. 1 EVALUATION CRITERIA

Due Date for Quotations

Offerors shall submit their quotations so that NIST receives them not later than 03:30 PM Eastern Time on June 26, 2015. FAX quotations shall not be accepted. E-mail quotations shall be accepted at Lynda.Roark@nist.gov. Offerors’ quotations shall not be deemed received by the Government until the quotation is entered into the e-mail address inbox set forth above.

Quotations shall be sent to the National Institute of Standards and Technology, Acquisition Management Division, Attn: Lynda Roark, 100 Bureau Drive, Stop 1640, Gaithersburg, MD 20899-1640. All offerors should ensure the RFQ number is visible on the outermost packaging.

Because of heightened security, electronic quotations are the preferred method of delivery of quotes. If quotes are hand delivered, delivery shall be made on the actual due date through Gate A, and a 48 hour (excluding weekends and holidays) prior notice shall be provided to Lynda Roark, Contract Specialist on 301-975-3725.

Addendum to FAR 52.212-1, Quotation Preparation Instructions

1) Price Quotation: The offeror shall submit an original and one copy of the completed price schedule. If the quotation is submitted electronically, additional copies are not required. The pricing quotation shall be separate from any other portion of the quotation. The offeror shall propose a firm-fixed-price, FOB Destination Required, for each CLIN. Price quotations shall remain valid for a period of 90 days from the date quotations are due.

2) Technical Quotation: The offeror shall submit an original and one copy of the technical quotation. If the quotation is submitted electronically, additional copies are not required. The technical quotation shall address the following:

Technical Capability: The offeror shall submit a technical description or product literature for the equipment it is proposing, which clearly identifies the capability of meeting the requirements listed in the SOW and Drawings. The offeror must demonstrate that its proposed equipment meets or exceeds each minimum requirement described in the statement of work by providing a citation to the relevant section of its technical description or product literature.

3). Acceptance of Terms and Conditions: This is an open-market solicitation for equipment as defined herein. The Government intends to award a Purchase Order as a result of this solicitation that will include the clauses set forth herein. The quotation should include one of the following statements:

“The terms and conditions in the solicitation are acceptable to be included in the award document without modification, deletion, or addition.”

“The terms and conditions in the solicitation are acceptable to be included in the award document with the exception, deletion, or addition of the following:

Note: This procurement is not being conducted under the GSA Federal Supply Schedule (FSS) program or another Government-Wide Area Contract (GWAC). If an offeror submits a quotation based upon an FSS or GWAC contract, the Government will accept the quoted price. However, the terms and conditions stated herein will be included in any resultant Purchase Order, not the terms and conditions of the offeror’s FSS or GWAC contract, and the statement required above shall be included in the quotation.

QUOTATION EVALUATION:

Evaluation Factors

Award shall be made to the offeror whose quotation meets or exceeds the requirements stated and is lowest price. The Government will evaluate quotations based on the following evaluation criteria: 1) Technical Capability and 2) Price.

Technical Capability: No prototypes, demonstration models, used or refurbished instruments will be considered. Evaluation of technical capability shall be based on the information provided in the quotation. NIST will evaluate whether the offeror has demonstrated that its proposed equipment meets or exceeds all minimum requirements. Quotations that do not demonstrate the proposed equipment meets all requirements will not be considered further for award. If an offeror does not indicate whether its proposed equipment meets a certain minimum requirement, NIST will determine that it does not.

Price: The Government will evaluate price for reasonableness.

Specifications for a 6,000 Gallon Liquid Nitrogen Storage Tank

1.0�Introduction

This specification is for a liquid nitrogen storage tank to be used as part of a helium refrigerator system for the NCNR deuterium cold neutron project. The vertical 6,000 gallon liquid nitrogen storage tank will consist of an inner stainless steel pressure vessel encased within a carbon steel outer vacuum vessel with insulation in between the evacuated space to ensure good thermal performance.

2.0�Scope of Work

�2.1�The contractor will have responsibility for the design of the vessels, piping configuration and supports to ensure safe and reliable operation. The inner vessel shall be designed and built in accordance with ASME Section VIII. The vessels will be designed to have the space between the vessels evacuated to ensure good thermal performance. Super Insulation shall be used to limit the losses at MAWP to less than 2,000 SCF per day.

�2.2�The industry standard piping configuration will be built in accordance with ASME B313.3 and leak tested at 1.1 times the design working pressure. The external piping and control system will allow for pressure transfer or pump transfer filling from a supply truck and for liquid withdrawal through vacuum jacketed piping and globe valve terminating at a vacuum jacketed female bayonet.

�2.3�Fabrication techniques and methods not specified in the NIST drawing are the responsibility of the contractor. The use of techniques specified in the NIST drawing does not relieve the contractor of responsibility for the proper design and fabrication of all components, but all alternative recommendations must be reviewed and approved by the government (NIST).

