C.1 STATEMENT OF WORK

Statement of Work for

Kitchen Equipment Replacement and Disposal of Equipment at

Fort Wingate High School Fort Wingate New Mexico

McKinley County November 4, 2020

GENERAL DESIGN REQUIREMENTS

SCOPE OF WORK

Kitchen Equipment Summary: The scope of work shall be purchasing of kitchen items, and installation of kitchen equipment which include:

1) Three (3) –Convotherm Combi Oven/ Steamer, 1.0W,120v/60/1ph, 10.6 amp, 218,400BTU, cUlus, NFS

2) (1) Reverse Osmosis system - 50 gallon atmospheric storage tank, 350 gpd production.

Wingate High School’s objective is to remove old portable combi ovens from there position, dispose of old equipment and replace by placing new combi ovens in place of old equipment with much needed kitchen equipment for students, staff, and faculty at their school with energy efficient equipment(s). Install inline reverse osmosis water system by inserting into existing above floor water line in place behind the portable combi ovens.

The vendor shall provide all goods required at a fair and economical price, be able to deliver, and install in a timely manner and provide items to be of good quality and durable. Items to be bid all or none and a comparable item would need to be clarified and accepted to be included in the final purchase.

Kitchen Equipment Requirement Inspection, Findings Reporting and Replacement:

The contractor shall furnish, install, and test of all existing equipment required for a complete operation of all kitchen equipment at Wingate High School. Any Material and/or equipment necessary for the proper operation of the system not specified or described in this SOW shall be deemed part of the replacement project, but not limited to other items in need of corrective action not addressed below:

a. Full replacement of Kitchen Equipment, conduct kitchen equipment operation and programing after replacement for the entire cafeteria.

b. Primary power supply. Verify that the circuit provides correct voltage to the all replaced items, labeling at the electrical panel board.

c. Liquefied petroleum supply, verify the proper size of existing gas lines

d. Visible equipment testing on temperature settings and operation. Ensure it meets the school requirements and standards per Principal.

e. Test all read out system.

f. All other testing /trouble shooting not listed above.

g. Notification –Before proceeding with any testing, Contractor and Facility Management office will coordinate with all administrative staff, persons and facilities and all building occupants shall be notified to of the testing to prevent unnecessary responses.

Installer Quality Assurance:

For all work, Contractors personal shall be trained and certified by the manufacturer for installation and certified by National Institute for Certification in Engineering Technologies (NICET), minimum at Level III and work performed by a UL –Listed Company.

Company to submit certifications to the BIA Contracting Officer prior to construction.

Security Background Checks:

The Contractor is required to participate and submit a background Clearance Check for the Contractors Project Superintend who will be working at the project location. BIA will provide the required forms and will pay for the clearance documentation if Superintendent is not cleared.

Site Visit Prior to Submitting Bid Proposal:

Contractor and its technical staff are encouraged to make a site visit prior to submitting a bid proposal to acquaint themselves with the site, project buildings, and equipment conditions. All preliminary costs related to the bidding of the project will not be reimbursed to the prospective Contractor.

Document Title

As Built Drawings:

Upon completion and acceptance of new work, Contractor shall submit copies AS_BUILT drawings and equipment list.

Operations and Maintenance Manuals:

Provide (1) set of Operation and Maintenance Manuel on all new equipment installed on this project.

Project Location:

The Project is located on the Navajo Indian Reservation, approximately 15 miles east of Gallup, New Mexico, Exit I-40 at Exit 33 and 3 miles on state Highway 400 south at Fort Wingate High School, 9th through 12th grade Facility, Fort Wingate, New Mexico, and McKinley County.

Demolition of Existing Kitchen Equipment:

Upon completion and acceptance of the new systems, it will also be the responsibility of the Contractor to demolish and properly dispose of all the existing equipment and devices that were replaced.

Final Inspection Submittal Requirements:

Contractor shall submit to the COR, the following documents prior to the final inspection:

a) Written statement that the system has been replaced and installed per approved plans and tested to manufacturer’s specifications and requirements.

Training:

One (1) hour of training shall be provided for the replaced kitchen Equipment. The Contractor shall also provide a certified training on their system whereby the maintenance person can gain experience and knowledge and get initial certification on the system.

Patch, Repair and Re-finish:

Contractor shall patch, repair, refinish and prime and paint all walls and ceilings where existing or new devices, pipes and panels were removed or any place(s) of disturbances(s). Match existing wall and ceiling paint colors. Paint new exposed electrical metal tubing (EMT) conduit to match existing wall and Ceiling surfaces color. Contractor is responsible for all damages during the construction period without additional cost to the government.

Code Requirements:

The following codes, handbooks, regulatory agency requirements shall apply to the project.

a. BIA School Facilities Design Handbook dated March 30, 2007.

Bid Proposal:

The bid proposal shall include all material, labor, tools, equipment, transportation, freight, insurance, supervision, the state of New Mexico Gross Receipt Taxes, Navajo Tribal taxes ( based on 6 percent of total cost estimate). Department of labor- Davis Bacon wage rates and applicable for this project.

