Section C - Descriptions and Specifications

DESCRIPTION/SPECIFICATION

NAVAIR Headquarters On-Site Shredding Service Statement of Work

Patuxent River, MD 20670

1.0. Scope

NAVAIR requests on-site shredding at locations in and around Patuxent River Naval Air Station.

Please see the locations, number of bins and other information on the attached Building Service List. Request drop off and leave behind the prescribed number of bins at each specified buildings for a total of 36 (96 Gallon) Bins and 47 (39 Gallon) Bins. Contractor will return once a month to shred the contents of the bins on-site.

Reserve the option to add up to 5 additional (96) gallon bins. Removal of the bins at the end of the contract. Request flat rate pricing and no other fees associated with service.

Add two additional CLINS for (2) unscheduled shredding events per Option that will provide weekly shredding of 20 (96 Gallon Bins) for 4 weeks each event to be executed only if needed.

2.0 Controlled Unclassified Information (CUI)

Controlled Unclassified Information (CUI) policy requires that agencies and organizations destroy CUI in a manner that makes it unreadable, indecipherable, and irrecoverable. The task of document destruction shall be conducted from start to finish on-site at the designated NAVAIR location listed in the NAVAIR Shred Table and witnessed by a Government employee or, if authorized by NAVAIR, a contractor employee may act as witness. The NAVAIR Headquarters Shred Table lists Building Facilitators who may act as witnesses.

3.0 Secure Collection Containers

The contractor shall provide secure lockable containers to collect and store materials to be shredded until such time destruction of the materials occurs. The contractor shall be required to provide containers that are adequate in size to accommodate the need of the office or centralized location (smaller containers for low volume, larger containers for higher volume). All containers and carts shall possess locking mechanisms and locks that can be opened with a master key.

4.0 Paper-based CUI Disposal

To dispose of paper-based CUI one of two methods can be used: single-step destruction or multistep destruction.

5.0 Guidelines for Single-Step Destruction:

Use cross-cut shredders that produce 1mm x 5mm (0.04in x 0.2 in) particles (or smaller); or Pulverize/disintegrate paper using disintegrator devices equipped with a 3/32 in (2.4mm) security screen.

6.0 Guidelines for Multi-Step Destruction:

Ensure CUI is secure while awaiting destruction. Many agencies use a locked container to store CUI waiting to be shredded (commonly referred to as "shred bins").

Determine whether material will be shredded on-site or at another location. Material that an agency consolidates and collects or stores, or that it shreds to a degree not meeting the CUI destruction standard and then consolidates and collects or stores, at interim storage facilities ( or by subcontractors) must be protected within a controlled environment that prevents access by unauthorized individuals. Procedures must be in place to account for and track consolidated CUI until it is destroyed to the standards of the CUI Program.

Establish the frequency of destruction or "pick-up" to ensure large quantities of CUI are not being accumulated unnecessarily.

Verify and ensure the physical safeguarding measures for all stages of the destruction process, including, as applicable: consolidation locations, pick-up, transportation to storage locations, any interim storage locations, transportation to interim or final shredding, recycling, or destruction sites, and storage at such sites while awaiting shredding, recycling, or destruction. This requirement extends to any contractor or subcontractor facilities where consolidated CUI is stored prior to final destruction or recycling.

Limit the time between pick-up and final destruction.

Ensure that only authorized and vetted employees are given access to any interim storage locations.

Ensure that all material provided for destruction has been completely destroyed and has not been misplaced during any step in the process.

Ensure and verify that the end product is unreadable, indecipherable, and irrecoverable.

Establish a validation/inspection time line and quality control process to ensure that destruction is occurring as expected and in compliance with all requirements.

Document any multi-step destruction methods used.

7.0 Personnel Requirements

Performance of work under this contract will require access to sensitive information. The Contractor shall coordinate and execute security processes and/or the provision of badges to allow access to designated locations and handing of materials up to CUI per government direction. The Contractor shall comply with all applicable security requirements, abide by direction given by military police or other security personnel, and adhere to installation traffic laws.

8.0 Period of Performance:

Period of performance: 1 April 2023 - 31 March 2026 Basic: 1 April 2023 – 31 March 2024 Option 1: 1 April 2024 – 31 March 2025 Option 2:

1 April 2025 – 31 March 2026

CUI Notice 2019-03: Destroying Controlled Unclassified Information (CUI) in paper form

July 15, 2019 Purpose I. This Notice provides guidance for destroying (via single and multi-step methods) Controlled Unclassified Information in paper form.

2. This Notice rescinds CUI Notice 2017-02, Controlled Unclassified Information and Multi-Step Destruction.

Background

3. The Director of the Information Security Oversight Office (ISOO), exercises Executive Agent (EA) responsibilities for the CUI Program. Title 32 CFR Part 2002, Controlled Unclassified Information (September 1 4, 2016), establishes CUI Program requirements for designating, safeguarding, disseminating, marking, decontrolling, and disposing of CUI.