�2.4�The vessels will be protected from over pressurization with pressure relief devices and by a secondary rupture disc assembly. The vacuum space will be protected from over-pressurization with a lift plate.

�2.5�The contractor is responsible for providing fully qualified and certified welders. All butt welds shall be visually inspected to confirm full penetration, visually inspect all ID welds where permissible.

�2.6�Certification of materials (mill test reports) procured by the contractor is required, and copies must be provided to the government (NIST).

2.7�The tank’s exterior carbon steel surfaces shall be painted, ‘white’ using a long life urethane or epoxy or an NIST approved equivalent. Inspect all painted surfaces for required mil thickness and coverage.

2.8�The contractor is responsible for packing, marking, and shipping. The contractor shall assume full responsibility for the storage tank while it is in transit to and until it is received by the government (NIST).

2.9�The contractor is responsible for final placement of the storage tank on the existing cement pad.

3.0�Design

The vertical liquid nitrogen storage tank shall have an internal volume of approximately 6,000 gallons. The vertical liquid nitrogen storage tank shall have one government supplied penetration consisting of a female bayonet and a vacuum jacketed globe valve, EDEN Drawings VA-999-610-001 & VA-999-800-001. This connection will supply liquid nitrogen with the pressure regulator set at approximately 55 psig (70 psia).

�3.3�Construction Requirements

The liquid nitrogen storage tank will be installed on an existing 10 ft. by 10 ft.

cement pad. The storage tank’s three support legs shall align with the existing studs, 1”- 8 UNC, as defined in NCNR Drawing 002-2952 Rev 1 and EDEN Drawing BC-002283-12-001 Sh. 19 Rev. E. Any changes to this requirement require approval by the government.

4.0�Conflicts

� If there is any discrepancy between the drawings and the written specifications, the written specifications shall take precedence. Any changes shall be approved by the government.

�Any alternatives to the materials specified below shall be approved by the government. Material certification (mill test reports) required for all materials.

Outer Storage Tank Vessel: SA 516 Gr. 70 Alloy Steel, Support base: SA 516 Gr. 70 Alloy Steel, Inner Storage Tank Vessel: SA 240 304/304L Stainless Steel Alloy.

Government Supplied: SA 312 304/304L Stainless Steel Alloy.

6.0�Acceptance

In addition to the terms articulated in FAR 52.212-3, (d), upon delivery of the liquid nitrogen storage tank to NIST the unit will be inspected for conformance with this specification. If the liquid nitrogen storage tank does not meet the requirements of this specification the unit will be unacceptable and will be returned to the manufacturer for repair or replacement at no expense to the government

7.0�Testing

The Contractor shall provide certification of all test results. Copies of all test results must be provided to the government (NIST) (Technical Point of Contact Shall be provided at Award). Refer to Section 10, Deliverables, for time frames:

�7.1�Radiography

� �All structural (pressure) welds shall be radiographed according to the ASME code.

�7.2�Pressure Test

The pressure test shall be performed pneumatically with either oil free nitrogen or helium as per ASME code.

8.0�Surface Finish

�Surface finishes as required by ASME code.

9.0�Cleaning

�All surfaces shall be free of moisture, dirt, organic compounds, scale and other foreign matter.

10.0 �Deliverables

�Documents/Drawings:

�The Contractor shall submit the following documents to the designated TPOC within 4� �weeks of receipt of order.

1. Certification of materials (mill test reports) procured by the contractor

2. Certified test reports, test record/data sheets and weld radiographic inspection reports, if applicable

3. Certification of all test results is required

4. Final delivery of the finished tank shall be not later than 6 months after receipt of the order.

Delivery shall be FOB Destination. Delivery term shall be FOB Destination. FOB Destination means: The Contractor shall pack and mark the shipment in conformance with carrier requirements, deliver the shipment in good order and condition to the point of delivery specified in the purchase order, be responsible for any loss of and/or damage to the goods occurring before receipt and acceptance of the shipment by the consignee at the delivery point specified in the purchase order; and pay all charges to the specified point of delivery. The contractor shall deliver the items to NIST, BLD 301, Shipping and Receiving, Gaithersburg, MD 20899.

52.203-98, Prohibition on Contracting with Entities that Require Certain Internal Confidentiality Agreements—Representation (DEVIATION 2015-02)

Insert the following provision in all solicitations that will use Federal funds, including solicitations for the acquisition of commercial items under FAR part 12.

PROHIBITION ON CONTRACTING WITH ENTITIES THAT REQUIRE CERTAIN INTERNAL CONFIDENTIALITY

AGREEMENTS—REPRESENTATION (FEB 2015)

(a) In accordance with section 743 of Division E, Title VII, of the Consolidated and Further Continuing Resolution Appropriations Act, 2015 (Pub. L. 113-235), Government agencies are not permitted to use funds appropriated (or otherwise made available) under that or any other Act for contracts with an entity that requires employees or subcontractors of such entity seeking to report fraud, waste, or abuse to sign internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information.

