This solicitation/award includes domestic preference requirements as identified in the Berry Amendment. 4.3.1.8 Calculations. The HPLC conditions employed here resolve the cis and trans permethrin isomers. Construct a calibration graph for each isomer using peak area. Determine a result for the two isomers present in each test sample by comparison with the calibration graph. Mean response factors calculated from the five standards should be used. The true result is a weighted average of the individual cis and trans

results. This method of calculation allows the result for a multicomponent insect resist agent to contain contributions from all the active ingredients and compensates for any difference in the proportions of the two isomers between standards and test extracts. The percent mothproofing compound content of a sample unit shall be reported as the average of the values obtained for the specimens tested and shall be reported with two significant figures. The individual values for each individual specimen used to calculate the average shall be reported to the nearest 0.001 percent.". The formulation containing 3-phenoxybenzyl(1RS)-cis,trans-3-(2,2-dichlorovinyl)-2 ,2-dimethylcyclopropanecarboxylate may be obtained under the trade name Edolan ETS from StarChem, LLC, 10150 Greenville Hwy, Wellford, SC 29385.

6.4 Active (pure) material content. This method determines the content of mothproofing agent as 100 percent (pure) material. This value is then mathematically converted to content of mothproofing agent as a percentage of commercial formulation (% vol/wt). The commercial product has a concentration of active material of 12 percent by weight (% wt/wt). The density of the commercial product is 0.83 g/mL, thus the concentration of the active material is 10 percent by volume (% wt/vol).

Permethrin standard shall be ?97%, mixture of cis/trans Isomers.

Permethrin standards are available from FMC Agricultural Products;

Princeton, NJ 08543; FMC reference #33297; 97% purity/specified technical; AccuStandard; New Haven, CT 06513; reference # P-128N, or equal. (see 4.3.1 and 4.3.1.6). 6.5 High performance liquid chromatography. An Agilent 1200 series high performance liquid chromatograph is suitable for the determination. Other comparable equipment and column materials may be substituted. The suitability should be determined by making test runs with standard solutions of known concentrations (see 4.3.1.6). 6.6 Extraction. The described extraction method removes 84 percent or more of the active material on the fiber. Aside from the active mothproofing agent, the methanol extract can contain other extractable substances such as dyes. As prescribed in 4.1804(d), insert the following provision:

(a) Definitions. As used in this provision -- Commercial and Government Entity (CAGE) code means --

(1) An identifier assigned to entities located in the United States or its outlying areas by the Defense Logistics Agency (DLA) Commercial and Government Entity (CAGE) Branch to identify a commercial or government entity by unique location; or

(2) An identifier assigned by a member of the North Atlantic Treaty Organization (NATO) or by the NATO Support and Procurement Agency (NSPA) to entities located outside the United States and its outlying areas that the DLA Commercial and Government Entity (CAGE) Branch records and maintains in the CAGE master file. This type of code is known as a NATO CAGE (NCAGE) code.

Predecessor means an entity that is replaced by a successor and includes any predecessors of the predecessor.

Successor means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term “successor” does not include new offices/divisions of the same company or a company that only changes its name.

The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.

(b) The Offeror represents that it [ ] is or [ ] is not a successor to a predecessor that held a Federal contract or grant within the last three years.

52.204-23 PROHIBITION ON CONTRACTING FOR HARDWARE, SOFTWARE, AND SERVICES DEVELOPED OR PROVIDED BY

KASPERSKY LAB AND OTHER COVERED ENTITIES (NOV 2021) FAR

As prescribed in 4.2004 , insert the following clause:

(a) Definitions. As used in this clause -- Covered article means any hardware, software, or service that --

(1) Is developed or provided by a covered entity;

(2) Includes any hardware, software, or service developed or provided in whole or in part by a covered entity; or

(3) Contains components using any hardware or software developed in whole or in part by a covered entity.

Covered entity means --

(1) Kaspersky Lab;

(2) Any successor entity to Kaspersky Lab;

(3) Any entity that controls, is controlled by, or is under common control with Kaspersky Lab; or

(4) Any entity of which Kaspersky Lab has a majority ownership.

(b) Prohibition. Section 1634 of Division A of the National Defense Authorization Act for Fiscal Year 2018 (Pub. L. 115-91) prohibits Government use of any covered article. The Contractor is prohibited from --

(1) Providing any covered article that the Government will use on or after October 1, 2018; and

(2) Using any covered article on or after October 1, 2018, in the development of data or deliverables first produced in the performance of the contract.