Temporary Utilities:

Contractor shall be responsible for all temporary utilities.

Temporary Office and Housing:

Construction office space and housing accommodation are not available at the school location.

PERFORMANCE TIMES AND DELIVERY DATES:

The project will be completed in the following states

1. On-site Inspection 2 Calendar days

2. Written Report on project 2 Calendar days

3. Construction on Replacement 3 Calendar days

4. Final Inspection and Testing 1 Calendar day

Project Duration time: 8 total Calendar Days

Payments shall be made in accordance with the provision of the contract.

C.2 COVID-19 GUIDELINES

The following guidelines will be adhered to at BIE-Fort Wingate High School l as preventive health strategy in response to the COVID-19 health pandemic. These guidelines are based on the Centers for Disease Control and Prevention (CDC) and Occupational Safety and Health Administration (OSHA) best practices to minimize risk of coronavirus transmission as employees return to the workplace.

(a) COVID Symptoms. Any Contractor personnel, employees, subcontractors, partners, or workers who are experiencing symptoms of COVID-19, including but not limited to cough, shortness of breath or difficulty breathing, fever, chills, muscle pain, sore throat, new loss of taste or smell should not report to work. Employees may be allowed to return to work after 14 days of having no symptoms. Contractor’s project managers and site superintendents are responsible to monitor employees for symptoms before and during work, and follow appropriate precautions in accordance with CDC Guidance –Safety Practices for Critical Infrastructure Workers. https://www.cdc.gov/coronavirus/2019-ncov/community/critical-workers/implementing-safety-practices.html. If a Contractor’s employee is unsure if they are sick, they should consult their supervisor. Visitors exhibiting or reporting COVID-19 symptoms (i.e., cough or shortness of breath or difficulty breathing fever, chills, muscle pain, sore throat, new loss of taste or smell) should be encouraged through notice and signage to leave the facility and reschedule their meeting/visit for a future time when they are in good health.

(b) Face Covers. Contractor personnel are required to wear cloth face coverings while onsite. Cloth face coverings may prevent people who do not know they have the virus from transmitting it to others. CDC does not recommend the general public wear surgical masks or N-95 respirators to protect themselves from respiratory diseases, including coronavirus (COVID-19). N-95s and other filtering face piece respirators should continue to be reserved for those at increased risk of exposure including health care workers and other medical first responders, as recommended by current CDC guidance and a job hazard analysis. Appropriate Personal Protective Equipment (PPE). Cloth face coverings are not respirators and are not appropriate substitutes where filtering face piece respirators are required. Employees who are performing tasks at elevated risk requiring respirators as identified through the job hazards analysis will be provided with the appropriate Personal Protective Equipment (PPE) to perform their jobs safely.

(c) Social Distancing. The CDC guidance includes a primary objective of disease mitigation through good hygiene, staying home when sick, and social distancing. Social distancing is a set of actions taken to stop or slow the spread of a highly contagious disease. The CDC has determined that social distancing is an essential step in preventing the spread of COVID-19. The goal of social distancing is to limit face-to-face contact to decrease the spread of illness among people in community settings. Employees should practice social distancing by putting space (currently six feet) between themselves and others. Visitors that exceed the maximum occupancy for the space should not enter the space. Waiting areas should have suitable floor markings to facilitate social distancing.

(d) Hygiene. Contractors will have an overall cleaning schedule that is consistent with CDC cleaning recommendations including using Environmental Protection Agency (EPA) recommended cleaning and disinfecting solutions (https://www.cdc.gov/coronavirus/2019-ncov/community/disinfecting-building-facility.html). Additionally, the Contractor shall encourage and support frequent hand washing, hand sanitizing and wiping down of surfaces in high traffic, shared spaces (e.g., elevator lobbies, community desk, pantry, nooks, meeting rooms, restrooms, phone booths). Workstation configurations and schedules should accommodate simplified cleaning measures wherever possible.

C.3 Payment for Unauthorized Work

No payments will be made for any unauthorized supplies and/or services, or for any unauthorized changes to the work specified herein. This includes any services performed by the Contractor of their own volition or at the request of an individual other than a duly appointed Contracting Officer. Only a duly appointed Contracting Officer is authorized to change the specifications, terms, and conditions under this effort.

C.4 Notice Regarding Late Delivery/Delayed Performance

The contractor will immediately notify the Contracting Officer in writing in the event the contractor encounters difficulty in performance by giving pertinent details, including the date by which it expects to complete performance or make delivery. However, the notification will be informal only in character and will not be construed as a waiver by the Government of any contractual delivery schedule or date, or any rights or remedies provided by law or under this effort.

To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice

- A copy of the contractor’s invoice shall be included with the IPP invoice. If no invoice is attached, the Invoice will be rejected.

The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) within 3 - 5 business days of the contract award date.