(b) The prohibition in paragraph (a) of this provision does not contravene requirements applicable to Standard Form 312, Form 4414, or any other form issued by a Federal department or agency governing the nondisclosure of classified information.

ऀ(c) Representation. By submission of its offer, the Offeror represents that it does not require employees or subcontractors of such entity seeking to report fraud, waste, or abuse to sign internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information.

Representation by Corporations Regarding an Unpaid Delinquent Tax Liability or a Felony Conviction Under Any Federal Law (Class Deviation) (March 2015)

(1) In accordance with Sections 543 and 544 of Public Law 112-55 Commerce, Justice, Science, and Related Agencies Appropriations Act 2012, Title V (General Provisions) none of the funds made available by that Act may be used to enter into a contract with any corporation that-

(a) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, unless the agency has considered suspension or debarment of the corporation and made a determination that this further action is not necessary to protect the interests of the Government.

(b) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, unless the agency has considered suspension or debarment of the corporation and made a determination that this further action is not necessary to protect the interests of the Government.

(2) The Offeror represents that, as of the date of this offer-

. 5 52.204-7 SYSTEM FOR AWARD MANAGEMENT (JUL 2013)

(a) Definitions. As used in this provision--

"Data Universal Numbering System (DUNS) number" means the 9-digit number assigned by Dun and Bradstreet, Inc. (D&B) to identify unique business entities.

"Data Universal Numbering System +4 (DUNS+4) number" means the DUNS number assigned by D&B plus a 4-character suffix that may be assigned by a business concern. (D&B has no affiliation with this 4-character suffix.) This 4-character suffix may be assigned at the discretion of the business concern to establish additional System for Award Management records for identifying alternative Electronic Funds Transfer (EFT) accounts (see the FAR at Subpart 32.11) for the same concern.

"Registered in the System for Award Management (SAM) database" means that--

(1) The offeror has entered all mandatory information, including the DUNS number or the DUNS+4 number, the Contractor and Government Entity (CAGE) code, as well as data required by the Federal Funding Accountability and Transparency Act of 2006 (see Subpart 4.14) into the SAM database;

(2) The offeror has completed the Core, Assertions, and Representations and Certifications, and Points of Contact sections of the registration in the SAM database;

(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS). The offeror will be required to provide consent for TIN validation to the Government as a part of the SAM registration process; and

(4) The Government has marked the record ``Active''''.

(b)

(1) By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.

(2) The offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation "DUNS" or "DUNS +4" followed by the DUNS or DUNS +4 number that identifies the offeror` name and address exactly as stated in the offer. The DUNS number will be used by the Contracting Officer to verify that the offeror is registered in the SAM database.

(c) If the offeror does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one.

(e) Processing time, which normally takes 48 hours, should be taken into consideration when registering. Offerors who are not registered should consider applying for registration immediately upon receipt of this solicitation.

(d) Inspection/Acceptance. The Contractor shall tender for acceptance only those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government must exercise its postacceptance rights-

(e) Excusable delays. The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence, such as acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. The Contractor shall notify the Contracting Officer in writing as soon as it is reasonably possible after the commencement of any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch, and shall promptly give written notice to the Contracting Officer of the cessation of such occurrence.

(f) Termination for the Government`s convenience. The Government reserves the right to terminate this contract, or any part hereof, for its sole convenience. In the event of such termination, the Contractor shall immediately stop all work hereunder and shall immediately cause any and all of its suppliers and subcontractors to cease work. Subject to the terms of this contract, the Contractor shall be paid a percentage of the contract price reflecting the percentage of the work performed prior to the notice of termination, plus reasonable charges that the Contractor can demonstrate to the satisfaction of the Government, using its standard record keeping system, have resulted from the termination. The Contractor shall not be required to comply with the cost accounting standards or contract cost principles for this purpose. This paragraph does not give the Government any right to audit the Contractor`s records. The Contractor shall not be paid for any work performed or costs incurred that reasonably could have been avoided.

(g) Termination for cause. The Government may terminate this contract, or any part hereof, for cause in the event of any default by the Contractor, or if the Contractor fails to comply with any contract terms and conditions, or fails to provide theGovernment, upon request, with adequate assurances of future performance. In the event of termination for cause, the Government shall not be liable to the Contractor for any amount for supplies or services not accepted, and the Contractor shall be liable to the Government for any and all rights and remedies provided by law. If it is determined that the Government improperly terminated this contract for default, such termination shall be deemed a termination for convenience.

(h) Warranty. The Contractor warrants and implies that the items delivered hereunder are merchantable and fit for use for the particular purpose described in this contract.

. 8 52.219-1 SMALL BUSINESS PROGRAM REPRESENTATIONS (OCT 2014)

(a) Definitions. As used in this provision-- Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business concern eligible under the WOSB Program.

Service-disabled veteran-owned small business concern--

(1) Means a small business concern--

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