4. The CUI regulation requires that agencies destroy CUI ''in a manner that makes it unreadable, indecipherable, and irrecoverable," (32 CFR It also prescribes National Institute of Standards and Technology (NIST) special Publication (SP) 800-88, Revision 1: Guidelines for Media Sanitization (December 2014) (N IST SP 800-88, rev l) destruction methods, or any destruction method approved for Classified National Security Information (32 CFR 2001.47), unless the CUI category's authority mandates other destruction methods (CUI Specified categories). Agencies must also use any destruction method specifically required by law, regulation, or Government-wide policy for CUI Specified categories.

5. This Notice clarifies certain aspects of the requirements for destroying paper CUI. NIST SP 800 88, rev I, describes authorized methods for destroying other media types that contain

CUI.

Single-step paper destruction standard

6. For the single-step paper destruction method, agencies must:

a. Use cross-cut shredders that produce I mm x 5 mm (0.04 in. x 0.2 in.) particles (or smaller); or

b. Pulverize/disintegrate paper using disintegrator devices equipped with a 3/32 in. (2.4

mm) security screen.

(NIST SP 800-88, rev l , Table A-I : Hard Copy Storage Sanitization)

7. The National Security Agency (NSA) maintains an Evaluated Products List (EPL) of equipment it authorizes to destroy hard copy (paper) Classified National Security Information.

This equipment also meets CUI single-step paper destruction standards. The most updated NSA EPL for "Paper Shredders" can be found at:

htlps://www.nsa.gov/resources/evervone/media-destruction/ Multi-step paper destruction standard

8. We have noted concerns raised by agencies that the primary destruction method for paper can be costly and may have negative effects on recycling waste paper after the shredding process. Paragraph 9 of this Notice is intended to help address these concerns while still satisfying the regulatory requirement for disposing of CUI.

9. A multi-step desfruction process in which an agency shreds CUI to a degree that doesn't meet the Table A-I standards, and then recycles or destroys it (or has a contractor or shared service provider shred and/or recycle/destroy), is a permitted alternative once your organization has verified and found this method satisfactory. Agencies that use a multi-step desfruction process must follow the guidelines in this Notice and the attached document, and the process must result in CUI that is unreadable, indecipherable, and irrecoverable. However, the standards described in paragraph 6 of this Notice (NIST SP 800-88, rev l,Table A-I : Hard Copy Storage Sanitization) are still required for destroying CUI via a single-step method.

I O. The alternative method provided for in paragraph 9 is supported by NIST SP 800-88, rev 1, which states, "Methods not specified in this table may be suitable as long as they are verified and found satisfactory by the organization" (Appendix A — Minimum Sanitization Recommendations).

I l. Recycling hard copy (paper) satisfies CUI destruction requirements as part of a multi-step desfruction process only if the process recycles the CUI into new paper. Recycling processes that convert paper into other products do not always render the CUI unreadable, indecipherable, and irrecoverable, and thus may not meet the CUI Program's standards.

Consolidating CUI and physical security

12. The physical security standards for CUI remain in effect until the information is destroyed in accordance with the standards of the CUI Program. Agencies maintain discretion to determine those controls necessary to meet the safeguarding requirements set forth in 32

CFR 2002.14.

13. Agencies may consolidate CUI prior to shredding, recycling, or destroying it. This includes shred bins and burn bags within the agency's controlled environments, and interim storage or confractor facilities.

a. Agencies must protect consolidated (e.g., baled) material that they collect and/or store at interim storage facilities (or by contractors) within a controlled environment that prevents access by unauthorized people.

b. Procedures must be in place to account for and track consolidated CUI until it is destroyed/recycled to the standards of the CUI Program.

Director Attachment Multi-Step Paper Destruction Guidelines for Controlled Unclassified Information (CUI) Agencies must:

1. Ensure they secure CUI while awaiting destruction.

Many agencies use a locked container to store CUI waiting to be shredded (commonly referred to as "shred bins").

2. Determine whether material will be shredded on-site or at another location.

Material that an agency consolidates and collects or stores, or that it shreds to a degree not meeting the CUI destruction standard and then consolidates and collects or stores, at interim storage facilities (or by subcontractors) must be protected within a controlled environment that prevents access by unauthorized individuals. Procedures must be in place to account for and track consolidated CUI until it is destroyed to the standards of the CUI Program.

3. Establish the frequency of destruction or "pick-up" to ensure large quantities of CUI are not being accumulated unnecessarily.

4. Verify and ensure the physical safeguarding measures for all stages of the desfruction process, including, as applicable: consolidation locations, pick-up, transportation to storage locations, any interim storage locations, transportation to interim or final shredding, recycling, or destruction sites, and storage at such sites while awaiting shredding, recycling, or desü-uction.

This requirement extends to any contractor or subcontractor facilities where consolidated CUI is stored prior to final desü•uction or recycling.

