SECTION C – DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

C.1 Scope Of Contract

The intent of this contract is to secure hazardous fuels reduction related services to perform fuelbreak construction/reconstruction activities on up to 514 acres of mixed chaparral shrub lands located either side of North Main Divide Road, Bedford Ridge Road and/or the main ridge of the Santa Ana Mountains. One additional 15 acre treatment unit lies west of the community of Rancho Capistrano in the San Mateo Wilderness. Activities will be performed solely on national forest system lands within the Trabuco Ranger District of the Cleveland National Forest in eastern Orange and western Riverside Counties, California.

Treatments would occur over the course of three years; one base year plus two option years to be exercised by the Forest based on fiscal year funding levels.

Contractor activities include cutting of live and dead shrubs with chainsaw, hand piling activity slash in addition to any existing dead and down woody debris; and covering piles with wax coated kraft paper. Within the San Mateo Wilderness, cutting of live and dead shrubs would be performed without the use of chainsaws, e.g., bypass loppers.

Optional items are included in the contract for completing fire line construction along the perimeter of each unit treated in the contract during each of the three years. Award is dependent on contractor price and available funding.

Services would be performed starting on August 1st of each season beginning in 2022.

Contractor Responsibility: The Contractor shall provide everything--including, but not limited to, all equipment, supplies, transportation, labor, and supervision--necessary to complete the project, except for that which the contract clearly states is to be furnished by the Government.

C.2 Project Location & Description

Location: The Project is located on the Cleveland National Forest, Trabuco Ranger District in eastern Orange and western Riverside counties.

The project area includes 7 units totaling 514 acres located along North Main Divide Road and Bedford Ridge Road from just north of the intersection with Maple Springs Road in the South to Sierra Peak in the North.

C.8-2 Specifications

C.8-2.1 CHAPARRAL FUELBREAK CONSTRUCTION

**Within the 14 acres located adjacent to the community of Rancho Capistrano and within the San Mateo congressionally designated Wilderness, chainsaws shall not be used to cut specified shrubs. Bypass loppers and other non-mechanical means must be utilized to be treat shrubs identified for cutting.

C.8-2.1.1 Thinning of Shrubs and Small Trees w/ Chainsaw – Cut and sever ALL dead shrubs.

Additionally, cut and sever below the lowest live limb 80 percent of live shrubs in an irregular fashion.

Leave untreated islands which represent the pretreatment species composition, generally no greater than 0.10 acre in size (37.2 foot radius for circular leave area), in an irregular pattern and shape distributed throughout the unit on a per acre basis.

Leave Islands shall not be clumped or left on any one portion of the unit and shall not occur within 50 feet of the road or unit boundary.

Islands, as well as unit boundaries, should have a wavy form or outline to provide a natural appearance.

Small conifers and hardwoods < 8 inches in DBH may be cut to create a minimum of 10’ spacing between residual tree crowns.

All residual trees shall be pruned to six feet in height, both live and dead limbs removed.

To remove fuel ladders, shrubs shall not be retained underneath residual trees.

Manzanita is the preferred leave shrub species but may be cut to meet targeted shrub cover removal. Leave shrubs of any species shall not be pruned or limbed to create an unnatural appearance.

Small populations and individuals of Heart-leave pitcher sage shall be left untreated. See photo for identification purposes and map of general locations (see section C.8-8 figures 1 and 2).

Shrubs shall be severed below a 4-inch height.

Dead or otherwise hazardous trees within the Fuelbreak boundary shall be cut regardless of dbh.

Piles may not be created within 100 feet of improvements, i.e., utility lines, gates, or outbuildings and residences.

C.8-2.1.3 Pile Construction - All piles shall be constructed by laying cut stems, and all other slash, including existing down woody material in the pile, in a vertical arrangement, to be triangular in shape, resembling a teepee.

Slash shall be bucked to 4-foot lengths to facilitate tight piles.

