracting Officer, the Contractor falls behind the approved schedule, the Contractor shall take steps necessary to improve its progress, including those that may be required by the Contracting Officer, without additional cost to the Government. In this circumstance, the Contracting Officer may require the Contractor to increase the number of shifts, overtime operations, days of work, and/or the amount of construction plant, and to submit for approval any supplementary schedule or schedules in chart form as the Contracting Officer deems necessary to demonstrate how the approved rate of progress will be regained.
(c) Failure of the Contractor to comply with the requirements of the Contracting Officer under this clause shall be grounds for a determination by the Contracting Officer that the Contractor is not prosecuting the work with sufficient diligence to ensure completion within the time specified in the contract. Upon making this determination, the Contracting Officer may terminate the Contractor’s right to proceed with the work, or any separable part of it, in accordance with the default terms of this contract.

F.6 52.242-14 SUSPENSION OF WORK APR 1984
(a) The Contracting Officer may order the Contractor, in writing, to suspend, delay, or interrupt all or any part of the work of this contract for the period of time that the Contracting Officer determines appropriate for the convenience of the Government.
(b) If the performance of all or any part of the work is, for an unreasonable period of time, suspended, delayed, or interrupted (1)by an act of the Contracting Officer in the administration of this contract, or (2)by the Contracting Officer’s failure to act within the time specified in this contract (or within a reasonable time if not specified), an adjustment shall be made for any increase in the cost of performance of this contract (excluding profit) necessarily caused by the unreasonable suspension, delay, or interruption, and the contract modified in writing accordingly.
However, no adjustment shall be made under this clause for any suspension, delay, or interruption to the extent that performance would have been so suspended, delayed, or interrupted by any other cause, including the fault or negligence of the Contractor, or for which an equitable adjustment is provided for or excluded under any other term or condition of this contract.
(c) A claim under this clause shall not be allowed-
(1) For any costs incurred more than 20 days before the Contractor shall have notified the Contracting Officer in writing of the act or failure to act involved (but this requirement shall not apply as to a claim resulting from a suspension order); and
(2) Unless the claim, in an amount stated, is asserted in writing as soon as practicable after the termination of the suspension, delay, or interruption, but not later than the date of final payment under the contract.

G.3 CONTRACTING OFFICER'S REPRESENTATIVE
A. The Contracting Officer shall designate a Contracting Officer's Representative (COR) who will represent the Contracting Officer in the technical phase of the work. The COR's duties, responsibilities, and limitations of authority will be set forth in a written COR designation letter. A copy of the COR designation letter will be made available to the Contractor.
B. The COR is not authorized to make any changes to the terms and conditions of this contract. Only the Contracting Officer is authorized to make any changes to the contract by a properly written signed modification to the contract.
C. The Contracting Officer is the only official who can legally commit or obligate the Government for expenditure of public funds.
G.4 INVOICE AND PAYMENT
Electronic Invoicing and Payment Requirements- Invoice Processing Platform (IPP) (April 2013)
Payment requests must be submitted electronically through the U. S. Department of the
Treasury's Invoice Processing Platform System (IPP).
"Payment request" means any request for contract financing payment or invoice payment by the Contractor . To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice [CO to edit and include the documentation required under this contract]:
- A copy of the contractor’s invoice shall be included with the IPP invoice. If no invoice is attached, the Invoice will be rejected.
The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) prior to the contract award date, but no more than 3 - 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production
Helpdesk via email ippgroup@bos .frb.org or phone (866) 973-3131.
If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

SECTION H -- SPECIAL CONTRACT REQUIREMENTS
H.1 TRIBAL TAXES, REQUIREMENTS AND/OR RESTRICTIONS
(a) Special attention is called to FAR Clause 52.236-7, Permits and Responsibilities and FAR Clause 52.229-3, Federal, State, and Local Taxes. Offerors are responsible for contacting the tribe or tribal organization involved with regard to any requirements regarding tribal taxes, royalties and/or other applicable tribal laws or ordinances. Any costs associated with this section shall be included in the contractor's bid.
(b) Offerors are responsible for contacting the Office of the Navajo Nation Tax Commission and the Office of Labor Relations for tribal taxes. Current available information is identified at this link: Office of the Navajo Tax Commission (navajo-nsn.gov) for more information on Navajo Nation Tax Commission.
H.2 MODIFICATION PROPOSAL - COST BREAKDOWN
The Contractor, in connection with any proposal he makes for a contract modification, shall furnish a price breakdown, itemized as required by the Contracting Officer (CO). Unless otherwise directed, the breakdown shall be in sufficient detail to permit an analysis of all material, labor, equipment, subcontract, and overhead costs, as well as profit, and shall cover all work involved in the modification, whether such work was deleted, added, or changed. Any amount claimed for subcontractors shall be supported by a similar price breakdown. In addition, if the proposal includes a time extension, a justification thereof shall also be furnished. The proposal, together with the price breakdown and time extension justification, shall be furnished by the date specified by the Contracting Officer.
H.3 POST AWARD CONFERENCES – FIRM FIXED PRICE CONTRACTS
The Contracting Officer shall conduct monthly post award meetings with the contractor and the Contracting Officer’s Representative (COR). Discussions at these meetings will center on the contractor’s performance to determine if the contractor is meeting and performing in accordance with the contract terms and conditions. The Contracting Officer will ensure that minutes of the meetings are taken and copies provided to attendees.

H.4 CHANGES
The contractor shall not perform any of contingent sum work, until the Contracting Officer issues a modification authorizing performance of work in accordance with FAR clause 52.243-04, Changes and 52.243-5, Changes and Changed Conditions.
The Contractor shall promptly notify the Contracting Officer, in writing, of subsurface or any physical conditions for those indicated in this contract or unknown physical conditions at the site before proceeding with the work.
The change orders request shall be forward to the Contracting Officer by memorandum outlining the need and justification for the change order. Upon receipt of the change order request the Contracting Officer will request a cost proposal from the Contractor. All cost proposal shall be in detail and itemized, showing price breakdown in sufficient detail to permit and analysis of cost for material, labor, equipment, hours, taxes, insurance, bonds, overhead costs, profit, and complete description of work involved in the change order, including any time extension.
In an emergency situation, the Contracting Officer may grant a telephone approval, and immediately the Contractor shall follow through by submitting a written cost proposal to the Contracting Officer. The Contracting Officer will issue a contract modification to authorize the work for the “emergency”.
H.5 CONTRACTOR SAFETY PROGRAM REQUIREMENTS
The Contractor shall establish a safety program, which is consistent of FAR Clause 52.236-13 and also shall include at a minimum the following requirements.
A. Safety Program Submittal: Within 10 days following the awarding of a contract, the Contractor shall submit in writing to the Contracting Officer a proposed comprehensive safety program for approval. The Contractor’s safety program shall detail policies, procedures and plans that will be implemented to ensure the safety and health of employees and visitors at the job site. The Contractor shall prepare a list of major hazards associated with the contract work and provide in the safety program means to minimize the hazards.
B. Pre-Construction Safety Meeting: Representative of the Contractor shall meet with the Contracting Officer’s Representative and the Contracting Officer prior to the start of construction to review the safety program and discuss implementation of the…
