SUBJECT: Sole Source Justification for Serv M21-048 Plastic Impact Tester

1. Impact testing is required for the development of best-practices and optimal designs for additive manufacturing of plastics. CEAST 9050 Plastic Impact Tester is specifically required, as it is the only version of a pendulum impact tester within the appropriate energy range that has automatic safety interlocks, preventing user error that may lead to the operator being struck by a pendulum.

2. On-Site Calibration Service for the Plastic Impact Tester can be performed by only the Original Equipment Manufacturer (OEM) due to them being the only entity authorized to perform Service and Calibration of the following items: (1) Pendulums Calibration of Encoder, (1) Pendulums Ver. of Span & Radius (per vice), (1) Ver. Impact Height, 2 Specimen Adaptor Radius, and (6) Ver. of Hammer Windage, Time Intv'l & Striker Radius. Data Rights to perform these services are not made available to outside entities.

3. Therefore it is determined that Illinois Tools Works, Inc. (INSTRON) is the only source capable of satisfying this requirement, and future purchases of the corresponding programming office.

4. Market research was performed reviewing Dynamic Small Business Search (DSBS) and System for Award Management (SAM) databases using North American Industry Classification System (NAICS) Code (811219) looking for companies that could provide a 5-year Preventive Maintenance contract for the Plastic Impact Tester. A review of small businesses to include 8(a), HUBZone, Service Disabled Veteran Owned Business, and Women Owned Small Business was conducted in search of a company that could provide a 5-year Preventive Maintenance contract for the Plastic Impact Tester. OBCA reached out to the original equipment manufacturer (OEM). Susan Lynch with Instron verified, Instron does not have any third party distributors/service providers that are authorized by Instron to provide service on the equipment listed in the Appendix A. In review there is one only (1) source that can provide this service for this acquisition.

5. The Government will continue to monitor the market place for other vendors should Instron allow distributors to service their commercial equipment.

6. I have determined, in accordance with FAR 13, that the circumstances of this contract action deem only a single source is reasonably available.
