JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN

COMPETITION (OVERSEAS CONTRACTING ACTIVITIES)

SINGLE SOURCE JUSTIFICATION

1. I recommend that the US Department of State (DOS), Bureau of International Narcotics and Law Enforcement Affairs in Guatemala (INL-G), use other than full and open competition for the acquisition of a Geographic Information System -GIS- Digital Maps to INL-Guatemala program goals. The estimated cost for this acquisition is which includes a base year and two option years.

2. Nature and/or description of the action being approved.

Purchase of a computer platform and applications for a Geographic Information System - GIS digital maps managing system, of software to enhance the ilities of the system, support and training. The a proactive community oriented police model, has used a GIS digital maps computer system since 2006 to aid in criminal investigation. Although the data is current, the system is now outdated and unsupported. In addition to updating the current digital maps, the ~ through INL-G seeks to expand the system capability through additional system development, various training sessions and technical advice.

3. A description of the supplies or services required to meet the agency's needs.

• Harrdware/software development to update the current ~IS system and enhance features, and to provide 36-months of local in Spanish support:

(1) Develop a system though GeoServer software to use existing data on a platform that can use current GIS data points as well as make the system more robust to enhance ~ GIS Server capabilities - Use the newest release (8 cores non-ASP Publish in other tools).

(1) - Develop through QGIS software the system so that it is desktop compatible for GIS systems - incorporate the newest software release.

(1)- Develop Criminal Analysis capabilities for the the GIS system.

(1) One - Develop Spatial Analysis capabilities for the GIS system.(1) One - Develop Network Analysis tools for the GIS system.

• Conduct GIS training and provide technical advice for. personnel:

o Training (in Spanish, in Guatemala):

(10) Ten - Participants course, sixteen-hour on QGIS Desktop.

(10) Ten - Participants course, sixteen-hour on GeoServer.

(5) Five - Participants course, sixteen-hour on Apps Development, GIS Web.

- 1-o Technical Advice

(360) HourslMan of GIS technical advice to include accompanying personnel throughout implementation, merge police information system with GIS police utilities as needed. HourlMan (within the year that runs).

• Local digital maps:

o Update digital maps of Guatemala for the". Vendor will provide 36-month local (in Spanish) support and updates.

(1) Create one Digital Map with geocoding capability for the city, Departamento de Guatemala.

(1) Create one Digital Map with geocoding capability, for all of Guatemala, excluding Departamento de Guatemala.

The estimated budget for this purchase is _ which includes a base year and two option years.

4. An identification of the regulatory authority permitting other than full and open competition.

FAR 6.302-1(b) (2) Only One Responsible Source and No Other Supplies' or Services Will Satisfy Agency Requirements.

(b) Application. This authority shall be used, if appropriate, in preference to the authority in 6.302-7; it shall not be used when any of the other circumstances is applicable. Use of this authority may be appropriate in situations such as the following (these examples are not intended to be all inclusive and do not constitute authority in and of themselves.

(2) The existence of limited rights in data, patent rights, copyrights, or secret processes; the control of basic raw material; or similar circumstances, make the supplies and services available from only one source (however, the mere existence of such rights or circumstances does not in and of itself justify the use of these authorities) (see Pmt 27).

5. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. (for sole source acquisitions; also required for unusual and compelling urgency where more than one offer will not be solicited).

As the Digital Maps and software will be issued in the name of a host government institution advised that digital maps they are using, and its updates are on Geosistec proprietary platforms, a GIS maps company at Guatemala; and states that Geosistec has been giving support to" since 2006.

The new GIS platform must be compatible with and able to use existing data algorithms.

Geosistecis the only and exclusive distributor of the digital maps" is curre~using in Guatemala and has the necessary experience to develop the GIS tools _ needs.

Furthermore, due to the nature of the data stored and analyzed, it is important that the vendor has a history of supporting and securiting the data. INL-G contacted Geosistec directl y in Guatemala, the digital maps, its updates and software development may be purchased directly from Geosistec in Guatemala as well as the local support and training.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. (The description should include whether a FedBizOpps notice was or will be publicized, as required by FAR 5.2, and if not, which exception under FAR 5.202 applies (e.g., blanket waiver provided in DOSAR 605.202-70).

In September/October 2016 INURMIGAPP issued a solicitation package to ESRI- Environmental Systems Research Institute, Inc. in the USA and their representative in Guatemala, Geosistec. However, those two companies have since terminated their business arrangement. INURM /GAPP terminated the solicitation as the required product could not be provided and supported as stablished on the SOW.

7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

Price analysis techniques will be utilized to determine the reasonableness of the proposed pricing.

8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted.

The required GIS system was reviewed in Guatemala, and found that among the GIS companies that exist in Guatemala, GEOSISTEC has been the only one capable of supporting Guatemalan police and updating the current system as they had first created the digital maps in 2006, They had the expertise on current data to enhance the Crime Analysis tools and maps focusing on specific thematic layers from Guatemalan police including precincts sectors, hot spots, key places, etc. Further the company has a history of providing the •• with digital maps support including developing new layers and tools for specific" tasks or requirements.

9. Any other facts supporting the use of other than full and open competition.

None

10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition.

Not applicable.

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

All future requirements will be analyzed in advance to try to ensure that additional sources are identified and considered for future purchases.
