THIS IS A COMBINED SYNOPSIS/SOLICITATION FOR COMMERICAL ITEMS PREPARED IN
ACCORDANCE WITH THE FORMAT IN FAR SUBPART 12.6, STREAMLINED PROCEDURES
FOR EVALUATION AND SOLICITATION FOR COMMERCIAL ITEMS, AS SUPPLEMENTED
WITH ADDITIONAL INFORMATION INCLUDED IN THIS NOTICE. THIS ANNOUNCEMENT
CONSTITUTES THE ONLY SOLICITATION; QUOTATIONS ARE BEING REQUESTED, AND A
SEPARATE WRITTEN SOLICITTION DOCUMENT WILL NOT BE ISSUED. THE SOLICITATION
IS BEING ISSUED USING SIMPLIFIED ACQUISITION PROCEDURES IN ACCORDANCE WITH
FAR 13.5 SIMPLIFIED PROCEDURES FOR CERTAIN COMMERICAL ITEMS.
The Request for Quotations (RFQ) number is SB1341-17-RQ-0361. This synopsis/solicitation constitutes a RFQ and incorporates provisions and clauses in effect through Federal Acquisition Circular (FAC) 2005-95.
The associated North American Industrial Classification System (NAICS) code for this procurement is 334516 – Analytical Laboratory Instrument Manufacturing, which has a size standard of 1,000 employees.
COMMERCE ACQUISITION REGULATION (CAR) 1352.215-72 INQUIRIES (APR 2010)
Offerors must submit all questions concerning this solicitation in writing, via email, to both the Contract Specialist, January Magyar at January.Magyar@nist.gov and the Contracting Officer Cory Worley at cory.worley@nist.gov. Questions should be received no later than five (5) calendar days after the issuance date of this solicitation. All responses to the questions will be made in writing, without identification of the questioner, and will be included in an amendment to the solicitation. Even if provided in other form, the question responses included in the amendment to the solicitation will govern performance of the contract.
This acquisition is being competed as a full and open competition.
BACKGROUND
The National Institute of Standards and Technology (NIST)/Center for Nanoscale Science and Technology (CNST) enables science and industry by providing essential measurement methods, instrumentation, and standards to support all phases of nanotechnology development, from discovery to production. The Energy Research Group within the CNST plans to conduct several time-resolved optical pump-probe spectroscopic measurements on novel materials and systems that require the acquisition of a short pulse, high power and high repetition rate Asynchronous Optical Sampling (ASOPS) System. Ultrafast optical spectroscopic measurements include numerous measurement techniques to study spectral and temporal dynamics in various optical, optoelectronic and optomechanical materials and systems. These techniques typically rely on measuring the response of a material system with high-resolution (in time or frequency domain) upon optical or electrical excitation. The ASOPS System is required by NIST to support research in the CNST user facility and will be used as a shared resource accessible to researchers from industry, academia, NIST, and other government agencies through collaboration.