5. Limit the time between pick-up and final desfr•uction.

6. Ensure that only authorized and vetted employees are given access to any interim storage locations.

7. Ensure that all material provided for destruction has been completely destroyed and has not been misplaced during any step in the process.

8. Ensure and verify that the end product is unreadable, indecipherable, and irrecoverable.

9. Establish a validation/inspection timeline and quality control process to ensure that destruction is occurring as expected and in compliance with all requirements.

10. Document any multi-step destruction methods used.

52.204-13 SYSTEM FOR AWARD MANAGEMENT MAINTENANCE (OCT 2018)

(a) Definitions. As used in this clause--

Electronic Funds Transfer (EFT) indicator means a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the commercial, nonprofit, or Government entity to establish additional System for Award Management (SAM) records for identifying alternative EFT accounts (see subpart 32.11) for the same entity.

Registered in the System for Award Management (SAM) means that--

(1) The Contractor has entered all mandatory information, including the unique entity identifier and the EFT indicator (if applicable), the Commercial and Government Entity (CAGE) code, as well as data required by the Federal Funding Accountability and Transparency Act of 2006 (see subpart 4.14), into SAM;

(2) The Contractor has completed the Core, Assertions, Representations and Certifications, and Points of Contact sections of the registration in SAM;

(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS). The Contractor will be required to provide consent for TIN validation to the Government as a part of the SAM registration process; and

(4) The Government has marked the record ``Active''.

System for Award Management (SAM) means the primary Government repository for prospective Federal awardee and Federal awardee information and the centralized Government system for certain contracting, grants, and other assistance-related processes. It includes—

(1) Data collected from prospective Federal awardees required for the conduct of business with the Government;

(2) Prospective contractor-submitted annual representations and certifications in accordance with FAR subpart 4.12;

and

(3) Identification of those parties excluded from receiving Federal contracts, certain subcontracts, and certain types of Federal financial and non-financial assistance and benefits.

Unique entity identifier means a number or other identifier used to identify a specific commercial, nonprofit, or Government entity. See www.sam.gov for the designated entity for establishing unique entity identifiers.

(b) If the solicitation for this contract contained the provision 52.204-7 with its Alternate I, and the Contractor was unable to register prior to award, the Contractor shall be registered in SAM within 30 days after award or before three days prior to submission of the first invoice, whichever occurs first.

(c) The Contractor shall maintain registration in SAM during contract performance and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement. The Contractor is responsible for the currency, accuracy and completeness of the data within SAM, and for any liability resulting from the Government's reliance on inaccurate or incomplete data. To remain registered in SAM after the initial registration, the Contractor is required to review and update on an annual basis, from the date of initial registration or subsequent updates, its information in SAM to ensure it is current, accurate and complete. Updating information in SAM does not alter the terms and conditions of this contract and is not a substitute for a properly executed contractual document.

(d)(1)(i) If a Contractor has legally changed its business name or ``doing business as'' name (whichever is shown on the contract), or has transferred the assets used in performing the contract, but has not completed the necessary requirements regarding novation and change-of-name agreements in subpart 42.12, the Contractor shall provide the responsible Contracting Officer a minimum of one business day's written notification of its intention to--

(A) Change the name in SAM;

(B) Comply with the requirements of subpart 42.12 of the FAR; and

(C) Agree in writing to the timeline and procedures specified by the responsible Contracting Officer. The Contractor shall provide with the notification sufficient documentation to support the legally changed name.

(ii) If the Contractor fails to comply with the requirements of paragraph (d)(1)(i) of this clause, or fails to perform the agreement at paragraph (d)(1)(i)(C) of this clause, and, in the absence of a properly executed novation or change-of-name agreement, the SAM information that shows the Contractor to be other than the Contractor indicated in the contract will be considered to be incorrect information within the meaning of the ``Suspension of Payment'' paragraph of the electronic funds transfer (EFT) clause of this contract.

(2) The Contractor shall not change the name or address for EFT payments or manual payments, as appropriate, in the SAM record to reflect an assignee for the purpose of assignment of claims (see FAR subpart 32.8, Assignment of Claims). Assignees shall be separately registered in SAM. Information provided to the Contractor's SAM record that indicates payments, including those made by EFT, to an ultimate recipient other than that Contractor will be considered to be incorrect information within the meaning of the ``Suspension of Payment'' paragraph of the EFT clause of this contract.

(3) The Contractor shall ensure that the unique entity identifier is maintained with the entity designated at www.sam.gov for establishment of the unique entity identifier throughout the life of the contract. The Contractor shall communicate any change to the unique entity identifier to the Contracting Officer within 30 days after the change, so an appropriate modification can be issued to update the data on the contract. A change in the unique entity identifier does not necessarily require a novation be accomplished.

(e) Contractors may obtain additional information on registration and annual confirmation requirements at https://www.sam.gov.
