SF 1009 - FAR 13.106-1(b) SOLE SOURCE JUSTIFICATION FOR

ACQUISITIONS AT OR BELOW THE SIMPLIFIED ACQUISITION THRESHOLD

Treasury Standard Form – 1009 (Rev 10/17) Prescribed by Treasury: DTAP 1013.106(b)

1. Identification of the requesting activity and contracting activity.

The requiring activity is the Consumer Financial Protection Bureau, and the contracting activity is Bureau of the Fiscal Service.

2.a A description of the supplies or services required to meet the agency’s needs.

The purpose of this sole source justification is to obtain approval to award a contract with Effective Edge Worldwide, LLC., for the purchase of three (3), up to 4.5-hour training courses, Effective Edge for Enforcement staff. Training dates for these courses are not yet set and will be determined at a later point. The anticipated Period of Performance is 09/16/2024 through 09/15/2025.

2.b Name and business size of the vendor. Effective Edge Worldwide, LLC.

2.c Requisition No. CFP-50400-24-0048

3. IGCE/Estimated dollar value.

The IGCE is $20,587.50, this is for course materials and attendance in three classes of Effective Edge for up to 30 people per class (90 individuals total). Refer to the IGCE for additional details.

4.a Identification of the circumstances that preclude competition (Check the appropriate box that applies).

The proposed contractor’s unique qualifications and the nature of the acquisition requires use of the authority cited as follows:

i. This course will provide training in a subject that is relevant to all ENF staff members especially since every staff member uses Microsoft Outlook on a daily basis for so many aspects of their jobs. These training sessions will focus on a number of areas including strategic thinking and development and a better methodology and approach to managing people and projects. Participants become more productive individuals, leaders and team members, and experience repeatable results they will value in their life and careers.

ii. This program focuses on strategic thinking and sustaining new behaviors which maximize both individual and team productivity. These workshops look to inspire team connection, communication, and collaboration on shared projects, goals, and initiatives.

iii. These topics are very relevant to staff members in the Office of Enforcement and their work.

5. Any other important information.

The Office of Enforcement requires a live remote and online program that includes demonstration by the instructor and step-by-step instructions that participants can follow as they make changes to their Microsoft Outlook software settings. Enforcement also requires that the instructor is available throughout the program to answer participant questions.

This training was identified by staff within the Office of Enforcement as being essential for their specific training needs. Market research was conducted by the Program Office, on the Internet, and this training program was found to be unique in terms of subject matter.

No other source has been identified who can offer anything similar; therefore, the CFPB believes it is in the best interest of the Government to procure these trainings to provide

Prescribed by Treasury: DTAP 1013.106(b) consistent training for all staff in the Office of Enforcement.

CFPB has procured one-off classes in the past (all under $10k) which did not require a contract. This will be the first time Fiscal Service Procurement procures Effective Edge classes on behalf of CFPB.
