DETERMINATION TO SOLICIT FROM A SINGLE SOURCE

Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.

1. Agency and Contracting Activity. U.S. Department of the Interior, Bureau of Reclamation, Denver-Acquisition Operations Branch.

2. Name and Address of Single Source.

Doble Engineering Co.

123 Felton ST

Marlborough, Massachusetts 01752-1999, United States

3. Description of Supplies/Services and Estimated Cost.

Purchase of RTS Software Maintenance & Support

Base one (1) year period of performance with three (3) optional years.

4. Description of Circumstances, including why only one source is reasonably available.

IAW FAR 13.106-1(b)(1)(ii), the specific characteristics of the RTS software is unique in that it enables Reclamation to have operational oversight of the maintenance condition of the numerous protective relays within 52 power generation facilities, 176 rotating power units, and the pumping facilities, through a single software package. This software monitors and test these protective relays within these facilities, accurately detecting and reporting any abnormalities within each system. This level of oversight is imperative, as inaccurate, or delayed reporting of a power system’s status, would result in the degradation of essential systems which could result in catastrophic a system failure wherein the safety of

Government’s employees, costly damage to infrastructure, and place the public in general at risk.

The RTS software package is proprietary license with Doble Engineering Company with no authorized re-sellers. Additionally, market research revealed that there are no comparable or compatible software license at this time that are able meet or exceed the current software specifications in functionality, scope, or cost. As such, incorporating a lesser monitoring software would presents an unacceptable risk to the Government and the public. Therefore, it is the Contracting Officer determination acquiring the RTS software from Doble Engineering Company as a sole source requirement is in the Government's best interest.

5. Determination of Fair and Reasonable Price.

The Contracting Officer will perform necessary price analysis techniques such as a comparison of the proposed price with prices found fair and reasonable on previous purchases (FAR 13.106-3 (a)(2)(ii)), and/or compare pricing within the Independent

Government Estimate (FAR 13.106-3(a)(2)(vi)).

6. Description of Market Research.

Internet searches, GSA inquiries, and direct contact with the Doble Engineering Company to identify any authorized re-sellers or locate alternative providers of a software comparable to and compatible with the current RTS software and systems. The Program Office’s Technical Representatives had even requested demonstrations of potential replacement software;

however, no suitable substitution could be identified.