(c) Reporting requirement. (1) In the event the Contractor identifies a covered article provided to the Government during contract performance, or the Contractor is notified of such by a subcontractor at any tier or any other source, the Contractor shall report, in writing, to the Contracting Officer or, in the case of the Department of Defense, to the website at https://dibnet.dod.mil. For indefinite delivery contracts, the Contractor shall report to the Contracting Officer for the indefinite delivery contract and the Contracting Officer(s) for any affected order or, in the case of the Department of Defense, identify both the indefinite delivery contract and any affected orders in the report provided at https://dibnet.dod.mil.

(2) The Contractor shall report the following information pursuant to paragraph (c)(1) of this clause:

(i) Within 1 business day from the date of such identification or notification: The contract number; the order number(s), if applicable; supplier name; brand;

model number (Original Equipment Manufacturer (OEM) number, manufacturer part number, or wholesaler number); item description; and any readily available information about mitigation actions undertaken or recommended.

(ii) Within 10 business days of submitting the report pursuant to paragraph (c)(1) of this clause: Any further available information about mitigation actions undertaken or recommended. In addition, the Contractor shall describe the efforts it undertook to prevent use or submission of a covered article, any reasons that led to the use or submission of the covered article, and any additional efforts that will be incorporated to prevent future use or submission of covered articles.

(d) Subcontracts. The Contractor shall insert the substance of this clause, including this paragraph (d), including in all subcontracts for the acquisition of commercial products or commercial services.

52.209-4 FIRST ARTICLE APPROVAL---GOVERNMENT TESTING (SEP 1989) FAR

As prescribed in 9.308-2 (a) and (b), insert the following clause:

(a) The Contractor shall deliver 5 unit(s) of Lot/Item 0001 within 30 calendar days from the date of this contract to the Government at DLA TROOP SUPPORT 700 ROBBINS AVE PHILADELPHIA, PA 19111 BUILDING 3A WORKSTATION 4005 ATTN: CHARLES BROWN ii for first article tests. The shipping documentation shall contain this contract number and the Lot/Item identification. The characteristics that the first article must meet and the testing requirements are specified elsewhere in this contract.

(b) Within 30 calendar days after the Government receives the first article, the Contracting Officer shall notify the Contractor, in writing, of the conditional approval, approval, or disapproval of the first article. The notice of conditional approval or approval shall not relieve the Contractor from complying with all requirements of the specifications and all other terms and conditions of this contract. A notice of conditional approval shall state any further action required of the Contractor. A notice of disapproval shall cite reasons for the disapproval.

(c) If the first article is disapproved, the Contractor, upon Government request, shall submit an additional first article for testing. After each request, the Contractor shall make any necessary changes, modifications, or repairs to the first article or select another first article for testing. All costs related to these tests are to be borne by the Contractor, including any and all costs for additional tests following a disapproval. The Contractor shall furnish any additional first article to the Government under the terms and conditions and within the time specified by the Government. The Government shall act on this first article within the time limit specified in paragraph (b) of this clause. The Government reserves the right to require an equitable adjustment of the contract price for any extension of the delivery schedule or for any additional costs to the Government related to these tests.

(d) If the Contractor fails to deliver any first article on time, or the Contracting Officer disapproves any first article, the Contractor shall be deemed to have failed to make delivery within the meaning of the Default clause of this contract.

(e) Unless otherwise provided in the contract, the Contractor -

(1) May deliver the approved first article as a part of the contract quantity, provided it meets all contract requirements for acceptance and was not consumed or destroyed in testing; and

(2) Shall remove and dispose of any first article from the Government test facility at the Contractor's expense.

(f) If the Government does not act within the time specified in paragraph (b) or (c) of this clause, the Contracting Officer shall, upon timely written request from the Contractor, equitably adjust under the Changes clause of this contract the delivery or performance dates and/or the contract price, and any other contractual term affected by the delay.

(g) The Contractor is responsible for providing operating and maintenance instructions, spare parts support, and repair of the first article during any first article test.

(h) Before first article approval, the acquisition of materials or components for, or the commencement of production of, the balance of the contract quantity is at the sole risk of the Contractor.
