COMBINED SYNOPSIS/SOLICITATION FOR COMMERCIAL ITEMS

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) subpart 12.6, “Streamlined Procedures for Evaluation and Solicitation for Commercial Items,” as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation document will not be issued. This solicitation is a Request for Quotation (RFQ). This RFQ document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2020-07 effective 07-02-2020.

Contractor shall provide all the resources to assume the deliverables as provided in the Statement of Work. Brand Name or Equal: To satisfy the Government’s needs, the Original Equipment Manufacturer (OEM) product you are providing must meet or exceed the Kajeet Smartspots.

SECTION I: PRICE SCHEDULE:

Prospective vendors shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the product you are providing, verified by an authorization letter or other documents from the OEM. All services and warranty associated with the product shall be in accordance with the OEM terms and conditions.

Shipping must be free on board (FOB) destination CONUS (Continental U.S.), which means that the seller must deliver the goods on its conveyance at the destination specified by the buyer, and the seller is responsible for the cost of shipping and risk of loss prior to actual delivery at the specified destination.

Prospective vendors shall provide a quote for the below Table 1-1 Pricing Schedule for the base and all option years with the OEM product you can provide. Unless you clearly indicates in your quote that the product you are providing is an “equal” product, the prospective vendor shall provide the Brand Name product referenced in the below Statement of Work.

Quotes may be submitted on company generated documents but must be itemized as provided in the below Table 1 - Pricing Table.

SECTION II STATEMENT OF WORK

1. Background: Bureau of Indian Education K-12 schools has economically disadvantaged students who lack access to broadband Internet when they leave school. With the COVID-19 Pandemic, many of our schools will be doing distance and virtual learning for our students.

Many of our staff and students will need access to online resources anytime, anywhere.

2. Scope: The BIE, Pine Ridge School needs mobile Wi-Fi hotspot devices and related service that provides safe access to our distance and virtual classroom learning initiative.

2.1 Specifically, the scope of services requires the contractor to provide the most economical and beneficial mobile Wi-Fi hotspot devices and related data services package that is 100% Children's Internet Protection Act (CIPA) and Exclusively for Education use. Default Filter setting - Block out adult and objectionable content – (All of YouTube).

2.2 Renewable Annual Service: At the end of each service period, the school’s administrator/technical point of contact will access the data usage consumption to determine if an increase or decrease in data is necessary. If a change in data in necessary, the contractor shall provide a new service quote upon request.

2.3 Any contract resulting from this SOW may be modified at any time to accommodate increases or decreases in the number of end users supported. No changes shall be made without a formal written SF 30 modification authorizing such change is issued by the Contracting Officer.

3. Brand Name or Equal: This is a Brand Name or Equal requirement. “Equal” products, including “equal” product of the brand name manufacture, must meet the salient physical, functional, or performance characteristic. The brand name or equal products are specified in the above Pricing Table.

4. Government’s Point of Contact. The Government’s technical point of contact information for the contract will be provided at contract award.

SECTION III: 52.212-1 INSTRUCTIONS TO OFFERORS-COMMERCIAL ITEMS

(OCT 2018) ADDENDUM

QUOTE DUE DATE: 03/3/20 AT 9:00 AM CENTRAL TIME

Basis for Award: This RFQ is issued in conjunction with FAR 13 Simplified Acquisition Procedures. The Government will make award to the responsible vendor whose quote conforming to the solicitation will be the lowest price meeting the requirement.

Evaluation Approach. The Government will evaluate quotations in accordance with the evaluation process outlined in FAR 13.106-2 (b) (3). The Contracting Officer will evaluate “equal” products on the basis of information furnished by the prospective vendor.

CUSTOM CLAUSE #1 –Electronic Invoicing and Payment Requirements – Internet Payment Platform (IPP) (April 2013)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Internet Payment Platform System (IPP). "Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).

Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice - A copy of the contractor’s invoice shall be included with the IPP invoice. If no invoice is attached, the Invoice will be rejected.

Invoice Contents:

Invoices will be paid upon approval and acceptance by the Government COR. Invoices must include, as a minimum, the following information:

Final Invoice Within sixty calendar days of acceptance and/or completion of services:

a. The contractor shall submit a final invoice, designated as such by a clear statement of “FINAL INVOICE” on the face of the invoice document.

b. The contractor shall provide a certificate of completion which certifies all goods and service have been provided as required by this task order.

c. The contractor shall provide a release of claims against the government for any further payment under this task order.

The sixty calendar day submission timeframe shall not be extended without written authorization from the contracting officer. In the event items a, b, or c above are not submitted within the authorized timeframe, the contracting officer will make final cost determinations in order to make final payment and close out the contract unilaterally.

The Contractor must use the IPP website to register, access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in CCR) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) within 3 – 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.

If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the contracting officer with its quotation.

To constitute a proper invoice, the invoice must conform to the requirements identified in FAR 32.905(b), “Payment Documentation and Process” and FAR 52.232-25, “Prompt Payment (OCT 2003)”.

(d) Comptroller General Examination of Record. (3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(2) While not required, the Contractor may include in its subcontracts for commercial items a minimal number of additional clauses necessary to satisfy its contractual obligations.

52.217-8 OPTION TO EXTEND SERVICES. (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days of contract ending date.

For any option exercised under this clause, the evaluation of options will be accomplished by using the same rates as those in effect under the contract each time an option is exercised under this clause and will be added to the base and all option periods to arrive at the total price.

52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract ending date. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