Following are the minimum functional requirements of the ASOPS system that would enable these aforementioned experiments and measurements:
1. The ASOPS system must allow measurements of the temporal response of various material systems with high time-resolution (<60 fsec). The temporal resolution of an ASOPS is perhaps its most-important characteristic because it directly places an upper-limit on the fastest temporal events that can be measured with the system. Equivalently this also places an upper-limit limit on the largest frequency that can be measured with the system. CNST requires the ASOPS system to exhibit a temporal resolution of less than 60 fsec such that it would allow the study of photo-physics in material systems that occur on the sub-100-fsec time scale. Note that shorter pulse widths of the lasers in ASOPS system also correspond to larger bandwidth and higher peak power, thereby allowing capabilities not possible with longer pulses. The system is being purchased for a broad range of experiments developing capabilities that are simply either not possible or inefficient with pulses that are longer.
2. Furthermore, the ASOPS system is intended to be operated with an existing femtosecond streak camera and other pump-probe setups currently installed in the Ultrafast Nano-Optics Lab at CNST. The small temporal resolution of the ASOPS system would allow us to make full use of the short time-resolutions of the existing systems.
3. The ASOPS system will be used for generation and detection of broadband terahertz radiation using home-built optics and electronics. The physical mechanism relying on generation of broadband terahertz radiation using ultrafast lasers is referred to as difference frequency generation wherein the bandwidth of optical pulse exciting the terahertz source directly determines the bandwidth of terahertz radiation emitted. Hence short temporal duration pulses in the ASOPS system would allow us to generate ultra-broadband terahertz radiation.
4. Since the signals in these measurements are weak – the measurements have to be repeated a number of times to average out the noise – requiring the lasers in the ASOPS system to have a very high repetition rate (number of pulses per second).
Minimum Requirements
The system shall meet or exceed the technical specifications identified below. All items must be new.
Prototypes, first articles, demonstration models, used, refurbished or otherwise developmental systems, will not be considered for award.
CLIN 0001: Asynchronous Optical Sampling (ASOPS) System, that meets or exceeds the technical specifications listed below:
Quantity: One (1)
Technical Specifications:
1. The ASOPS system must consist of two femtosecond ti:sapphire lasers producing <15 fsec pulses at 1 GHz repetition rate at a center wavelength of 800 nm. The two ti:sapphire lasers must deliver a time-averaged power of >1.2 W each.
2. The ASOPS system must include an optical triggering module to temporally synchronize the femtosecond pulse trains from the two ti:sapphire lasers with a temporal jitter of <30 fsec (between
0.1 kHz – 100 kHz).
3. The ASOPS system must include the necessary optics and electronics to both stabilize and modulate the repetition rate of the ti:sapphire lasers. The system must also include the ability to perform ASOPS offset stabilization throughout the pump-probe temporal delay range.
4. The ASOPS system must exhibit a temporal resolution to be <60 fsec across the full measurement window (e.g. 1 nsec corresponding to 1 GHz repetition rate) for an offset frequency between 1 kHz and 5 kHz.
5. The ASOPS system must exhibit an offset-frequency range of at least 15 kHz.
6. The femtosecond laser pulses from one of the two ti:sapphire lasers must be carrier-envelope-phase (CEP) locked using an f-2f interferometer or an equivalent mechanism for future integration of a frequency-comb generation unit.
7. The ASOPS system must include an optical fiber for spectral broadening using the CEP locked ti:sapphire laser.
8. The complete ASOPS system including the peripherals must be controlled through a single software interface and compatible in their operation. This control and data acquisition software must be provided by the vendor.
9. The control/acquisition software for the system must be able to interface with a computer using an ethernet or a USB connection, and must be able to acquire time-resolved pump-probe data, including providing the ability to continuously the sweep the delay range, or step and dwell through the temporal range.
CLIN 0002: OPTION - Accessories Required to Upgrade to Comb Generation.
1. The system must include the option to purchase the necessary optics and electronics including an appropriate frequency reference to upgrade the CEP stabilized femtosecond oscillator to generate a frequency comb with a repetition rate or comb spacing of 1 GHz.
Site Preparation
The vendor shall provide a list of installation and facility requirements (with explanations and technical drawings, wherever necessary) including in-house services, electrical, temperature, humidity and vibration requirements within two weeks after the award is made. NIST will provide any required connections to the in-house services.
Installation and facility requirement shall be submitted to the technical point of contact (TPOC) via email no later than two (2) weeks after receipt of order (ARO).
Installation
The system shall be installed by the Contractor no later than two (2) weeks after the complete system is received by NIST personnel. Installation shall occur in Building 216, room D111 of the NIST Gaithersburg, MD Campus on a Monday – Friday between the hours of 8:00AM – 5:00PM EST; excluding federal holidays. The contractor shall contact the NIST COR at least five (5) business days prior to the date of the installation to allow adequate time for visitor registration.
a) The vendor is responsible for the delivery and installation of the full system to the building and room specified at NIST.
b) The vendor shall contact the NIST Contracting Officer’s Representative (COR) via email at least one week prior to the shipping date to coordinate installation.
c) The vendor shall install the complete system including un-packaging, setup, connections, start-up, and demonstration of all the required minimum technical specifications. Upon completion of demonstration, the contractor shall provide the diagnostic test data which demonstrates the system is fully-functional and meets or exceeds all the required specifications.
d) The vendor shall provide the personnel necessary to perform the installation and perform all activities necessary to ensure that the system is fully-functional and meets or exceeds all the required specifications. The contractor person(s) installing the system is required to have performed one (1) prior installation of an ASOPS system of similar or higher complexity.
Training
The contractor shall conduct at least one (1), eight (8) hour training session for up to three (3) users at NIST immediately following installation. The training shall provide a thorough demonstration of all system functions, maintenance, data administration, and basic troubleshooting. The training may be completed at NIST immediately after installation/set-up and on-site measurements demonstrating that no damage or misalignment issues arose during transportation and installation, but shall be completed no later than 5 days after installation.
Warranty
The Contractor shall warrant the entire system (to include parts, labor, and installation) for a period of at least two (2) years, commencing upon acceptance of the system. The warranty must include unlimited telephone/e-mail support for questions regarding operation/troubleshooting. All costs including parts, labor, travel, and other expenses necessary to repair the system will be borne solely by the contractor at no additional cost to the U.S. Government.
Delivery
FOB Destination delivery terms are requested. Delivery shall be completed within sixteen (16) weeks from the date of an award. The Contractor shall deliver all equipment to NIST, Building 216, Shipping and Receiving, Gaithersburg, MD 20899-1640.
Inspection/Acceptance
Inspection and acceptance shall take place upon installation. In addition to the inspection and acceptance terms articulated in 52.212-4, the Government reserves the right to perform such performance tests and evaluations as defined below to verify specified system performance. Such tests and evaluations, if performed, shall be conducted within the environment that the system is to be operated. The Contractor has the right to be present during the tests and evaluations, if performed, at the Contractor’s expense.
The installation personnel shall perform all diagnostic tests after installation in the presence of NIST personnel. Diagnostic test data must include:
(a) Pulse length and repetition rate measurements for the two laser oscillators.
(b) Temporal resolution measurement for the ASOPS system over the duration of the pump-probe delay range.
This test data will be reviewed by the NIST COR. Upon review, the COR will provide final acceptance of the equipment, or advise the vendor of performance weaknesses. Any required rework and re-testing shall be completed at no additional cost to the Government within a time-frame agreed upon by the COR, the Contracting Officer, and the vendor. Payment for this requirement will be made upon completion and acceptance.
The Government anticipates acceptance/rejection of the system within thirty (30) days of receipt.

