SECTION B – CONTINUATION

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. The solicitation document and incorporated provision and clauses are those in effect through 2022-04, effective date 01-30-2022.

This is a request for quote (RFQ) in accordance with FAR part 12, Commercial Items and FAR

13.5, Simplified Procedures for Certain Commercial Products and Commercial Services.

NAICS Code: 238330 – Flooring Contractors, $16.5M

Product Service Code: 7220 – Floor Coverings

ON- SITE INSPECTION:

The Contractor may request to inspect the site where the work is to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of the contract performance to the extent that the information is reasonably obtainable. Request may be coordinate with Susan Malaterre-Langan, Email: susan.mataterre-langan@bie.edu. However, due to COVID- 19 pandemic situation and at the discretion of Susan Malaterre-Langan, a site visit may not be provided.

This RFQ is 100% set-aside for Indian Small Business Economic Enterprises.

Offerors will not be reimbursed for any costs incurred in developing their submission in response to this RFQ.

Wage Determination - No.: 2015-5385, Revision No.: 16, Revision date: 12/27/2021 shall apply at time of award.

1. CONTRACT TYPE

The Department of the Interior (DOI), Bureau of Indian Education (BIE), Division of Acquisition anticipates awarding a single firm fixed price Purchase Order for removal and installation of new vinyl flooring in support of Ojibwa Indian School as a result of this opportunity.

2. SERVICE/SUPPLIES PRICES

Shipping shall be free on board (FOB) destination CONUS (Continental U.S.), which means that the seller must deliver the goods on its conveyance at the destination specified by the buyer, and the seller is responsible for the cost of shipping and risk of loss prior to actual delivery at the specified destination.

Prospective vendors shall provide a quote for the below Table 1 - Pricing Schedule for the product you can provide. Unless you clearly indicate in your quote that the product you are providing is an “equal” product, the prospective vendor shall provide the Brand Name Product provided in the price schedule.

No additional sums will be payable on account of any escalation in the cost of materials, equipment or labor, or because of the Contractor’s failure to properly estimate or accurately predict these prices or difficulty of achieving the results required by this contract. Nor will the contract price be adjusted on account of fluctuations in the currency exchange rates.

3. SCOPE OF WORK

Introduction:

1.0 Place of Performance: Ojibwa Indian School is Located at 9620 42nd Avenue NE., Belcourt, North Dakota. Student enrollment: 250 active students. All teachers and students returned to face to-face instruction in August 2022.

2.0 Period of Performance: The effect date of this contract is date of award through June 30, 2022.

3.0 General Requirements: Contractor shall remove old flooring, preparation of all rooms and hallways and install new vinyl plank tiles in all areas with exception of Mechanical and

Project Title gymnasium. Administrators are in the building 7:00 AM - 4:30 PM, however Maintenance

Supervisor can let Contractor in the building in the evenings to remove, prepare and install new flooring.

4.0 Contract Administration:

4.1 The CO responsibility: Authority to negotiate changes in terms, conditions, or amounts cited in this contract is reserved for the Contracting Officer. The contractor shall not perform work that is outside the SOW unless directed in writing by the Contracting Office

(CO). Any work done by the Contractor outside the SOW without direction from the

Contracting Officer will be at the Contractor's own risk.

4.2 The CO shall provide a Notice to Proceed (NTP) to begin performance of work after the contract has been awarded.

4.3 The COR is responsible for the following:

1. Monitoring the Contractor’s technical progress, including surveillance and assessment of performance and recommending to the Contracting Officer changes in requirement;

2. Performing technical evaluation as required;

3. Performing technical inspections and acceptance required by this contract; and

4. Assisting the Contractor in the resolution of problems encountered in performance.

5.0 Responsibility of Contractor:

5.1 The Contractor shall have complete responsibility for the management of floor installation work at site. The Contractor shall assign a Project Coordinator (PC) to represent the

Contractor at site and to manage the performance of work during currency of the contract.

The PC shall have adequate English language skills to be able to communicate with CO and COR.

5.2 The Contractor shall have complete responsibility and management control for the sub-contracted Contractor in dealings with the School.

