SECTION B – CONTINUATION

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. The solicitation document and incorporated provision and clauses are those in effect through 2022-04, effective date 01-30-2022.

This is a request for quote (RFQ) in accordance with FAR part 12, Commercial Items and FAR

13, Simplified Acquisition Procedures.

Product Service Code: PSC 7125 - Cabinets, Lockers, Bins, and Shelving

ON- SITE INSPECTION:

The Contractor may request to inspect the site where the work is to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of the contract performance to the extent that the information is reasonably obtainable. Request may be coordinate with Mr. Curtis Keplin, Email: curtis.keplin@bie.edu. However, due to COVID 19 pandemic situation and at the discretion of Mr. Keplin, a site visit may not be provided.

This RFQ is 100% set-aside for Indian Small Business Economic Enterprises.

Offerors will not be reimbursed for any costs incurred in developing their submission in response to this RFQ.

Wage Determination - No.: 2015-5383, Revision No.: 16, Revision date: 12/27/2021 shall apply at time of award.

1. CONTRACT TYPE

The Department of the Interior (DOI), Bureau of Indian Education (BIE), Division of

Acquisition anticipates awarding a single firm fixed price Purchase Order for removal and installation of new student lockers in support of Turtle Mountain Elementary School as a result of this opportunity.

2. SERVICE/SUPPLIES PRICES

Shipping must be free on board (FOB) destination CONUS (Continental U.S.), which means that the seller must deliver the goods on its conveyance at the destination specified by the buyer, and the seller is responsible for the cost of shipping and risk of loss prior to actual delivery at the specified destination.

Prospective vendors shall provide a quote for the below Table 1-1 Pricing Schedule for the product you can provide. Unless you clearly indicate in your quote that the product you are providing is an “equal” product, the prospective vendor shall provide the Brand Name Product provided in the price schedule.

Project Title

No additional sums will be payable on account of any escalation in the cost of materials, equipment or labor, or because of the Contractor’s failure to properly estimate or accurately predict these prices or difficulty of achieving the results required by this contract. Nor will the contract price be adjusted on account of fluctuations in the currency exchange rates.

3. SCOPE OF WORK

A. Purpose: Contractor shall remove and install 720 student lockers for the Turtle Mountain

Elementary School.

B. Location: Turtle Mountain Elementary School, 1350 Braves Blvd., Belcourt, ND 58316

C. Description of Service:

Project Title

Description of Service: Contractor shall provide all labor, material, tools, equipment, transportation, and supervision necessary to remove old lockers, provide delivery, assemble and install new student lockers at Turtle Mountain Elementary School in a manner that will maintain a satisfactory facility condition and present a clean, neat, and professional appearance.

The Contractor shall be required to

(a) commence work under this contract upon receipt of the award,

(b) prosecute the work diligently, and

(c) complete the entire work ready for use no later than June 30, 2022. The time stated for completion shall include final cleanup of the premises.

D. Scope/General Requirements/ Contractor Responsibility:

1. All work and services shall be performed in a skillful and workmanlike manner and shall meet all building code regulations.

2. Work Hours: All work shall be performed during normal business hours, 8:00 a.m. to 5:00 p.m., Monday through Friday, unless otherwise specified by the Facility Manager.

3. The Contractor shall provide all labor, materials, services and equipment required to complete tasks. All materials and supplies shall be of the highest and suitable grade and quality or equivalent free from any defects or imperfections for the purposes needed.

4. The contractor shall provide a milestone chart in which the Contractor proposes to perform the work, and the dates in which the Contractor contemplates starting and completing the work.

5. The Contractor shall implement all necessary work control procedures to ensure timely accomplishment of work requirements, as well as to permit tracking and reporting of work in progress. The Contractor shall plan and schedule work to assure material, labor, and equipment are available to complete work requirements within the specified time limits and in conformance with the quality standards established herein. Verbal scheduling and work status updates shall be provided when requested by the POC/COR. A status update of any item of work must be provided within two hours of the inquiry during regular operating hours.

6. The contractor shall provide a guaranteed warranty of work.

7. Licenses: Contractor shall maintain in current status all federal, state, and local licenses and permits required for the operation of the business conducted by the Contractor.

8. Safety Standards: All items supplied on this contract shall comply with current applicable

Occupational Safety and Health Standards of the State of North Dakota and other applicable safety standards.

9. Performance Interference: Contractor shall notify the POC/COR immediately of any occurrence of conditions that interfere with the full performance of the contract and confirm it in writing within twenty-four (24) hours.

10. The Contractor shall perform all work under this contract in strict accordance with all safety codes to eliminate the possibility of damage or injury to personnel, equipment, and

Project Title building structures. The contractor shall display warning signs in all areas where Contractor operations may cause traffic obstructions or personal hazards. All signs shall be placed so that they are visible from all approaches.

11. The contractor shall provide and maintain all tools and equipment necessary to perform the required work.

12. No product for this contract shall be drop shipped directly to the project site. All deliveries must be coordinated by the Contractor and delivered to the Turtle Mountain Elementary

School at the time of installation. The Contractor shall provide all necessary materials, equipment, labor, supervision, and management to: (1) coordinate pick-up; (2) load and unload; (3) place/install per provided site plan; (4) assemble items as required; (5) secure and store, as designated; and (6) properly dispose of all associated packing/crating materials.

13. Contractor shall remove existing lockers and dispose daily.

14. Contractor shall demolish existing concrete bases in areas needed to allow for installation of new locker systems.

15. Locker layout shall be discussed with POC/COR so bulletin boards or murals can be relocated.

16. Install fillers and finished ends as needed on banks of lockers.

17. Discuss with POC/COR the locker layout as the layout may differ from existing and locker count may change. POC/COR shall approve the proposed layout prior to work being performed.

18. Pre and Final Acceptance Inspection: The Inspection personnel, plus the superintendent or other primary management person, and the POC/COR shall attend this inspection.

Additional Government personnel may also be in attendance. The final acceptance inspection will be formally scheduled by the POC/COR based upon results of any Pre-Final inspection. Notice shall be given to the POC/COR prior to the final acceptance inspection and shall include the Contractor's assurance that all specific items previously identified to the Contractor as being unacceptable, along with all remaining work performed under the contract, will be complete and acceptable by the date scheduled for the final acceptance inspection.

E. Background Investigations: The awarded contractor shall provide a designated individual(s) from their company who will be subject to a BIA Security Background

Investigations in accordance with Section 231 of the Crime Control Act of 1990, Public Law

101-647. Background Investigation forms will be provided at the pre-construction meeting.

F. Changes

The Contracting Officer is the only person authorized to approve all changes to this requirement that will affect the scope of work and/or incur additional cost. No changes to contract shall be made without a formal written SF 30 modification authorizing such change is issued by the

Contracting Officer.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the

Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor

Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the

Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)

(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items.
