Repair and Maintenance
PART 1 – Description The Food and Drug Administration (FDA) Northeast Food & Feed Laboratory (NFFL) and the Detroit
Laboratory perform numerous analyses that require the use of inductively coupled plasma mass spectrometers to detect trace levels of metals in regulated products.
This solicitation is a Request for Quote (RFQ) using FAR Part 12 and 13 procedures. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2020-04 January 15, 2020. The North American Industry Classification System (NAICS) code for the proposed acquisition is 811219, Other Electronic and Precision Equipment Repair and Maintenance.

PART 3 – Description/Specifications
3.1 STATEMENT OF WORK: Purchase of Triple Quadrupole Mass Spectrometer
NFFL and Detroit Laboratory require new Inductively Coupled Plasma Triple Quadrupole Mass Spectrometry (ICP-QQQ-) systems to detect trace/low level of toxic elements in various types of food matrices while reducing interferences. Arsenic, an element currently under Office of Regulatory Science’s (ORS) compliance program for toxic metals analysis, will be more accurately and efficiently analyzed with an ICP triple quadrupole mass spectrometer system. Additionally, the Center of Food Safety and Applied Nutrition (CFSAN) is issuing a new method that utilizes the capabilities of a triple quadrupole mass spectrometer system. Both NFFL and Detroit will require a new instrument to implement these methods and use them for regulatory sample analysis.
Scope
The Contractor shall provide all resources necessary to accomplish the tasks and deliverables described in this Statement of Work (SOW). The Contractor shall provide two ICP-QQQ systems that meet the requirements set forth below:
I. Requirements
Minimum Technical Requirements:
• Shall have an additional quadrupole placed before the reaction cell that allows for the selection of ions prior the entering the reaction cell.
• Shall have a quadrupole after the reaction cell for the selection of ions after the reaction cell and before the detector.
• Shall have a collision/reaction cell (CRC) operation with controlled reaction chemistry.
• Shall have a solid-state radio frequency generator
• Shall have standard nickel cones with option platinum cones
• Shall have a conical extraction and off-axis Omega lens located outside the high vacuum region.
• Shall have a dual-mode, discrete dynode electron multiplier detector
• Shall have a four-channel cell gas control
• Dimensions shall not exceed: (cm: w x d x h) 106 x 60 x 60
• Weight shall not exceed: 315 lbs
Trade and Service Specifications
1. The equipment must be a newly manufactured unit, not used and refurbished or previously used for demonstration.
2. The Contractor shall provide installation and provide installation qualification with an employee who can provide proof of installation qualification/Operation qualification (IQ/OQ) certification.

3. FOB Point destination to include delivery to NFFL loading dock and the Detroit Laboratory.
4. Equipment shall be delivered with all necessary supplies and accessories required for installation and start-up.
5. Sufficient familiarization training for 3-5 users per delivery onsite location will be provided at time of installation or shortly thereafter (within 30 days), such that operators may independently operate the instrument and with increased familiarity and proficiency. The training shall include manuals and any consumables to be used during training.
6. The entire system must be warranted for parts and labor for 12 months from the date of formal government acceptance. The vendor must also be capable of servicing the instrument through the covered warranty period. The system must include at least a one (1) year warranty and shall include at a minimum: coverage on all non-consumable items and parts supplied including base instrument, factory-certified replacement parts, engineer labor and travel costs. Any equipment repair and maintenance work shall be performed by an OEM-trained engineer. This factory-trained engineer shall have (verified by the OEM) the following: 1) access to OEM factory telephone support; 2) access to the most current OEM factory training for both hardware and software components; and 3) access to all current OEM factory parts, not build-to-order parts. The OEM-trained service engineer shall not use salvaged parts from other instruments for performing maintenance and repairs. All parts used in PM and repairs must be guaranteed, factory-tested, OEM quality parts.

PART 5 –Contract Administration
5.1 Representative’s
The Contracting Officer Representative (COR) will perform inspection and acceptance of equipment and services to be provided.
For this PART, To-Be-Determined (TBD) is the authorized representative of the Contracting Officer.
The COR is responsible for the following as required by this order: (1) monitoring the Contractor's technical progress, including the surveillance and assessment of performance and recommending to the Contracting Officer changes in requirements; (2) interpreting the Statement of Work and any other technical performance requirements; (3) performing technical evaluations; (4) performing technical inspections and acceptances; and (5) assisting in the resolution of technical problems encountered during performance.
The Contracting Officer is the only person with authority to act as an agent of the Government under this order. Only the Contracting Officer has authority to: direct or negotiate any changes in the order, including modifying or extending the period of performance, changing the delivery
5 | P a g e schedule, authorizing reimbursement to the Contractor for any costs incurred during the performance of this order, or otherwise change any terms and conditions of this order.

(i) Name and address of the contractor;
(ii) Invoice date and invoice number;
(iii) Contract/Order number (including a reference to any base award for Indefinite- Delivery/Indefinite-Quantity Contracts or Blanket Purchase Agreements);
(iv) Description, quantity, unit of measure, unit price, and extended price supplies delivered or services performed, including:
(a) period of performance for which costs are claimed;

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