C.8-2.1.4 Pile Size – Unless approved otherwise by the COR in writing, maximum pile size shall be 10 feet in diameter by 6 feet in height, and minimum pile size shall be 5 feet in diameter by 3 feet in height at the time of final inspection.

C.8-2.1.5 Pile Covering – All constructed piles shall receive one – (1) 4-foot-wide by 6 foot long sheet, or multiples sheets to cover 60 percent of the surface area, whichever is greater; of 50 wt. wax covered Kraft paper at the 2/3rd depth of the pile.

Contractor shall pile additional material (top third) on top of the Kraft paper to prevent paper from moving off the pile by environmental conditions.

On hillsides, paper shall be shifted to downhill side of pile to allow for ease of ignition.

C.8-2.2 FIRE LINE CONSTRUCTION (OPTIONAL)

Upon Forest Service exercise of optional fire line construction items, fire line would be constructed along the perimeter of each unit as awarded.

C.8-2.2.1 Fire Line Location, Width Fire line shall be constructed directly adjacent to the treatment boundary following the line of cut and uncut vegetation.

Construction shall consist of cutting, scaping, and removing vegetative debris, forest residues, roots, grasses, and forbs until mineral soil is fully exposed thus removing any continuous fuel between the treated and untreated areas.

Constructed fire line shall meet a minimum width requirement of 3 feet of exposed mineral soil along the entirety of its length.

C.8-2.2.2 Water Bar Placement Water bars shall be placed on fire line constructed along the fall line (up/down slope) when slopes exceed 6 percent. Spacing shall be calculated in the field using a clinometer by walking downslope on the fire line till the prior water bar when viewed through the clinometer aligns with the zero mark. A water bar is then placed at point of standing.

Additionally, see recommended spacing in C.8-8 figure 3.

Water bars shall be constructed at 45 degrees to the fire line and extend beyond constructed fire line by 2 feet to drain water away from downhill constructed fire line.

Height of water bar will vary with slope, but shall be of a minimum to dissipate energy from overland flow and direct water of line.

COR will have final approval on placement and size.

C.8-3 Contractor-Furnished Equipment

Unless otherwise specified herein, the Contractor shall provide all labor, transportation, materials, and equipment necessary to perform the work as described herein.

The Forest Service anticipates the use of chainsaws, bypass loppers, wheeled chipper capable of chipping < 3 inch diameter material, and manual labor to complete the tasks stated under C.8-2.1

The Contractor shall begin work within 7 calendar days after the effective date of the Notice to Proceed and shall prosecute the work at a rate that will result in completion of all work within the following time frame:

Item No. Estimated Start Work Date Contract Time (Calendar Days)

0001 August 1, 2022 73 Calendar Days

Option 1 & 2 August of that year

Failure to begin work on schedule will make the contract subject to immediate termination for default.

Delays due to normal adverse weather, weekends, and holidays have been included in the calculation of contract time. The Government reserves the right to set the priority of items or subitems. Contractor shall complete all work on one subitem before proceeding to another.

[] If this solicitation has more than one numbered item, award of more than one item to one contractor will not change the start work dates or the amount of contract time; times will run concurrently.

[ ] In the event of award of more than one item to one contractor, times will run consecutively. Time on the second item will begin automatically the day following expiration of time (including any extensions) on the first item. Likewise, time on a third item would begin immediately following expiration of time on the second, and so on.

Winter Shutdown

When winter weather sets in and the continuation of work is impractical, the Contracting Officer may authorize a total suspension until such time as work can proceed. During the period of total suspension, the calendar days elapsed will not be charged against the contract time.

SECTION G--CONTRACT ADMINISTRATION DATA

Pre-work Pre-work conference. Before work begins on service contracts, a pre-work conference is normally held to discuss the contract--especially the specifications, labor provisions, plan of work, and selected standard clauses. The pre-work meeting should be attended by an officer of the firm or someone designated in writing to act on behalf of the firm. The pre-work meeting may be waived at the discretion of the Contracting Officer.

