4.b Supporting information and facts:
The proposed contractor developed and owns the propriety and patented software, algorithms, and work efforts that are used in these products and support the services specifically required for this acquisition; thereby the proposed source has the sole unique technical and other resources required for this acquisition.
As a joint effort with the White House Council of Economic Advisors the OFR to is required to research the rising number of corporate defaults and bankruptcies in the wake of the COVID-19 pandemic event.
The OFR requires current and historical bankruptcy data sourced from at least 90 U.S. bankruptcy courts beginning at least from the year 2000. Data must report, on a continual weekly basis, public companies currently operating under Chapter 11 protection and all companies with at least $50 million in assets or liabilities. Information on reported companies must at a minimum include: plans of reorganization and disclosure statements, debtor-in-possession financing information, professional retention data, 363 sales motions, key employee incentive plans, monthly operating reports, claim transfer activity, securities and security pricing data, and committee information.
The processes are proprietary and unique to BankruptcyData. The company built an algorithm that specifically goes to the court and pulls business filing petitions and case information daily (up to 8 times per day). From there the data is cleaned, scrubbed and manually appended with industry specific Data Points and financial data (current assets and liability figures for companies that release this data in court documents or SEC documents) and financial ranges from the petition. Pacer is an electronic court system that provides bankruptcy as one section of its service. The service has no connection to Pacer other than working with bankruptcy data. The company purchases a selection of documents and bankruptcy court streams for the end user and presents them via BankruptcyData. Distress data collection is also proprietary to NGR/BankruptcyData.
Data can be delivered via API, Data Feed, and can be delivered into an AWS bucket for retrieval vial FTP. User may receive the data update either Daily, Weekly or Monthly.
All historical Data can be stored to users’ database/servers. The Data goes back to the early 1980's but prior to 2000 these data were only collected by hand. Therefore these pre 2000 data are not a complete set of all bankruptcies but rather a best attempt at getting the Largest bankruptcies filed in those years.
Beginning in 2000, the courts went to electronic filing and the Data is very near complete.

5. Any other important information.
The urgent and compelling need for this justification for other than full and open competition arises from a discussion between OFR and the Council of Economic Advisors (CEA) of the White House revolving around the assessment of corporate credit markets and potential implications for new policies to address the rising corporate defaults and bankruptcies in the wake of the COVID-19 pandemic. New Generation Research is the leading provider of bankruptcy data and related analytics and is related to other work on corporate credit OFR does, and it is also in the interest of OFR’s work with the CEA. Given the effect of the pandemic on this data and the need to research this data in the wake of the pandemic, the OFR has requested this acquisition be fast-tracked for this urgent and compelling need.