(a) As required by sections 744 and 745 of Division E of the Consolidated and Further Continuing
Appropriations Act, 2015 (Pub. L 113-235), and similar provisions, if contained in subsequent appropriations acts, the Government will not enter into a contract with any corporation that--
(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless an agency has considered suspension or debarment of the corporation and made a determination that suspension or debarment is not necessary to protect the interests of the Government; or
(2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.

FAR 52.212-1, INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS
(Reference FAR 12.301(b)(1))
INSTRUCTIONS:
System for Award Management, SAM
In accordance with FAR 52.204-7, the awardee must be registered in the system for award management (www.sam.gov) prior to award. Refusal to register shall forfeit award.
Due Date for Quotations:
Offerors shall submit their quotations so that NIST receives them not later than 12:00 PM Eastern Standard Time on May 8, 2017. FAX quotations shall not be accepted. E-mail quotations shall be accepted at january.magyar@nist.gov.
Please reference the RFQ number in the subject line of email communications and packages mailed. Offerors’ quotations shall not be deemed received by the Government until the quotation is entered in the e-mail box set forth above.
All hand delivered quotations and material shall be made on the actual due date through Gate A, and a 48 hour (excluding weekends and holidays) prior notice shall be provided to January Magyar, Contract Specialist on 301-975-5442.
Addendum to FAR 52.212-1, Quotation Preparation Instructions
1. Price Quotation: The offeror shall submit an original and one copy of the completed priced schedule. If the quotation is submitted electronically, additional copies are not required. The pricing quotation shall be separate from any other portion of the quotation. The offeror shall propose a firm fixed-price, FOB Destination for CLIN 0001 and Optional CLIN 0002. Contractor shall state warranty coverage. Price quotations shall remain valid for a period of 90 days from the date quotations are due.
2. Technical Quotation: The offeror shall submit an original and one copy of the technical quotations. If the quotation is submitted electronically, additional copies are not required. The technical quotation shall address the following:
Technical Capability: The offeror shall submit a technical description or product literature for the item it is proposing, which clearly identifies each requirement listed above. The offeror must demonstrate that its proposed item meets or exceeds each minimum requirement described above by providing a citation to the relevant section of its technical description or product literature. Offerors must not simply state they will meet the requirement; evidence must be provided. If applicable, evidence that the Offeror is authorized by the original provider to provide the item(s) in the quotation should be included.