5.3 The Contract shall have complete responsibility for safe performance of work at site and comply with all local laws pertaining to construction labor and safety. Should a conflict arise regarding the safety requirements relative to the SOW, the local laws and the requirements, the more stringent of the two shall apply.

5.4 Vinyl Floor Installation: The Contractor shall comply with security requirements and be responsible for conduct of employees and subcontractors at work site.

5.5 The Contractor shall be liable for the damages caused by the Contractor's negligent performance of any of the services furnished under this contract.

5.6 The Contractor shall provide warranty for workmanship and materials for 12 months from the date of final completion.

6.0 Execution of Work at Site

6.1 The COR and the Contractor shall review the method statement submitted with the technical proposal, before the contract award, and agree to a sequencing and phasing plan.

The Contractor shall begin activities in a phase after ensuring availability of material and tools.

6.2 The Contractor shall neatly stage materials and tools in a designated location. No tools and materials shall be left in work area at the end of work-day. Keep the work areas clear of hindrances, trip hazards, and unused materials at all times. The Contractor shall be

Project Title responsible for safe-keeping of materials and tools equipment at site. Move carpet materials from storage area to work area as needed for accomplishing work each day.

Store materials under conditions recommended by manufacturer.

6.3 The Contractor shall not damage any fixed property and provide temporary protective covers in a manner acceptable to COR. The Contractor shall, prior to starting removal of existing flooring, move & cover furniture with full covers, and move the moveable items

(including artwork, area rugs, table lamps, furnishings, or office equipment appliances} away from work area. Following completion of floor replacement in each room, the

Contractor shall remove covers, clean the fixtures with approved method and return the furniture and artwork to their original position.

6.4 If the Contractor spills any adhesive, or in any way soils the walls or other furnishings, the

Contractor shall clean up using a specialist at the Contractor's expense.

6.5 Contractor shall provide equipment for maximum exhaust ventilation during installation to protect occupants from exposure to odors and pollutants and protective barriers to keep dust, pollutants from spreading to other parts of the building.

6.6 The Contractor shall move the modular workstations to install floor behind/ under them.

The School IT Specialist will assist the Contractor to disconnect and reassemble sections of the workstations as well as the electric/ telecom equipment.

6.7 The Contractor shall contain debris including old flooring materials, empty cardboard containers, adhesive rollers, plastic sheets, etc. and Contractor must take debris to the local landfill, they cannot use school dumpsters as per Facility Manager.

7.0 Specifications:

7.1 Glue down flooring 5.5 mil thick, high pressure glue, 14,400 lineal ft. cove base {100,000

sq. ft.) - all 30 new transition strips must be glued down - cove base needs to be water sealed - gun metal cove base color

7.2 Vinyl flooring shall be installed by trained installers trained in the installation of commercial flooring in projects of similar size and scope specified herein.

7.3 Prior to the installation, and at the COR's direction, meet at the project site to review installation procedures, coordination with other elements, special details and conditions, standard of workmanship, and other pertinent topics related to the work. Examine existing installation and install sample of new tiles for review and agreement on methods of work performance.

7.4 Vinyl Flooring replacement work activities shall include removal of old floor vinyl, if needed and installation of new vinyl flooring. Remove old tiles, if needed and place in dumpster for disposal. Clean floor surface to remove dust, dirt, staple pins, paper clips and other such items. Scrape old glue or tile pieces, if stuck to the floor surface. The floor surface to receive new vinyl flooring shall be smooth, free from loose particles or any foreign materials or humps.

8.0 Qualifications: Contractor shall ensure all personnel are trained, competent and posses a current valid license, certification, etc. to perform work.

9.0 Government furnished property/information: All unique government information related to this service that is necessary for Contractor performance will be made available to the

Contractor. The Contracting Officer or COR designee will be the point of contact for identification of any information supplied by the government.

Project Title provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the

Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor

Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the

Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)

(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. 52.212-17 Option to Extend Services (Nov 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The

Contracting Officer may exercise the option by written notice to the Contractor within 30 days prior to contract expiration.