Notice to Proceed.

A. [] No work may begin on this contract until the Contracting Officer has issued a Notice to Proceed.

B. [ ] Work on this contract may proceed and contract time will begin upon receipt of the awarded contract. Any adjustments to the anticipated completion date will be noted in the award letter.

Measurement Methods of Measurement.

[ ] Acreage was measured by dot grid method from aerial photographs.

[ ] Acreage was measured on a horizontal plane using compass and chain.

[] Acreage was measured on a horizontal plane using a Global Positioning System.

[ ] Linear measurements have been taken with a wheel on the centerline of the trail or road.

[ ] Estimated acreage: Actual acreage worked will be measured by the method(s) indicated above.

Remeasurement. Unless otherwise indicated by this contract, the contractor may request remeasurement of any quantities in Part B, when the units are acres or any linear measurement.

The request must be made in writing and must be made within 10 calendar days of completing work on the unit in question. If remeasurement indicates a variance of five percent or less from the stated quantity, the Contractor shall pay for the actual cost of remeasurement and no adjustment will be made in the quantity as stated in Part B. If remeasurement indicates a variance more than five percent from the stated quantity, payment will be based on the remeasured quantity, and the Contractor will not be liable for the costs of remeasurement. All remeasurements will be done by the Government. Remeasurement of acreage will be done with two people using a hand compass and ground measurement or by means of a Global Positioning System. This clause is not applicable to quantities listed as estimated quantities.

Payment Payments and Deductions. Payment will be made for fully acceptable work at the prices bid in the schedule of items. In the event of extended non-work periods because of adverse weather, the Contracting Officer may authorize progress payments for partially completed sub-items on a case-by- case basis. In accordance with the inspection clause, payment may be made for less than fully acceptable work at a reduced price. Other exceptions are noted below:

A. [] Payment will be made in full if inspection results are 90 percent or higher. No payment will be made if inspection results are less than 90 percent.

B. [ ] Payment will be made in full if inspection results are 90 percent or higher. If inspection results are below 90 percent, a deduction will be made equal to 2 percent for every 1 percent below 90. For example, if inspection results are 87 percent, the bid price would be reduced by 6 percent. No payment will be made if results are less than 80 percent.

C. [ ] Liquidated damages will be charged as follows:

Contract Release. The following supplements the Payments clause in Section I:

Before final payment will be made the Contractor shall sign a release of all claims against the Government arising by virtue of this contract, other than claims, in stated amounts, that the Contractor has specifically excepted from the operation of the release. A release may also be required of the assignee if the Contractor's claim to amounts payable under this contract has been assigned under the Assignment of Claims Act of 1940 (31 U.S.C. 3727 and 41 U.S.C. 15).

Invoices.

Payment will be made from the contractor’s invoice. All invoices are to be submitted via the electronic Invoice Processing Platform (IPP). This is a mandatory requirement initiated by the U.S. Department of Treasury and you can find more information at this website https://www.ipp.gov/index.htm There is no pre-award registration.

After award of a contract, please make sure that your company registers promptly at https://www.ipp.gov/vendors/enrollment-vendors.htm to establish your account. PRIOR to starting the IPP enrollment process, please verify that the point of contact’s (POC’s) email address is up to date in your company’s System for Award Management (SAM) account at www.sam.gov and that any recent update(s) have been allowed time to process resulting in an “Active” status on the SAM account. The one-time enrollment in IPP means a series of emails will be sent to the SAM POC. If you have questions on the IPP enrollment process, the help desk phone number is 1-866-973-3131.

RETAINAGE (applicable to service contracts where work accomplishments are measured in units other than time)

The following supplements Clause 52.232-1, Payments:

The Contracting Officer may retain up to 10 percent of the invoiced amount if the contractor is behind schedule at the time the invoice is presented. “Behind schedule” means that the percentage of work completed is less than the percentage of time used.