3. Acceptance of RFQ terms and conditions: This is an Open-Market Combined Synopsis/Solicitation for an asynchronous optical sampling system in accordance with the above specifications. The Government intends to award a Purchase Order as a result of this Combined Synopsis/Solicitation that will include the terms and conditions that are set forth herein. In order to facilitate the award process, ALL quotes shall include a statement regarding the terms and conditions herein as follows:
a. The offeror shall state “The terms and conditions in the solicitation are acceptable to be included in the award document without modification, deletion, or addition.”
OR
b. The offeror shall state “The terms and conditions in the solicitation are acceptable to be included in the award document with the exception, deletion, or addition of the following:”
Offeror shall list exception(s) and rationale for the exception(s)
Please note that this procurement IS NOT being conducted under the GSA Federal Supply Schedule (FSS) program or another Government-Wide Area Contract (GWAC). If an offeror submits a quotation based upon an FSS or GWAC contract, the Government will accept the quoted price. However, the terms and conditions stated herein will be included in any resultant Purchase Order, not the terms and conditions of the offeror’s FSS or GWAC contract, and the statement required above shall be included in the quotation;
4. Quoters shall provide their Dun and Bradstreet Number (DUNS number) for the quoter’s active
System for Award Management (SAM) registration. Quoters must have an active registration at www.SAM.Gov to receive an award;
5. Quoters shall include a completed copy of the attached provision, “Representation By
Corporations Regarding An Unpaid Delinquent Tax Liability or A Felony Conviction Under Any Federal Law”(February 2016)” with their quotation.
QUOTATION EVALUATION:
Evaluation Factors The award shall be made to the Offeror whose quotation offers the lowest priced, technically acceptable offer to the Government.
Award shall be made to the offeror(s) whose quotation offers the lowest priced, technically acceptable CLINS. The Government will evaluate quotations based on the following evaluation criteria: 1) Technical Capability 2) Price.
Technical Capability: No prototypes, demonstration models, used or refurbished instruments will be considered. Evaluation of technical capability shall be based on the information provided in the quotation.
NIST will evaluate whether the offeror has demonstrated that its proposed equipment meets or exceeds all minimum requirements, as well as any areas where offers demonstrate exceeding the minimum requirements. Quotations that do not demonstrate the proposed equipment meets all requirements will not be considered further for award. If an offerors technical description and/or product literature does not indicate whether its proposed equipment meets a certain minimum requirement, and/or the offeror does not submit the test measurements/data from a real device, NIST will determine that it does not meet the requirements.
Price: A Firm-Fixed-Price (FFP), FOB Destination price quotation for The Government will evaluate the Contractor’s ability to deliver an efficient and effective quotation at a fair and reasonable price.
52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS -- COMMERCIAL ITEMS

The offeror shall complete only paragraphs (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site accessed through http://www.sam.gov/portal. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (u) of this provision.
Per Court Injunction dated 24 Oct 2016 and OMB memo dated 25 Oct 2016 the following definitions of FAR 52.212-3 are not implemented into this solicitation.

FAR 52.217-5 EVALUATION OF OPTIONS (JUL 1990)
Except when it is determined in accordance with FAR 17.2026(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).

(a) Definitions. As used in this clause— “Manufactured end product” means any end product in Federal Supply Classes (FSC) 1000-9999, except—

If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

CAR 1352.201-72 CONTRACTING OFFICER’S REPRESENTATIVE (APR 2010)
(a) To Be Determined (TBD) is hereby designated as the Contracting Officer’s Representative (COR).
The COR may be changed at any time by the Government without prior notice to the contractor by a unilateral modification to the contract. The COR is located at:

(b) The responsibilities and limitations of the COR are as follows:
(1) The COR is responsible for the technical aspects of the contract and serves as technical liaison with the Contractor. The COR is also responsible for the final inspection and acceptance of all deliverables and such other responsibilities as may be specified in the contract.
(2) The COR is not authorized to make any commitments or otherwise obligate the Government or authorize any changes which affect the contract price, terms or conditions. Any contractor request for changes shall be referred to the Contracting Officer directly or through the COR. No such changes shall be made without the express written prior authorization of the Contracting Officer. The Contracting Officer may designate assistant or alternate COR(s) to act for the COR by naming such assistant/alternate(s) in writing and transmitting a copy of such designation to the contractor.

Prompt payment discount terms, if offered.
Any other information or documentation required by the contract.
