USTRANSCOM JUSTIFICATION FOR
OTHER THAN FULL AND OPEN COMPETITION
CONTROL NUMBER
SOFTWARE AG BUSINESS PROCESS MANAGEMENT SUITE (BPMS)
LICENSE MAINTENANCE SUPPORT, AND TECHNICAL CONSULTATION
SERVICES FOR THE GLOBAL TRANSPORTATION PLANNING (GTP)
FORMERLY AGILE TRANSPORTATION FOR THE 21ST CENTURY (AT21)
PROGRAM
1. CONTRACTING ACTIVITY.
United States Transportation Command (USTRANSCOM), IT Programs and Support Services Division, USTRANSCOM/TCAQ-D, 508 Scott Drive, Building 1900W, Scott
AFB IL 62225-5357.
2. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED.
The GTP program (formerly known as AT21) program management office requires other than full and open competition for the acquisition of annual license maintenance and technical consultation services for Software AG Business Process Management Suite
(BPMS).
Initially, a firm-fixed priced contract, HTC711-13-M-D018, was awarded for maintenance of flex licenses, including base period (15 Jul - 14 Oct 2013) and four option periods (15 Oct 2013 - 30 Sep 2014, 1 Oct 2014 - 30 Sep 2015, 1 Oct 2015 - 30 Sep 2016, and 1 Oct 2016 - 14 Jul 2017) and follow on extensions from 15 Jul - 30 Sep 2017 and 1 Oct 2017 - 30 Sep 2018. This contract is no longer available to provide maintenance on the GTP BPMS licenses. GTP acquired perpetual licenses from Software AG starting in Oct 2017 (concluding in Sep 2108) and a new annual maintenance and technical support agreement is required to ensure uninterrupted services of these licenses for the period of performance from 1 Oct 2018 - 30 Sep 2019. This contract also includes two option year periods from 1 Oct 2019 – 30 Sep 2020 and 1 Oct 2020 – 30 Sep 2021.
3. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE
AGENCY' S NEEDS.
The scope of this acquisition is to acquire the essential maintenance and support to sustain the mission-critical BPMS software that enables GTP to provide development life cycle management for multiple global transportation applications supporting USTRANSCOM and SDDC. GTP specifically uses the Software AG webMethods® software components as the BPMS tool to support operations and purchased multiple perpetual licenses in October 2017 to ensure continued BPM. Technical consultation and maintenance services are required to ensure Software AG components are configured, deployed, and maintained in accordance with Software AG component-specific configuration requirements. The total estimated value of this acquisition is for 12 months of performance and lifecycle.
4. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION.
FAR 6.302-1(b)(1)(ii) For DoD, NASA, and the Coast Guard, unique supplies or services available from only one source or only one supplier with unique capabilities.
5. DEMONSTRATION THAT THE PROPOSED CONTRACTOR'S UNIQUE
QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE
OF THE AUTHORITY CITED.
GTP utilizes Software AG proprietary software which was acquired as a bundle under a flex license agreement. No resellers are authorized by Software AG to provide maintenance and support, including patches and upgrades which the government requires in order to maintain the Authority to Operate certification on Government databases and to ensure continued operations.
6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICAL.
As required by the Small Business Act (15 USC 637€) and 41 USC 1708, a notice will be publicized on the GPE.
7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND
REASONABLE.
After receipt of a quote, the Contracting Officer will make this determination by comparing proposed prices with prices obtained through market research for the same or similar items and/or historical prices paid under previous contracts. Additionally, the labor rates will be compared utilizing the official government website Contract-Awarded Labor Category (CALC). CALC is a compilation of actual Labor Rates currently on GSA service schedules;
and corresponding labor rates on Government Schedules. A further price evaluation will be conducted when the proposal is received.
8. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE
RESULTS OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS
NOT CONDUCTED.
Market Research revealed that Software AG is the sole provider of maintenance for their bundled proprietary software. There are no authorized resellers who provide maintenance and support for bundled Software AG products, no other vendor is authorized by Software AG to provide maintenance or support.

OPEN COMPETITION.
